China restores pre-Covid traffic

China reaches pre-pandemics domestic traffic

Air trips in China have returned to January 2019 levels before the important Lunar New Year holidays, according to the Cirium Aviation Data Provider. Airlines in the People’s Republic of China are scheduled to operate 99.8% of January 2019, although recovery has been largely driven by national trips. National seats are 9.5% higher than 2019 levels, Cirium said.

China’s surprise decision to eliminate border restrictions earlier this month of 01/2023 has given the industry an impulse after the previous projections for a reopening much later in 2023. The 40 -day Chinese New Year period of the new Chinese Year It began on January 7, 2023 represents the greatest annual migration on Earth. Although national trips take off, international trips continue to decrease considerably, with exits from China almost 90% lower compared to the levels prior to the pandemic, according to the Cirium data provider.

Boeing scheduled to appear justice
Fraud charges after 737 MAX accidents

AW-District Court Northern Texas__Isologotype

The Boeing Company will be tried for fraud in a Court of Justice of the State of Texas after the families of the victims of accidents that have involved two Boeing 737-8 MAX, opposed the legal immunity granted to the aerospace manufacturer. The Federal District Judge Reed O’Connor ordered Boeing to send a representative to his room in Fort Worth on January 26, 2023 to listen to the position of serious crime. A Boeing spokesman said the company had no comments. The United States Department of Justice, which did not oppose a public hearing but has fought against the reopening of the agreement, also declined to comment.

In January 2021, the United States Department of Justice (DOJ) granted immunity to Boeing when the manufacturer agreed to pay a total criminal monetary amount of more than US$ 2.5 billion to resolve the case involving the lack of security due to security The accidents of the JT-610 flights of Lion Air in October 2018 and the ET-302 flight of Ethiopian Airlines in March 2019.

In October 2022, federal judge Reed O’Connor ruled that the agreement reached between Boeing and the Department of Justice violated the Law on the Rights of Crimes. «The court considers that the tragic loss of lives that resulted from the two air accidents was a reasonably predictable consequence of the Boeing conspiracy to disappoint the United States», the judge wrote at that time. Reed O’Connor ordered the manufacturer of aircraft based in Arlington, Virginia (VA), United States to appear in the Fort Worth court on January 26, 2023 to be accused of fraud.

The families argued that the Department of Justice «lied and violated their rights through a secret process», and asked the federal judge of Fort Worth, from the northern district of Texas, Reed O’Connor, to rescind the immunity of Boeing from criminal prosecution. In October 2022 he said that people killed in two accidents at Boeing 737 MAX are legally considered victims of crimes, and family members had urged him to demand that Boeing be legally prosecuted for the position of serious crime. The federal judge ordered that any legal representative of those who identified themselves as «victims of crimes» who intend to appear to be heard in the procedures must notify and an appropriate person appear in reading charges on behalf of the Boeing company.

Accidents in 2018 and 2019 in Indonesia and Ethiopia, which cost Boeing more than US$ 20,000 million, led to a twenty -month grounding for the world’s best-selling plane and took to the United States Congress to Approve legislation that reforms for the certification of airplanes.

Both Boeing and the Department of Justice oppose the deferred prosecution agreement, which included US$ 500 million in compensation for the victims, a fine of US$ 243.6 million and US$ 1.7 billion in compensation to airlines per grounding of its units during the re-certification process.

737 MAX accidents

Accidents occurred in October 2018 in Indonesia and less than five months later in March 2019 in Ethiopia. In both airplanes, an automated flight control system that Boeing did not initially reveal to the airlines and the pilots pushed the nose down based on a single sensor reading in the fuselage.

The Federal Aviation Administration (FAA) authorized 737 MAX to resume flights at the end of 2020 after Boeing redesign the flight control system known as Maneuvering Characteristics Augmentation System (MCAS). The accidents led to Congress investigations that criticized both Boeing and FAA, and changes in the way in which FAA will certify airplanes in the future.

The only criminal charges derived from the 737 MAX saga were presented against an ex-test of evidence of The Boeing Company, who was accused of deceiving FAA.

