Gobierno argentino podría cerrar aerolínea LADE
La aerolínea histórica de LADE (Líneas Aéreas del Estado), podría finalizar su actividad como prestadora e servicios de fomento en la Región Patagonia. El Decreto Nº712/2024 emitido por el Gobierno de Argentina prohíbe la utilización de los aviones del Estado para desarrollar actividades aerocomerciales.
La aerolínea estatal fundada en Septiembre de 1940, ha sido parte importantes del desarrollo patagónico y pionera en la conexión soberana entre el continente y las Islas Malvinas, entre 1972 y 1982. Es la aerolínea más antigua en actividad de la Argentina.
Mediante el Decreto Nº712/2024 publicado en el Boletín Oficial de la República Argentina el Viernes 9 de Agosto de 2024 el Gobierno nacional dictó la prohibición a la utilización de los aviones del estado para desarrollar actividades aerocomerciales.
El Artículo 1 mandatorio del Decreto expresa: “Las aeronaves públicas no podrán ser utilizadas para realizar ninguna actividad aérea distinta de aquella que hace a su condición jurídica esencial al servicio del poder público. Prohíbese su utilización en cualquier actividad aérea que, por su condición, pueda ser considerada propia de una aeronave privada”.
La medida alcanza a las aeronaves de la Fuerza Aérea Argentina que conforman la flota con la que opera Líneas Aéreas del Estado (LADE), principalmente compuesta por aviones SAAB 340.
En su Artículo 2, exceptúa de la medida a “las aeronaves privadas de titularidad del Estado Nacional, de las Provincias, de la Ciudad Autónoma de Buenos Aires, de los Municipios, de entes descentralizados, desconcentrados o de empresas estatales”. También refuerza el sentido prohibitivo: “Podrán realizar actividades aerocomerciales de transporte aéreo y trabajo aéreo en cuanto cuenten con las autorizaciones correspondientes otorgadas por la autoridad aeronáutica”. Artículo que, sin nombrarlas; hace una diferencia entre la condición de empresa estatal que posee LADE, que vuela con aviones y pilotos de la Fuerza Aérea; a la de Aerolíneas Argentinas, como compañía de servicio público de conducción e integración civil en todas sus áreas.
El Gobierno de Argentina no ha emitido oficialmente ningún comentario del posible cierre de la aerolínea de fomento LADE, pero deja abierto a interpretación.
El Artículo 3, expresa: “Los servicios de navegación aérea deberán otorgar prioridad de operación a las aeronaves públicas”. El Artículo 4 dice: “Las aeronaves públicas podrán ser objeto de todo tipo de contratos interjurisdiccionales de utilización, siempre que todas las partes involucradas pertenezcan al Sector Público”. Decisión que corta toda posibilidad que los aviones del Estado sean alquilados por el sector privado.

Argentine government could close LADE airline
The historic airline of LADE (Líneas Aéreas del Estado), could end its activity as a provider of development services in the Patagonia Region. Decree No. 712/2024 issued by the Government of Argentina prohibits the use of state aircraft to develop commercial aviation activities.
The state airline founded in September 1940, has been an important part of the development of Patagonia and a pioneer in the sovereign connection between the continent and the Falkland Islands, between 1972 and 1982. It is the oldest airline in operation in Argentina.
Through Decree No. 712/2024 published in the Official Gazette of the Argentine Republic on Friday, August 9, 2024, the national government issued a ban on the use of state aircraft to develop commercial aviation activities.
The mandatory Article 1 of the Decree states: “Public aircraft may not be used to carry out any air activity other than that which makes their essential legal status in the service of public power. Their use in any air activity that, due to their condition, may be considered proper to a private aircraft is prohibited”.
The measure affects the aircraft of the Argentine Air Force that make up the fleet with which Líneas Aéreas del Estado (LADE) operates, mainly composed of SAAB 340 aircraft.
In its Article 2, it exempts from the measure “private aircraft owned by the National State, the Provinces, the Autonomous City of Buenos Aires, the Municipalities, decentralized, deconcentrated entities or state companies”. It also reinforces the prohibitive sense: “They may carry out commercial air transport activities and aerial work as long as they have the corresponding authorizations granted by the aeronautical authority”. Article that, without naming them; It makes a distinction between the status of a state-owned company owned by LADE, which flies with Air Force planes and pilots, and that of Aerolíneas Argentinas, as a public service company for civil integration and management in all its areas.
The Argentine Government has not officially issued any comment on the possible closure of the promotional airline LADE, but leaves it open to interpretation.
Article 3 states: “Air navigation services must grant priority of operation to public aircraft.” Article 4 says: “Public aircraft may be subject to all types of interjurisdictional contracts for use, provided that all parties involved belong to the Public Sector”. This decision cuts off any possibility of State planes being rented by the private sector.
