Diputados aprueba iniciativa contra privatización Aerolíneas
En Diputados, el Frente de Todos (FdT) ha aprobado el Miércoles 23/08 en Comisión el proyecto que protege las acciones de futura venta a privados de la compañía aérea Aerolíneas Argentinas. El proyecto impulsado por el oficialismo limita la transferencia de las acciones de la línea de bandera. El Partido opositor Juntos por el Cambio (JXC) rechazó la propuesta y no participó de la reunión de Comisión.
En medio de los fantasmas privatizadores que empezaron a trascender en la campaña electoral presidencial, el oficialismo envió un mensaje desde la Cámara de Diputados y aprobó en Comisión un proyecto de Máximo Kirchner que protege la venta de las acciones de Aerolíneas Argentinas. El proyecto modifica la ley de estatización de Aerolíneas de modo de limitar la transferencia de las acciones de la línea de bandera, forzando a que quien sea que termine asumiendo el 11 de Diciembre de 2023 deba tener dos tercios en ambas cámaras si pretende privatizar la empresa. Pese al rechazo de Juntos por el Cambio, que optó por retirarse de la comisión antes de que comenzara el debate, el Frente de Todos logró firmar el dictamen en soledad. El objetivo del FdT es llevar el proyecto al recinto, sin embargo primero tendrá que hacerse con el número, pues de momento no están los votos para su aprobación.
Fue una reunión de poco más de una hora, que contó con la presencia Carlos Figueroa, Director de Comunicación y Relaciones Institucionales de Aerolíneas Argentinas. El Diputado Máximo Kirchner había presentado el proyecto hace un mes atrás, no ha participado de la reunión de Comisión de Legislación General, el FdT pretendía darle despacho a modo de contraataque frente a la exacerbación del discurso privatizador luego de las PASO.
La propuesta legislativa de Máximo Kirchner tiene como objetivo modificar la ley de nacionalización de Aerolíneas Argentinas, con la finalidad de prohibir las transferencias de acciones de la aerolínea sin la autorización del Congreso de la Nación. La iniciativa de Kirchner busca resguardar a la compañía aérea estatal de cualquier intento de privatización. Propone alterar el Artículo 2 de la Ley Nº26466/2008, que declaró de utilidad pública y sujeta a expropiación las acciones de Aerolíneas Argentinas S.A. y Austral S.A., y prohíbe expresamente la transferencia de acciones sin previa autorización del Congreso de la Nación Argentina.
No solo establece que el Poder Legislativo tendrá el poder de autorizar la enajenación de las acciones, sino que, para llevarlo a cabo, requerirá una mayoría cualificada, pues estipula que se necesitará la aprobación con el voto favorable «de las dos terceras partes del total de los miembros de cada Cámara». Este requisito se encuentra en la Ley Nº26741, que es la norma que se aprobó en 2012 y que posibilitó la expropiación de las acciones de la empresa petrolera YPF.

The project modifies the law for the nationalization of Aerolíneas in order to limit the transfer of shares of the flag line, forcing whoever ends up assuming office on December 11, 2023, must have two-thirds in both chambers if they intend to privatize the company. Despite the rejection of Together for Change, which opted to withdraw from the commission before the debate began, the Frente de Todos managed to sign the opinion alone. The objective of the FdT is to bring the project to the venue, however, first, it will have to get hold of the number since at the moment there are no votes for its approval.
It was a meeting of just over an hour, which was attended by Carlos Figueroa, Director of Communication and Institutional Relations of Aerolíneas Argentinas. Deputy Máximo Kirchner presented the project a month ago, but he has not participated in the meeting of the General Legislation Commission, the FdT intended to give him clearance as a counterattack against the exacerbation of the privatization discourse after the PASO.
Máximo Kirchner’s legislative proposal aims to modify the nationalization law of Aerolíneas Argentinas, in order to prohibit the transfer of shares of the airline without the authorization of the National Congress. Kirchner’s initiative seeks to protect the state airline from any privatization attempt. He proposes to alter Article 2 of Law No. 26466/2008, which declared the shares of Aerolíneas Argentinas S.A. to be of public utility and subject to expropriation. y Austral S.A., and expressly prohibits the transfer of shares without prior authorization from the Argentine National Congress.
Not only does it establish that the Legislative Branch will have the power to authorize the sale of shares, but, to carry it out, it will require a qualified majority since it stipulates that the approval with the favorable vote of «two-thirds of the total of the members of each Chamber». This requirement is found in Law No. 26741, which is the norm that was approved in 2012 and that made possible the expropriation of the shares of the oil company YPF.
