Smartwings demands to Boeing

Seeking compensation for grounding the 737 MAX

The consequences of the landing of the Boeing 737 MAX continue with the Czech airline Smartwings Airlines suing The Boeing Company. Smartwings took legal action against Boeing on Tuesday 06/22. The low-cost carrier is seeking an unspecified amount for damage caused by the plane’s grounding.

AW-Smartwings_0002

Low-cost Smartwings ordered three Boeing 737-8 MAXs (3) in 2013, adding another five in 2017 to its order book, extending leasing another 31 MAXs to replace its single-aisle fleet of Boeing 737-800s. The incorporation of the first MAX 8 had arrived in Prague, Czech Republic at the beginning of 2018. Then, Smartwings took seven additional Boeing 737-8 MAXs under lease mode before grounding due to problems caused by the crisis of the MAX line. After two plane crashes, the 737 MAX was grounded worldwide on March 10, 2019. Aviation regulators began approving recertification towards the end of 2020.

The amount of grounding costs for Smartwings’ 737 MAX line reached values of US $ 93.8 million. In February 2021 Smartwings resumed the flight of its MAX fleet. Six of the seven aircraft are classified as active, while the registered aircraft OK-SWC is still stationed in Prague.

Smartwings is pursuing financial damages, wants to return an aircraft, and is seeking a refund of payments made for that aircraft and advance payments from other MAXs.

The same report says that Smartwings has canceled its remaining direct orders from Boeing. Smartwings had paid US$ 833,332 in advance payments for two planes. The airline also wants that money back. Smartwings is also pursuing more unspecified damages.

In his filing, Smartwings makes several accusations against Boeing and its handling of the MAX Program. Smartwings alleges that Boeing did not conduct a full safety assessment regarding the failure modes of the Maneuvering Characteristics Augmentation System (MCAS). «(Boeing) misled the Federal Aviation Administration and other regulators regarding the nature and purpose of MCAS», the airline’s filing reads. Rather than make aerodynamic changes to the MAX, Smartwings alleges that «Boeing chose a cheap and hastily implemented bandage». The Czech airline further alleges «gross negligence and fraud» on the part of Boeing and says that the aircraft manufacturer made «material misrepresentations and non-disclosures» to pilots about the MCAS System. The inflammatory language suggests a significant rift in the relationship between Boeing and Smartwings. It’s a far cry from mutual endorsement and positive public relations statements when the first Boeing 737 MAX landed at Smartwings more than three years ago.

Smartwings Airlines is not the first airline to seek a reward from Boeing regarding the 737 MAX. But taking the public complaint and filing a lawsuit is a high-risk strategy. Smartwings currently has forty aircraft in its fleet of which 39 are from the Boeing fleet. The airline will need continued support from Boeing to keep these aircraft operating.

Strategies vs relationships

Leaving aside contractual obligations, the performance of that support, and the cost, it could very well depend on the strength of the relationship between the airline and the aircraft manufacturer. The demand strategy also puts Smartwings on the back burner when purchasing new aircraft in the future. While aircraft manufacturers are keen to strike deals to keep production lines running and revenue flowing into their coffers, the ill will generated by suing Boeing could see the aircraft maker less willing to negotiate a deal for Smartwings in the future. Smartwings’ position could not be easily resolved by turning its business towards the Airbus Group competition, moreover knowing that the European aircraft manufacturer knows that you are sitting at the negotiating table in Toulouse because you are persona non grata at Boeing, it is likely that Airbus will agree to an indifference and does not offer a favorable financial solution. It is a consequence of which an intelligent operator like Smartwings is undoubtedly aware. After weighing the pros and cons of suing Boeing and making some inflammatory claims, they have clearly decided that entering the courtroom is the best strategy going forward.

Canadá rechaza reporte Irán por PS752

Informe canadiense critica a Irán imprudente por derribo vuelo PS752

AW-PS752UIA

Canada rejects Iran report by PS752

Canadian report criticizes Iran’s reckless downing of flight PS752

A Canadian Government report on the downing of a Ukrainian plane has found no evidence that it was premeditated, but said the Islamic Republic of Iran was totally responsible. Ukraine International Airlines flight PS752 was hit by two missiles after taking off from Tehran on January 8, 2020. All 176 people on board were killed.

