Tragedia Sol Líneas Aéreas continúa querella ante prescripción

El 18 de Mayo del 2011 el avión SAAB 340B de la aerolínea regional rosarina Sol Líneas Aéreas realizaba la última escala del vuelo 8R5428 Neuquén-Comodoro Rivadavia, en Argentina, cuando sobre la noche se estrelló y fallecieron todas las 22 personas a bordo. La causa solo tiene como querella a Juan Carlos Ruíz, padre de una de las víctimas y a la esposa del piloto Juan Raffo. Pese a las posibilidades de prescripción de la causa, ambas querellas sostienen que los imputados deben ser condenados por un estrago doloso culposo que tiene una sentencia hasta 25 años de prisión.

A diez años de la tragedia del vuelo 8R5428 de Sol Líneas Aéreas no existe sentencia condenatoria firme por la muerte de 22 personas, cinco de ellas de Comodoro Rivadavia. La causa prescribió el pasado 8 de Febrero de 2021 y absolvieron a los directivos de la aerolínea. Ahora, la Cámara de Apelaciones de Genera Roca deberá decidir si la acción penal prescribió o no. Las familias siguen reclamando justicia por las veintidós personas que murieron el 18 de Mayo de 2011, cuando el avión en que el viajaban desde Córdoba con escalas en Mendoza y Neuquén con destino a Comodoro Rivadavia, se estrelló entre las localidades de Los Menucos y Prahuaniyeu, en la Provincia de Río Negro, Argentina.

Juan Carlos Ruiz , padre de una de las víctimas del accidente, indicó que a la fecha “los únicos que quedamos con las querellas somos la esposa del piloto y yo» en el intento de buscar justicia por las víctimas. Juan Carlos Ruiz era padre de su hijo Juan Manuel fue quien luchó hasta lograr que se reabriera la causa para investigar las causa de la tragedia. «No se puede cargarles las tintas a quien no se puede defender [por el piloto] porque es querer cerrar la causa y eso favorece a los grandes intereses económicos. Los funcionarios -que deberían controlar- no lo hicieron y los jueces fueron permeables a todo esto que fue un combo terrorífico para la seguridad de la sociedad. Ahora estamos por tercera vez en la Cámara de Apelaciones a la espera de que no se cierre la causa. En la Cámara de Casación, uno de los jueces reconoció que nuestra querella tenía aspectos de interés y que en la Cámara de Apelaciones no teníamos garantías de jueces imparciales”, cuestionó Juan Carlos Ruiz.

Sobre el sobreseimiento de los imputados directivos de la aerolínea a los nueve años de la tragedia, Juan Carlos Ruíz precisó que el juez se fundamentó «en pruebas selectivas que hizo la fiscal y el primer informe de la Junta de Investigaciones. Luego, volvimos a la Cámara de Apelaciones y gracias a los abogados (una de ellas la esposa del piloto) se logró revertir esta causa que ya tenía destino para ser cerrada. El año pasado, la Cámara de Apelaciones volvió el expediente a Bariloche para que se continúe con la investigación y que exista una determinación por trabajo en el expediente y no por prescripción. Se tomó declaraciones a los peritos y el Juez que está ahora (Gustavo Zapata en situación interina) estableció el sobreseimiento por prescripción. Nosotros estamos en la pelea para la carátula dentro del artículo 190 del Código Procesal Penal que es un estrago doloso culposo que tiene una sentencia hasta 25 años de prisión. Estamos peleando muy duro. Cuando se cae el avión, hay un expediente principal y luego se abrió otro expediente por la quema de restos humanos en cercanías del cerco perimetral donde se recogían los restos del avión. Esa denuncia la hizo APLA (Sindicato de Pilotos) pero el juez de Buenos Aires se declaró incompetente porque la causa ya tenía un juez natural”, expresó Juan Carlos Ruiz.

Aeroparque transfieren temporalmente regionales a Ezeiza

Los vuelos regionales que operan en el Aeropuerto Jorge Newbery serán trasladados temporalmente al Aeropuerto Internacional de Ezeiza debido a que dejó de funcionar el laboratorio de análisis para detectar Coronavirus que lo hacía en esa estación aérea, informó este Miércoles 19/05 el concesionario Aeropuertos Argentina 2000. Según lo proyectado desde la primier hora de este Miércoles el laboratorio de testeos que funcionaba en Aeroparque, LabPax, dejaba de funcionar. La aeroestación de Aeroparque recibía un total de dos vuelos diarios entre las compañías Aerolíneas Argentinas, JetSmart Airlines y Paranair.

