Ecuador elimina ISD para aerolíneas

AW | 2021 09 03 12:47 | AIRLINES MARKET / GOVERNMENT

Ecuador eliminates ISD for airlines

Government seeks to stimulate air traffic

The Government of Ecuador has announced the elimination of the Foreign Currency Exit Tax (ISD) for airlines operating in the country, seeking to improve market competitiveness. The Ministry of Economy and Finance of Ecuador announced that the Income Tax is eliminated for foreign airlines operating in Ecuador. This change in taxation will improve traffic rates, anticipating an Open Skies agreement with the United States. With these measures, Ecuador establishes stimuli for the development of post-pandemic commercial aviation, which have been encouraged by the United States to advance in the process of signing an Open Skies agreement, which will allow increasing the maximum frequencies assigned by country, airlines, destinations.

The elimination of the Foreign Currency Exit Tax to the airlines will allow to bring multiple benefits to Ecuador: being more competitive and attractive in the South American market, as well as, it will allow the airlines to adjust their operating costs, allowing them to obtain an improvement in airfares. It will also bring benefits in the purchase of parts and spare parts that airlines carry out abroad, send crews to training in other countries, operating costs, fees paid in foreign destinations, among other details. The main benefit will be for the user, which will allow them to choose more airlines in the market, increases in frequencies in Ecuador, which will generate more supply in the market and more competitive airfares.

Presidential Decree No. 182 issued on September 2, 2021 effective on the date of publication specifies: «Establish a rate of zero percent (0%) of the Tax on the Outflow of Foreign Currency for transfers, shipments or transfers of foreign currency that carried out by foreign airlines authorized to operate in the country that have the document that proves that they have been designated by their aeronautical authority to operate an international service, be it passengers, cargo and mail in a combined way, or exclusive cargo in Ecuador. The SRI will have 15 days to modify the respective resolutions that allow the suspension of the ISD collection».

Ecuador will continue to advance towards an improvement in the field of commercial aviation, applying stimulus measures to generate more competitiveness and an improvement in the air transport service with the United States and the rest of the region.

UE impone nuevas restricciones EEUU

AW | 2021 08 30 20:27 | GOVERNMENT / AIR TRAFFIC

EU imposes new US restrictions

EU imposes travel restrictions to the US amid increased infections

European Union (EU) countries voted to subject the United States to new restrictions on non-essential travel amid a surge in new coronavirus cases, dealing a blow to the tourism industry. A qualified majority of ambassadors voted to reintroduce the restrictions, which had been lifted in June, according to an EU statement on Monday. The change seems more likely to affect unvaccinated Americans. The United States had 588 new cases of Covid-19 per 100,000 inhabitants in the two weeks ending August 22, 2021, according to the European Center for Disease Prevention and Control, well above the limit of 75 established in the EU guidelines. While countries have largely followed EU guidelines, there have been times when individual nations have deviated from them. The EU cites rising infections to curb non-essential travel.

White House Press Secretary Jen Psaki said the United States is still developing its international travel policy, including possibly strengthening testing rules and eventually possibly requiring vaccination for all visiting foreign nationals. . No final decision has been made, they argue from the United States. «The fastest way to reopen travel is for people to get vaccinated, masked, and slow the spread of the deadly virus. We continue to work across federal agencies to develop a consistent and safe international travel policy – this includes travel from Europe», Jen Psaki said at the White House on Monday 08/30.

Air traffic

The guidance of the European bloc is a recommendation and any decision on who to let in, and what restrictions to impose, ultimately rests with the governments of each member state. Countries may also choose to accept proof of vaccination to waive travel restrictions.

The actions of the airlines fell in the United States, probably in anticipation of the movement of the European Union by the announcements of new sanitary measures implemented. The move to restrict visitors from the world’s largest economy is a significant setback for airlines and travel companies that have been pushing for a complete reopening of lucrative transatlantic routes. Shares of Air France-KLM, IAG SA and Deutsche Lufthansa AG all came under pressure last week on the news of the vote.

«This decision is extremely disappointing for Europe’s airlines and our ailing tourism sector, particularly given that the risk of transmission of the virus among air travelers has proven to be extremely low. The overwhelming majority of international travelers today are fully vaccinated, tested or recovered from the virus», lobby group Airlines for Europe (A4A) said in a statement on Monday 08/30.