DOJ posture

The Department of Justice said in 2021 that «the deceptive statements, the half truths and the omissions communicated by Boeing employees to the Federal Aviation Administration prevented the government’s ability to guarantee the security of the public that flies». The Department of Justice said in a judicial presentation in November 2022 that he did not oppose a reading of charges for Boeing, but he opposes undoing the agreement, saying that «it would impose serious difficulties to the parties and the many victims who have received compensation» .

Boeing posture

In September 2022, Boeing agreed to pay US$ 200 million to resolve the civil positions of the stock exchange and values that cheated investors about the Boeing 737 MAX. The Polish national airline LOT Airlines requested in October 2022 Federal Reed O’Connor to declare it victim of a crime in the criminal case of 737 MAX, a measure that could make the airline eligible for significant compensation. Boeing said in November 2022 that he opposes any effort to reopen the agreement, qualifying it as «unprecedented, unfeasible and inequitable» and pointed out that he has been fulfilling the agreement for almost two years.

Boeing trial perspectives

A lawyer, Paul Cassell, said the Department of Justice (DOJ) could support the agreement even after the hearing, in which the passenger relatives are expected to speak. «But we believe that this was such a rotten treatment that … [the Department of Justice] can and should, after listening to the victims, remakeing the treatment», said Paul Cassell.

The Federal Judge of Texas is narrow and does not guarantee that Boeing faces a trial. However, that remains the objective of the lawyers of the relatives of some of the 346 people who died in the accidents of 2018 and 2019. Judge Reed O’Connor has not yet pronounced on a separate motion from families’ lawyers to strip Boeing of prosecution immunity. Families accuse the government of reaching a secret agreement with Boeing without informing them about negotiations.

The relatives of some victims of the accident believe that the United States Government violated their rights when reaching an agreement without notifying families
The United States Department of Justice has fought against the reopening of the agreement
The lawyers of some relatives of the passengers who died in accidents want Boeing to be processed

Peruvian airport taking

Suspensions of operations in airports in Peru

The national strike in the Republic of Peru continues on Thursday 01/19 in several regions, with road blockages and marches that affect 27% of the country. Meanwhile, in Lima there is a great mobilization with demands such as the closing of the Congress, the Constituent Assembly and the resignation of President Dina Boluarte. In this framework of chaos, three airports were about to be taken this Thursday by protesters. The Peruvian airports of Arequipa, Cusco and Juliaca were an epicenter of clashes between protesters and police officers within the framework of the national strike. The temporary closure decision of Arequipa and Cusco aerostations were preventive, while Juliaca is inoperative for clashes and the social disorder of public knowledge.

In Arequipa, the second most populous city in the country, hundreds of Protestants tried to enter the facilities of Alfredo Rodríguez Ballón airport, whose operations were suspended on the morning of 19/01 as a prevention measure. The protesters broke the metal fences of the perimeter of the air terminal, to which the police officers responded with the launch of tear bombs. The Ministry of Transport and Communications reported the closing «in safeguarding the integrity of citizenship and the security of aeronautical operations».

In the course, the Government of Peru also suspended the operations of the Alejandro Velasco Astete de Cusco International Airport, the entrance door to Machu Picchu, where the protesters tried orchestrated an attack with stones at the forces of the order.

The third incident in the day of the day was recorded at the Inca Manco Cápac airport in Juliaca, in Puno, inoperative for a few days. More than 30% of the perimeter fence is affected and at least 15,000 passengers have been prevented from traveling after closing, which makes a total of 100 flights a week. A week ago, Andean airports of Peru had announced that the rehabilitation of this air terminal, also attacked in December 2022, would take at least thirty days. Since then, the scene of blockages and confrontations affects almost six hundred flights and 150,000 passengers. The repercussions could arrive until July 2023, experts point out.

JKC victoria por Jet Airways

AW | 2023 01 19 12:39 | AIRLINES / GOVERNMENT

Gana batalla judicial adquisición Jet Airways de India

Jet_Airways_Isologotype

JKC Victoria by Jet Airways

Win judicial battle Jet Airways acquisition of India

The Kalroock Capital-Muurri Lal Jalan Consortium (JKC), owners of Jet Airways has reached a victory in the Court of Justice, with the National Court of Law of Societies of India (NCLT) clearing the way for its acquisition of the airline later of the continuous resistance of the creditors.

