Saudi startup to select purchase of commercial aircraft
Airbus, Boeing compete for deal over 80 Saudi startup planes

The new airline in preparation named RIA Airlines of the Kingdom of Saudi Arabia has announced the intention to select the fleet of aircraft to start operations. In this way, it will seek to make the direct purchase of the constructors Airbus and Boeing. The Saudi Arabian Public Investment Fund (PIF) is close to announcing a large aircraft order of up to eighty (80) aircraft to be operated by a new airline to be established in Riyadh, the capital of the Kingdom of Saudi Arabia.

The new airline, to be called RIA Airlines, must have a fleet of wide-body aircraft, but also narrow-body. Airbus was close to closing an agreement for 40 A350 units plus 40 purchase options, while it was revealed on Sunday 10/23 that the PIF is also negotiating with Boeing. The new airline aims to compete with airlines of the caliber such as Emirates Airline, Qatar Airways and Etihad Airways with a new global hub in Riyadh.

Vision Plan 2030

Thanks to the Vision 2030 Plan, the city of Riyadh aims to establish a global hub that will rival Dubai, Doha and Abu Dhabi in the Gulf region. The goal is to diversify the economy, which currently depends on oil. Some sources previously reported that the Saudi fund was close to ordering the Boeing 787, however, recent friction between the US and Saudi governments, due to the position regarding the Russian invasion of Ukraine, could theoretically hinder a deal. RIA must co-exist with Saudi Arabian Airlines (Saudia), the flag carrier of the Middle Eastern country, despite the similar market profile.

Justicia vs derechos víctimas 737 MAX

AW | 2022 10 22 14:22 | AIR INVESTIGATION / GOVERNMENT

Críticas al acuerdo enjuiciamiento caso Boeing 737 MAX

Boeing 737 MAX_Isologotype

DOJ Justice vs victims rights 737 MAX

Criticism of the trial agreement in the Boeing 737 MAX case

The relatives of the victims of the air accidents of the flights JT-610 of Lion Air and ET-302 of Ethiopian Airlines have sued the Justice for the violation of the rights of the people on board the crashed Boeing 737 MAX aircraft, in a trial agreement of the parties. The deferred settlement marks a broad repudiation of the approach taken by Department of Justice (DOJ) officials in the case.

The Department of Justice violated the rights of the passengers killed in the two damaged Boeing 737-8 MAX planes when the Federal Government reached a deferred prosecution agreement with The Boeing Company in 2021, the Federal District Judge ruled on Friday 10/21 Reed O’Connor, rejecting the arguments of the United States Department of Justice and The Boeing Company, finding that the 346 people who died in accidents in Indonesia in 2018 and Ethiopia in 2019 are victims of crimes under Federal Law. Reed O’Connor has not commented on what the Government should do to remedy the violation of his rights.

The ruling marks a broad repudiation of the approach taken by Justice Department officials in the case. Family members and attorneys for some of those killed have asked the judge to throw out the Justice Department’s deferred prosecution agreement with Boeing. As part of that agreement, Boeing admitted to conspiring to defraud federal regulators, but the company would be immune from prosecution for that conspiracy if it complies with the terms of the agreement, which was signed on January 6, 2021.

Those killed in Boeing 737 MAX crashes are not «crime victims», the Justice Department says. In a strongly worded opinion, Reed O’Connor said the evidence was clear that Boeing’s admitted conspiracy led to the deaths of hundreds of people. «The Court finds that the tragic loss of life resulting from the two plane crashes was a reasonably foreseeable consequence of Boeing’s conspiracy to defraud the United States», Reed O’Connor wrote.

Long before the Boeing 737-8 MAX plane crash disasters, Boeing had a history of failing to address safety issues responsibly and diligently. The Boeing 737 MAX crashes were a horrific culmination of mistakes, investigators say.

Paul Cassell, a University of Utah Law Professor and a former Federal Judge representing victims’ families, said the Justice Department had engaged in a «major, deliberate, and orchestrated violation of a law that requires victims of crimes involved in crafting these types of arrangements. The Government and Boeing had several attorneys working on this secret agreement, and now the Judge has made it clear that the secrecy was a serious violation of Federal Law». The Justice Department and Boeing officials declined to comment on the current declarations.

