Flair judicial por arrendamientos MAX

AW | 2021 07 13 14:47 | AIRLINES / GOVERNMENT

Flair MAX leases lawsuit

Flair Airlines lawsuit over 737 MAX leases

Flair Airlines, a Canadian low-cost airline, has filed a lawsuit filed by one of its shareholders over its fleet expansion plans announced during the pandemic, said President and CEO Stephen Jones. The majority shareholder Prescott Strategic Investments LP through its general partner Prescott Strategic Investments Ltd. filed a petition in the Supreme Court of British Columbia, Canada, on June 18, 2021, naming as defendants Flair Airlines and its shareholder and lessor of the 24.9% based in Miami, 777Partners.

Flair_Airlines_Isologotype_New_Logo_2019

The petition seeks statements that Flair’s affairs are being conducted in a manner that is oppressive to Prescott Strategic Investments LP. He is also seeking an order for Flair and 777 Partners to buy Prescott shares for CA$ 0.85/ US$ 0.68 per share. Prescott Strategic Investments LP owns just under 68% of the airline’s voting shares and took over management of the company in 2018. «Shortly after taking over as Flair, Prescott’s partners realized that Flair required an immediate infusion of funds to pay off a line of credit», the petition reads, a situation in which 777 Partners signed up as an investor after being contacted by Flair. The airline reportedly owes 777Partners CA$ 140 million/US$ 112.3 million, most of which is at an interest rate of 18%.

In the court filing, Prescott Strategic Investments LP asserts that the dispute was fueled by the Flair management who decided to «aggressively expand its operations during a global pandemic» by signing thirteen new Boeing 737-8 MAX leases with a subsidiary. controlled by 777Partners.

As previously reported, Flair expects to accept delivery of eight Boeing 737-8 MAXs (8) by August 1, 2021, from an initial lease commitment of 13 of the aircraft type from 777Partners. The next batch of deliveries will start from December 2021 to spring 2022. The plan is to acquire 50 aircraft within five years, in a vision called F50.

According to the petition, Flair Airlines’ decision to lease the thirteen Boeing 737-8 MAXs (13) for new routes to five Canadian airports caused serious concerns for Prescott Strategic Investments LP, which claims that Flair had not sought shareholder approval for the leases and expansion plans. «Because Flair had already started selling tickets connected to the expanded services, Flair’s position was entrenched and any post-fact vote by shareholders would be futile», the petition says.

Prescott Strategic Investments LP claims that Flair Airlines also failed to obtain approval for the leases from the Canadian Transportation Agency, raising significant concern about whether the leases would put the company under the effective control of Miami, United States-based 777Partners, which could lead to a conclusion that it was not in fact controlled by Canadians as required by the Canadian Transportation Act. Such a conclusion could strip the aviation company of its license to operate in Canada, alleges Prescott Strategic Investments LP.

Meanwhile, the directors of 777Partners allegedly threatened to call Flair Airlines’ debt and put it in suspension of payments if it does not proceed with the leases and expansion plans, which Prescott Strategic Investments LP claims are not in Flair’s best interest. Airlines. According to the petition, Flair’s fleet of three Boeing 737-800s (3) were mostly grounded from September 2020 to April 2021, with the airline using only one for its Vancouver—Edmonton, Vancouver—Toronto/Pearson route. and its Vancouver—Calgary—Toronto/Pearson route during that time.

Prescott Strategic Investments LP notes that the expansion plans came amid the flight health crisis, as Canadian air travel dropped about 90% of passenger numbers before the pandemic, prompting other airlines such as WestJet and Air Canada halted or halted expansion plans, including canceling orders for its new Boeing 737-8 MAXs.

Flair CEO Stephen Jones had expressed in June 2021 that he is confident in the business model and our cost base, and in supporting investors. He noted that during the last year and during the pandemic, the market share of ultra and low cost companies grew from 25% to 30% globally. The factual basis of the petition has not been proven in Court of Justice, and Flair Airlines and 777Partners had not submitted responses at the time of publication.