The downing of Flight PS752 from a Boeing 737-800 in January 2020 claimed the lives of all 176 people on board, including 138 people with ties to Canada. All the people on board were killed when the aircraft took off from Tehran/ Imam Khomeini International Airport and headed for Kiev, Ukraine, but the Boeing 737-800 aircraft was hit by a military action.

The Iranian government that was accused of obstructing independent investigations has said it mistook the plane for a US missile. Canada announced on Thursday 24/06 that the fault lay with the civil and military authorities of Iran. While acknowledging that an air defense unit operator «probably acted on his own in making the decision to launch the missiles», an eight-month forensic investigation concluded that it would not have happened were it not for «incompetence, recklessness and unwarranted disregard. for human life», of Iranian officials. Canadian Foreign Minister Marc Garneau in a press conference on Thursday said that «Iran is fully responsible for what happened».

The investigation found that Iranian anti-aircraft missiles were on high alert, yet authorities did not close their airspace or notify operating airlines at the time. Marc Garneau said a missile operator made «a series of extremely wrong decisions that could and should have been avoided». Iranian military command and control has been too slow both to address the failures and to take action to prevent future tragedies. Officials called for «a full and honest explanation of the Iranian regime» as the Canadian report acknowledges the Iranian government’s lack of access to evidence, crash site and witnesses.

Iranian authorities initially denied responsibility for the accident and allowed the crash site to be razed and looted. But as tests mounted, the Revolutionary Guardians Aerospace Force said an air defense unit had mistaken the Boeing 737-800 for a US missile. Iran’s air defenses had been on high alert at the time because the country had just fired ballistic missiles at two Iraqi military bases that house US forces in retaliation for the death of senior Iranian General Qasem Soleimani in a US drone strike in Baghdad five days before the air attack.

A final report from Iran’s Civil Aviation Organization concluded in March 2021 that an operator misidentified the plane and fired the missiles without authorization from a commander.

On Wednesday 06/23, Canadian Minister Marc Garneau said that the Iranian report had «huge holes and blames everyone who is lower down in the structure», but admitted that his government’s forensic team relied on the report and he could not draw conclusions that differ from the formal explanation of Iran’s «human error».

Canadian Prime Minister Justin Trudeau said: «Iran’s official account of events is false, misleading and perfunctory, and willfully ignores key factors. Senior regime officials made the decisions that led to this tragedy, and the world did not it must allow them to hide with impunity behind a handful of low-ranking scapegoats». The Canadian Administration is seeking reparations from Iran to compensate the families of the victims. He has also indicated interest in applying sanctions or going to the International Criminal Court for the incident.

On the part of the Government of the Republic of Ukraine, it tacitly rejects the Final Report of the aviation agency of the Republic of Iran.

Polémica viajes Aerolíneas a Rusia

AW | 2021 06 25 07:50 | AIRLINES / GOVERNMENT

Gobierno abonó AR$ 751.750.000 a Aerolíneas Argentinas

Controversial airline travel to Russia

Government paid AR$ 751,750,000 to Aerolíneas Argentinas

The choice of Aerolíneas Argentinas to transport the vaccines against the Coronavirus had a huge cost than being transported by other private companies. For some transfers, such as those brought by the AstraZeneca consignments, the Government of Argentina hired companies that charged it up to twelve times less than the value of being transported by the Argentine flag carrier.

Around AR$ 751.75 million Argentine Pesos were used to cover the operating costs of Aerolíneas Argentinas for the use of Airbus A330-200 aircraft to transport the vaccines to Argentina. This cost does not include other disbursements such as handling, purchase or rental of special pallets for temperature maintenance, ground logistics and other complementary aviation fees, which would add an additional variation of AR$ 1,050 million, according to official information.

