Ley aprobada en Congreso entrará en vigencia en Octubre 2020

El Gobierno de la República Argentina promulgó la Ley 27.563 de Sostenimiento y Reactivación Productiva de la Actividad Turística Nacional, aprobada el 1 de Septiembre de 20202 en el Congreso de la Nación, a través del Decreto Nº753/2020 publicado en el Boletín Oficial. La Ley de reactivación turística prevé beneficios fiscales y económicos para las empresas y trabajadores del sector, al tiempo que establece incentivos para los consumidores.

Ley de Sostenimiento y Reactivación del Turismo

Extensión del Programa de ATP (Asistencia al Trabajo y la Producción) desde el 1 de Julio hasta el 31 de Diciembre 2020 para las actividades y rubros comprendidos que se encuentren paralizados o tengan una facturación inferior al 30%.
Reducción del 95% del pago de contribuciones patronales y el salario complementario abonado por el Estado Nacional para los trabajadores en relación de dependencia del sector privado del 50% del salario neto.
Se faculta al Jefe de Gabinete a establecer condiciones especiales para garantizar la continuidad de las fuentes de trabajo y de los emprendimientos turísticos, y a establecer una asistencia económica no reembolsable por un monto de hasta dos salarios mínimos.
Se prorroga por 180 días el vencimiento del pago de los impuestos existentes, o a crearse, que graven el patrimonio, los capitales o las ganancias de las actividades alcanzadas por la ley, cuyos vencimientos operen hasta el 31 de Diciembre de 2020.
Se suspende por 180 días la traba de cualquier medida cautelar a requerimiento de la AFIP o la ANSES.
Se instruye al Banco Central a disponer líneas de crédito para los sujetos comprendidos y para municipios y comunas donde la actividad principal sea el turismo.

Beneficios para los consumidores

Se establece un bono fiscal vacacional para las familias cuyos ingresos mensuales no superen el equivalente a cuatro salarios mínimos, por única vez, para su uso dentro del país.
Regirá una preventa que consistirá en el reconocimiento, por parte del Estado Nacional, de un crédito a favor de las personas humanas, que será del 50% del monto de cada compra de servicios turísticos a ser brindados dentro del país.
Se crea un programa especial para el turismo de la tercera edad, por el cual el Estado aportará hasta el 21% de los paquetes turísticos, con el fin de sostener la actividad durante las temporadas bajas y para el bienestar de las personas mayores.
Se establece un programa de financiación de los paquetes turísticos de viajes de turismo estudiantil con destino nacional mediante una línea de crédito específica del Banco Nación.
Establecimientos hoteleros de alojamiento temporario y empresas de transporte podrán ofrecer la reprogramación de los servicios contratados, respetando la calidad, estacionalidad y valores convenidos dentro de un período de 12 meses; la entrega de vouchers de servicios para ser utilizados hasta 12 meses posteriores al cese de la cuarentena; el reintegro del monto abonado mediante el pago de hasta seis cuotas iguales, mensuales y consecutivas con vencimiento dentro de los 60 días de recibida la solicitud de reembolso.
Si el consumidor contrató servicios mediante intermediarios (agencias de viajes) podrá reprogramar sus viajes o recibir un voucher.
Las reprogramaciones y devoluciones de servicios de turismo estudiantil serán determinadas por el Ministerio de Turismo.

Perspectivas turísticas

Durante los primeros días de Octubre 2020 entrará en curso legal uno de los principales beneficios para viajeros integrados en la Ley de Promoción al Turismo sancionada a principios de este mes, donde la devolución del 50% de los gastos que se hagan este año en reservas turísticas para 2021 mediante un crédito que se podrá usar en más servicios turísticos nacionales, traerá muchos beneficios para lograr una reactivación.

Benefits for consumers