Argentina foresees a post-pandemic start

Government foresees 09/2021 start of post-pandemic

AW-Flybondi_702

The Government of the Argentine Republic has shown a positive attitude towards the advance of vaccination in the country. President Alberto Fernández has pronounced that there are interesting data that say that the economy is beginning to move, where he was confident that by September 2021 there will be many Argentines vaccinated and that the country can start with everything. More than 25 million Argentines received at least one dose of vaccines against the Coronavirus and it is expected that in the coming months progress will be made with the national vaccination plan. «I would like to reach September with a very important number of vaccines», said Alberto Fernández.

In the Government they foresee that September is the month for the beginning of the post-pandemic. The government’s optimism is based on one explanation: Argentina has already exceeded 25 million vaccinated and there are 5 million vaccines available to apply in the coming weeks. But in addition, new agreements were made with laboratories to acquire more doses, progress is being made with local production and more flights have been scheduled to bring components from abroad. «By September we are going to have many Argentines vaccinated, I would like to reach September having a very important number of vaccines, we already have many but those under 18 years old are missing and that everyone has a second dose, and get to September well and start with everything».

Flight restrictions

Regarding Argentines stranded abroad, he said that «work is being done so that they can return» and recalled that the Government recommends that the population «try to avoid traveling because the virus comes by plane. The restriction of flights is done by the whole world. «Not only us, the pandemic is not over. Look what is happening with Spain, where there is talk of a fifth wave due to the Delta variant».

This Monday 07/12 the Ministry of Health announced that another nine positives of the Delta Variant of SARS-CoV-2 were detected in travelers who arrived in the country from the United States, Mexico and Paraguay, bringing the number of cases reported in the Argentina, and indicated that contagions have not yet been verified between people «without a travel history».

Aéreas UE preparan despegue verano

AW | 2021 07 13 11:00 | GOVERNMENT / AIR TRAFFIC

Sector turístico europeo busca reactivación

AW-Eurostat_Isologotype

EU airlines prepare summer takeoff

European tourism sector seeks reactivation

The commercial flights of the European Union (EU) are showing an upward trend at the beginning of the boreal summer, according to the agency Eurostat, the statistical office of the EU. The tourism industry and the aviation sector were hit hard by the pandemic due to the current health crisis forcing most air travel to remain on the ground. During the second wave of outbreaks in early 2021, the number of commercial flights fell dramatically by about 70 percent compared to pre-pandemic levels in 2019, Eurostat said. But in June 2021, the number of commercial flights increased significantly to just 54 percent less than two years ago thanks to the vaccination campaign and the relaxation of lockdowns in the European Union.

Airline prospects

European airlines are on the road to recovery for travel within the European Union, but the story is totally different when it comes to long flights and travel outside the community. Routes to Latin America, Asia continue to be closed to air traffic. «Now that it is much easier to travel within the Mediterranean space, and in Europe we see an increase in demand. Air France-KLM planes that are leaving France for trendy tourist spots like Greece, Italy, Spain and Portugal are full», said Benjamin Smith, General Director of the Air France-KLM group last week.

The European Union launched on July 1, 2021 the COVID Digital Certificate to facilitate travel within the Schengen Area and revive the tourism industry. The bloc is currently in talks with the United States and some other countries to achieve mutual recognition of vaccination certificates.

EEUU mantiene cautela de reapertura

AW | 2021 07 13 10:03 | GOVERNMENT / AIR TRAFFIC

US remains cautious about reopening

Prospects for the schedule of border reopening

The United States remains cautious about opening borders to tourists from destinations such as Brazil, Europe, India, and China, while putting pressure on the world of industry, advancing vaccination, and open borders in most parts of the world. In a press conference on Friday 07/09, the White House Press Secretary, Jen Psaki, acknowledged the frustration of tourists and the sector, but stressed that there is still no set timetable for a process of reopening the borders to these countries: «There is a process underway, which I know is frustrating for many, and includes working groups with countries so that we can communicate and share information on what the criteria will be to ease these travel restrictions. We certainly want to make sure that families get together, people get together and people can travel, but I have nothing planned in terms of schedule», said Jen Psaki.

