Titan Consortium obtiene sentencia favorable

Aerolíneas Argentinas afronta un nuevo juicio en Nueva York que viene de su expropiación. El Estado argentino ha sido demandado por el fondo Titan Consortium por el caso Aerolíneas Argentinas, cuyo reclamo asciende a US$ 320 millones de Dólares. La presentación fue realizada por el fondo Titan Consortium, que obtuvo una sentencia favorable por ese monto en el Tribunal arbitral del Banco Mundial en 2019, y donde la Argentina nunca pagó. La demanda originada en la expropiación de Aerolíneas Argentinas, sostiene que incumplió el pago de un fallo en contra del país dispuesto por el tribunal arbitral del Banco Mundial, el Centro Internacional de Arreglo de Diferencias relativas a Inversiones (CIADI).

En 2019, el demandante obtuvo una sentencia firme favorable en el CIADI, pero la Argentina nunca pagó. Por esta razón, y dado que no existen más instancias para recurrir dentro del CIADI, el pasado Miércoles 25/08 presentó la demanda de “Enforcement” ante la Justicia de los Estados Unidos. “Todos pensamos que en algún momento el Gobierno iba a pagar el fallo. Hoy nos enteramos que no pagó y entonces Titan va al distrito de Columbia, que es la Corte que tiene jurisdicción exclusiva sobre cualquier acción relacionada con fallos del CIADI, cuando en el tribunal del Banco Mundial ya no quedan más instancias para seguir”, explicó Sebastian Maril, Director de Latam Advisors. El gobierno tiene 60 días para responder la demanda, aunque el juez podría exigir esa respuesta en un plazo más corto. Además, consideró que Aerolíneas Argentinas afronta un nuevo juicio en Nueva York que viene de su expropiación probable que aparezcan medidas de embargo contra activos argentinos, tal como ocurrió en las negociaciones con los “fondos buitres” por el default de la deuda pública.

El caso que llegó a los tribunales neoyorquinos lleva más de una década. En 2017, el CIADI dictó su primera sentencia en contra de la Argentina, en favor del grupo español Marsans, dado que consideró que el gobierno no le había pagado lo correspondiente por la línea aérea de bandera. Al mismo tiempo, el tribunal arbitral del Banco Mundial redujo la pretensión de Marsans de US$ 1.600 millones a US$ 320 millones. En ese entonces, la Argentina pidió la anulación de la sentencia. El juicio, se encontraba en manos del fondo inglés Burford Capital (el mismo que litiga contra la Argentina por la expropiación de YPF). Posteriormente, en 2018, con la sentencia a su favor por US$ 320 millones, Burford decidió venderlo a Titan Consortium por US$ 107 millones, dado que sabía que la Argentina continuaría apelando. En 2019, el CIADI rechazó el pedido de anular la sentencia y obligó a la Argentina a pagar US$ 320,7 millones en carácter de indemnización. “La solicitud de anulación de Argentina fue rechazada. La Argentina sufragará la totalidad de los costos del procedimiento y les pagará a las demandantes la suma de US$ 1 millón en concepto de costos de representación; y todas las demás pretensiones son desestimadas”, expresó la sentencia.

The government has 60 days to respond to the lawsuit, although the judge could require that response in a shorter period of time. The trial was in the hands of the English fund Burford Capital (the same one that litigates against Argentina for the expropriation of YPF). Later, in 2018, with the judgment in his favor for US$ 320 million, Burford decided to sell it to Titan Consortium for US$ 107 million, since he knew that Argentina would continue to appeal. In 2019, ICSID rejected the request to annul the judgment and forced Argentina to pay US$ 320.7 million in compensation. “Argentina’s request for annulment was rejected. Argentina will bear the entire costs of the proceeding and will pay the plaintiffs the sum of US$ 1 million as representation costs; and all other claims are rejected”, stated the sentence.