Flagship European airlines like Lufthansa German Airlines and Air France have been counting on their long-haul passenger numbers to pick up. The recovery for airlines has not been the same across Europe, as European low-cost airlines have been able to benefit from Covid-19 vaccine passes, making intra-European travel easier during the summer season.

Travel between the EU and the United States has been a point of political contention. The Biden administration has maintained border restrictions despite pressure to allow visitors from allies like the EU who have eased their own restrictions. US officials have cited the rise in delta infections as one reason for that stance. Other countries such as Israel, Montenegro, Kosovo, Lebanon and North Macedonia were also removed from the European Union’s safe travel list.

EU rules specify that for third countries to be allowed to travel without being essential to the bloc, the trend of new cases must be stable or decrease and that no more than 4% of those tested for the virus are positive. The latest figures from the United States represent the seventh consecutive increase.

The guidelines also take into account whether variants of concern have been detected in a particular nation and whether it has reciprocated in opening travel. Germany classified the United States as a high-risk area as of August 15, 2021, which means that visitors must show that they have been vaccinated, have recovered from the disease, or have a negative test result. France, Spain, Italy and Belgium also require some kind of test to show that the traveler has Covid antibodies or proof of vaccination. But none have imposed quarantine rules.

EEUU abandona Afganistán

AW | 2021 08 30 20:02 | GOVERNMENT / AVIATION

USA leaves Afghanistan

Close airlift for Afghan refugees
FAA bans US commercial flights to the area

The United States Army has ended its presence in the Republic of Afghanistan after setting a deadline of 08/31 to leave the Asian country. Following the ultimatum imposed by the Taliban army, military and rescue units strategically accelerated the abandonment of Kabul International Airport, as the last stronghold and only escape route for many people.

The Federal Aviation Administration (FAA) has reported that Kabul International Airport is now out of control; while US airlines have been banned from landing or flying over Afghan airspace. Kabul Airport is without air traffic control services now that the US military has withdrawn from Afghanistan.

The Taliban celebrate victory as the last US troops leave Afghanistan. The United States completes the withdrawal of its forces from Afghanistan, says the Pentagon, ending a twenty-year war with the Taliban in control. Taliban fighters fired their weapons into the air in celebration in the Afghan capital, Kabul, as the United States completed the withdrawal of its forces from Afghanistan, nearly twenty years after it invaded the country following the attacks of September 11, 2001 (11-S) against the United States.

General of the Marine Corps Frank McKenzie, Chief of the United States Central Command, made the withdrawal announcement at a Pentagon press conference on Monday 08/30 after the last troops sent to evacuate Americans and Afghans at risk. after the return of the Taliban to power. «I am here to announce the completion of our withdrawal from Afghanistan and the end of the military mission to evacuate American citizens», said Frank McKenzie. The final flight took place under heavy security after two attacks on the two-week evacuation operation of the Islamic State’s Khorasan province (ISKP), one of them a suicide bombing that left at least 175 dead, including 13 soldiers. Americans. The last flight, a large C-17 military transport, took off from Hamid Karzai International Airport one minute before midnight Kabul time, Frank McKenzie said. President Joe Biden set a deadline of August 31, 2021 for the recall earlier this year.

Ultimando evacuaciones en Afganistán

AW | 2021 08 29 16:24 | GOVERNMENT / AVIATION SAFETY

Finalizing evacuations in Afghanistan

Last evacuation efforts from Kabul Airport

As the US military reduces its airlift to US citizens and Afghan refugees from Kabul in the wake of the Taliban’s takeover of Afghanistan, satellites have captured stark views of the effort from space.

Images from satellites operated by Maxar Technologies show scenes of Hamid Karzai International Airport from Friday, August 27, 2021 as the United States approaches the 08/31 deadline to complete its evacuation efforts. They were taken a day after a deadly suicide bombing killed some 170 civilians and 13 members of the US military at the airport’s Abbey Gate. Some black and white views were captured by Maxar’s WorldView-1 satellite. «You can see people on the runway preparing to load onto a C-17 transport plane, crowds linger at the airport’s northwest gate, while other gateways have far fewer people present than in previous days», they wrote. the representatives of Maxar in a description of the images.

