Argentina extiende restricciones

AW | 2021 07 11 16:46 | AIR TRAFFIC / GOVERNMENT

Argentina extends restrictions

Flexible air quotas without special repatriation flights

The virtual meeting developed by the Government of Argentina on Saturday 10/07 in the morning in which representatives of the airlines, the Jurca Chamber and also the International Airline Association (IATA) participated, it has been decided to extend the air quotas to the passenger traffic to Argentina, but this quota has been slightly relaxed where airlines will be able to bring a greater number of passengers per flight to Argentina, while special repatriation flights have been denied. The head of the National Civil Aviation Administration (ANAC), Paola Tamburelli, and the National Director of Air Transport, Florencia Dovichi, have transmitted the Government’s decision to foreign airlines operating in the country, grouped in the JURCA chamber. «There will be no special flights, since they are not contemplated in the Administrative Decision that is in force», said Paola Tamburelli to the commercial aviation sector.

The new Administrative Decision No. 683, which replaces the previous one, No. 643 allows ANAC to manage the distribution of seats on a weekly basis, with a maximum capacity of 5,200 seats. The daily quota increase from 600 increases to 742 people per day. However, the airlines did not hide their disappointment with the confirmation that there will be no special flights. The airlines face strong complaints from Argentines stranded abroad. Foreign airlines expressed that the meeting did not contribute anything new, apart from that they announced that there will be no special repatriation flights. The authorities have stated that as of Sunday 07/11 they would begin to receive from the Aeropuertos Argentina 2000 (AA2000) the feasibility of the requested flights.

The Regional Vice President for the Americas of IATA, Peter Cerdá, only until Tuesday 29/06 accumulated 14,000 Argentines stranded abroad, due to the restrictions that the Government had in place since the end of last month. The airlines have communicated that the assigned daily passenger quotas are insufficient for the sustainability of our industry.

Latam Airlines has confirmed this Saturday 07/10 that the ANAC continues without authorizing at least until August 6, 2021, orders for flights from Chile and Brazil, two destinations forbidden by the current health regulation, along with flights from United Kingdom, Turkey, India and African countries.

Administrative Decision No. 683/2021 signed on Friday 07/09 by the Chief of Staff, Santiago Cafiero, will be in force until 08/06, establishes a gradual increase in the number of passengers that can arrive in the country, after the drastic restriction from 2,000 passengers per day to 600 that has been in force since 06/28, as part of the measures to prevent the entry and circulation of the Delta strain of Coronavirus. From this Saturday 07/10, that quota increased to 5,200 passengers per week, and the following week it will rise to a cap of 6,300. Between July 25 and August 6, 2021, the maximum number of passengers that can arrive from abroad will rise to 7,000 per week. Although the increases in quotas have been insignificant by the airlines, they have expressed tha they estimate that only until this Saturday 07/10, the number of passengers who have not been able to enter Argentina reaches close to 20,000 passengers.

Seizure of Interjet for non-compliance

Justice Mexico seizes Interjet for payment defaults

The President of the Federal Board of Conciliation and Arbitration (JFCA), María Eugenia Navarrete Rodríguez, ordered the precautionary embargo of Interjet (ABC Aerolineas SA), up to MX$ 1,379 billion Mexican Pesos, for non-compliance with salaries to pilots, flight attendants and unionized workers. The embargo reaches from slots, routes, brands, real estate, companies, bank accounts, and everything owned by ABC Airlines. “It is a fact of the public domain that the company faces a financial situation that places it at risk of insolvency, so the precautionary measure is granted and a precautionary embargo of ABC Airlines is decreed up to the amount of MX$ 1,379,642,427.54 Pesos”, says Navarrete Rodríguez, in charge of resolving labor disputes between employees, unions and companies.

On May 25, 2021, the Federal Board of Conciliation and Arbitration ordered to seize «everything that is made up of the set of goods and services so that it can face what is owed by ABC Airlines». Compensaciones accidentes 737 MAX

AW | 2021 07 11 08:48 | AIR INVESTIGATION / GOVERNMENT

Compensación a familiares vuelos JT-610/ET-302

Accident compensation 737 MAX

Compensation to family flights JT-610 / ET-302

The families of the victims of the two accidents of the flights Lion Air JT-610 and Ethiopian Airlines ET-302 aboard the Boeing 737-8 MAX that killed a total of 346 people in Indonesia in 2018 and Ethiopia in 2019 have begun to receive payments from the US$ 500 million settlement agreement reached in the case against The Boeing Company.

