Aerolíneas Argentinas y los sindicatos firmaron acuerdo

Aerolíneas Argentinas y los tres sindicatos aeronáuticos del sector firmaron esta madrugada del Miércoles 13/11 el acuerdo que permitirá ponerle fin a un extenso conflicto que mantuvo en vilo a la actividad y a los pasajeros. Las actas se formalizaron a las 04:00 de la mañana, luego de varias jornadas de intensas negociaciones. Las actas del acuerdo fueron firmadas entre autoridades de la empresa y representantes de la Asociación del Personal Aeronáutico (APA), la Asociación de Pilotos de Líneas Aéreas (APLA) y la Asociación Argentina de Aeronavegantes (AAA). Lo acordado deberá ser aprobado en asambleas de cada organización gremial. Incluye una mejora económica y cambios en las condiciones de trabajo, que, según fuentes oficiales, le pondrán fin a los privilegios que tenían los pilotos dentro de sus convenios. Lo firmado entre ambas partes, de todas formas, deberá ser convalidado en asambleas por cada organización sindical en las próximas horas, aunque desde este sector admitieron que están conformes con lo que se acordó, sobre todo en medio de enorme la presión del Gobierno.

La adecuación de los convenios colectivos de trabajo fue el punto central de las negociaciones y a partir de que los sindicatos aceptaron discutir ese punto pudo avanzarse sobre el impacto económico que ocasionará. Entre los cambios figuran, entre otros, la renuncia a los pasajes en clase ejecutiva para los pilotos y sus familias, el replanteo del servicio de remises para que pilotos y tripulantes de cabina se trasladen entre sus casas y los aeropuertos, y viceversa, y la hora de tiempo de servicio desde que se suben a los autos que los trasladan hasta que comienzan a trabajar en forma efectiva.

Una de las fórmulas que destrabó la negociación fue definir ciertas mejoras a partir de un aumento de la productividad, un criterio que no era aceptado por todos los sindicatos. La idea de Aerolíneas fue tratar de adaptar algunas cláusulas convencionales a lo que rige en la actividad aerocomercial. Los detalles del acuerdo firmado aún no se conocen porque, deslizan en los sindicatos, el Gobierno busca hacer un anuncio sobre el tema que apuntale su discurso de que lo firmado significa una concesión de los gremios duros y un compromiso de adaptarse a la política oficial de que Aerolíneas se convierta en una empresa sustentable, más allá del objetivo de que sea privatizada.

Como forma de facilitar las negociaciones, los líderes de los sindicatos, Pablo Biró (APLA), Juan Pablo Brey (AAA) y Edgardo Llano (APA), no participaron de las últimas tres reuniones y delegaron la tarea en sus responsables del área Gremial, con quienes estaban en contacto permanente desde sus celulares para monitorear lo que se estaba hablando en la sede de la empresa en Aeroparque.

Las negociaciones se reanudaron el Viernes 08/11 en medio de un clima enrarecido por la profundización del conflicto en Intercargo, a raíz del despido de un empleado, que derivó en protestas de APA, liderada por Edgardo Llano, enrolado en el kirchnerismo, que mantuvo como rehenes a cientos de pasajeros de diversos vuelos atrapados en los aviones sin poder bajar. La postura contribuyó a flexibilizar la postura de los sindicatos, que aceptaron sentarse a negociar el Viernes 08/11 y a seguir las tratativas este lunes y martes, durante jornadas maratónicas de discusiones y con predisposición a readecuar algunas cláusulas de los convenios que el Gobierno apuntaba como privilegios por encima de la actividad aeronáutica y de los trabajadores en general.

Al mismo tiempo, hubo una fuerte presión de la Administración de Javier Milei: los funcionarios advirtieron a los sindicatos que si no firmaban el acuerdo, se iba a cerrar Aerolíneas o la empresa presentaría un PPC (Procedimiento Preventivo de Crisis), que, sobre la base de los números que deben demostrar la crisis económica que atraviesa, habilita a la compañía a negociar con los sindicatos las suspensiones del personal o las indemnizaciones por un monto menor al fijado por ley.

