AIRGWAYS ® Icon-AW

Alitalia receives government aid and avoids bankruptcy

The Italian government has dealt with the crisis experienced by the airline Alitalia with the appointment of three commissioners who will have to draw up an industrial plan to save it from bankruptcy and with a loan of 600 million euros to guarantee its operation in the next six months.

The Council of Ministers approved two decrees with which it establishes an «extraordinary administration» with three commissioners to manage Alitalia for half a year and to grant a loan of 600 million euros to guarantee its continuity in that period.

From now on, Luigi Gubitosi, ex-director of public television RAI, Enrico Laghi, ex-deputy of steel company ILVA, and technician Stefano Paleari, university professor and expert in the air transport sector, will join the company. Its objective will be to elaborate a viable industrial plan with which to clean the accounts and to reactivate an airline, Alitalia, that does not obtain benefits since 2002.

In parallel, the bridge loan approved by the Ministry of Economy and agreed with the European Union (EU) will serve to ensure the operation and operation of Alitalia in the next six months, the time that will last the extraordinary management.

Prime Minister Paolo Gentiloni said at a press conference that the government’s intervention not only responds to the company’s «explicit request», but is an «act of responsibility» aimed at securing a service that he considered «fundamental.»

He clarified that the loan objective should in no way be understood as a «second nationalization», since the airline went private. «The nationalization of Alitalia has been excluded from the outset and we also reject it now,» he said.

Economic Development Minister Carlo Calenda, in charge of appointing commissioners, said that the loan is «the maximum that can be disbursed today» and that Alitalia, after the work of the administrators, should «open up to new buyers.»

«The mandate of the commissioners is very clear. In a short period of time they should be open to expressions of interest from potential buyers to maintain services, routes and personnel and to spend the minimum amount of public money,» the minister urged.

The effort on the part of the public coffers is directed essentially to prevent the worst of the scenarios, the liquidation of a company that Gentiloni considers «a patrimony» of the country.

All to prevent the airline’s fleet from staying on the ground and avoiding a series of «very violent impacts», in the words of Minister Calenda, since Alitalia currently has 4.9 million reserves in operation and transports two million people to month. A \ W

AIRGWAYS ® Icon-AW

Brazil’s airlines may charge checked baggage

The new regulation, announced in December 2016, which allowed companies to charge for any checked baggage, was questioned in court and temporarily suspended before it had a chance to be implemented

Sao Paulo, BRASIL · A court in the Brazilian state of Ceara has overturned an injunction and is now re-allowing Brazilian airlines to charge for checked baggage on domestic flights. The new regulation, announced in December 2016, which allowed companies to charge for any checked baggage, was questioned in court and temporarily suspended.

The latest court decision however allows ticket holders only a 10-kilo hand luggage allowance free of charge and leaves it up to individual airline companies to decide the cost of transporting checked luggage.

Despite the announcement, airline companies have not yet announced their plans or the cost of checking luggage on a domestic flight. According to Brazilian Airline Association (ABEAR) the new measure is a step forward in bringing Brazilian aviation regulations to international standards.

“With the application of the measure established by ANAC (Brazilian National Aviation Agency) the national companies will be able to offer to their passengers the possibility to buy tickets with price equivalent to the type of luggage that it transports,” noted an ABEAR press release after the latest court decision.

“Thus, passengers who travel without luggage will pay less and the passenger who check in luggage will pay only for what they carry,” concluded the release.

The former rules allowed customers with tickets purchased in Brazil to check a maximum 23-kilo bag (domestic) or two 32-kilo bags (international) free of charge.

According to ABEAR, the cost of transporting luggage in the previous regulation was diluted in the ticket prices of all passengers, regardless of whether they traveled only with hand luggage or checked more than one bag.

“With the new measure, tariff justice will be established, companies will be able to make promotions and differentiate their tariffs – previously prohibited,” argued ABEAR when the measure was announced. “This will naturally increase competition between companies, which will benefit all passengers,” added the entity.

Adapting to the new measure, Brazilian airline, GOL, announced in March a new tariff, Light, which would be cheaper, for those not checking in bags. Although the major airlines have announced they are still assessing the new measure, the expectation by aviation experts is that by charges for checked baggage will start before the month-long vacation period in July.

Illustration of Republic Airways Bombardier CS300

AW | 2017 05 03 12:15 | AIRLINES

AIRGWAYS ® Icon-AW

Republic exits Chapter 11 bankruptcy

Republic Airlines parent firm Republic Airways Holdings’ (RAH) has announced that as of April 30 it has exited Chapter 11 bankruptcy proceedings. The Indianapolis-based regional airline holding was forced to seek court protection in early 2016 after a pilot shortage left it unable to carry out its contractual obligations to partners United Airlines, Delta Air Lines, and American Airlines.

Prior to entering Chapter 11, Republic’s debt included USD91.8 million in secured credit, almost USD3.5billion in aircraft and equipment financing, and USD15.3 million in the loan of industrial revenue bonds in connection with the construction of MRO facilities at Milwaukee General Mitchell airport.

