Familias víctimas denuncian una “farsa de fallo”
La República Islámica de Irán condenó a diez hombres a prisión por el derribo del vuelo PS752 de un avión Boeing 737-800 de Ukraine International Airlines. El Tribunal Militar de la República Islámica de Irán condenó a diez personas a prisión por su papel en el derribo del vuelo comercial. Mizan News Agency, la agencia de noticias del sistema judicial iraní, anunció el veredicto el 14 de Abril de 2023. Ali Eftekhari, el Jefe del Tribunal Militar iraní, declaró que el caso era complejo y tenía numerosos aspectos técnicos, por lo que fue presentado al Tribunal Militar. El tribunal condenó a diez personas a penas de prisión variables, señalando que las filas de los acusados iban desde el segundo Brigadier hasta el tercer Teniente.
El Jefe del Tribunal señaló que el operador del misil tierra-aire Tor M1 cometió dos errores, a saber, que no pudo ajustar el nivel del radar asociado con el sistema y no preguntó a otro Centro de Comando si derribar el objetivo. Si bien el acusado declaró que hubo una pérdida de comunicación, “la pérdida de comunicación no fue confirmada, actuó según su propio juicio. El diagnóstico fue incorrecto, y este error es un error individual y humano”, advierte el Tribunal.
Familiares: farsa de fallo
Los familiares de víctimas del vuelo PS752 denuncian una farsa de fallo en el veredicto del Tribunal iraní. La Asociación PS752, que une a las familias de las víctimas del accidente, que se cobró la vida de 176 personas, calificó los fallos del juicio como sin sentido e inaceptables. “Este Tribunal no procesó a los comandantes y principales autores de este crimen, presentó a diez oficiales acusados de bajo rango con total oscuridad de sus antecedentes e identidades, celebró sesiones en privado, burló a las familias que asistieron a las audiencias y, finalmente, emitió una decisión falsa para poner fin a este espectáculo de acuerdo con su escenario predeterminado sin llevar a cabo ninguna decisión completa, ha sido una investigación imparcial”, expresó la Asociación PS752.
Las familias emitieron cuatro demandas a los cuatro gobiernos, cuyos ciudadanos murieron en el accidente: La remisión de la controversia a la Corte Internacional de Justicia por parte de los cuatro países afectados debe presentarse inmediatamente después del final del período de arbitraje, el 28 de Junio de 2023. Los cuatro países afectados deben apoyar la denuncia presentada por la Asociación ante la Corte Penal Internacional, en La Haya, Países Bajos. El Cuerpo de la Guardia Revolucionaria Islámica (IRGC) debe figurar como una entidad terrorista. La Real Policía Montada de Canadá (RCMP) debe abrir un caso penal e investigar el derribo del vuelo PS752 y la inmensa pérdida de vidas de ciudadanos canadienses.
El 8 de Enero de 2020, el Boeing 737-800 Next Generation de Ukrainian International Airlines operaba un vuelo PS752 programado regularmente entre el Aeropuerto Internacional Imam Jomeini (IKA), Teherán, Irán, y el Aeropuerto Internacional Boryspil (KBP), Kiev, Ucrania. Poco después de despegar de IKA, el avión fue derribado por dos misiles tierra-aire, matando a 176 personas a bordo. Las víctimas incluyeron ciudadanos iraníes, canadienses, ucranianos, suecos, afganos y británicos. En Marzo de 2021, la Organización de Aviación Civil de la República Islámica de Irán (CAA.IRI) concluyó que el “error humano” debía ser culpado por el derribo del vuelo PS752.

The four affected countries must support the complaint filed by the Association before the International Criminal Court, in the Hague, Netherlands. The body of the Islamic Revolutionary Guard (IRGC) must appear as a terrorist entity.