The reopening is the subject of constant debate in the Joe Biden Administration. In June 2021, the Democrat announced the creation of working groups with Canada, Mexico, the European Union (EU) and the United Kingdom to comply with the criteria that allow the reopening of borders, based on technical criteria. «They are based on a series of criteria, but they are based on public health discussions. Public health experts are part of these discussions from all sides of our country and from other participants», added the Press Secretary. Currently, 33 countries have restrictions on entry to the United States. Non-US citizens who have been to Brazil, South Africa, India, China, Iran, Ireland, the United Kingdom, or the 26 European countries of the Schengen area are prohibited from traveling to the country. The restrictions were established by presidential proclamations.

The rules for these countries have been in effect since the pandemic began in 2020, and were closed on 01/2021 by then-President Donald Trump days before leaving office. After taking office, the new president Joe Biden resumed the restrictions and extended them to South Africa and India after identifying cases of variants of Coronavirus. Despite the ban, the country has defined some cases that can be considered a National Interest Exception (NIE), such as the return or initiation of students, immigrants, or fiancées of US citizens.

The Joe Biden Administration has come under pressure from various segments of the tourism industry, as well as from Democratic and Republican lawmakers whose states are severely affected by the impact of border closures on tourism.

A group led by the United States Travel Association that brings together hotels, casinos and airlines has asked the White House to end its travel restrictions before July 15, 2021 due to the impact on the economy. According to the data presented by the entity, the restrictions cost the US economy US$ 1.5 billion in weekly income, only considering the spending of tourists from the European Union, Canada and the United Kingdom.

Hungría participación Budapest Airport

AW | 2021 07 12 12:50 | AIRPORTS / GOVERNMENT

Hungary Budapest Airport participation

Government offer purchase of participation in Budapest Airport

The Hungarian Government has presented a non-binding offer to the Budapest Airport shareholders to buy the airstation, its operator AviAlliance GmbH said on Monday 07/12. The Government of Prime Minister Viktor Orban earlier this year 2021 expressed interest in buying a majority stake in the main international airport of the Republic of Hungary, saying that its privatization had gone against the strategic interests of the country. Viktor Orban, a nationalist often at odds with the European Commission (EC) on a number of issues, has said he wants to see the airport in national hands, but so far its owners have not expressed any interest in selling it.

The main shareholder with 55.44% is AviAlliance GmbH, formerly Hochtief AirPort GmbH, which is owned by the Public Sector Pension Investment Board of Canada (PSP Investments). GIC Special Investments of Singapore and Caisse de dépôt et placement du Québec of Canada each hold about 21% of the shares. «We can confirm that the Hungarian Government submitted a non-binding offer to the Budapest Airport shareholders. In the interest of our co-shareholders and for legal reasons, we are obliged to review possible offers. However, this NBO was not initiated by us. AviAlliance is a committed long-term investor. We deeply look forward to the opportunity to continue investing in this airport», said AviAlliance.

The state currently has no stake in the airport, which was privatized in 2005. The Hungarian Government has expanded state ownership in various sectors since taking office in 2010. Budapest Airport is a fast-growing medium-sized airport It has benefited from a boom in low-cost travel, but faces a tough market due to the pandemic. AviAlliance, which has interests in five airports, including Hamburg, Dusseldorf and Athens, said that like all European airports, Budapest has been severely affected by the current pandemic. «However, we continued our investments in the airport’s infrastructure and operation during the current crisis, as we believe in its rapid economic recovery and long-term growth potential», said AviAlliance GmbH.

