Congress will debate the 2023 Budget of Aerolíneas Argentinas
The President of Aerolíneas Argentinas, Pablo Ceriani, will attend the Argentine Congress on Tuesday 10/11 to discuss the 2023 Budget for the airline. The airline has announced that next year AR$ 90,000 million pesos were allocated, 26% more than in 2022. The reduction in financial assistance by the State reaches AR$ 102 million Dollars. So far this year, the company has executed 46% of the planned budget and estimates that it will close 2022 with only 55% execution. Aerolíneas Argentinas has had losses worth US$438 million despite state assistance. «This is a number well below current inflation indicators. If the trend towards growth continues, Aerolíneas Argentinas will continue to under-execute its budget to finance itself with the income generated», they said from the company.
The airline has spent 46% of the budget planned for 2022, which represents AR$ 34,075 million used of the AR$ 72,000 million allocated by the State, projecting an execution of a total of 55% of the budget.
Aerolíneas Argentinas based its growth on the reduction of its personnel, which registered significant growth during 2018 and 2019. «If we take as a starting point, the month of January 2018, when it was the last massive entry, the casualties among the pilots reach 162 casualties and 144 among cabin crew», they communicated. In fact, the flag carrier currently has a workforce of 11,393 employees. Currently, procedures have been initiated to incorporate pilots and cabin crew, based on the increase in operations and the incorporation of new aircraft.

American claims JetBlue alliance
CEO American Airlines testifies necessary partnership with JetBlue
American Airlines CEO Robert Isom said Monday 10/03 that his airline needed a partnership with JetBlue Airways because Delta Air Lines had exploded through a merger before American, had more takeoff and landing rights at New York airports York and fewer unionized workers. Robert Isom also admitted that Delta has «run a nice, reliable airline» and enjoys some cost advantages over American.
The Department of Justice (DOJ) and six states are suing American and JetBlue in Federal Court over their regional partnership in the Northeast, which government lawyers are calling a de facto merger. Robert Isom defended the agreement, which has been in place for more than a year, as did JetBlue Airways CEO Robin Hayes last week during a trial in Federal Court in Boston, Massachusetts (MA). Robin Hayes, however, once had second thoughts about the deal, called the Northeast Alliance (NEA), because of American Airlines’ size advantage over JetBlue Airways. «I think NEA is dead as Robin doesn’t support it», former JetBlue executive Scott Laurence told a consultant in January 2021. Scott Laurence, who later jumped to American after a month-long gig at Delta, testified that Robin Hayes feared that American had almost unlimited resources to tilt the alliance in his favor. Despite Robin Hayes’ concerns, American and JetBlue announced their deal six months later.
The Justice Department is trying to convince US District Judge Leo Sorokin to kill the partnership, under which American Airlines and JetBlue Airways work together to set schedules and share revenue, though they are not allowed to collaborate on prices. Government lawyers argue that the deal limits competition and will raise rates.
American and JetBlue say the government has no evidence the deal is hurting consumers. Instead, they say it will help travelers by creating a stronger competitor to Delta Air Lines and United Airlines in New York and Boston. Both airlines say they couldn’t grow in New York on their own because they couldn’t get enough new takeoff and landing times, slots, at congested airports. JetBlue Airways resorted to unusual tactics, including red-eye flights, and tried to get slots from other airlines. The trial is expected to last another week, but it could be weeks or months before Judge Leo Sorokin rules on him.