With the arrival of June 3, 2021, from Moscow, 31 flights with vaccines had arrived at the Ezeiza Airport. Of them, 23 wore the insignia of the flag carrier. Four were from KLM, the Dutch company and the remaining four from Lufthansa German Airlines, Qatar Airways, Latam Cargo and Air Canada. According to the records of the Ministry of Health, through a request for public information, flights to Russia cost, on average, US$ 304,000. Those who brought Sinopharm from China, about US$ 425,000. However, those that arrived from India had a cost of US$ 25,000. The reason behind the difference is that, to bring in the AstraZeneca, the Government hired Hellman Worldwide Logistics, a mega-company dedicated to international trade that outsources flights and other services. The final price for the freight from India to Buenos Aires, on February 17, 2021, to bring 580,000 doses was US$ 25,671.80. Freight carrier DHL had also priced the flight at US$ 25,500. The cost was also lower in the transfer from other destinations. The Government of Argentina paid Hellman US$ 31,709 for freight and logistics to bring vaccines from the Netherlands. The company used commercial flights to bring up to 864,000 doses in the hold, in the case of the KLM flight, which arrived in Argentina on April 18, 2021.

In contrast, with the Aerolíneas flights, shipments with as little as 200,000 doses arrived from Russia, at a higher price. Sources close to Hellman confirmed that it would have been possible to carry out similar services to bring Sputnik V from the Russian capital, but the Ministry did not even ask them for a quote. From DHL they expressed that they prefer not to give details about their commercial relationship with the Government, but they assured that they have the warehouse transport service available. “The problem is one of efficiency. If the plane were to come full, the only option is a charter, use a full flight. But if you are going to bring a few vaccines, less than 500,000, it makes no sense to use a complete plane, as in the case of Aerolíneas”, explained an international logistics services entrepreneur.

Aerolíneas Argentinas was responsible for bringing vaccines from Russia and China. Of the 23 flights carried out by the company, 15 came loaded with 500,000 vaccines or less. Before March 25, 2021, it was not possible to transport more than that amount with Argentine planes, since they did not fit in the warehouse space. On 03/25, the Airbus was reconditioned to be able to transport up to a million where previously there were passenger seats. Since the vaccination campaign began until the beginning of the month, two companies, in addition to Aerolíneas Argentinas, were involved in the management, beyond the flights. DHL and Hellman were contracted to carry out the transport operations at the airport of origin. These services involve trucks from the laboratory, conditioning, palletizing, among others, as the case may be.

On average, the bills for benefits in Russia or China amount to US$ 130,000, which is added to the flights that the Ministry of Health pays to Aerolíneas. They are also in charge of handling at the Ezeiza Airport. Then, the Andreani company takes over the storage, for days or even weeks, and then distributes to the whole country.

Asked about the efficiency of the flights and the space in the cabin and warehouse that is occupied in each case, Aerolíneas Argentinas said that the laboratories do not always send the vaccines with the same presentation. Boxes and containers play a role in determining the number of doses that can enter each flight. When making a regular flight it takes three times longer for transfers and the triangulation is delayed, reasons for the use of Aerolíneas Argentinas to bring vaccines directly.

The logistical advantages of making direct flights were exposed by the Chief of Staff, Santiago Cafiero, in his rendering of accounts before the Senate. Company sources usually explain, in addition, that one of the advantages that Aerolíneas Argentinas offers to the Government is the fact of having immediate and available transportation to bring a key input.

At the beginning of July 2021, 18,450,150 million vaccines had arrived in Argentina on 31 flights, an average of 595,167 doses per transfer. If it continues at this rate, to reach the estimated 90 million to immunize the entire population with the full scheme, 120 more flights will be necessary.

Vaccines increase

Aerolíneas Argentinas doubles the number of flights. The airline has responded to increased demand with a doubling of weekly frequencies to bring more doses to the country.

Gremios denuncian Latam en Paraguay

AW | 2021 06 24 06:55 | AIRLINES / AVIATION ORGANISMS / GOVERNMENT

ASATUR (Paraguayan Association of Travel Agencies and Tourism Companies) and the AAVIP (Association of IATA Travel Agencies of Paraguay), filed a formal complaint against Latam Airlines in a claim to the Minister of Tourism, Sofía Montiel, and eventually other companies air for flagrant violation of Law 2828 of Tourism, at the time of requesting the opening of an administrative summary for the purposes of the subsequent imposition of the pertinent corresponding sanctions. The law regulates tourism activity and airlines have historically opposed subsection F of Article 33, which establishes that tourism service providers, registered in the National Tourism Registry, enjoy certain rights, among which is mentioned that of “receiving for the commercialization of air tickets a percentage not less than 6% of the fare of the passage that will be paid by the airlines”.