Controladores Aéreos
En medio de las tratativas que mantenía Aerolíneas, por otra parte, el sindicato de controladores aéreos, que no negoció con el resto de los gremios en conflicto, anunció este Martes 12/11 un plan de lucha desde el Sábado 16/11 próximo que incluye paros de dos horas en distintos días que afectarán los vuelos nacionales e internacionales y, en un gesto inusual, pidió disculpas a los usuarios por las demoras y complicaciones que esta medida pudiese ocasionar. El plan de lucha de la Asociación Técnicos y Empleados de Protección y Seguridad a la Aeronavegación (ATEPSA), que fue dispuesto porque el Estado no permite ningún tipo de negociación salarial, imponiendo una paritaria única para todo el sector público, contempla el siguiente esquema de paros: el Sábado 16/11, de 20:00 a 23:00, en los vuelos internacionales; el Lunes 18/11, de 15:00 a 18:00, en la aviación en general y comercial no regular; el miércoles 20, en toda la aviación, de 07:00 a 09:00, y el Viernes 22/11, de 18:00 a 20:00, también en toda la aviación. Fuentes oficiales aseguraron que los vuelos afectados por estas medidas podrán ser reprogramados por las aerolíneas y así se evitarán cancelaciones y no tendrá impacto negativo en la operación, por lo que los vuelos partirán en otro horario con normalidad.

The adaptation of the collective labor agreements was the central point of the negotiations and since the unions agreed to discuss this point, progress could be made on the economic impact that it will cause. Among the changes are, among others, the waiver of business class tickets for pilots and their families, the rethinking of the taxi service so that pilots and cabin crew can travel between their homes and the airports, and vice versa, and the hour of service time from the time they get into the cars that transport them until they begin to work effectively.

One of the formulas that unblocked the negotiation was to define certain improvements based on an increase in productivity, a criterion that was not accepted by all unions. The idea of ​​Aerolíneas was to try to adapt some conventional clauses to what governs the commercial aviation activity. The details of the signed agreement are not yet known because, the unions suggest, the Government is seeking to make an announcement on the subject that supports its discourse that what was signed means a concession from the hardline unions and a commitment to adapt to the official policy of Aerolíneas becoming a sustainable company, beyond the objective of it being privatized.

As a way of facilitating the negotiations, the leaders of the unions, Pablo Biró (APLA), Juan Pablo Brey (AAA) and Edgardo Llano (APA), did not participate in the last three meetings and delegated the task to their leaders in the Union area, with whom they were in permanent contact from their cell phones to monitor what was being discussed at the company’s headquarters in Aeroparque.

Negotiations resumed on Friday 08/11 amid a tense atmosphere due to the deepening of the conflict at Intercargo, following the dismissal of an employee, which led to protests by APA, led by Edgardo Llano, a Kirchnerist supporter, who held hundreds of passengers from various flights hostage, trapped on the planes without being able to disembark. This position contributed to softening the position of the unions, who agreed to sit down to negotiate on Friday 08/11 and to continue the negotiations on Monday and Tuesday, during marathon days of discussions and with a willingness to readjust some clauses of the agreements that the Government pointed out as privileges above the aeronautical activity and the workers in general.

At the same time, there was strong pressure from the Javier Milei Administration: officials warned the unions that if they did not sign the agreement, Aerolíneas would be closed or the company would present a PPC (Preventive Crisis Procedure), which, based on the numbers that must demonstrate the economic crisis it is going through, enables the company to negotiate with the unions the suspensions of personnel or compensations for an amount less than that set by law.

Air Traffic Controllers
In the midst of the negotiations that Aerolíneas was maintaining, on the other hand, the union of air traffic controllers, which did not negotiate with the rest of the unions in conflict, announced this Tuesday 12/11 a plan of struggle starting next Saturday 16/11 that includes two-hour strikes on different days that will affect national and international flights and, in an unusual gesture, apologized to users for the delays and complications that this measure could cause. The plan of struggle of the Association of Technicians and Employees of Protection and Security in Aeronautics (ATEPSA), which was established because the State does not allow any type of salary negotiation, imposing a single collective bargaining agreement for the entire public sector, contemplates the following strike schedule: Saturday 16/11, from 20:00 to 23:00, on international flights; Monday 18/11, from 15:00 to 18:00, in general aviation and non-scheduled commercial aviation; Wednesday 20, in all aviation, from 07:00 to 09:00, and Friday 22/11, from 18:00 to 20:00, also in all aviation. Official sources assured that the flights affected by these measures can be rescheduled by the airlines and thus cancellations will be avoided and there will be no negative impact on the operation, so the flights will depart at another time as normal.