Some family members said Friday night 10/21 that they are seeking to prosecute The Boeing Company and its executives. «Families like mine are the true victims of Boeing’s criminal misconduct, and our views should have been considered before they were given loving treatment by the government», Naoise Connolly Ryan, whose husband, Mick, died in the crash in Ethiopia.

Michael Stumo, whose daughter Samya was killed in the crash outside the Ethiopian capital Addis Ababa, said in a statement that «Boeing captured the FAA to get certification of the deadly MAX 8. They captured the Justice Department under Trump and Biden to deny the rights of shock families to participate in criminal investigation and prosecution. They thought they could capture a Federal Judge in Fort Worth, Texas».

Michael Stumo said Attorney General Merrick Garland «should order a new investigative team to redo the entire criminal investigation against Boeing». The question before Reed O’Connor was whether those killed on the Boeing planes were «directly and proximately injured as a result of the commission of a federal crime», which is the definition of a victim under the Crime Victims’ Rights Act.

The Justice Department argued in court papers that it could not prove beyond a reasonable doubt that the Boeing fraud conspiracy resulted in «the accidents of two flights in foreign countries, operated by foreign airlines, overseen by foreign regulators, and flown by pilots foreign». Reed O’Connor has not ruled in accordance with the criminal position of the United States Department of Justice.

US Congress would extend 737-7/10 MAX certification deadline

The Senators of the United States Congress are mobilized to change a law that requires a new Cabin Warning System from December 2022 that would affect the Boeing 737-7 MAX and Boeing 737-10 MAX versions.

The Boeing Company has gained more support among US lawmakers to change the law that requires a new crew warning system on commercial aircraft starting in December 2022. Republican Senator Lindsey Graham has spoken in favor of extending the deadline for Boeing have time to complete certification of the 737-7 MAX and 737-10 MAX. In addition to the congressmen, the American manufacturer also received the support of United Airlines, one of its largest clients. The airline’s CEO, Scott Kirby, advocated a common warning system for the 737: the MAX 8 and MAX 9 versions, already certified, will not need to be upgraded to the new standard.

Both planes are behind schedule for certification and are not expected to gain approval this year 2022. The MAX 10, the larger variant, is not expected to be ready until the second half of 2023, according to recent forecasts.

The order book for the MAX 7 and MAX 10 versions is abundant, so airlines are eager to meet the stipulated deliveries. the case of Southwest Airlines has requested 100 units of the Boeing 737-7 MAX, while United Airlines has 150 orders for the Boeing 737-10 MAX and will end up ordering more Airbus A321NEO if the law takes effect in December 2022, explained Scott Kirby, CEO of the airline.

Thousands of jobs are at stake if Boeing has to switch both planes. The company’s CEO, David Calhoun, has even threatened to cancel the MAX 10 if he has to redesign it.

Airbus-Qatar dispute sparks controversy

Boeing tainted by Airbus-Qatar Airways dispute

Airbus_Logotype Globe_001

Lawyers for the Airbus Group are demanding to see the purchase contracts for the Boeing 737 MAX planes that Qatar Airways says it had to buy due to a difference in the negotiating process between the parties. The judges have accepted the request, so now we have another protagonist in the fight for economic interests, even if he is not a party to the original conflict.

The story of the court battle between Airbus and Qatar Airways has generated a lot of press due to a possible influence on the negotiations between Airbus-Qatar Airways. Boeing has no part in the conflict, but it could be affected. On Friday 10/14 in London, Airbus lawyers demanded to see the purchase contracts for the 737 MAX aircraft that Qatar Airways says it had to buy when Airbus canceled the sale of the A321 that the Gulf airline had acquired. In the aeronautical environment, the announcement of the purchase of these aircraft was made so quickly in relation to the cancellation of the sale of the A321, that many do not believe that it was real, but only a simulation, which would cause a strong impact also in the image of Boeing. The judges accepted Airbus’s request, so now we have another protagonist who could come out badly, even if he is not a party to the conflict.