Attempts to request the repeal or modification of the Tourism Law 2828 by the airlines have been a constant since the enactment of the law in December 2005. A letter sent by JURCAIP to the President of DINAC at the beginning of 2020 meant a new questioning because it requested the modification of the Tourism Law, noting that «Paraguay is the only country that has such a high commission set by law».

In the middle of the pandemic, another subsequent JURCAIP claim led to a virtual meeting held on June 24, 2020 in which, in addition to the Minister of Tourism, representatives of JURCAIP, DINAC, ASATUR and AAVIP were present. Among other points discussed on the occasion, JURCAIP representatives mentioned the high percentage of sales made through travel agencies (approximately 70%) and consequently the high amount of commissions they must pay to them. Contradictorily, on the one hand, the excellent commercial production of the agencies was highlighted, which far exceeds the sales that the airlines could achieve directly, and on the other, the remuneration that should be paid for said commercial management was questioned. The meeting ended with the promise to continue a dialogue that would allow the interests of both sectors to be reconciled.

On December 4, 2020, Latam Airlines requested travel agencies to sign a “Travel Agency Contract”, which established “new commercial conditions and the waiver of the right and the action to receive for the commercialization of tickets. air the payment in money of the commission of 6% of the fare of the passage established in Art. 33, subsection (F) of Law No. 2828/05”. On December 11, 2020, both associations (ASATUR and AAVIP) spoke by sending a note to LATAM, with a copy to Senatur, rejecting «the excessive claims of the airline, its extortionate attitude and the illegality of the contract submitted». Through the intermediation of Senatur, the associations and Latam began a work table seeking to reach a commercialization agreement. According to the claim made by the associations at the beginning of April 2021, the JURCAIP through the lawyer Alejandro Piera, firmly proposed to eliminate the inc. f of the law. “In the desire to reach a satisfactory agreement for all, we agreed to give JURCAIP more time to rethink the proposal and present a new one, but JURCAIP did not make any constructive proposal and simply reiterated their approach to eliminate the article. of the law. This was again affirmed in an email sent on May 10, 2021 by JURCAIP, in which they expressed that they are not in a position to present an additional proposal beyond the one shared with the work table”, states the letter sent to the Minister of Tourism.

«It seems pertinent to specify what is established in Art. 9, second paragraph, of the National Constitution, which provides» […] No one is obliged to do what the law does not order. In the case in question, the wording provided in inc. F of Art. 33 of Law No. 2828/2005 orders the airlines to pay the minimum commission, which implies, from the point of view of the aforementioned constitutional rule, that the provision in question becomes mandatory, inalienable and non-derogable by agreement of the parties, as it is ordered by current law From the foregoing, we can conclude that non-compliance with what is established in Subsection F of Art. 33 of Law No. 2828/2005, also violates the National Constitution», adds the letter sent by ASATUR and AAVIP.

As an authority and regulatory body for tourism activity, the Senatur must rule «putting respect for the law as appropriate in a state of law before proposals that deviate from their normal channels and seek to transgress what is legally established», say comments received from agents travel in our newsroom.

EEUU fondo deudos Boeing 737 MAX

AW | 2021 06 22 21:22 | GOVERNMENT / INDUSTRY / AVIATION SAFETY

US Boeing 737 MAX debt fund

United States fund of US$ 500 million for families of victims

A victim’s compensation fund of US$ 500 million for the families of 346 people killed in two fatal accidents involving the Boeing 737-8 MAX, the administrators of the lawsuit said on Monday 06/21. The fund is part of an agreement with the United States Department of Justice (DOJ). The Boeing Company agreed in January 2021 to pay the amount of US $ 500 million to compensate the heirs, relatives and beneficiaries of the passengers who died on Lion Air flight JT-610 and Ethiopian Airlines flight ET-302 in 2018 and 2019 respectively.