The consortium returned to the NCLT at the end of 2022 to obtain orders to end the transfer of property after months of disputes with the creditors, including a powerful banks union, with respect to payments, expiration dates and interpretations of the orders of the orders previous of the NCLT. Jet Airways stopped flying in April 2019, and the NCLT approved the acquisition of the airline by JKC in June 2021, and the consortium agreed to put fresh capital on the airline and pay a part of the pending debts. In return, creditors would sign a liberation certificate that would allow JFC to relaunch the airline. However, disputes over agreed payments have seen creditors, including the banking union led by the State Bank of India, refusing to sign the certificate, and the airline remains firmly on land.

But according to Reuters, the NCLT has returned with an unpublished decision that favors JKC. The decision establishes a new effective date on November 16, 2022. That date is the starting gun for a period of six months within which JFC must settle their payments agreed to the creditors. Disputes on when the effective date of the property occurred have been the source of ongoing disputes between the consortium and the creditors. After the NCLT decision is officially issued, creditors are expected to meet to determine their response. If you agree with the result, JKC is positioned to move forward with the relaunch of Jet Airways.

Anularían fusión Avianca-Viva

AW | 2023 01 19 11:15 | AIRLINES / AVIATION ORGANISMS / GOVERNMENT

They would cancel Avianca-Viva fusion

Integration would be canceled by Transport of Colombia

The process has been found a series of procedural irregularities, which would prevent the union of the airlines AviancaViva Air, said Wednesday 18/01, said Colombia Transport Minister Guillermo Reyes. On Monday 01/23 will be announced whether the application for integration of the airlines is permanently approved or rejected, but which has reached an agreement for the annulment of the integration process.

In April 2022, the majority shareholders of Avianca Airlines and Viva Air Colombia requested their integration before the civil aeronautics of Colombia (ACC), with the aim of viating the permanence of the Low-Cost airline for the benefit of passengers, connectivity in Colombia And Peru, «as well as to safeguard jobs that directly and indirectly depend on Viva», says the document.

When studying the case presented by Colombian airlines, a series of irregularities have been found in the processes, which would prevent union. «We know the importance of a prompt decision, but also the effects of not taking it for the public treasury and for aerocivil», said the Minister of Transportation. Since August 8, 2022, when Avianca and Viva Air Colombia submitted to control of the aeronautical authority, the integration operation between said aerocomercial public transport operators was carried out in depth the scope of said application. In the first instance, civil aeronautics denied the request of Avianca and Viva Air to integrate for several reasons, including that the last one did not show an imminent risk for its disappearance from the market and that its union would mean a majority position in the market, hindering free competition.

One of the arguments given by airlines to join was due to market conditions regarding the price of aircraft fuel, inflation and valorization of the US currency. In this regard, Adrian Neuhauser, president and CEO of Avianca, said: “The application for integration with Viva seeks to fight for its survival in the market, as well as to maintain the competitiveness it has built for 10 years of operation. Even with the complex panorama that aviation lives in the world on behalf of fuel rise, as well as historical inflation in the region, Avianca has a solid financial position, evident in the recent ads, which would allow him to achieve synergies and take advantage of economies of Live scale, provide financial support and participate in your management. We trust that the aeronautical authority can study this request quickly, given the relevance of the same for the country”.

Although from the Colombian Ministry of Transportation they reported that the news will be official in the next few days, the possibility is open for airlines to start the process again if they wish to continue with their intention of being part of the same economic group. Since the airline synergy was known, from several sectors of society they have asked the National Government to stop the Avianca-Viva Air Union. Senators and representatives, mostly from Antioquia, led a request to the Minister of Transportation to pronounce on the case of merger between airlines. The document includes a call to «analyze with speed and responsibility the guarantees that so much living and Avianca have offered to the authorities to protect aerial users and safeguard competition in the sector».

Conferencia Airline Economics en Dublín

AW | 2023 01 18 15:22 | CONGRESS / AVIATION ORGANISMS / GOVERNMENT

Airline Economics Conference in Dublin

Broken European Commission with Russia Federation
«There will be no flights until Russia loses war»

The General Director for Mobility and Transportation of the European Union, Henrik Hololei, who participates in the Airline Economics Conference, in Dublin, Ireland, has expressed that the reopening of the European airspace to the Russians will only occur when he loses the war in Ukraine. «Right now we do not know how long the sanctions against Russia will last, because we do not know how things will evolve and how the aggressor will be treated in the future», but, among other things, he said that the rate for flying over Russian Air Space It will have to disappear. Henrik Hololei explained that these payments for flying through the Russian sky are illegal. However, they remained. He added that «I can’t imagine a situation in which European airspace is reopened as if nothing had happened».