The trial is taking place before the London Court and has countless ramifications. On the one hand, the underlying issue is whether or not Qatar Airways has the right to stop the A350 aircraft due to a «design» problem and ask for financial compensation. If the judges accept the idea of Airbus, that the plane presents only external damages that do not affect safety, Qatar would not be right in its request. A little more complicated, however, is the decision on a consequence of this conflict: Airbus, in addition to canceling all sales of the A350, also canceled a contract for the sale of fifty A321 (50), a highly popular aircraft, with Qatar Airways, without the airline having made any mention of this matter in the lawsuits. Upon this cancellation, Qatar Airways was quick to announce the purchase of the Boeing 737 MAX.

Aerolíneas Argentinas has reported that it estimates a reduction in State contributions for 2023 of a value of US$ 102 million. The announcement, which was made within the framework of the presentation of the Budget Project for 2023 by the Ministry of Transport of the Nation, has given that the transfer by the National Treasury to the airline would amount to US$ 412 million Dollars, a reduction of US$ 102 million compared to 2022.

“These indicators account for the significant growth that Aerolíneas Argentinas has been experiencing. We have been able to cover a good part of the expense with our own income and that is why we are under-executing the item assigned for this year. And we did it in a complex macroeconomic context”, explained the CEO of Aerolíneas Argentinas, Pablo Ceriani.

The state contributions to the airline will represent 0.31% of the General Budget of the Nation, while in 2019 it was 0.48% and during this year 2022 it represents 0.45%. In the latter case, it is worth noting that, so far in 2022, the company has executed only 48% of its budget, having received AR$ 34,700 million Pesos, of the AR$ 72,000 million budgeted. On the other hand, the company presented its operating results where it estimates to transport 11 million passengers in 2022 and reach 13 million by 2023, thus equaling the maximum figure of 2019.

Aerolíneas Argentinas was created on December 7, 1950 and later privatized in 1990. Finally, on December 24, 2008, the National State resumed its control. The company serves as the operator of a wide network of routes serving the markets of Argentina, America and Europe, and its main function is to contribute to the economic and social development of Argentina based on the country’s connectivity with the world.

Discrepancias números en Aerolíneas

AW | 2022 10 13 12:37 | AIRLINES / GOVERNMENT

Number discrepancies in Aerolíneas

Government discrepancies cross over Aerolíneas Argentinas

The current CEO of Aerolíneas Argentinas Pablo Ceriani crossed the former Minister of Transport of the previous Government Guillermo Dietrich for figures from Aerolíneas Argentinas. The head of Aerolineas Argentinas, Pablo Ceriani, harshly crossed the former Minister of Transport during the Government of Mauricio Macri, Guillermo Dietrich, for the data he provided in relation to the current management of the flag carrier. «It’s hard to understand if they don’t know the issues or intentionally lie», he launched on social networks by denying a tweet from the former official for the comparison between 2019 and 2022 on the number of passengers transported and the accusation of the airline’s monopolistic position in the market. local.

AW-7000068

Through his official Twitter account, the CEO of the airline stated: «Today, Aerolíneas has the same percentage of the cabotage market as in 2019 and practically the same number of passengers transported (9.8M vs 9.2M). By 2023 we project exceed those numbers to 9.9 M. Currently, the only two private companies that managed to survive the «Airplane Revolution» operate in Aeroparque and add planes, frequencies and destinations. Where do you see the monopoly of Aerolineas Argentinas or the lack of competition that they intend to install?» While, in relation to the macrismo, he pointed out: «Andes, Avian and Norwegian stopped operating before the end of their government. Latam had losses of US$ 600 million in 2018 and 2019. Airlines were left with a tremendous deficit and with a debt of US$ 1,000 million dollars. We continue working to rebuild what you. broke. Regional connectivity today has an unprecedented offer that connects important cities such as Sao Paulo with different cities in the interior. It is one of the engines of the growth of receptive tourism and one of the main policies of this management».