Each eligible family will receive nearly US$ 1.45 million and the money will be paid on an ongoing basis as claim forms are submitted and completed, administrators Ken Feinberg and Camille Biros said in a joint statement. Families have until October 15 to complete claim forms. The fund is part of a US$ 2.5 billion Justice Department settlement reached in January 2021 with Boeing after prosecutors charged the company with fraud over the 737 MAX certification following a Lion Air accident on Sept. 29 October 2019 and a second Ethiopian Airlines accident on March 10, 2019.

The settlement allowed Boeing to avoid criminal prosecution, but did not affect civil litigation by the victims’ families that continues. In July 2019, Boeing appointed Feinberg and Biros to oversee the distribution of a separate US$ 50 million to the families of those killed in accidents, and the distribution from the new fund follows a similar formula. While Boeing has mostly settled Lion Air lawsuits, it still faces numerous lawsuits in Chicago federal court from families from the Ethiopian crash asking why the MAX continued to fly after the first disaster.

The Justice Department settlement includes a US$ 243.6 million fine and a US$ 1.77 billion compensation to airlines for fraud conspiracy charges related to the aircraft’s faulty design. The Justice Department said in January: «Boeing employees chose the path of profit over frankness by withholding material information from the FAA about the operation of its 737 MAX aircraft and participating in an effort to cover up their deception».

Some lawmakers say the US government didn’t go far enough, while Boeing says it has taken numerous steps to review its safety culture. Congress ordered a major review of how the FAA certifies new aircraft in December and led an independent review of Boeing’s safety culture.

Reclaman transferencias de Latam

AW | 2021 06 21 11:18 | AIRLINES / GOVERNMENT

Acreedores Latam reclaman transferencias fraudulentas

AW-Latam Airlines Group

Latam creditors demand transfers

Latam creditors claim fraudulent transfers

The Unsecured Creditors Committee have asked the Bankruptcy Court for the Southern District of New York to review alleged “fraudulent transfers” between the airline Latam Airlines Group with its partners from Qatar Airways and Delta Air Lines, before filing for Chapter 11 of the United States Bankruptcy Law. According to the documents presented by the creditors to the Court, before starting the reorganization of Latam Group, both Qatar Airways and Delta Air Lines canceled the contracts for A350 aircraft, leases (5) and purchases (4), so they would not have to pay them. About Delta Air Lines, the document mentions that, later the pandemic arrived and the value of the planes dropped. Delta, which was Latam’s second largest shareholder at the time, wanted to evade its obligations to pay for planes that were worth less than the price agreed in the contract, so it asked Latam to terminate the agreement.

The Creditors Committee, apparently, also mentions in the document the suspicious intention with which this withdrawal of the airlines would be made. “The timing of the transfer, which is detailed just hours after starting the restructuring process, was suspicious and inappropriate”, for which the creditors of Latam indicated in the document that: “respectfully requests that the Court grant permission, legitimation and authority to the Committee to prosecute and, if appropriate, resolve (subject to the approval of the Court), the claims presented herein”, referring to the two airlines Qatar Airways and Delta Air Lines.

Latam Airlines Group has stated that it is routine to request the review of these two transactions: “the motion to review two transactions presented by the group of creditors organized under the figure of UCC (United Creditors Committee) is part of a routine process under the Chapter 11, equivalent to the concept of Bankruptcy Revocation Actions, in which the judge can review the transactions carried out before availing themselves of the voluntary reorganization process», according to the airline’s statement.

Indonesia reestructuración Garuda

AW | 2021 06 19 16:37 | AIRLINES / GOVERNMENT

Mercado agitado de la aviación comercial indonesia

Garuda_Indonesia.svg

Indonesia would support Garuda restructuring

Troubled indonesian aviation market

The Republic of Indonesia will have to decide on the future of commercial aviation when faced with the economic problems posed by the country’s airlines. Southeast Asia’s largest economy is mulling over whether to shut down or refinance its national airline, Garuda Indonesia Airlines, amid widely divided debates, those sentimental and those focused on the bottom line.

Garuda Airline has continued to fight for profit even before the Coronavirus pandemic hit. The State Enterprise Ministry recently unveiled four options: the first three keep the 72-year-old airline high and the fourth is the airline shutdown option. To keep Garuda flying despite falling revenue and huge expiring debts, the Indonesian government must pump cash, announce a debt standstill, followed by a restructuring, and debt rollover while creating an airline that would take over the Garuda Indonesia Airlines routes.