Under its plan of reorganisation, Republic’s aims were four-fold: to update its agreements with its mainline partners to secure more realistic financial terms; to withdraw from leases of unsuitable aircraft, namely its fleet of Dash 8-400 and ERJ-145s; streamline its fleet to one unified type and AOC, namely EMB-170/EMB-175; and restructure its debt and secure additional liquidity.

On the first point, Republic revised its Capacity Purchase Agreements (CPA) with each of American, United, and Delta. The airlines have also taken equity stakes in the new holding company, reorganised RAH.

On the latter point regarding AOC consolidation, its Shuttle America (S5, Fort Wayne) unit was formally merged into Republic Airlines in February. Regarding the withdrawal of its ERJ-145 fleet, an objection was filed by lessor Wells Fargo and ALF VI (known jointly as Residco), but as previously reported that objection was rejected. Another objection was filed after the plan was officially approved and has presumably been dismissed.

Under its new structure, Republic has transitioned from a public company, with its shares now distributed amongst its major creditors: 25% by American, 17.35% by Delta, and 19.16% by United. Other claimants, including Embraer and GE Capital, will take a more than 5% stake. In a press release, CEO Bryan Bedford said the airline is starting a ‘new chapter’.

«We have streamlined the airline around a single fleet of E-Jets and a single operating certificate. These operational simplifications, along with restructured commercial agreements with each of our core business partners, has positioned Republic to deliver on its mission,» Bedford said. A \ W

https://i0.wp.com/www.ainonline.com/sites/default/files/styles/ain30_fullwidth_large_2x/public/uploads/2017/03/max10.jpg

AW | 2017 05 02 19:38 | INDUSTRY

Boeing reveals more details on planned design of the Boeing 737-10 MAX

While Boeing Co.  remains coy on its plans to launch a fourth version of its new 737 MAX family, the company has revealed its thinking on perhaps the thorniest problem facing the company as it comes to decision on the new 737-10. The plane would be the largest in the 737 MAX family and is expected to seat 189 passengers in a conventional dual-class cabin and to have a range of 3,000 to 3,300 nautical miles.

The issue the company is wrestling with is a design for a new landing gear. The 737-10 would be 66 inches longer than the 737-9. Those extra inches require Boeing to modify the proposed plane’s main landing gear to ensure adequate clearance of the longer body for takeoffs and landings. It may sound simple, but apparently it is not.

Boeing has a number of goals for the 737-10. First among them a strong challenger to the Airbus A321NEO, a plane designed to carry 193 passengers over a similar range. That said, Boeing wants to limit both the cost of the new plane and get it to market as soon as possible.

Many analysts expect Boeing to launch the plane this summer with a delivery date of 2020. Some potential customers for the 737-10 believe the aircraft has to meet a first delivery date in 2019. Designing a workable landing gear is probably the key to keeping the cost down and meeting a 2019 deadline for first deliveries.

Boeing’s general manager for the 737 MAX program, Keith Leverkuhn, told Aviation Week how the company envisions the landing gear to work:

«[Boeing is focused] the upper portion of the gear as it integrates with the actuator. [Our new design will include] clever folding using a link mechanism at the top. [The lower part of the gear leg will include] an additional shock strut that fits inside the same forging. This moves the contact point aft a little bit. That’s fundamentally what we are doing and yes, it will look like a trailing link gear. We want to make it maintainable, reliable, and we are going to need that gear to get the performance we want out of the -10 but I’m confident in the solution set».

Boeing sees a market of about 1,000 for the 737-10. Is that really enough to build a new plane that may be just an interim solution to the “middle of the market” problem the company is looking at solving with an all-new dual-aisle replacement for the 767 that has been dubbed the 797? A \ W

AIRGWAYS ® Icon-AW

Malaysia Airlines reaches agreement with family of victims of the flight MH17

MALAYSIA AIRLINES MH-017

The flight was shot down in eastern Ukraine in July 2014. It had taken off from Amsterdam and was headed to Kuala Lumpur with 298 people on board, mostly Dutch citizens.

Malaysia Airlines announced Tuesday that it reached an agreement with an Australian family that lost four of its members on the MH17 flight knocked over Ukraine on July 17, 2014 with 298 people on board.

Anthony Maslin and Marite Norris of Perth (southwest of Austrialia) lost their children Evie, 10, Mo, 12, Otis, 8, along with the grandfather of children traveling on Malaysia Airlines Boeing 777.

The airline said in a statement that they reached «a confidential agreement with the Maslin family so that the claim [filed against the company] was withdrawn.» The airline added that it would not reveal details of the agreement «out of respect for the privacy of the family.»

Malaysia Airlines also said that to date, a «substantial number» of victims’ associates reached agreements with the airline while others «continue to seek compensation from lawsuits filed in their respective jurisdictions.»

A lawyer representing the Malaysian six-member families of the MH17 crew told AFP that the airline offered to close the case by proposing an amount of money last June, which was not disclosed, but the families rejected the sum. «There was another proposal in January but we are still considering it,» Saw Wei Siang said Tuesday.