Last Tuesday 10/11, Guillermo Dietrich said that Aerolíneas Argentinas, in 2019, «carried 14 million passengers with 65% of the local market, that is, competing and that this year they expect to end up with 11 million fewer passengers but with 90% of the market. Not only that, but domestic flights fell by 20% and international flights by 50%, compared to our last year. Argentines today fly less, with less supply and much higher prices for the lack of competition. There are thousands of employment and development opportunities that are lost by privileging a few, punishing all Argentines».

According to information from Aerolíneas, differing from what the former Minister stated, they confirmed that a total of 13 million passengers were transported between domestic and international flights and not 14 million as Guillermo Dietrich had claimed. In turn, Pablo Ceriani appeared on Wednesday 10/12 at the Budget and Finance Commission where he mentioned, among other things, that this year would close with a total of 11 million passengers transported, which represents 9.9 million passengers on domestic flights.

Regarding the accusation that Aerolíneas Argentinas has a monopolistic position in the market, the data provided by Pablo Ceriani shows that in 2019 it occupied 63% of the total with companies that do not operate in the country such as LATAM Airlines Argentina, Norwegian Air Argentina and Andes Líneas Aéreas. Despite this, the figures show that Flybondi Líneas Aéreas and JetSMART Airlines Argentina grew and the flag carrier remains at a percentage of 69% market share. Also in the framework of the presentation of the 2023 Budget, the company confirmed that it estimates a reduction in State contributions for 2023 of US$ 102 million. In turn, the projected US$ 412 million is US$ 19 million less than in 2019. They also reported that the item for next year means 0.31% of the total National Budget, while in 2019 it was 0. 48%. While he closed that, so far this year, only 48% of the total annual budget has been executed.

Senado EEUU vs plazo cert. 7/10 MAX

AW | 2022 10 12 23:30 | GOVERNMENT / INDUSTRY

Senado no extendería plazo para certificación homogénea

Boeing 737 MAX_Isologotype

US-Senate-Logo

US Senate vs term cert. 7/10 MAX

Senate would not extend the term for homogeneous certification

US-Senate-Logo.svg

The US Senate is not likely to grant The Boeing Company an extension to the certification deadline for the Boeing 737-7 MAX and Boeing 737-10 MAX versions. Boeing would only have until December 2022 to demonstrate the airworthiness of the 737-7 MAX and 737-10 MAX to the Federal Aviation Administration (FAA). Senator Roger Wicker (R-MS) has proposed extending Boeing’s deadline to September 2024 by attaching an amendment to the US Senate’s annual defense bill. However, the latest version of the bill reportedly does not include the crucial amendment.

The Boeing 737 MAX was initially grounded after serious design flaws led to two plane crashes that killed 346 people. Since then, 737 MAX aircraft have been conditionally cleared by the FAA for re-entry into service under strict safety regulations. The country’s civil aviation regulatory agency required Boeing to make several significant changes to the 737 MAX before it could be properly recertified.

Major pilot unions are divided on the issue. The Southwest Airlines pilots union, SWAPA, supports an extension of the deadline, while the American Airlines pilots union, APA, opposes the American construction company being granted an extension. Without the extension, the controversial Boeing 737-7 MAX and Boeing 737-10 MAX aircraft would not be able to fly in the United States until recertified.

Demandan por accidente LaMia 2933

AW | 2022 10 11 00:05 | GOVERNMENT / AVIATION

Víctimas y familiares demandan reparaciones a aseguradoras

AW-LaMia__LMI2933__AVRO RJ85-002

LaMia 2933 accident sued

Victims and relatives demand reparations from insurers

The victims and relatives of the plane crash of flight LMI2933 seek reparations for damages worth US$844 million from insurers through a lawsuit in the Supreme Court of Brazil. The plaintiffs filed a lawsuit in the Superior Court on 09/2022 against the insurers Aon and Tokio Marine Kiln seeking compensation for the air disaster that occurred on November 28, 2016 that caused the death of 19 members of the Chapecoense soccer team. from Brazil. Victims of the LaMia Airlines crash that killed 71 of the 77 people on board have filed a lawsuit in Superior Court against the insurers, seeking to overturn an injunction that prevented them from going after insurance brokers for compensation. through the US courts.