American Airlines recibió US$ 12.600 millones de Dólares, Delta Air Lines US$ 11.900 millones, United Airlines US$ 10.900 millones de Dólares y Southwest Airlines US$ 7.200 millones de Dólares.
US airlines reject share buyback
Request from legislators to refrain from share buybacks
A trade group representing major US airlines has rejected a request by seventy US Lawmakers to voluntarily extend an expired ban on share buybacks that was a condition of the US Government’s COVID-19 Payroll Assistance. Rep. Peter DeFazio, a Democrat who chairs the House Transportation and Infrastructure Committee, led a group of 70 lawmakers last week urging airlines to «refrain from initiating stock buybacks … at least until that airlines can post and meet schedules that meet demand; staff flights and key staff positions appropriately; and return service to every community».
The US Congress approved US$ 54 billion in three rounds that cover a large part of the payroll costs of US airlines for eighteen months until the end of September 2021. The ban on share buybacks expired on Friday 09/30. DeFazio’s letter, which was reported and signed by House Democrats including Aviation Subcommittee Chairman Rick Larsen, Alexandria Ocasio-Cortez, David Cicilline, Eleanor Holmes Norton, Jerrold Nadler, Carolyn Maloney, Rosa DeLauro and Debbie Dingell.
Aviation unions launched a campaign in August 2022 to pressure airlines against share buybacks. It came as major airlines are negotiating new contracts with pilots seeking higher wages and better schedules. Airlines for America (A4A), a group representing major U.S. carriers including American Airlines, Delta Air Lines, United Airlines, Southwest Airlines and others, told lawmakers in a previously unreported letter dated Friday 09/30 airlines voluntarily agreed to intentionally temporary (payroll support program) restrictions to protect jobs and preserve their workforces amid the unprecedented global health crisis. American Airlines received US$ 12.6 billion, Delta Air Lines US$ 11.9 billion, United Airlines US$ 10.9 billion and Southwest Airlines US$ 7.2 billion. Of the US$ 54 billion, the airlines must reimburse US$ 14 billion, or 26.2% of the funds received.
Delta Air Lines said in a statement that its «top financial priority is to restore its financial foundation by generating significant and sustained profitability and cash flow to support debt reduction and reinvestment in the business».
In September 2022, the chairs of two other congressional committees sought a federal investigation into whether airlines used payroll funds to finance pilot buyouts and early retirement.

Argentina airport investments
Transportation announced investments for AR$ 56,700 million
The head of the portfolio of the Ministry of Transportation of Argentina, Alexis Guerrera, has announced that the amount of investment in works for the current year 2022 is approximately AR$ 16,700 million pesos. The minister reported this Monday that the Government plans to invest in airport infrastructure through the Federal Development Plan, while by 2023 the amount of investment will exceed AR$ 40,000 million pesos, to which is also added direct investment by the concessionaire Aeropuertos Argentina 2000 (AA2000) of approximately AR$ 28,700 million pesos.
The announcements in the framework of the inauguration of the 2022 Annual Assembly and Conference of the Airports Council International of Latin America and the Caribbean (ACI-LAC), which began on Monday 10/03 in Buenos Aires with the participation of the main authorities, executives and aviation experts from different countries and which ends on Tuesday 10/04. The official highlighted the very important role that the airport system has, and pointed out that «back in mid-2019, the socioeconomic difficulties of Argentina, the effects of bad political and economic decisions had interrupted the chain of payments for public works. At the same time, due to the macroeconomic situation at that time, it was difficult for companies to access credit and financing. This generated a unique crisis in which all the works in the airport sector were losing momentum until they stopped. The most obvious example, the most symbolic and perhaps most painful, not only for us as a State but also for Aeropuertos Argentina 2000, is the new departure terminal at the Ezeiza international airport, a project that was stopped in September 2019. However, despite the difficulties, and of the times that we have had to live, we made the decision to resume that work and many others in a context of strong recovery of the domestic market. Of course, this recovery is key to guaranteeing the country’s connectivity with the regions and with the world. Perhaps the only positive thing in the aviation and airport system that the pandemic left us was having been able to work at the Jorge Newbery Airport, where we carried out the biggest milestone in the airport sector in the last 50 years», said the Minister of Transportation. Alexis Guerrero.
In addition, he highlighted that there are works underway at the Posadas, Santa Rosa, San Juan, San Rafael and Jujuy airports. «During the period that covers the remainder of the current year and all of 2023, major works will be carried out in fifteen passenger terminals, on nine runways, ten taxiways, thirteen platforms, also executing a number of sixteen new beacons», Transportation pointed out.