Ribbeck Law Chartered, representing more than 90 clients, made the announcement on July 8, 2021. The result was achieved after at least three years of litigation by the law firm. «For most of our customers, this ends civil and criminal cases filed against Boeing after the tragic accidents of Lion Air JT-610 on October 29, 2018 and Ethiopian Airlines ET-302 on March 10, 2019». stated Manuel von Ribbeck of Ribbeck Law Chartered, according to a press release.

The Boeing 737-8 MAX aircraft from the Lion Air flight JT-610 crash crashed into the sea near Indonesia with nearly 190 people on board. The Boeing 737-8 MAX aircraft on Ethiopian Airlines flight ET-302 bound for Nairobi, Kenya, crashed shortly after taking off from Addis Ababa’s Bole International Airport, killing all 149 on board, including 32 Kenyans, 18 Canadians, nine Ethiopians, eight Italians, eight Chinese, eight Americans, seven British, seven French citizens, six Egyptians, five Germans, four Indians, and four Slovakians. At least thirty nationalities were aboard that unfortunate plane.

Earlier this year, the United States Department of Justice (DOT) charged The Boeing Company with conspiracy to defraud the United States. The Justice Department indicted Boeing after a lengthy investigation that concluded that the company knowingly misled Federal Aviation Administration (FAA) aviation regulators while seeking approval for its Boeing 737 MAX fourth-generation line aircraft.

Argentina continúa restricciones aéreas

AW | 2021 07 10 14:33 | AIR TRAFFIC / GOVERNMENT

Argentina continues air restrictions

Slight relaxation of air restrictions in Argentina

The panorama of flights abroad to the United States and other countries for the return of the stranded continues to affect Argentines on their return to the country. The Government of the Argentine Republic will continue to maintain the authorized flights until this Sunday 07/11 with a quota of 600 passengers per day, but the National Civil Aviation Administration (ANAC) will convene the companies to define the details of the scheme until 6 August 2021.

The Government has published this Friday 07/09 Administrative Decision 683/2021 that outlined how the quota of Argentines who can return from abroad will be implemented from Saturday, July 10 to August 6, 2021. There are four weeks in those that the limit to the income by air will be gradually more flexible. The ANAC, in charge of operationalizing the national air policy, will administer a quota of 5,200 weekly admissions. As of 07/17 there will be a quota of 6,300 per week and in the last two weeks, from 07/24 to 08/06, the entry of 7,000 passengers, at an average of a thousand per day, but with a pattern that will allow a greater flexibility than you currently have. The ANAC has stated that the schedule of flights enabled until 07/12 will not have any changes. However, as announced by the Government, as of Saturday 07/10 the entry of 142 additional Argentines a day. Therefore, in conversations with commercial airline companies, the agency will define how and to which companies it will authorize flights and passenger capacity.

The Ministry of Transport has not yet published the Administrative Decision. When it is published, the ANAC must verify which companies want to fly and when, which passengers request immediate return and divide the capacity into a number of flights that implies at least one daily connection with the different destinations.

For this Sunday 07/11, the head of the aviation organization, Paola Tamburelli, will meet with the airlines to prepare and publish the new schedule for a week of programming. It is a huge job, they said from the body that regulates and coordinates the commercial aviation sector. From the companies they say that going from 600 to 740 passengers is not even half a plane and that the measure will not modify the current scheme in a significant way, although they could add extra flights from next week. Developing a flight schedule in these circumstances implies coordinating with all sectors of aviation; while users stranded abroad continue to suffer from the vulnerability of their rights.

Flights enabled by ANAC until 07/12

KLM_772

Aerolíneas Argentinas has developed a flight on the afternoon of Friday 07/09 to Madrid; one this Saturday 07/10 to Lima; a frequency on 07/11 from Lima and one from Madrid, a destination to which a flight will also depart from Ezeiza, as well as a frequency to Miami. American Airlines has a daily flight to Miami, so the flights on July 10, 11 and 12 remain, and it maintains the same flight schedule from that destination. Two flights are suppressed for 07/11, one from New York and the other from this same destination. Air France has scheduled a flight between Buenos Aires and Paris on 07/10. KLM Airlines announced at the time six flights between Buenos Aires and Amsterdam 2, 4, 5, 7, 9 and 11/07, so that only the flight for next Sunday, July 11, 2021 remains.

