Comunidad Europea cancela cobro equipaje mano
El Parlamento Europeo (Eurocámara) toma posición sobre el equipaje de mano en vuelos dentro de la Comunidad Europea en las aerolíneas. A partir de la nueva sentencia, la líneas aéreas no podrán cobrar por una maleta como equipaje de mano, como así también se ha expedido sobre la armonización de las medidas y el peso del equipaje de cabina.
Cuando se trata de viajar en avión con equipaje de mano, los pasajeros debemos tener en cuenta que no todas las compañías aéreas operan de la misma manera. En ocasiones, principalmente en vuelos low cost, se nos exigirá pagar un suplemento por llevar una maleta que no quepa debajo del asiento delantero. Además, aunque la Asociación Internacional de Transporte Aéreo (IATA) recomienda unas medidas óptimas para el equipaje en cabina, tendremos que prestar especial atención a las dimensiones permitidas por cada aerolínea. Los eurodiputados han dado un paso para poner fin a esta falta de regulación equitativa referente a los abusos en el transporte aéreo europeo.
La Comisión de Peticiones del Parlamento Europeo ha aprobado este Miércoles 20/09 por unanimidad una resolución que pide a la Comisión Europea y a los estados miembros que desarrollen una sentencia que considere al equipaje de mano como elemento indispensable del transporte aéreo comercial.
Se trata de un movimiento con el que se pretende que, de una vez por todas, se respete una sentencia del año 2014 en el que Tribunal de Justicia de la Unión Europea determinó como indispensable al equipaje de mano, por lo que este debía ser transportado de manera gratuita y sin costes extras para el pasajero. Por ejemplo en España, esta mecánica está claramente estipulada en el Artículo 97 de la Ley de Navegación Aérea. Este señala que las aerolíneas están obligadas a transportar a los viajeros y sus pertenencias básicas de forma gratuita, lo que incluye el equipaje de mano y bultos que se lleven en cabina.
La Comisión, además, ha votado una resolución que pide la armonización de las medidas y el peso de las maletas. Estamos frente a un movimiento que pretende abordar otro los problemas. La idea es que todas las aerolíneas se guíen bajo el mismo estándar, aunque no se especifica si por el de IATA. De momento, se deberá esperar para saber cuál será la respuesta de la Comisión Europea ante este asunto para saber si finalmente se materializará y en qué plazos. Muchas aerolíneas han estado cobrando por el equipaje de mano desde hace tiempo, aunque técnicamente no deberían haberlo hecho.
Aunque estas prácticas no siempre han salido bien, han existido reclamos como los realizados en 2018 con una pasajera de Ryanair que se vio obligada a pagar un extra de € 20 Euros en la puerta de embarque de un vuelo de Madrid hacia Bruselas por no haber incluido una maleta de mano en el coste original de su billete. Tiempo más tarde, la Justicia falló a favor de la mujer. Una sentencia del Juzgado de lo Mercantil Nº 13 de Madrid obligó a la aerolínea a reintegrarle los € 20 Euros más el interés moratorio. Este año 2023, el Ministerio de Consumo abrió un expediente sancionador a varias compañías low cost por prácticas abusivas. Ahora se enfrentan a posibles sanciones punitorias.

The European Parliament takes a position on hand luggage on flights within the European Community on airlines. As of the new ruling, airlines will not be able to charge for a suitcase as carry-on luggage, as has also been issued on the harmonization of the measurements and weight of cabin luggage.
When it comes to traveling by plane with carry-on luggage, passengers must keep in mind that not all airlines operate in the same way. Sometimes, mainly on low-cost flights, we will be required to pay a supplement for carrying a suitcase that does not fit under the front seat. Furthermore, although the International Air Transport Association (IATA) recommends optimal measurements for cabin luggage, we will have to pay special attention to the dimensions allowed by each airline. MEPs have taken a step to put an end to this lack of equitable regulation regarding abuses in European air transport.
This Wednesday 20/09, the Petitions Committee of the European Parliament unanimously approved a resolution that asks the European Commission and the member states to develop a ruling that considers hand luggage as an essential element of commercial air transport.
This is a movement that aims to, once and for all, respect a ruling from 2014 in which the Court of Justice of the European Union determined that hand luggage was indispensable, so it had to be transported. free of charge and without extra costs for the passenger. For example in Spain, this mechanics is clearly stipulated in Article 97 of the Air Navigation Law. This indicates that airlines are obliged to transport travelers and their basic belongings free of charge, which includes hand luggage and packages carried in the cabin.
The Commission has also voted on a resolution that calls for the harmonization of the measurements and weight of suitcases. We are facing a movement that aims to address other problems. The idea is that all airlines are guided by the same standard, although it is not specified whether it is by IATA. For now, we will have to wait to know what the European Commission’s response to this matter will be to know if it will finally materialize and in what timeframe. Many airlines have been charging for carry-on luggage for some time, even though technically they shouldn’t have.
Although these practices have not always gone well, there have been complaints such as those made in 2018 with a Ryanair passenger who was forced to pay an extra €20 Euros at the boarding gate of a flight from Madrid to Brussels for not having included a carry-on bag in the original cost of your ticket.