En un comunicado, la empresa LabPax que tiene a su cargo la operación de la mayor parte de los aeropuertos del país señalo que “desde las 00:00 horas del 19/05 el laboratorio de testeos que funcionaba en Aeroparque, ha cesado su operación. Para garantizar el control sanitario al ingresar al país y poder cumplir con la Decisión Administrativa Nº 268 del 25 de Marzo de 2021, las líneas aéreas que cuentan con vuelos regionales en esta terminal, trasladarán su operación al aeropuerto Internacional de Ezeiza con la aprobación de las autoridades aeronáuticas”. Stamboulian Servicios de Salud se encuentra realizando los procesos administrativos para asumir la dirección técnica de la operación de testeos para pasajeros internacionales también en Aeroparque e indicó que una vez operativo el nuevo laboratorio, los vuelos regionales volverán al Aeroparque.

Los testeos en Aeroparque, al igual que lo que ocurría en Ezeiza, eran realizados por el laboratorio LabPax, pero tras detectarse irregularidades en esa empresa, fueron desafectados, primero en Ezeiza, donde ya se hizo cargo Stamboulian, y ahora de la estación aérea metropolitana de la Ciudad de Buenos Aires. A partir de esta decisión del concesionario, la empresa dirigida por Daniel Stamboulian y fundada en 1974 se hará cargo de las tareas que desarrollaba LabPax.

La Decisión Administrativa Nº 268/2021 determina que las personas que entren al país deberán cumplir, además de todos los protocolos que ya se encontraban vigentes desde que se decretó la emergencia sanitaria por Covid-19, una serie de medidas adicionales, entre ellas la realización de una prueba al arribo al país y otra al séptimo día del ingreso, con costo a cargo del pasajero.

La concesionaria aeroportuaria AA2000 indica que los exámenes se realizan todos los días, incluidos Sábados, Domingos y feriados, sin turno previo y las muestras se obtienen mediante dos técnicas diferentes: el RT PCR con un valor de AR$ 6.000, cuyo resultado está disponible a las dos horas de efectuado, y/o el test PCR Antígeno, con un costo de AR$ 4.000, con resultado a los 5 minutos de tomarse la muestra.

La Justicia de la Unión Europea ha solicitado este Miércoles, 19 de Mayo de 2021 a la Comisión Europea (CE) que justifique la autorización que otorgó a las ayudas estatales que recibieron las líneas aéreas TAP Air Portugal y KLM Royal Duth Airlines, cuestionadas por la compañía de presupuesto irlandesa Ryanair que ha presentado un reclamo ante la Justicia. En dos fallos por separado, el Tribunal General de la UE consideró insuficiente la justificación de la Comisión a esas ayudas, que de acuerdo con Ryanair distorsionan la competencia en el sector aeronáutico de bajo costo. Así, el Tribunal formalmente anuló las autorizaciones de Bruselas a esas ayudas excepcionales, pero dejó en suspenso la decisión y otorgó a la Comisión dos meses para adoptar una nueva determinación. En una tercera sentencia, la Justicia europea convalidó este Miércoles 19/05 las medidas de ayudas españolas a empresas estratégicas en el país, consistentes en recapitalizaciones por valores totales de hasta € 10.000 millones de Euros. Estas medidas también fueron demandadas por Ryanair.

Para la aerolínea de presupuesto irlandesa Ryanair, la postura del Tribunal de Justicia sobre las aerolíneas TAP Air Portugal y KLM Airlines ha representado una victoria simbólica en los Tribunales, aún sin beneficio concreto inmediato. «KLM ha tomado nota de la decisión del Tribunal de Primera Instancia Europeo y la estudiará. La decisión del Tribunal no tiene actualmente consecuencias para KLM y las ayudas de las que KLM se ha beneficiado», expresó el comunicado difundido por la aerolínea holandesa. El Primer Ministro de Portugal, Antonio Costa expresó: «Por el momento, no hay consecuencias para nosotros», explicando que la justicia europea simplemente había decidido buscar información adicional de la Comisión Europea.

El Tribunal General de la UE en Febrero 2021 desestimó los recursos de la aerolínea irlandesa contra las ayudas a Air France y SAS. Grupo aéreo primer vuelo larga distancia con biocombustible

Air France-KLM Group, Total SE, ADP Group y Airbus Group unieron fuerzas para realizar el primer vuelo de larga distancia con Combustible de Aviación Sostenible (SAF*) producido en Francia. El vuelo AF342 despegó ayer a las 15:40 horas de la Terminal 2E del Aeropuerto Paris/Charles de Gaulle con destino a Montreal, Canadá, llevando por primera vez en sus depósitos combustible de aviación sostenible producido por la compañía de hidrocarburos Total SE en sus plantas francesas. Este vuelo hace realidad la ambición común de los cuatro grupos de descarbonizar el transporte aéreo y de desarrollar una industria francesa de producción de combustibles de aviación sostenibles, condición indispensable para la generalización de su uso en los aeropuertos franceses.