The Executive Director of the Chamber of Air Companies in Argentina (JURCA), Felipe Baravalle has expressed regarding the situation of travel restrictions due to limited places in Argentina: “The airlines are surprised that the modification of the daily quota is practically nil. Those 142 passengers that are added per day in the first week do not know how they are going to distribute them; As of tomorrow, the new Administrative Decision begins to run and we still have no idea how they are going to distribute those extra passengers”, said the representative of JURCA.

Aerial unpredictability

The representative of the JURCA airlines that operate in Argentina explained that airlines are beginning to get tired of the Government’s modality of travel quotas: “This is what we have been saying for some time, to operate correctly the commercial aviation sector needs predictability , planning and clarity in the conditions. We still do not know how the passengers will be distributed, with what criteria, with what priorities”, stated Felipe Baravalle.

The airlines have filed formal complaints about the unpredictability of rescheduling flights for their passengers without any advance payment. Citing an example by case is the Turkish Airlines company that has a flight from Turkey on Monday 07/12 and has sold the capacity of the tickets but they are subject to Argentine government decision, being three days from the date there is no notification if the flight Istanbul-Buenos Aires can be made. “Our recommendation is that the flight schedules are drawn up for 3 months of operations, and that the ratings are issued at least 15 days in advance; if not, it is very difficult to work correctly”, detailed Felipe Baravalle. Specifically, the airlines have not yet received approvals for the frequencies as of July 12, 2021, while they remain expectant about which flights will be approved by ANAC and how the new quota of Argentines and residents will be distributed. come back from abroad.

Corte Suprema caso PLUNA

AW | 2021 07 09 01:47 | AIRLINES / GOVERNMENT

Supreme Court PLUNA case

Uruguay Supreme Court confirms conviction of ex-CEO of BROU

The sentence of twenty months in prison of the former Executive Director of the Banco República de Uruguay (BROU), Fernando Calloia, was confirmed on Tuesday 06/07 by the Supreme Court of Uruguay, thus extinguishing the chain of appeals available to the accused involved in scandal to buy planes from the Uruguayan airline PLUNA Líneas Aéreas.

Fernando Calloia was found guilty of abuse of functions by granting a guarantee of US$ 12 million to the firm Cosmo Lineas Aereas, for the acquisition of the aircraft belonging to the former flag carrier PLUNA. The sentence also includes a fine of UY$ 1,337,000 Uruguayan Pesos/US$ 30,560 and the disqualification from holding public office for two years. But Fernando Calloia will not have to serve any actual prison time because he has been granted parole. Calloia was president of the BROU during the government of José Mujica.

At the time of its liquidation, in 2012, PLUNA accumulated a liability of US$ 300 million, and in an attempt to recover something, the company’s seven aircraft were put up for auction. On October 1, 2012, during the auction, Hernán Calvo Gómez, representing Cosmo Lineas Aereas, wanted to buy the planes. Calvo Gómez was the godfather of the grandchildren of Juan Carlos López Mena, owner of Buquebús, who wanted to take charge of the planes and acted through this other company.

The ruling of the Supreme Court of Uruguay on Tuesday 06/07 was unanimously supported by its five members. The Court of Appeals had indicated that Fernando Calloia acted deliberately and consciously to make the presentation of the Cosmo company viable in a clearly abusive and arbitrary manner, which was later shown to be linked to the owner of Buquebus, Juan Carlos López Ore.

Fernando Calloia ordered the then Manager of the BROU business division, Raúl García, to grant the endorsement after receiving the call from the then Minister of Economy, Fernando Lorenzo, so the bank’s technical services skipped each and every one of the most elementary rules of prudence that banking activity should have. Raúl García had testified that he had informed Calloia that the conditions for the guarantee were not met. «Calloia tells me that it was a matter of national interest […] that he had the consent of the bank directors necessary to do so». He has also stated that López Mena was the one who reported that he issued the documents in the name of Cosmo Líneas Aéreas, a firm that notoriously served as a front, according to the prosecution.

Argentina extendería restricciones

AW | 2021 07 08 07:22 | AIR TRAFFIC / GOVERNMENT

Viajar en vuelos privados alcanzaría valores cercanas entre US$ 1.500 y US$ 3.500 Dólares.

Argentina would extend foreign restrictions

Traffic quota of 600 admissions per day to the country would continue

The Government of Argentina would announce when the expiration of the restrictions of the 600 passenger quotas for international trips approaches, it plans to extend the limitations until the end of July 2021. The authorities of the Ministries of Health, Interior and Transport held a virtual meeting to evaluate the continuity of the measure, and concluded that they would be inclined to maintain the controversial restriction for at least a week, but the final decision would fall on the national Executive.

