Usuarios de la aerolínea Latin American Wings (LAW) acusan por problemas técnicos en los aviones, irregularidades en los permisos de vuelos, mecánicos a bordo en dudosas condiciones de sobriedad y dificultosos problemas de tiempos. Afectados preparan demanda colectiva contra aerolínea Law y denuncian precario servicio.

Según denuncian los afectados del vuelo LW701 que viajaba desde La Romana hacia Santiago llevan tres días “atrapados” en ese país luego que el avión no despegara por “problemas operaciones”. Además aseguran que no han tenido respuesta de la compañía sobre la fecha en que podrán regresar.

Dificultades operativas

LAW presenta problemas técnicos en sus aviones y los permisos de vuelos de estos estarían negados en algunos países; lo que explica la compleja situación que vive la firma. La aerolínea no puede entrar a Estados Unidos por sí misma, por lo que se ven obligados a realizar un contrato de prestación de servicios con la empresa Extra Airlines, lo cual le permite entrar al país para llegar a sus destinos. LAW utilizaría las normas aeronáuticas de Venezuela, y no las de Chile, para así obtener mayores permisos y libertades en algunos de sus servicios. Debido a su compleja situación, LAW ya no podría comprar combustible para sus aviones de forma sistemática, como suele hacerse, y se vería obligada a realizar la transacción con dinero en efectivo.

Acciones Legales

Tras la situación vivida, Héctor y otros afectados crearon un grupo de Whatsapp mediante el cual se están organizando para presentar una demanda colectiva por los presuntos malos servicios entregados por LAW.

En ese sentido, ya solicitaron la lista de socios de la empresa, de la cual se conoce, según Pulso, la participación del abogado José Manuel Rebolledo, presidente de LAW, Andrés Dulcinelli, gerente general, Héctor Valenzuela, gerente comercial LAW, Luc Van Eyghen, directorio LAW, Vivian Valenzuela, gerente de marketing LAW y Claudia Vásquez, gerente de finanzas LAW.

Azores flies in fifth freedom

The so-called «fifth freedom» is a request from airlines to allow a company to make a route from a third country, in this case, outside the European Union (EU), make a stopover in another country for passenger traffic or load, and continue your flight to another country.

The Fifth Freedom of the Air refers to the right or privilege granted by one state to another to embark or disembark in the territory of the first state of traffic originating or destined for a third state. A chamada «quinta liberdade» é um pedido das companhias aéreas para permitir que uma empresa faça uma rota de um país terceiro, neste caso, fora da União Européia (UE), faça uma parada em outro país para o tráfego de passageiros ou carregar e continuar seu vôo para outro país.

A Quinta Liberdade do Ar refere-se ao direito ou privilégio concedido por um estado a outro para embarcar ou desembarcar no território do primeiro estado de trânsito originário ou destinado a um terceiro estado. Este direito refere-se não apenas ao tráfego de passageiros, mas também ao correio e à carga aérea e está sujeito a acordos entre estados.

El Instituto Dominicano de Aviación Civil (IDAC) ha establecido ejercer el control de los bienes de la aerolínea Pawa Dominicana.

La aerolínea PAWA posee siete Boeing MD-80 en su flota, del cual solo una está operativo. El resto de la flota esta bajo supervisión de mantenimiento y evaluación de las autoridades.

Debido al atraso en los pagosal Estado de República Dominicana, la aerolínea Pawa fue suspendida por un lapso de tres meses. La flota de las aeronaves fueron ubicadas en la Terminal Norte del Aeropuerto Las Américas Dr. José Francisco Peña Gómez.

La IDAC está supervisando junto a un equipo de técnicos el total de la flota de aviones de la compañía. Preveen retomar las operaciones a Sint Maarten, Aruba, Curazao, San Juan, Puerto Rico y La Habana, Cuba.

“Hemos tomado la decisión de poner bajo el control del Instituto Dominicano de Aviación Civil (IDAC), los bienes y propiedades que tiene Pawa en el país, hasta tanto la empresa honre sus compromisos con el Estado Dominicano”, expresó el Alejandro Herrera. Sin embargo, funcionarios de Pawa dijeron que la empresa se acogería a la ley de quiebra.

Herrera dijo que las autoridades de Aeronáutica Civil no tienen un inventario acabado del costo de los equipos y bienes que tiene en el país la aerolínea, bajo la responsabilidad del empresario venezolano Simeón García. El Director General de la empresa es el norteamericano Gary Stone, quien viajó al exterior, tras un compromiso que firmó con las autoridades de Aeronáutica Civil, mediante el cual se comprometió a regresar al país cuando sea requerido tanto por el IDAC como por la Junta de Aviación Civil (JAC). Alejandro Herrera significó que se permitió la salida del país de Stone porque éste por sí mismo no tiene capacidad de acuerdo con el Estado dominicano, sino el propietario de la aerolínea, el venezolano Simeón García, de quien se dijo está en Miami, Florida.

El empresario venezolano Simeón García, es propietario de Pawa Dominicana,como así también de las aerolíneas Aserca y Santa Bárbara Airlines en la República de Venezuela, quien tiene que responder sobre los U$S 7.8 millones de dólares que adeuda al Estado dominicano.

También Pawa Dominicana, que no podrá volar durante tres meses, tiene deudas millonarias con diferentes instituciones privadas de servicios aeroportuarios, incluyendo el Consorcio Aeropuertos Dominicanos Siglo 21 (Aerodom), a cual le debe la suma de U$S 1,5 millón dólares.  AIRWAYS® AW-Icon TXT

The Dominican Institute of Civil Aviation (IDAC) has established to exercise control of the assets of the airline Pawa Dominicana.

The PAWA airline owns seven Boeing MD-80s in its fleet, of which only one is operational. The rest of the fleet is under supervision of maintenance and evaluation of the authorities.