AW | 2022 09 30 10:55 | GOVERNMENT / AVIATION ORGANISMS / AVIATION / AIRLINES
Europe restores 80/20 slots standard
Possible changes to the aviation slots standard
The airlines warn Brussels of the impact that the restoration of the 80/20 rule of the time slots of flights within the European Community would have. The tension would become more acute in European aviation due to the possible change in the slot norm. On October 30, 2022, the current regulation of 64% expires and Brussels is opposed to approving an extension.
The regulatory change that made it possible to soften the slot rule will expire on 10/30, which will mean that airlines will have to make use of 80% of the assigned slots again so as not to lose their flight rights, compared to the current 64%. This situation, the final decision of which depends on the European Commission, worries practically all airlines, especially those that are having the most difficulty in recovering pre-pandemic levels of activity. Even more so, when a complex autumn-winter season is expected due to the possible economic recession and the rise in fuel prices.
The return of the 80/20 slot rule could be an opportunity for low cost airlines to take market share from the classic airlines of the old continent. Among them is the Irish Ryanair, which has been operating at full capacity for weeks in search of more time slots.
Although no decision has been made, the Executive of the European Community is in favor of recovering the existing regulations before the pandemic, reestablishing the claim that is aligned with the interests of the airports.
IATA Opposition
IATA, the great lobby of the airline sector, has been warning Brussels for weeks of the impact that a return to the pre-pandemic slot rule would bring. Its implementation would bring about the return of ghost flights, with planes covering routes without passengers solely and exclusively to maintain flight rights. “Meeting that torrent of demand has proven to be a challenge and will likely continue to be. All the more reason to continue showing flexibility in the rules for the use of slots, since the intention of the European Commission to return to the old 80-20 requirement is premature”, IATA Director General Willie Walsh recently warned. The director of the aviation agency stresses that airports, many of them in chaos, are not prepared to serve even 64% of pre-pandemic passengers. “This is why flexibility remains essential to support a successful recovery”, says Willie Walsh.

US airlines real ticket rule
According to new federal rule, airlines will show real cost of tickets
The proposed rule comes as tension grows between the Biden administration and airlines. President Joe Biden announces a new initiative Monday 9/26 that would eventually allow consumers to see a more complete price on airline tickets, including baggage and change fees, before they buy, as the White House continues to look for ways to reduce costs for Americans amid high inflation.
The White House says the Department of Transportation’s (DOT) proposed rule will prevent airlines from hiding the «true cost» of airline tickets, helping consumers save money up front and encouraging more competition among airlines to offer best rates. The requirement will apply not only to airlines directly, but also to third party search sites such as Kayak and Expedia.
Airlines earned almost US$ 5.3 billion in baggage fees and almost US$ 700 million in cancellation and change fees last year, according to figures from the Department of Transportation. Airlines charge a variety of other fees for extra legroom and other benefits that the government doesn’t track.
A trade group for America’s largest airlines said airlines already disclose the terms and full cost of a ticket. «This includes transparency regarding government taxes and fees on airline tickets, which account for more than 20% of many domestic one-stop roundtrip tickets», said Katherine Estep, a spokeswoman for Airlines for America. The proposal dates back to the Obama Administration and was scrapped in 2017 by then-President Donald Trump after airlines complained it was unnecessary and would incur significant costs. It must now go through a 60-day comment period before final approval.
The proposed rule comes as tension grows between the Biden administration and airlines, with each blaming the other for a spike in canceled and delayed flights this summer. The Department of Transportation also began publishing information to help consumers know what each airline is offering when flights are canceled or delayed for reasons within the airline’s control. That prompted several airlines to update policies on finding a new flight and covering hotel and meal expenses for stranded travelers.