The MH17 flight was shot down in eastern Ukraine in July 2014. It had taken off from Amsterdam and was headed to Kuala Lumpur with 298 people on board, mostly Dutch citizens.

A criminal investigation in the Netherlands concluded in September that a Russian-born BUK missile was fired from ground in an area controlled by pro-Ukrainian rebels in eastern Ukraine and struck the plane. But it does not say who pulled the trigger. The investigation does not directly accuse Moscow of having supplied the missile. Russia denied being involved in the case.

Malaysia Airlines contends that the aircraft was flying in an unrestricted airspace and that it complied with all required regulations. A \ W

The Pax treatment—United effect

Congress of United States uses United incident to crack down on airlines’ treatment of passengers

The shocking images of a passenger on a United Airlines being dragged screaming off an airplane have spurred Congress into action including a piece of legislation that would keep airlines from kicking passengers off a plane once they’ve been seated.

The April 9 incident, in which Chicago Air Police forcibly removed David Dao from a flight from Chicago to Louisville, Ky., in order to find space for four United employees, upset many lawmakers. Video from the plane showed Dao, a doctor in Louisville, arguing with police about leaving the plane. He had been randomly selected to give up his seat so that United employees could get to Louisville for an April 10 flight, but wouldn’t go because he had to get home in order to serve patients.

Police eventually grabbed Dao and pulled him from his middle seat. In the process, Dao was forced into the aisle of the plane and smashed his head against an armrest and an airplane seat. According to his attorney, he suffered a concussion, lost two teeth and needs reconstructive surgery. Among the angry lawmakers is Sen. Chris Van Hollen, D-Md., who signed a letter with 20 other Democratic senators demanding answers from United on the incident.

UNITED AIRLINES AND DELTA AIR LINES COMPANIES ARE INVOLVED IN SCANDALS FOR PAX, ANIMAL AND LOAD TREATMENT

Van Hollen is also taking the lead in finding a legislative way to ensure passengers on full flights can’t be forcibly removed from the plane once they’re on the aircraft.

The freshman senator is circulating a bill he’s calling the Customers Not Cargo Act, which would require the Department of Transportation to update its rule on full flights.

Among the updates Van Hollen wants to see are requiring airplanes to resolve overbooking issues before passengers get on a plane and making it easier for airlines to increase the amount of money they’re able to offer passengers to voluntarily give up their seat. Right now, airlines are limited to offering $1,350 to passengers they involuntarily bump from a plane.

«We should act immediately to ensure that airlines cannot force passengers who have already boarded to leave the plane in order to free up seats for others,» Van Hollen said in a statement. «Instead, they must provide sufficient incentives to encourage passengers to voluntarily deplane.»

He added, «It is outrageous that airlines can bodily remove passengers after boarding rather than providing appropriate incentives to encourage volunteers. Airlines should resolve these common overbooking issues prior to boarding.»

Van Hollen first floated the idea for the bill in the days after Dao’s removal went viral and has been working to get co-sponsors on the bill in the interim.

An aide to Van Hollen told the Washington Examiner the process of getting co-sponsors continues, but wouldn’t give a number on how many senators have joined the proposal.

«We are working to build bipartisan support and haven’t heard from [the Department of Transportation],» the aide said when asked if the senator’s office has heard if the department is taking its own action.

It’s unclear when the bill will be formally introduced in the Senate, but it’s already getting praise from a consumer advocacy group.

Lisa Gilbert, vice president for legislative affairs for Public Citizen, encouraged all members of the Senate to jump on board with Van Hollen’s proposal.

«Airlines and corporations clearly are not people, because if they were, a number of them would have been arrested and prosecuted for assault, theft and/or bad public interactions with their customers,» she said in a statement. «Sen. Van Hollen’s legislation is a timely and overdue step to reassert the rights and importance of the American consumer in the marketplace and in our democracy.»

Vaughn Jennings, a spokesman for Airlines for America, said the industry group didn’t want to comment on legislation it hasn’t seen but argued companies have their best interest at heart, despite the incident that United CEO Oscar Muñoz acknowledged as «unacceptable.»

«The well-being of all our passengers is and will remain the highest priority for airlines, and we are committed to ensuring the highest standards of customer service are achieved,» Jennings told the Washington Examiner. «We continue to caution against unnecessary regulatory actions, which could have unintended consequences for the 2.2 million passengers who take to skies each day.»

Both chambers of Congress also plan to investigate the United incident in more depth in coming weeks. In addition to the Senate letter demanding answers to 11 questions about United’s decision-making that resulted in police dragging Dao from the plane, the House Transportation and Infrastructure Committee plans to do its own oversight work.

Chairman Bill Shuster, R-Penn., and top Democratic Rep. Peter DeFazio, of New York, announced late last week they plan to gather the committee on Tuesday to examine consumer issues in the airline industry sparked by the incident on United. Among the attendees at the hearing will be United CEO Oscar Munoz and multiple other executives from major airlines.

«The oversight hearing will give Committee Members an opportunity to get much-needed answers about airline customer service policies and what is being done to improve service for the flying public,» Shuster said in a statement. A \ W