The plane crash of the AVRO RJ85 aircraft occurred in the vicinity of Medellín, Colombia on November 28, 2016 with a flight chartered by the Chapecoense professional soccer team that crashed during a trip from Viru-Viru/VVI, Bolivia to Medellín/MDE, Colombia, after the LaMia Airlines flight ran out of fuel. Subsequently, the survivors of the accident carried out a litigation campaign seeking US$ 844 million in damages from the airline operators LaMia and Kite Air through the courts of Miami, United States. Insurers previously said they would not pay for a policy provided to LaMia, over claims the airline had failed to pay its second installment of its US$ 25 million premium on the policy and had been negligent in not refueling the plane. In 2019, insurers offered victims’ families US$ 225,000 in compensation each as a goodwill gesture, in a settlement that 23 family members accepted.

The victims of the plane crash are now seeking to overturn a High Court injunction that prevents them from suing the insurers in US courts, in order to collect the full sum of US$ 844 million. The Superior Court lawsuit came after the victims filed a motion to add the insurers to the original Florida claim.

Insurers are trying to argue that Florida’s US$ 844 million settlement is unreasonable, considering the original policy was worth just US$ 25 million. They also claim that they have no connection to Florida, apart from the fact that the original lawsuit against the planes was filed there, and that any case must be heard in British Courts.

American opone ampliar CERT. 7/10MAX

AW | 2022 10 07 10:37 | AVIATION SAFETY / AIRLINES / GOVERNMENT

Oposición pilotos a extensión fecha límite certificación 7/10 MAX

AW-Boeing 737-71000MAX

Boeing 737 MAX_Isologotype

American opposes extension CERT. 7/10 MAX

Opposition pilots to extension deadline certification MAX 7 / MAX 10

Allied Pilots_Islogotype

The Allied Pilots Association (APA) union, which represents American Airlines pilots, has expressed opposition to any extension of the late December 2022 deadline that Boeing faces to certify the Boeing 737-7 MAX and Boeing 737-10. MAX without the addition of an Engine and Crew Alert System (EICAS) to their flight decks. A law passed in December 2020 in the United States known as the Aircraft Certification, Safety and Accountability Act (ACSAA) will require Boeing to install the system on both models unless they achieve certification by the end of 2022 or Congress allows a extension. Mississippi Sen. Roger Wicker, the top Republican on the Senate Commerce Committee, has proposed an amendment to this year’s defense appropriations bill that would give Boeing until September 2024 to complete its work on the two planes before before the ACSAA provision required by EICAS enters into force.

«Boeing needs to proceed with installing modern crew alert systems on these aircraft to mitigate the effect of pilot startle and confusion during complex composite system malfunctions. Once these systems are in place and pilots have been trained properly in them, our crews will be better able to identify system failures and prioritize corrective actions that could save lives», said Allied Pilots Association President Edward Sicher.

American Airlines flies more than 300 Boeing 737s, including 42 MAX 8s, and holds delivery positions on another 88 MAXs. The airline has not specified whether or not its delivery plans involve MAX 7 or MAX 10.

«We oppose any extension of the waiver and disagree with Boeing’s assertion that pilots could be confused when going from an aircraft without the modern warning system to one that is equipped with it. Nothing could be further from our flight deck reality. Consider the Boeing 757 and the Boeing 767; they are substantially different aircraft, but they operate under a single certificate. Pilots have routinely flown both on the same day without any confusion», added Edward Sicher.

For its part, Boeing continues to cite safety as the «driving factor» in the certification effort and laments the safety compromise that the loss of similarity between various 737 submodels would cause by the need to install an EICAS on the MAX 7 and MAX 737. 10. «Safety gains in commercial aviation over several decades have shown that consistent operating experience across a family of aircraft is an industry best practice that benefits flight crews and the flying public by improving safety and reduce risk», Boeing said in a statement.
