Justicia europea anula ayudas pandémicas a tres aerolíneas italianas
El Tribunal General de la Unión Europea (TGUE) impugna la aprobación por la Comisión Europea (CE) de un paquete de fondos italianos por un valor de € 130 millones de Euros para ayudar a tres aerolíneas italianas durante la pandemia. El Tribunal General de la Unión Europea ha vuelto a anular una ayuda financiera concedida por un Estado miembro de la UE durante la pandemia de la Covid-19. La partida de 130 millones de Euros que el Gobierno de Italia destinó a tres aerolíneas italianas menores: Neos, Blue Panorama y Air Dolomiti.
El TGUE ha considerado que la Comisión Europea, la encargada de aprobar estas ayudas “no motivó su conclusión según la cual la medida controvertida no era contraria a otras disposiciones del Derecho de la Unión distintas de las relativas a las ayudas de Estado”.
En Octubre de 2020 el Gobierno italiano notificó a Bruselas de unas ayudas disponibles a empresas con licencia italiana que garantizaban a todos sus empleados una retribución igual o superior al convenio para el sector aéreo. Pero la corte europea considera que la Comisión Europea no realizó las investigaciones pertinentes para asegurar que las condiciones necesarias se cumplían, por lo que ha anulado la decisión.
Esta no es la primera vez que la justicia europea se manifiesta en contra de ayudas concedidas durante los primeros meses de la pandemia de la Covid-19. El pasado 10 de Mayo de 2023 se pronunció de forma similar y anunció que anulaba la aprobación por la Comisión Europea de un paquete de ayuda financiera de € 6.000 millones de Euros a la aerolínea nacional alemana Lufthansa.
Ambos paquetes de ayudas se concedieron para compensar a las compañías aéreas por la excepcional pérdida de ingresos causada por la pandemia y ambos fueron impugnados por la aerolínea de bajo coste Ryanair ante el Tribunal, que detectó errores en la evaluación. La Comisión, que podría recurrir la decisión ante el Tribunal de Justicia de la UE, afirma que examinará detenidamente la sentencia antes de dar ningún otro paso. Para evitar que las ayudas de estado perjudiquen la libre competencia y el mercado único, la Comisión Europea es la encargada de aprobarlas.

The General Court of the European Union (TGU) challenges approval by the European Commission (EC) of a package of Italian funds for a value of € 130 million Euros to help three Italian airlines during the pandemic. The General Court of the European Union has once again annulled financial assistance granted by an EU Member State during the Covid-19 pandemic. The game of 130 million Euros that the Italian government allocated to three minor Italian airlines: Neos, Blue Panorama, and Air Dolomiti.
The TGU has considered that the European Commission, in charge of approving these aid “did not motivate its conclusion according to which the controversial measure was not contrary to other provisions of the law of the Union other than those related to state aids”.
In October 2020, the Italian government notified Brussels of available aid to Italian license companies that guaranteed all its employees compensation equal to or greater than the agreement for the air sector. But the European Court considers that the European Commission did not carry out the relevant investigations to ensure that the necessary conditions were met, so it has annulled the decision.
This is not the first time that European justice is manifested against aid granted during the first months of the Covid-19 pandemic. On May 10, 2023, it was pronounced similarly and announced that it annulled the approval by the European Commission of a financial aid package of € 6,000 million Euros to the German national airline Lufthansa.
Both aid packages were granted to compensate the airlines for the exceptional loss of income caused by the pandemic and both were challenged by the low-cost airline Ryanair before the court, which detected errors in the evaluation. The Commission, which could resort to the decision before the EU Court of Justice, affirms that it will carefully examine the sentence before taking any other step. To prevent state aid to harm free competition and the single market, the European Commission is responsible for approval.