SEC fines Boeing against investors
Charges against aerospace for misleading investors Boeing will pay US$ 201 million in fines
The United States Securities and Exchange Commission (SEC) accused The Boeing Company and its former CEO, Dennis A. Muilenburg, on Thursday, September 22, 2022, of making materially misleading public statements following the accidents of the two Boeing 737-8 MAX aircraft in 2018 and 2019. The accidents involved a Flight Control function called the Maneuvering Characteristics Augmentation System (MCAS). According to the SEC’s orders, after the first accident, Boeing and Muilenburg knew that MCAS posed an ongoing aircraft safety issue, but nevertheless assured the public that the 737 MAX aircraft was «as safe as any aircraft that has ever flown in the world the skies». Later, after the second accident, Boeing and Muilenburg assured the public that there were no slips or loopholes in the certification process regarding MCAS, despite being aware of information to the contrary.
«There are no words to describe the tragic loss of life caused by these two plane crashes. In times of crisis and tragedy, it is especially important that public companies and executives provide full, fair and truthful disclosures to the markets. The Boeing Company and its former CEO, Dennis Muilenburg, failed in this most basic obligation Misled investors by providing assurances about the safety of the 737 MAX, despite knowing serious safety concerns The SEC remains committed to stamping out misconduct when public companies and its executives fail to meet their fundamental obligations to the investing public», said SEC Chairman Gary Gensler.
According to the SEC order, a month after Lion Air Flight JT-610, a 737-8 MAX aircraft, crashed into the Java Sea, Indonesia in October 2018, Boeing issued a press release, edited and endorsed by Dennis Muilenburg, who selectively highlighted certain facts from an official Indonesian government report suggesting that pilot error and poor aircraft maintenance contributed to the crash. The press release also gave assurances of the aircraft’s safety, without disclosing that an internal safety review had determined that MCAS posed an ongoing «aircraft safety issue» and that Boeing had begun redesigning MCAS to address that issue, according to the statement. SEC orders.
Approximately six weeks after the March 2019 crash of Ethiopian Airlines flight ET-302, another 737-8 MAX, and the grounding by international regulators of the entire 737 MAX fleet, Dennis Muilenburg, while aware of the information questioning certain aspects of the certification process related to MCAS, told analysts and reporters that «there was no surprise or gap […] that somehow slipped through the certification process for the 737 MAX and that Boeing had returned and reconfirmed […] that we follow the exact steps in our design and certification processes that consistently produce safe aircraft».
«Boeing and Muilenburg put profits before people by misleading investors about the safety of the 737 MAX, all in an effort to rehabilitate Boeing’s image after two tragic accidents that resulted in the loss of 346 lives and a pain incalculable to so many families. But public companies and their executives must provide accurate and complete information when making disclosures to investors, no matter the circumstances. When they don’t, we will hold them accountable, as we did here», said Gurbir S. Grewal , Director of the SEC Enforcement Division.
The SEC’s orders against Boeing and Muilenburg find that they negligently violated the anti-fraud provisions of the Federal Securities Acts. Without admitting or denying the SEC’s findings, Boeing and Muilenburg consented to cease and desist orders that include fines of US$ 200 million and US$ 1 million, respectively. A Fair Fund will be established for the benefit of injured investors pursuant to Section 308(a) of the Sarbanes-Oxley Act of 2002.
The SEC investigation was conducted by Ibrahim Sajalieu Bah, Kenneth Gottlieb, Derek Schoenmann, Heather Shaffer, and Tian Wen of the New York Regional Office with the assistance of Richard Hong of the Trial Unit. The case was overseen by Celeste Chase and Sanjay Wadhwa. The SEC appreciates the assistance of the Fraud Section of the Criminal Division of the Department of Justice and the Federal Bureau of Investigation.

Chinese market expectations 737 MAX
Chinese aviation authorities to confirm 737 MAX talks
The Boeing Company has raised expectations after the Civil Aviation Administration of China (CAAC) communicated on Tuesday 09/20 that they had met with the aircraft manufacturer to discuss the return of the Boeing 737 MAX to service in the eastern country.
The narrow-body aircraft has not flown commercially in China after being grounded in March 2019 following two plane crashes. The meeting with Boeing took place in eastern China on September 14, 2022, according to the CAAC agency. The government agency is expected to release a report on the 737 MAX after issues raised at the meeting are resolved. The publication will indicate that the process for the Boeing aircraft to be reintroduced to China has been completed, the CAAC said without providing a timetable.
Boeing said last week that it was redirecting some planes that were reserved for China to other customers as the company navigates global political tensions that have halted deliveries. The move affects a small number of 737 MAX planes, CEO Dave Calhoun said at an industry event in Washington.