This first SAF Made in France was certified ISCC-EU by the International Sustainability & Carbon Certification, an independent organization that guarantees its sustainability. Its incorporation in a proportion of 16% in this flight made it possible to avoid the emission of 20 tons of CO2. By developing and supporting in this way the first stage of a French sustainable aviation fuel industry, Air France-KLM, Total, the ADP Group and Airbus are leading the way to make France a driving force for innovation, serving the transition energy and environmental. French legislation currently provides for the incorporation of 1% of this type of biofuel in all flights started in France from 2022, anticipating the ambition of gradual incorporation (2% in 2025 and 5% in 2030) that will be will be held within the framework of the European «Green Deal». Impulsado por los defectos en la línea de gerenciamiento de defectos de calidad de Boeing en la producción del 787 Dreamliner, el 737 MAX y el avión cisterna KC-46 basado en el 767, un comité del Congreso envió cartas el Martes 18/05 tanto a Boeing como a la Administración Federal de Aviación en busca de registros pertinentes de fabricación y control de calidad. La medida señala una pérdida de confianza por los repetidos fallos de calidad y se produce después de un drástico cambio en el sistema de Boeing de comprobar la calidad de producción que desde 2019 ha recortado cientos de puestos de trabajo de inspectores de calidad.

La investigación profunda del mismo Comité de Transporte de la Cámara de Representantes sobre los dos accidentes de las aeronaves Boeing 737-8 MAX en los que fallecieron las 346 personas produjo un mordaz informe en el 3Q2020 que se ha remarcado una serie de errores técnicos y juicios erróneos preocupantes de la administración en Boeing y una supervisión manifiestamente insuficiente por parte de la FAA.

Las cartas inician una nueva investigación sobre la calidad de la producción que caduca en una gama de aeronaves: Un problema en los tanques de combustibles ocacionares supervisión. Un sistema eléctrico que dejó en tierra 109 Boeing 737 MAX más nuevos el mes de Abril de 2021 y detuvo las entregas de los aviones durante unas cinco semanas. El fuselaje defectuoso que detuvo las entregas del Boeing 787 Dreamliner durante más de cuatro meses y condujo a una acumulación de unos 100 aviones estacionados que requerían inspección y reelaboración. La semana pasada, la FAA aprobó la solución de Boeing para el problema eléctrico del Boeing 737 MAX. Driven by flaws in Boeing’s quality defect management line in the production of the 787 Dreamliner, 737 MAX, and the 767-based KC-46 tanker, a Congressional committee sent letters on Tuesday 05/18 to both Boeing and the Federal Aviation Administration for relevant manufacturing and quality control records. The move signals a loss of confidence from repeated quality failures and comes after a drastic change to Boeing’s system of checking production quality that has cut hundreds of quality inspection jobs since 2019.

The in-depth investigation of the same House Transportation Committee on the two accidents involving the Boeing 737-8 MAX aircraft in which 346 people died produced a scathing report in 3Q2020 that has highlighted a series of technical errors and judgments worrying misconceptions by management at Boeing and grossly insufficient oversight by the FAA.

The letters initiate a new investigation into the quality of production that expires in a range of aircraft: A problem in the fuel tanks occasionally monitoring. An electrical system that grounded 109 newer Boeing 737 MAXs in April 2021 and halted deliveries of the planes for about five weeks. The faulty airframe that halted deliveries of the Boeing 787 Dreamliner for more than four months and led to a backlog of about 100 parked aircraft requiring inspection and rework. Debris left inside newly manufactured jet fuel tanks, a recurring problem at the KC-46 refueling tank. «In light of these ongoing new issues that point to issues in maintaining quality control and proper FAA oversight of production issues, I will thoroughly and deliberately investigate any issues, such as those affecting the 737 MAX and 787, which can endanger public safety», said Peter DeFazio in a statement on Tuesday 05/18.

Last week, the FAA approved Boeing’s solution to the Boeing 737 MAX electrical problem. Boeing has started to deliver the 787 line again, progressively allowing the aircraft production and delivery lines to be reactivated. The last report of debris found inside fuel tanks was last summer.

Yet as Boeing struggles to get out of the twenty-month grounding of the 737 MAX after the accidents while grappling with collapsing demand and shrinking cash, the eruption of one quality issue after another has presented a series of of new obstacles. This follows a radical transformation of Boeing’s quality system in 2019 that deliberately eliminated thousands of quality controls during production and reduced hundreds of quality inspector jobs. The idea was to ensure quality with tools and automation during initial installation and to allow mechanics to inspect their own work without a second set of eyes to check.

Ernesto González-Beltrán, the Vice President of Quality whom Boeing brought in from the automotive industry to oversee this major change in its quality system, left the company in December 2020. Connie Kelliher, spokesperson for the International Association of Machinists (IAM) Union said Boeing has recently started hiring quality inspectors again.