Global travel was devastated by the pandemic, seriously affecting even big players such as Singapore Airlines and Emirates, the flag carrier of the United Arab Emirates. Garuda’s revenue likely dropped to US$ 1.67 billion/S$ 2.24 billion in 2020, from US$ 4.57 billion in the previous year, according to a research note from stock brokerage Ciptadana. Sekuritas Asia, based in Jakarta, capital of the Republic of Indonesia.

The airline has not yet released its full financial results for 2020. On Thursday, June 17, 2021, a payment on a US$ 500 million Islamic debt was missed. A recent viral recording of Garuda CEO Irfan Setiaputra’s management to staff, the content of which was later confirmed by management, revealed that it planned to reduce its fleet by 50%, reduce staff and sell assets. «The fact is that our debt reached 70 trillion Rupees/US$ 6.5 billion Dollars and each month it grew by more than one trillion Rupees».

The airline had undergone a debt roll-over in 2006 to help it become profitable. But a culture of timeframe on acquisitions and poor governance, among other factors, continued to plague Garuda even as he battled low-cost rivals. In 2020, former CEO Emirsyah Satar was sentenced to eight years in prison for receiving bribes for his support of obtaining contracts to acquire Bombardier, Airbus and ATR aircraft, as well as Rolls-Royce engines. Separately, British fraud investigators were investigating Bombardier for contracts related to Garuda, according to the Serious Fraud Office. «Frankly, this is a long-term and deep-seated problem. We could just let the private sector do the flight, or invite foreign carriers, for example Emirates. This way, we would not burden taxpayers and the flying public», said a senior government official during a recent discussion with business editors in Jakarta.

Political arena

In the field of politics, the deputies of the ruling and opposition parties have other opinions, they have urged the Government to save Garuda Indonesia Airlines. In a June 10, 2021 filing to the Indonesian Stock Exchange, it reported that Garuda Indonesia Airlines returned two Boeing 737-800 aircraft to a lessor and is in talks with other companies to restructure the lease terms. It currently operates a fleet of 142 aircraft. They noted that the airline not only provided jobs, but also generated employment in related sectors, such as ground services at airports and courier services.

Mr. Herman Khaeron, a member of a Parliamentary Commission that oversees state-owned companies and investments, said the majority of the commission is in favor of keeping Garuda flying as it is an asset the nation is proud of. «We have held a meeting with the minister of state enterprise to act quickly, to allow Garuda to take corporate actions that lift its operational pressures», said Herman Khaeron, a member of the Democratic Party on Thursday 06/18. Several politicians share in the need for the Government to prepare a financial and organizational restructuring of Garuda so that it can emerge stronger after the pandemic.

Indonesia akan mendukung restrukturisasi Garuda

Pasar Penerbangan Komersial Indonesia Berombak

Garuda_Indonesia.svg

Garuda Airlines terus berjuang mencari untung bahkan sebelum pandemi virus corona melanda.

Alitalia suspends flights due to strike

Alitalia suspends several flights due to staff strike

AW-Alitalia_A330

The airline Alitalia has canceled several flights this Friday 06/18 after the call for a strike by the transport unions to prevent the wave of layoffs among Italian airlines caused by the impact of the pandemic. The airports of Fiumicino, in Rome, and Linate, in Milan, are affected by the strikes. The strike has lasted for a few hours. The unions are calling for the extension of benefit programs and the cessation of dismissals of all foreign airlines based and employed in our country, of airport management, baggage handling and catering companies and of all seasonal and precarious workers in the sector.

Alitalia, which has reported the cancellations on its website, has not provided benefits for years and relies on state aid to keep flying. The Italian government has the idea of replacing the company with a new startup called Italia Transporto Aereo (ITA), but there are disputes with the competition authorities of the European Union (EU).

The aeronautical unions consider in this sense unacceptable and incomprehensible the continuous delays in the start-up of the new operator ITA, which should start as soon as possible, but have asked that this start should not be accompanied by additional job losses. The Ministry of Economy announced on Thursday the appointment of Alfredo Altavila as the new director of ITA and promised that the implementation of this new company will be accompanied by a new wave of job destruction.