Maxar captured seven images of the US military’s evacuation of Kabul during two passes over Afghanistan on Friday, one at 10:15 a.m. local time by a satellite capable of color images and another pass at 01:50 p.m. local time by the WorldView-1 satellite, which took the images in black and white.

The satellite observations come as the United States approaches the August 31 death line set by the Biden administration to evacuate thousands of Americans and Afghan allies who aided American forces during the 20-year war that began in the wake of the terrorist attacks of September 11, 2001.

As of Sunday morning 08/29, the United States has airlifted more than 117,000 people from Kabul since the evacuation effort began this month after the Taliban’s swift takeover of Afghanistan.

Esfuerzos evacuación en Afganistán

AW | 2021 08 28 18:20 | GOVERNMENT / AIRLINES

Evacuation efforts in Afghanistan

Airlines and Federal officials seek to facilitate Afghan refugees
Countdown final stage of bailouts

US airlines expressed concern over processing bottlenecks that kept refugees trapped on arriving planes for hours. Airline executives and government officials are drawing up plans to ease long waits for Afghan refugees once they land in the United States, people familiar with the discussions said.

The Pentagon this week began using US planes to transport people fleeing Afghanistan from Qatar, Germany and Bahrain in hopes of easing overcrowded conditions at those overseas bases. The effort quickly created a new bottleneck at Dulles International Airport near Washington, D.C., where flights have begun arriving, with planes piling up on the runway in some cases for hours before passengers are allowed to disembark.

Airline executives including American Airlines Group Inc. CEO Doug Parker, United Airlines Holdings Inc. CEO Scott Kirby and Atlas Air Worldwide Holdings CEO John Dietrich expressed concern with Federal officials on the issue this week, including Thursday in conversations with Homeland Security Secretary Alejandro Mayorkas and other officials, according to some of the people. United Airlines has made its hangar in Dulles available as an area where passengers can wait to be processed, these people said. American Airlines is working to establish a space to accommodate people prior to clearance at Philadelphia International Airport, where flights will soon begin arriving. Other places like New York, Chicago and Houston have also been considered, the people said. Some flights arriving this week have waited 10 to 12 hours after landing for customs clearance and border protection from the United States, in addition to the already long flights from abroad. The problems continued with longer waits through Thursday night. The situation began to improve on Friday, with passengers from three flights disembarking in two hours, government and industry officials said.

Evacuation efforts

Evacuation efforts at Kabul Airport began to slow down on Saturday 08/28 when the Afghan capital was on high alert for possible terrorist attacks in the wake of a US attack on the Islamic State. President Joe Biden said he was informed by his military commanders that another attack in Afghanistan is «highly likely in the next 24-36 hours». The Islamic State claimed responsibility for the attack on Thursday 08/26 in front of the Kabul Airport that killed almost 200 people, including 13 members of the US military.

«The situation on the ground remains extremely dangerous, and the threat of terrorist attacks at the airport remains high», Joe Biden said in a statement. The President of the United States has asked military commanders to take all possible measures to prioritize the protection of the force. The United States and its allies have evacuated more than 117,000 people from Afghanistan in the two weeks since the Taliban toppled the Afghan government. Some 1,400 people were inside the airport and waiting for flights on Saturday 08/28. After the United States told its partners that it was wrapping up evacuation efforts, thousands of people who tried to flee but were unable to enter the airfield began to shift their attention to other possible escape routes, including the land border with Pakistan.

Air Seychelles solicitan liquidación

AW | 2021 08 28 16:01 | AIRLINES / GOVERNMENT

Air Seychelles request settlement

Air Seychelles liquidation requested by creditors

The bondholders will seek the liquidation of the airline Air Seychelles, unable to pay more than US$ 71 million owed to them. The court hearing is scheduled for September 6, 2021. The current pandemic and travel crisis has highlighted the difficulties for airlines to continue flying. In the African region, the numerous job cuts at Air Mauritius, the worsening difficulties of Air Madagascar and the threat of dilution of Air Austral into a holding company whose management will probably escape from Reunion Island, the consequences of the political management in some companies and the Coronavirus crisis are leading to a total recomposition of the aviation landscape in our region.