The government remained firm in maintaining the restriction on the entry of Argentines to the country, but the possibility of modifying the scope had been evaluated. It was evaluated to relax the ban, so that a greater amount could enter, amid the strong questions that came from the airline companies.

The decision to further restrict the entry of Argentines had been established initially at 4,500 passengers per day, then at 2,000 and currently at 600, which has produced an avalanche of complaints and strong controversy from passengers stranded abroad and those who they need to leave the country.

Cost of going home

Passengers stranded abroad continue to redefine strategies to achieve their return in the short term. Air transport users grouped in social networks, take for granted that the Government will maintain the limited quota at least until the end of July 2021, so they continue to analyze a strategy to coordinate private flights to the San Fernando Airport, an airport of executive aviation, although transportation costs to return to Argentina would rise considerably. Others are analyzing other options to return by air to Paraguay and from there by land. Another alternative is to risk flying to Montevideo, Uruguay, and then board the crossing to Buenos Aires through the rainwater navigation system through the Buquebus company.

The San Fernando International Airport air terminal remains open for international executive flight operations. While in Ezeiza the daily average of incoming passenger flights is in the order of the three frequencies per airline, while San Fernando approaches the order of fifty with executive jet aircraft. The companies Baires Fly, Flyzer, Aerorutas and Pacific Ocean, are the companies that began to accumulate consultations and contracts after the limitations imposed by the National Civil Aviation Administration (ANAC). These firms had already been intensifying their operations due to the mass vaccination enabled in the United States. Currently, the demand of some passengers stranded abroad are emerging to arrive in Argentina before waiting for the flights rescheduled for September, October and even November 2021, according to the offers of the airlines for rescheduling. Traveling in private flights would reach values close to between US$ 1,500 and US$ 3,500 Dollars. «The cost per passenger in a private service from Uruguay to San Fernando is between US$ 2,500 and US$ 3,500 Dollars. The price varies according to the type and model of airplane. In general, they are units that have from 5 to 7 places», said one source linked to charter companies. The source consulted has argued that there are no inconveniences in flying Miami-Montevideo and then taking off for Argentina since they are passengers in transit. This figure allows a stay of up to 24 hours in Uruguay. «Flights are arriving every day from abroad. So far, the ANAC (National Civil Aviation Administration) has not suspended any service unlike what happens in Ezeiza, although it must be taken into account that the authorizations for each flight to San Fernando takes up to 96 hours», said the executive company consulted.

Fracaso reunión aéreas argentinas

AW | 2021 07 06 18:47 | AIRLINES / GOVERNMENT

Argentine air meeting failed

Government-airlines without agreements for air quotas

The Government of Argentina, the airlines together with the International Air Transport Association (IATA) have met this Tuesday 06/07 in the morning in a virtual way to try to reach an agreement regarding the air traffic quota imposed by the authorities on June 25, 2021, which limits 600 passengers per day with a maximum for entering the country, which generated a strong claim from Argentines stranded abroad. The meeting lasted a few minutes to establish the approaches of both parties. There has been no announcement or definition on determinations with the number of flights from abroad that can land in Argentina and the passengers who are stranded.

On behalf of the national government, the head of the National Civil Aviation Administration (ANAC), Paola Tamburelli; and the Secretary of Planning, Gastón Jaques. While in representation of Iata participated María José Taveira, regional representative of the entity in Argentina, Paraguay and Uruguay; Alejandro Muñoz Torres, Member of Foreign Relations for Latin America and the Caribbean; Lars Pottgiesser, Head of Business Development for the Americas region. The Minister of Transportation, Alexis Guerrera, neither Peter Cerdá, IATA Vice President for the Americas, nor the Chief of Cabinet of Ministers, Santiago Cafiero, whose presence had been demanded by both IATA and JURCA (Chamber of Air Lines in Argentina) were not present.

The IATA association has insisted on lifting the imposed passenger quotas for international flights, as well as knowing what will happen next week with the end or not of the restrictions on air quotas by 07/12.

On June 30, 2021, the airline companies association had refused to participate in a meeting when they warned that the Chief of Staff, Santiago Cafiero, would not be present, who was responsible for signing Administrative Decision No. 643, which reduced from 2,000 600 the number of foreign passengers that can enter Argentina per day.

“Of course IATA represents the interests of the airlines. They proposed to reduce the restrictions on flights in the Argentine Republic. We explain that this has to do with caring for the life and health of Argentines. Doing an analysis of the epidemiological evaluation, which of course results in the imposition of the necessary measures to guarantee them”, explained Paola Tamburelli, from the ANAC.