«If one day we will have the opportunity to see the opening of Russian airspace, one thing has to disappear Siberia overflight royalties. Any opening of Russian airspace will not be as usual», said Henrik Hololei. The Russia Federation must stop charging foreign airlines for the use of Siberian airspace as the overflow restrictions introduced as a result of the conflict in Ukraine are lifted, said a senior official of the European Union on Monday 01/16.

European airspace

The Dublin conference also attended the Irishman Willie Walsh, president of IATA, who groups all the world airlines, who took the opportunity to question precisely against Henrik Hololei the European decision to ban short radio flights to reduce CO2 emissions: «This debate has to get away from the emotional and must focus on data, based on facts». Airlines, for example, question the ineffective of Eurocontrol, which, with their border fragmentation, forces airlines to make paths with a much greater fuel consumption than if they fly along the shortest route.

Aerolíneas menos subsidios estatales

AW | 2023 01 18 14:54 | AIRLINES / GOVERNMENT

Aerolíneas less state subsidies

Used only 65% of the projected budget for 2022

Aerolíneas Argentinas has reduced the dependence of the subsidies of the Argentine State in concepts of representative expenses, using only 65% of the budget allocated by 2022 as reported by the airline on Tuesday, 17/01 Cominating in advance some key figures that will be part of your management report corresponding to last year.

«During the past year, the flag airline received only 65% of the AR$ 72,000 million pesos assigned by the national state, using AR$ 47,000 million or US$ 353,147,000», said the airline in a statement, which leaves a difference of US$ 25,000 million that the company did not apply. The flag airline stressed that the US$ 357 million involved a reduction of almost 50% compared to state contributions used during 2021, when it received about US$ 644.5 million.

“These results account for the effort we have been making to continue shrinking the contributions of the State and solving expenses with their own income. It is great news because we could do it in a complex macroeconomic context”, said Pablo Ceriani, president of Aerolíneas Argentinas.

With regard to 2023, the transfers planned by the State Treasury amount to US$ 412 million, a reduction of US$ 102 million compared to the budget projected by 2022, although above the effectively spent in the year in real terms, for this year and in national currency values, the projected contribution would be ar AR$ 90,000 million, 26% above 2022.

“During this year, the contributions to the airline will represent 0.31% of the state budget, while 2019 was 0.48%. Not only are we getting the company to require lower contributions from the State, but also its relative weight in the national budget is shrinked year after year”, said Pablo Ceriani on his Twitter account.

Expansion operations

In addition, the company made public the numbers referring to ticket sales, for which the company was joined by US$ 1,864 million in the last year. In 2022, 11,670,000 passengers were transported throughout the network of 38 destinations, 48 interprovincial routes and 21 international destinations. According to what was projected by 2023, the company aims to overcome the historical brand of 13,000,000 passengers. «As long as we improve the numbers, we continue to expand the operation: we add frequencies, destinations and airplanes so that our country has greater connectivity every day», said the president of Aerolíneas Argentinas through their social networks.

Aerolíneas Argentinas seeks to return the loading activity, confirming the announcement in December 2022 to incorporate two new freighters Boeing 737-800BDF aircraft to launch at 2023 with the objective to enhance the 100% freighter transport business.

The two new aircraft will arrive in Argentina during the first semester of 2023, the airplanes will have a configuration to transport 22 tons of palette load. “This is a very important advance for the country and for our flag airline because, on the one hand, with these two freighters that are incorporated into the Aerolíneas Argentinas fleet we will have more tools to connect our producers and producers in a federal way And with the world”, said Transport Minister Diego Giuliano.

The Bonza flight network is expected to expand to twenty -seven national, interstate, and international routes as the fleet and workforce of the airline grows. The Minister of Infrastructure, Transport, Regional Development and Local Government, Catherine King, said that «the airline was a welcome milestone for the nation’s aviation industry». The minister described the planned routes of Bonza as poorly attended by another allerolinean and said that low-cost rates will help with the growing demand for flights after the Covid-19 pandemic.

