Reunión acuerdo sindicatos-Interjet pagos salariales

La Confederación de Trabajadores de México (CTM) Sección 15 ha anunciado una nueva reunión entre los empleados de Interjet y la administración de la compañía en la Junta Federal de Conciliación y Arbitraje el próximo Jueves 12 de Noviembre de 2020 a las 11:00 a.m. En la reunión se continuará con el proceso de comunicación entre empresa, trabajadores y autoridades, señaló el sindicato en un comunicado. “Como primer acuerdo, el ingeniero Alejandro del Valle se comprometió a depositar el Viernes 6 de Noviembre una quincena; asimismo, la Secretaría de Gobernación apoyará a preparar una mesa con más autoridades para que todos dialoguemos y resolvamos lo antes posible este problema que va en contra de los intereses de México”, indicó la Sección 15.

La aerolínea de presupuesto Interjet continúa adeudando dos meses de quincena a sus trabajadores, como así también dificultades en últimos meses para establecer operaciones. Además, arrastra deudas multimillonarias con Aeropuertos y Servicios Auxiliares (ASA), empresa supervisar la gestión, las operaciones y el desarrollo de los aeropuertos de México. La nueva administración de Interjet ha expresado ante la Secretaría de Gobernación, “que no entendía la razón por la cual ASA les daba a todas las aerolíneas un crédito de 21 días por tema Covid-19 mientras que a Interjet se le exigía el prepago de servicios, aún y cuando Interjet no tiene adeudos por combustible pues quien tiene adeudos es una empresa diferente”. El Juzgado Octavo de Distrito en Materia Civil admitió una demanda civil de Aeropuertos y Servicios Auxiliares (ASA), compañía del Estado mexicano, en contra de Interjet por el impago de combustible. «Se admite a trámite la demanda en la vía y forma propuesta», falló el juez Luis Alberto Ibarra sobre el recurso presentado la semana pasada, con el Expediente Nº 233/2020. De acuerdo con el último reporte financiero de ASA, Interjet, a través de su representante Impulsora de Productos Sustentables, S.A.P.I. de C.V., ha mantenido, por dos trimestres consecutivos, su adeudo de MX$ 191.699.441 Pesos. Asimismo, Interjet tiene una deuda directa de MX$ 5.143.303 Pesos.

La decisión ocurre después de que este fin de semana, del 3/10 al 02/11, unos 3.099 pasajeros quedaron varados por el impago de combustible de la aerolínea, según la Procuraduría Federal del Consumidor (Profeco). Al acumular más de 1.500 quejas de los consumidores, la Profeco emitió una alerta formal en la que advierte del riesgo de comprar viajes con la aerolínea por la cancelación de vuelos.

REX Airlines recibe primer entrega Boeing 737-800

Regional Express Airlines ha dado un gran salto hacia el lanzamiento de sus operaciones domésticas con la entrega de su primer Boeing 737-800 Next Generation, ingresando almercado de aeronaves nerrowbodies. El nuevo avión ha arribado a Sydney en la tarde de este 5 Noviembre de 2020 en Australia. Es el primero de los seis 737-800 arrendados por REX Airlines y se utilizará para actividades de entrenamiento antes del vuelo de prueba para la Autoridad de Aviación Civil y Seguridad (CASA).

El Vicepresidente de Rex, el Hon John Sharp AM, dijo: «Rex tiene una trayectoria de dieciocho años de rendimiento a tiempo líder y tarifas asequibles en sus servicios regionales y por primera vez el mercado nacional puede esperar un servicio aéreo seguro y confiable que sea asequible. Si nuestros servicios resultan exitosos, inyectaremos hasta 10 aviones en el mercado nacional a finales de 2021. A partir de ahí, tenemos la intención de desarrollar una red de aerolíneas nacionales completa, que vincule todas las capitales a lo largo del tiempo».

REX Airlines comenzará a volar los nuevos servicios Melbourne-Sydney el 1 de Marzo 2021, como así también la ruta Brisbane-Isla de Pascua (Chile). La librea de la flota de Rex Airlines será anunciada a finales de Noviembre 2020. REX Airlines receives first Boeing 737-800 delivery

Avianca Argentina presenta telegramas despidos a todo su staff

Avian Líneas Aéreas, bajo la denominación de fantasía Avianca Argentina ha solicitado el proceso de liquidación, enviando los telegramas de despido a su personal, después de diecinueve meses sin pagar sueldos, aportes, contribuciones ni cobertura médica. Los trabajadores denuncian la situación a través de las redes sociales.