The restriction on the return of tourists who are abroad left thousands of Argentines outside the country without a certain date of return to the country. The Argentine Government has not yet authorized any international air operation after July 12, 2021. From the ANAC, the governmental body that administers civil aviation, they indicated that the rearrangement of passengers is a decision that corresponds to each airline, but from the airlines they maintain that the limitations of the quotas, also limit the return of the passengers stranded abroad.

IATA reclama Gobierno Argentina

AW | 2021 07 06 07:30 | AVIATION ORGANISMS / GOVERNMENT

Líneas aéreas acusan Gobierno dejar tirados a pasajeros

IATA demands the Argentine Government

Airlines accuse government of dumping passengers

The International Air Transport Association (IATA) accused the Government of the Argentine Republic on Monday 05/07 of leaving 1,400 people per day stranded around the world, based on the latest restrictions on the entry of passengers in the midst of the pandemic. The airline association claims that the companies could temporarily or permanently suspend their activity in Argentina.

In a strong criticism of the restrictions on the entry of air passengers arranged in the framework of the health emergency, the IATA has raised the alarms about the neglect of the situation of passengers stranded around the world. Given the advance of the new strains of Coronavirus, the Government has issued a reduction in the amount of daily passengers entering the country from 2,000 to 600, generating multitudes of claims against violated rights.

The entity considered in a statement that with an agenda coordinated with the Government, it will be possible to bring back the thousands of passengers affected by the restrictions imposed on June 25, 2021. «The flight scheduling is done months in advance and in Argentina there are approvals that have even arrived a day before. This makes it very difficult to operate, so it is to be expected that more airlines will temporarily or permanently suspend their operations in this market», criticized the world-renowned aeronautical association.

In a statement signed by IATA’s Regional Vice President for the Americas, Peter Cerdá, the entity stated that «the industry wants to be part of the solution to this crisis. It has done everything possible to continue offering essential air connectivity to and from Argentina. The uncertainty is maximum since, ten days after this measure was decreed, the Argentine government has not yet authorized any air operation after July 12 and we do not even know if it will extend the current limitations of flights as of July 9 2021. The only thing that is clear to us so far is that the authorized flights are not enough to bring back the thousands of stranded passengers», the statement said.

The entity urgently requested a meeting with the Chief of Cabinet, Santiago Cafiero, to whom they propose to foreseeably coordinate flights to and from Argentina, in such a way as to allow the industry to operate in a stable manner, while the pandemic continues. The IATA had previously requested a meeting with the Chief of Staff, which had originally been scheduled for Thursday 01/07, but it was not finally possible.

EEUU obliga aéreas reembolso equipaje

AW | 2021 07 05 06:38 | GOVERNMENT / AIRLINES

United States will force air baggage reimbursement

Airlines will refund money for delayed luggage

The Federal Government of the United States seeks that airline customers are protected from possible abuses in the sector, given the increase in air traffic. With this measure by the Joe Biden Administration, it is intended that passengers are more protected in case their luggage arrives late. United States airlines operating in the country must compensate for the delay in the delivery of luggage for which they charge an extra and do not arrive at their destination on time.

The new measures applied to commercial aviation seek to protect consumers and also promote fair competition. In the framework of a press conference by Brian Deese, Joe Biden’s Economic Advisor, «these rules, specifically, will ensure that if a passenger pays for luggage, they must receive that money back if the suitcase does not arrive on time». With these new measures, it is not only intended that this applies to things related to luggage, but also if a passenger pays for a service such as Wi-Fi and it does not work, they will quickly receive that money back. Brian Deese explained that these two measures are part of a package that the US president will make public soon and will be sent to the Department of Transportation (DOT) for implementation with the aim of promoting greater competition and lowering prices for consumers. The government package will also include an obligation to report baggage and cancellation costs transparently and in advance so that consumers clearly understand the fees and what they are actually paying for.

This announcement is made within the framework of the increasingly notorious opening of commercial air travel at all airports in the country. Last year with social distancing, airlines had to stop their operations, severely affecting their finances. Unlike the previous year, airlines are slowly recovering from the economic downturn they experienced last year, which is why the International Air Transport Association (IATA) reported fewer losses in the first quarter compared to consumption in the same period. from the previous year. With the arrival of the boreal summer, the number of flights will be greater and there may be saturation, so it is possible that many users will be affected by luggage delays, which is why the government is already taking the necessary measures to avoid the abuses.