«The entry of a new operator will boost competition in the Australian aviation sector, offering more options to the traveler public and exercising down pressure on the rates. I congratulate the staff of the house and Bonza who have worked hard for many months for many months to Advance in this certification and ensure that Bonza complies with the high required security standards of all airlines operating in Australia», said Catherine King.

Bonza received his first nicknamed ‘Shazza’ plane, VH-UJT on August 1, 2022, his second ‘Bazza’, VH-UIK on October 29, 2022, and the third and last of the three initial aircraft ‘Sheila’, VH-UJK on December 12, 2022.

The planes are leased to the majority shareholder of Bonza, 777 Partners, who made a request for twenty-four Boeing 737 MAX (24) aircraft in March 2021, some of which will also be assigned to Flair Airlines, based in Canada, in which 777 Partners has a participation. 777 Partners, in December 2021, also confirmed an order with Boeing to take thirty Boeing 737-8-200 MAX high capacity. Post-colapso tráfico EEUU

AW | 2023 01 17 10:19 | AIR TRAFFIC / GOVENRMENT / AVIATION ORGANISMS

Presión a FAA

Post-Colapso Traffic USA

What was behind the collapse of the FAA last week?

The Secretary of Transportation, Pete Buttigieg, spoke after heading to the Transportation Research Board in Washington, on January 11, 2023. Pete Buttigieg personnel elections were certainly a factor.

After the problems with the Notam notice system of the Federal Aviation Administration (FAA) last week, which caused flight delays throughout the United States, the Secretary of Transportation Pete Buttigieg is besieged and under scrutiny due to the breakdown. However, although many critics have rushed to blame the secretary, there is an important context that has not been informed otherwise.

Rotatory doors project

Until the past spring, the FAA was supervised by a designated by the Trump administration called Steve Dickson, a former Delta Air Lines executive who, as head of the FAA, directed the agency that regulated Delta and its competitors. Unfortunately, this type of rotating door disposition is not unusual for FAA, which has a regulatory capture history. The friend-friendly relationship between the FAA and the industry that Supervisa was so extreme that the House of Representatives, not known for its strong scrutiny of the lobbying of the industry, unanimously voted to create a complainant office within the isolated FAA of the administrator. That protection of the complainant was particularly important with Steve Dickson to the helm, given his reprisals against a complainant who raised security concerns in Delta while he was an executive of the airline. After a Delta pilot presented a report that documented security concerns and what it considered possible violations of FAA regulation, Steve Dickson forced her to see a psychiatrist who diagnosed him bipolar disorder. This diagnosis was rejected by a panel of doctors from the Mayo Clinic. After the terrible experience, FAA corroborated one of the claims made by the pilot.

Pete Buttigieg could have given Steve Dickson the boot from the jump, but he did not. While the FAA administrator is appointed for a period of five years, the president can still fire him, just like the National Executive can fire the heads of other agencies of the Executive Power. The presidents Clinton and Trump fired directors of the Federal Office of Investigations. Biden did the same with the director of the Republican Office of Financial Protection of the Consumer, the General Advisor of the National Board of Labor Relations, among others. But it seems unlikely that Joe Biden will make that call in the FAA on his own, particularly in a matter as technical as the regulation of aviation. Most likely to be referred to Pete Buttigieg’s trial.

There was a complete restart in the Department of Transportation (DOT) in particular. Elaine Chao, the predecessor of Pete Buttigieg, was jealously anti-regulation and dedicated to allowing or instigating corporations while exploding US consumers. His driving philosophy seemed to be that his role as a secretary was to serve elite and transport corporations, one of which, the Naviera Fornost company is owned by his family. Elaine Chao spent her time both in the Department of Transportation and, under George W. Bush, in the Labor Department seeking to weaken workers while channeling more profits to the pockets of economic elites.

It is difficult for FAA to work for the public interest while they are continuously directed by people who have deep links with the executives of the airlines.