La aerolínea Avian Líneas Aéreas presentó el Concurso de Acreedores en Julio 2019, un mes después de dejar de volar. El proceso lento de disolución de Avianca Argentina comienza, tras los serios problemas económicos que atraviesa Argentina, tiempo después de presentar el Concurso de Acreedores en Julio de 2019, finalizando las operaciones aerocomerciales en Agosto 2019, prometiendo un plazo de ajuste y reestructuración de deuda para volver a iniciar vuelos hacia 10/2020, pero la aerolínea continuó estancada hasta la llegada de la pandemia, prolongando la agonía de todo su staff. Desde iniciada la pandemia por Decreto presidencial se prohíben los despidos, lo que en la práctica no se ha cumplido, con más de veinte empleados de Avianca Argentina que recibieron sus telegramas de despido durante este Miércoles 04/11, tras diecinueve meses sin cobrar sueldos ni ayudas por parte del Gobierno Nacional.

Cumbres borrascosas

La historia de Avianca Argentina comenzó iniciada la etapa de la Revolución de los Aviones del anterior Gobierno, pero la aerolínea no ingresó de la mejor manera, pues antes del comienzo de las operaciones aéreas comenzaron a surgir problemas de causas judiciales que involucraron a directivos y políticos. Tras la activación de sus vuelos regionales domésticos en Argentina empleando modernas aeronaves turboprop ATR 72-600, empezaron a unir puntos de la Región Litoral, pero debido a la profunda crisis económica, la desvinculación con Avianca Holdings respecto al uso de la marca, comenzaron a profundizar el pasivo financiero, eliminando rutas y aeronaves.

Reclamo sindical

La Asociación del Personal Aeronáutico (APA) ha solicitado con carácter de suma urgencia una reunión con el Ministerio de Trabajo de Argentina para convocar a la empresa y a la sindicatura tras la decisión de la compañía de despedir al personal. La APA, sindicato liderado por Edgardo Llano emitió un comunicado en donde pide con urgencia una reunión con Ministro de Trabajo, Claudio Moroni para que se convoque a la empresa y a la Sindicatura a una audiencia de manera perentoria. En esa misma línea APLA, liderada por Pablo Biró, hace un enérgico llamado a los Ministros, Moroni y Meoni, de trabajo y transporte respectivamente para que abandonen la pasividad e intervengan en el conflicto, ante el incumplimiento de la empresa.

Perspectivas Avianca

Aunque la aerolínea ha anunciado este 04/11 el despido de los empleados, desde el fuerte reclamo sindical ante el Ministerio de Trabajo denunciaron el accionar que contraviene el Decreto Nacional anunciado por Presidencia que prohíbe los despidos hasta fin 2020. Actualmente, el CEO de Avian Líneas Aéreas, Carlos Colunga, había confirmado los despidos, ratificando nuevamente que continúan con los planes en continuar las operaciones. «Esperemos que el Covid y la situación económica nos lo permita. Somos optimistas», expresó el titular de la aerolínea regional.

La Cámara de Apelaciones en lo Contencioso Administrativo, Tributario y de Relaciones de Consumo de la Sala 1 ha ratificado una multa contra la aerolínea Flybondi Líneas Aéreas, aplicada por el área de Protección al Consumidor del Gobierno de Buenos Aires, por una publicidad que no cumplía con la normativa vigente. La sanción aplicada a la empresa Flybondi, consistente en una multa de AR$ 500.000 Pesos, fue confirmada por los jueces Carlos Balbín, Mariana Díaz y Fabiana Schafrik, de la Sala 1. El fallo dispuso rechazar el recurso directo interpuesto por la compañía contra lo resuelto por el área de Protección al Consumidor del Gobierno de la Ciudad de Buenos Aires.

El Gobierno de la Ciudad Autónoma de Buenos Aires ha sancionado a Flybondi con una multa de AR$ 500.000 Pesos por transgredir lo establecido en las normas, al explicar que «la publicidad de un precio al que se le debe adicionar una suma de dinero en concepto de tasas y cargos, que no está determinada expresamente en el anuncio’ provocaba que los potenciales clientes interesados en la oferta realizada no [cuenten] con información cierta, veraz y detallada acerca del precio total y final que [deben] abonar».

El acta de infracción fue labrada el 10 de Diciembre de 2018 por el Área Operativa de Contralor Comercial de la Dirección General de Defensa y Protección al Consumidor del GCBA. La resolución explicó que en un control realizado en la página web de FB Líneas Aéreas SA se detectó una publicidad que ofrecía pasajes aéreos «desde AR$ 9 + tasas y cargos», lo que constituiría una presunta infracción a lo normado en las leyes de protección del consumidor. Embraer E195-E2 pintura especial se entregará en próximas semanas

Azul Linhas Aéreas ha permitido observar el nuevo avión Embraer E195-E2 que se incorporará en las próximas semanas apodado como «Ararinha Azul». El nuevo esquema de pintura especial realizado en asociación con la compañía de pintura Coral, permitirá verse en los aeropuerto de Brasil a principios de Diciembre 2020. La más moderna aeronave de la flota ingresará con el registro PS-AEF.