Magyarország Budapest Airport részvétel

Kormány ajánlat a Budapest Airport részvételének megvásárlására

AW-Budapest Airport_Isologotype_001

AW | 2021 07 12 10:37 | AIR TRAFFIC / GOVERNMET / AIRLINES / AVIATION ORGANISMS

Argentine airlines would publish programming

ANAC establishes air schedules

The domestic and international airlines operating in Argentina will communicate the frequencies for July 2021 in accordance with the new quotas established by the Government of Argentina. Currently United States airlines would have received the approvals. The publication of Administrative Decision No. 683/2021 that begins to relax the daily quota of international passengers that can enter the country up to a thousand per day in the first week of August, it is expected that this Monday 07/12 the airlines will begin to report the flights approved by the National Civil Aviation Administration (ANAC) in accordance with the limitations. The approvals were being approved on Sunday 07/11 and the companies would be in charge of informing the new programming. The first to receive them would have been the American companies to avoid sanctions from the United States Department of Transportation (DOT) for reciprocity issues, which in any case do not meet the regulatory deadlines for approvals with very little time in advance. In May 2021, the DOT issued an order according to which Aerolineas Argentinas had to inform thirty days in advance of the flights it would operate to and from the United States due to government decisions that limited the flights of North American operators to and from Argentina.

On Saturday 07/10, ANAC authorities met with representatives of the International Air Transport Association (IATA) and the Chamber of Air Companies in Argentina (JURCA) to explain the scope of the administrative decision. The programming of the quotas for air transport has established that repatriation specials will not be approved, only the quotas provided in Administrative Decision No. 683 of 5,200 seats for the week from 7/10/2021 to 7/16/2021, 6,300 seats will govern for the week of 7/17/2021 to 7/23/2021, 7,000 places for the weeks of 7/24/2021 to 7/30/2021 and 7,000 places for the week of 7/31/2021 to 8/6 / 2021.

At the meeting, the representatives of the airlines expressed their concern about the problem of strandings that, according to their vision, would worsen due to the accumulation of passengers every day, making it clear from the airlines that the daily passenger quotas assigned in these administrative decisions are insufficient for the sustainability of commercial aviation.

Due to the impact of the measures on air navigation, the airline Latam Airlines reported that it is canceling operations from Argentina to Brazil and Chile until August 6, 2021, since the administrative decision established the closure of borders with those countries until that date. Those affected passengers will be able to modify the date of their ticket without any cost, based on the available places. Passengers with affected flights who purchased ground services with Latam Travel should contact the Contact Center. If the change of date is not a solution, they may request the return of the ticket, regardless of the fare they have purchased. If the purchase was made through a travel agency, they may request a refund from the agency, which will carry out the corresponding procedures with LATAM. After 08/06, flights to Brazil and Chile will be subject to the provisions adopted by the Government of Argentina. The company was awaiting information on the itinerary to Lima, Peru.

UE aprueba plan ayudas aéreas rumanas

Bruselas aprueba plan de ayudas a aerolíneas rumanas

TATOM_737700

European Commision_Isologotype

EU approves Romanian air aid plan

Brussels approves aid plan for Romanian airlines

The European Commission (EC) has approved a plan by the Government of Romania in which € 1.15 million euros are granted to help airlines affected by the current air crisis affected by the pandemic to resume or start their flights from the airport from Târgu Mureș in the Transylvania Region. This public aid will take the form of direct grants up to a maximum of € 600,000 Euros per beneficiary. The amount of aid per company will be calculated on the basis of an individual score derived from certain evaluation factors, such as the number of flights per week.

The aim of this aid is to mitigate the sudden liquidity shortage that beneficiaries face due to the Coronavirus outbreak and the restrictive measures that the Romanian Government had to implement to limit the spread of the virus. The European Commission concluded that the measure is necessary, appropriate and proportionate to remedy a serious disturbance in the economy of a Member State, therefore it approved the measure in accordance with EU state aid rules.