Steve Dickson was appointed to direct the FAA following the accidents of Boeing 737 Max to stabilize the ship and restore faith in the besieged Aviation Regulatory Agency. He successfully solved the Boeing problem and renewed security inspections. He even insisted not to certify the 737 Max until he had personally flown and had judged him from the perspective of a pilot. But this does not obviate the compensatory tendency of Steve Dickson to undermine the security concerns of the pilots by sending them to a mental health exam to a Delta Air Lines pilot for posing such problems. It is difficult for FAA to work for the public interest while they are continuously directed by people who have deep links with the executives of the airlines. This is especially true when FAA leadership has a history of taking energetic measures against employees when they pose security concerns, instead of taking energetic measures against self-confidence.

The easy solution for Pete Buttigieg would have been to get rid of Steve Dickson and appoint a new FAA agent. Instead, Buttigieg and Biden chose to let Steve Dickson continue his mandate. However, at the beginning of 2022, Steve Dickson resigned his position for his own will, saying, as usual, that he wanted to spend more time with his family. The Biden administration candidate to assume the position has languished in the Senate for months. Phil Washington, the nominee, has faced criticism so some aviation experts believe it is a specific insufficient experience of aviation. For their part, Buttigieg and the White House have cited their extensive management and infrastructure managerial experience.

Meanwhile, FAA has stayed with a vacancy at the top during most of the year. By law, the attached administrator is supposed to carry out the duties of the administration when the office is empty. This is not how the DOT has handled the vacancy. The agency overlooked the attached administrator Bradley Mims and instead appointed Billy Nolen, an associate administrator for aviation security, as an interim administrator. When announcing the promotion of Billy Noen, the same statement indicated that Bradley Mims would also assume additional responsibility.

There is no real explanation of why Billy Nolen was chosen about Bradley Mims. Both have decades of experience. The most notable difference between them is that Noen is a former executive of an airline who also worked on Airlines For America (A4A), a powerful commercial group (which includes Southwest among its most prominent members). Bradley Mims, on the other hand, worked mainly on transport consulting, as well as a variety of public sector advice roles. Buttigieg went with someone who used to press for airlines and then went on to help administer an airline. Given the problematic legacy of the FAA to approach the airlines, that choice was not reassuring.

Matt Stoller, of the American project for economic freedoms, has opined that Notam’s malfunction was probably not Pete Buttigieg’s fault, since the airlines had refused to pay for the system update. However, what is Buttigieg’s fault is to allow FAA and DOT to continue using silk gloves when they act as regulators. It has allowed all but a national airline to get yours with a warning for illegally retaining customer refunds. And after the debacle of the air trips last summer, instead of taking energetic measures against airlines, Buttigieg has just sent a severe letter.

The Notam system is suffering from negligence, which resulted last week in the first mass ground connection since 9/11. Buttigieg is not directly guilty of that specific failure, but is responsible for personnel decisions about who was supervising the situation. He is also responsible for establishing the tone of the interactions between the DOT and an aviation industry that apparently distributes dividends in a more timely way of what he transports to Americans.

FAA pressure

The pressure is increasing on the Federal Aviation Administration (FAA) after several high -profile incidents created headaches for travelers and President Biden’s candidate, Phil Washington, faces a controversial confirmation process for the main position of the agency that is ready to start.

Millions of air travelers were stranded in the airports throughout the country during the vacation season when the Southwest Airlines Collapsed crew system, which caused an investigation by the Department of Transportation (DOT), which is the parent agency of FAA.

Flights throughout the country were temporarily suspended last week after an interruption in the Air Missions (Notam) of the FAA, which alerts the pilots and other personnel about air problems and delays in the airport, which which It resulted in the cancellation of more than 1,000 canceled flights and thousands more delayed. The Secretary of Transportation, Pete Buttigieg, and FAA officials are investigating the computer failure that has been caused by personnel who have not followed the procedures.

In addition to the agency’s problems, an almost disaster was avoided at the John F. Kennedy airport in New York on Friday 13/01 when air traffic controllers saw a Boeing 777 American Airlines rolling through the track while a Boeing 737 Delta was using to take off. The FAA told him that Delta’s flight managed to stop her «approximately 1,000 feet» take off before reaching the American flight. The agency is investigating the incident in conjunction with the National Transport Security Board (NTSB).

These incidents have caused greater scrutiny of FAA’s operations and have drawn attention to the fact that the agency has been without an administrator confirmed by the Senate since March 2022, when the Trump era administrator Stephen Dickson, He resigned and was replaced by interim administrator Billy Nolen.