El esquema de pintura especial se aprecia en el diseño colorido y varias aves de diferentes géneros. La entrega de esta aeronave estará programada para el 3/12. Actualmente, Azul Linhas aéreas ha recibido cinco aviones E195-E2 en total, pero debido a la pandemia ha aplazado los nuevos pedidos pendientes, sujetando el nuevo acuerdo Embraer-Azul para incorporar más E195-E2 dependiendo de la evolución de la economía post-pandemia.

La aerolínea Latam Airlines Argentina insistió ante el Ministerio de Trabajo en su solicitud de abrir un Procedimiento Preventivo de Crisis (PPC) para cerrar la filial local y pagar una indemnización equivalente al 50% de lo que establece el convenio colectivo. Esa solicitud ya ha sido rechazada por el Ministerio de Trabajo encabezada por Claudio Moroni. Los directivos de la filial argentina de la aerolínea admitieron que no tienen expectativas con un nuevo pedido de PPC, entendiendo que el Gobierno volverá a rechazar la solicitud formulada.

La aerolínea había anunciado su cese de operaciones el 17 de Junio de 2020, con la presentación de la solicitud para abrir un procedimiento de crisis con el Ministerio de Trabajo. Después de una serie de audiencias virtuales con sindicatos y funcionarios del ministerio, el Ministerio de Trabajo rechazó la solicitud de la compañía, que continúa avanzando silenciosamente en un proceso de auto-liquidación: además de retiros voluntarios, devolvió todas las oficinas y cargos que ocupó en los aeropuertos, principalmente Aeropuerto Jorge Newbery y Aeropuerto Ezeiza y los doce destinos dentro del país donde continuó volando hasta Marzo 2020.

Pero mientras que los abogados de la compañía avanzan con lo que no es más que una mera formalidad de presentaciones de procesos PPC; el número efectivo de empleados continúa disminuyendo semana tras semana, a través de acuerdos de jubilación voluntaria. Según fuentes de Latam Airlines Argentina, unos 1.100 empleados han finalizado su contrato de trabajo optando por este mecanismo. Alrededor de 1.715 empleados que poseía la filial argentina al 17/06, fecha donde se presentó al Ministerio de Trabajo la PPC, actualmente unos 700 trabajadores continúan vinculados a la empresa. El importe de estos retiros equivale a más del 100% de la compensación del Convenio Colectivo de Trabajo. Según algunos sindicatos aeronáuticos denunciados, dentro de los acuerdos se negocia una suma más baja, que no alcanza el 100%. Independientemente de la cantidad exacta que se abone, el número de acuerdos actualmente celebrados representan dos tercios del personal de Latam Airlines retirado. Inclusive algunos empleados de Latam Airlines o Latam Travel, también han decidido por retiros voluntarios.

Estos acuerdos de despido representan una puja que la empresa pide desde el exterior y las demandas de los sindicatos aeronáuticos. La postura de afirmación legal de Latam Airlines Group es que está pasando por una situación de fuerza mayor como resultado de la decisión del Gobierno de haber suspendido todos los vuelos comerciales desde mediados de Marzo 2020, debido a la pandemia. Según esta interpretación, la sociedad se enmarca en el Artículo Nº 247 de la Ley de Contratos Laborales de Argentina, que establece que cuando los despidos se den por fuerza mayor, el importe de la indemnización es equivalente a la mitad del establecido en el Convenio Colectivo de Trabajo.

El Martes 28/10, una marcha convocada por los sindicatos se ha dado cita en Aeroparque hacia la Embajada de la República de Chile, culminando la manifestación en el Obelisco, sobre la Avenida 9 de Julio. La mayoría de los convocados responden a los sindicatos de Personal de Tierra (APA), Técnicos Aeronáuticos (USTARA) y Tripulación de Cabina (ATCPEA). La demanda de los sindicatos es que se aplique el Decreto Nº 528, que prorrogó la doble compensación hasta Diciembre 2020.

A nivel internacional, Latam Airlines Group había solicitado su quiebra preventiva basada en el Ley en los Tribunales de Nueva York, Estados Unidos, en un procedimiento conocido como Ley de Quiebras Capítulo 11 que no incluye a su filial argentina. Latam Airlines Group tiene su sede en Santiago de Chile y es el resultado de la fusión entre la LAN Airlines (Chile) y TAM Linhas Aéreas (Brasil). En la actualidad, el control gerencial está en manos de la familia Cueto en Chile con 21,5% de las acciones, seguida de la aerolínea estadounidense Delta Air Lines (20%), Qatar Airways (10%) y Grupo Amaro, ex-accionista de TAM (2%), como socios individuales. El resto de las acciones, al 31 de Marzo de 2020, se distribuyeron entre los fondos de pensiones chilenos AFP (16%), inversionistas extranjeros (8,9%) y otros tipos de inversores (17,7%).