By 2015, Air Seychelles had become a 40% subsidiary of Etihad Airways, with the remaining 60% owned by the State of Seychelles. The UAE airline then obtained operational management from Air Seychelles. Air Seychelles’ long-haul flights fueled Etihad’s hub in the United Arab Emirates, an essential stopover to get to or from the Seychelles Islands with the national airline.

In April 2021, the Ministry of Finance announced that it had reached an agreement for the state to take full ownership of Air Seychelles. In the context of a global crisis in the sector linked to the coronavirus pandemic, Etihad wanted to disassociate itself. Operationally, renationalization has resulted in the end of long-haul flights, with Air Seychelles limited to domestic and regional routes. From an accounting point of view, Etihad has agreed to sell its 40% stake at a very advantageous price. Air Seychelles then owed Etihad Airways US$ 72.3 million; With the 79 percent depreciation, the airline has to pay US$ 11.34 million. A total of US$ 71.5 million is still owed to the bondholders, making this debt threaten the survival of Air Seychelles.

Public audience

The announced press release of the Committee formed on behalf of the bondholders states that «on August 19 a motion was presented for the liquidation of Air Seychelles and on August 24 Air Seychelles notified and acknowledged this request». Air Seychelles is scheduled to appear in Supreme Court on September 6, 2021. A lawyer for the petitioners said their clients «just want to get back the investment they made in the airline». The Committee added that «to date, there has been no substantive commitment, nor any sense of urgency regarding the situation of the airline, neither Air Seychelles nor its sole shareholder, the Government of Seychelles». In this way, the Committee has come to the conclusion that the only viable option that remained was to file a request for liquidation of Air Seychelles in order to request the recovery of the debts contracted with it and with the other bondholders of EA Partners. EA Partners was established in 2015 to allow Etihad Airways to finance the airlines in which it has interests.

Seychelles President Wavel Ramkalawan chaired a meeting with Transport Minister Anthony Derjacques and the Air Seychelles Board of Directors at the State House to discuss the issue. After the meeting on Friday 08/27, Anthony Derjacques assured the public that the Government will do whatever it takes to support Air Seychelles in this legal case. «We look forward to bringing a positive result and moving forward with the airline», said Anthony Derjacques, adding that employee job security is extremely important for Air Seychelles to continue to be a commercially viable airline.

AW | 2021 08 27 04:35 | AIRLINES / GOVERNMENT

Titan Consortium obtiene sentencia favorable

Lawsuit to Argentina for Aerolíneas

Titan Consortium obtains favorable judgment

Aerolíneas Argentinas faces a new trial in New York that comes from its expropriation. The Argentine State has been sued by the Titan Consortium fund for the Aerolíneas Argentinas case, whose claim amounts to US$ 320 million. The presentation was made by the Titan Consortium fund, which obtained a favorable judgment for that amount in the World Bank arbitration court in 2019, and where Argentina never paid. The lawsuit originated in the expropriation of Aerolíneas Argentinas, maintains that it failed to pay a judgment against the country established by the World Bank arbitration tribunal, the International Center for Settlement of Investment Disputes (ICSID).

In 2019, the claimant obtained a favorable final judgment at ICSID, but Argentina never paid. For this reason, and given that there are no more instances to appeal within the ICSID, last Wednesday 08/25 he presented the «Enforcement» lawsuit before the United States Justice. «We all thought that at some point the Government was going to pay the judgment. Today we found out that it did not pay and then Titan goes to the District of Columbia, which is the Court that has exclusive jurisdiction over any action related to ICSID judgments, when in the World Bank tribunal there are no more instances to follow», explained Sebastian Maril, Director of Latam Advisors. The government has 60 days to respond to the lawsuit, although the judge could require that response in a shorter period of time. In addition, he considered that Aerolíneas Argentinas faces a new trial in New York that comes from its expropriation, it is probable that embargo measures will appear against Argentine assets, as occurred in the negotiations with the “vulture funds” for the default of the public debt. The caseThe case that reached the New York courts has been going on for more than a decade. In 2017, ICSID issued its first judgment against Argentina, in favor of the Spanish group Marsans, given that it considered that the government had not paid the corresponding amount for the flag carrier. At the same time, the World Bank arbitration tribunal reduced Marsans’ claim from US$ 1.6 billion to US$ 320 million. At that time, Argentina requested the annulment of the sentence. The trial was in the hands of the English fund Burford Capital (the same one that litigates against Argentina for the expropriation of YPF). Later, in 2018, with the judgment in his favor for US$ 320 million, Burford decided to sell it to Titan Consortium for US$ 107 million, since he knew that Argentina would continue to appeal. In 2019, ICSID rejected the request to annul the judgment and forced Argentina to pay US$ 320.7 million in compensation. “Argentina’s request for annulment was rejected. Argentina will bear the entire costs of the proceeding and will pay the plaintiffs the sum of US$ 1 million as representation costs; and all other claims are rejected», stated the sentence.

South-African_Isologotype

South African Airways returns 09/2021

After restructuring, it will restart operations

AW-SAA_7319003

South African Airways (SAA) will return to commercial air operations after almost a year. The airline has confirmed that it will resume flights on September 23, 2021. It has also established the opening of reservations and travel credit exchanges as of 09/06. After an administration process that had put the South African airline at risk in the midst of an unprecedented crisis in the history of commercial aviation, South African Airways, entered a crisis not only economic but also by the pandemic, they came to drag to the company on the brink of bankruptcy. The airline had been put into Administration in December 2019, while the situation of the flight crisis caused by the global virus, complicated its situation. The flights were interrupted in September 2020, entering a long process of restructuring and financial rescue by the Government of South Africa. The airline came out of the business rescue at the end of April 2021, with the foundations laid for a return to operations. With the airline’s solvent and control turned over to the Board of Directors and executive team, it was only a matter of time before a relaunch was given the green light. Acting CEO Thomas Kgokolo commented on the relaunch, stating: «After months of diligent work, we are delighted that SAA is resuming service and we look forward to welcoming our loyal passengers on board and flying the South African flag. We remain a carrier. safe and complying with COVID-19 protocols».

The airline says its initial flights will operate from Johannesburg to Cape Town, Accra, Kinshasa, Harare, Lusaka and Maputo. It plans to restart more routes and expand its network as market conditions improve. Thomas Kgokolo added: «There is a deep sense of excitement within the SAA Team as we prepare for takeoff, with a common purpose: to rebuild and maintain a profitable airline that once again takes a leadership role among local, continental and international airlines».

Following the exit from the Administration process, the SAA team has been working hard to prepare the airline to restart operations. At the beginning of August 2021, the airline reported having obtained its Air Operator Certificate (AOC) for national and international flights. Under the renewed AOC, South African Airways has listed only eight aircraft to re-establish its commercial aviation operations: A319-100 (3), A320-200 (2), A330-300 (1), A340-600 (2). All aircraft are under lease, while the two A340-600s (2) are owned by the company. The cleanup of the airline has established a new beginning with a smaller and more homogeneous fleet across Airbus.

South African Airways keert terug 09/2021

EEUU vs evacuación a contrarreloj

AW | 2021 08 25 07:02 | AVIATION / GOVERNMENT

USA vs evacuation against the clock

EU requests US to stay at Kabul Airport while evacuation lasts

AW-Boeing C-17 Globemaster

The President of the European Council, Charles Michel, has asked the United States this Tuesday 24/08 to stay at Kabul Airport for as long as the evacuation operations last and to guarantee the rescue of citizens who are in danger under the new military regime. in the Republic of Afghanistan. “We have addressed this situation with our American partners and friends, in two particular ways. First of all, the need to secure the airport for as long as necessary to complete operations», said Charles Michel at a press conference after participating in the extraordinary videoconference of G7 leaders on Afghanistan. He has also asked the United States «fair and equitable access to the airport for all citizens entitled to evacuation».

Crisis evacuation

Desperation rages at Kabul Airport. The controls of the fundamentalists are intensified and their attitude is more violent after the new political directives. The announcement on Monday 08/23 that the Taliban will not allow international troops to control the airport beyond August 31, 2021 as the deadline and the warning that they will not let more Afghans through to the airport has made it even more chaotic. and dangerous the escape from Kabul. The Taliban this Tuesday 24/08 reinforced the controls they exercise over the accesses to the international airport. The increase in the military presence of the fundamentalists is most notable in the face of a turn of the most aggressive, violent and intransigent political actions.
