Gobierno sin definición del PPC a Latam Airlines Argentina
La compañía Latam Airlines Argentina había anunciado el 17/06 que la filial de Argentina iniciaba el proceso de cierre de la aerolínea adhiriéndose al Proceso Preventivo de Crisis (PPC), pero posteriormente el Gobierno había rechazado el PPC. Las audiencias se iniciaron el 8 Julio 2020 tras varias postergaciones, sin arribar a ningún acuerdo de ambas partes.
EL PPC es un sistema previsto en la ley que permite a las empresas pedir que se aplique una reducción de la indemnización a la mitad cuando aparece un caso de fuerza mayor que modifique la actividad, en este caso de la crisis sanitaria mundial, siendo apelable ante la Justicia y ese será el camino que recorrerá Latam Argentina, pero la aerolínea ha tomado la decisión irrevocable de abandonar el país.
Procesos negociaciones
Latam Argentina mantiene negociaciones con los empleadospara acordar retiros voluntarios. El rechazo del PPC por pàrte del Estado ha tomado la iniciativa de numerosos empleados para negociar su salida de la empresa o judicializar su reclamo.
La filial argentina de Latam Airlines ha avanzado en las negociaciones para la devolución de los diferentes espacios tanto de oficinas comerciales como en los aeropuertos donde operaba hasta antes de la pandemia.
Por parte de los gremios han reiterado la imposibilidad legal de producir despidos y por tanto la continuidad laboral y la obligación del pago salarial. Han solicitado la intimación del cumplimiento de pago de los salarios adeudados y la garantía de la continuidad de los puestos de trabajo en orden a la normativa vigente. Además, han exigido detener el desmantelamiento de la empresa de sus oficinas y hangares. Los aviones de la compañía continúan en Aeroparque, pero muchos de ellos son propietarios de los leasors internacionales que serán devueltos.
La compañía
«La decisión que lamentablemente ha debido ser tomada, de carácter irreversible, ha generado presentaciones espontáneas de parte significativa del personal, interiorizándose por la posibilidad de postular al programa de retiro voluntario que estuviera en vigencia hasta el pasado 5 Mayo 2020, situación que nos ha llevado a disponer su reapertura, en las mismas condiciones. Rechazamos que se pudieran haber generado presiones, extorsiones, sometimientos u otro tipo de irregularidades en dicho proceso», dijo el representante de la compañía. Las aeronaves de la compañía están detenidas en la pista del Aeropuerto Jorge Newbery.
Se iniciaron negociaciones con los gremios para trasladar las aeronaves, pues desde el 1 Agosto 2020 empiezan los trabajos de las obras de mantenimiento con el cierre de la estación hasta el 30/11. La línea aérea sostiene que no hay ningún impedimento como para acceder al vuelo hacia otro destino, ya que la empresa ha cumplido con sus obligaciones. No está en concurso ni quebrada como para que se inmovilicen sus activos. Pero los gremios quieren que se conviertan el centro de la negociación. A falta de poder tomar medidas de fuerza por la parálisis aérea que lleva cerca de 130 días, los aviones son un elemento vital para la negociación.
Los pasajeros
La línea aérea comunicó lo siguiente: «Devolución de ticket por canje de millas. El pasajero que canjeó un pasaje con millas podrá realizar la solicitud de devolución en su cuenta Latam Pass a través de latam.com; los impuestos serán abonados en la misma forma de pago utilizada.
Programa Latam Pass: Respecto del Programa de Pasajero Frecuente Latam Pass, la compañía refuerza su continuidad, independiente del ajuste de la operación. La validez y valor de las millas se mantienen intactos, al igual que las opciones de canje aéreo en vuelos de otras filiales del Grupo Latam Airlines y de aerolíneas asociadas.
Canje no aéreo: En cuanto al canje no aéreo, se mantienen las opciones y se agregarán nuevas alternativas. Así mismo, las categorías Elite y sus beneficios continuarán de la misma forma y se respetarán las condiciones para los socios.
Excepción Covid: Por último, debido al contexto de la pandemia de Coronavirus, todos aquellos socios Latam Pass con millas a vencer entre Marzo y Septiembre 2020, sus millas no expirarán y tendrán validez hasta 1 Octubre para canjearlas. En la Argentina se mantiene vigente un acuerdo con el BBVA, que es un socio estratégico en la red Latam Pass».

Juicio a responsables atentado Malaysia MH-017 en Países Bajos
Un 17 Junio 2014 el vuelo MH-017 de Malaysia Airlines sufre un atentado en el espacio aéreo ucraniano controlado por la milicia rusa en el este de la República de Ucrania. El crimen militar ruso, cometido en el Donbass ocupado, cobró la vida de 298 personas. El proceso penal contra los perpetradores está en marcha. El 9 Mayo 2020, el juicio de sospechosos en la catástrofe del vuelo MH-017 comenzó en La Haya. Originalmente se planeó que las audiencias judiciales durarían 25 semanas. Se han dado a conocer los nombres de los tres principales sospechosos del accidente, dos de origen ruso y uno ucraniano: Girkin, Pulatov, Dubinsky y Kharchenko. Año 2014

23 Julio. Ucrania entregó al Consejo de Seguridad holandés la autoridad para investigar técnicamente las causas del desastre.
28 Julio. El Ministerio de Asuntos Exteriores británico publicó una declaración titulada «Mitos rusos sobre MH17», en la que calificó de falsos todos los argumentos de la Federación Rusa en un intento de acusar a Ucrania de la tragedia.
31 Julio. El primer grupo de expertos internacionales, que incluía especialistas de Australia y los Países Bajos, llegó a la escena del accidente después de varios intentos fallidos. Se ha comenzado a trabajar en la repatriación de los cuerpos de las víctimas.

El Senado de Brasil ha aprobado este Miércoles 15 Julio 2020 la Medida Provisional (MP) 925/2020 que establece un plazo de 12 meses para el reembolso de boletos aéreos, crea reglas para reprogramar boletos aéreos cancelados durante la pandemia y trata con ayuda a los sectores aeronáutico y aeroportuario durante la crisis sanitaria. La agenda había sido aprobada por la Cámara de Diputados la semana anterior.
La Medida Provisional todavía regula el pago de tarifas y elimina el recargo de embarque internacional. Aprobado en la forma del Proyecto de Ley de Conversión (PLV) 23/2020, tal medida se dirige a la sanción de la Presidencia de la República. El Senador Eduardo Gomes ha expresado que el MP tiene el objetivo de promover un alivio inmediato en el flujo de caja de las compañías en el sector de las aerolíneas. Enfatizó que, con la crisis generada por el coronavirus, la demanda de vuelos domésticos ha disminuido un 93% y los vuelos internacionales con una caída del 98%. «El artículo es extremadamente urgente y tiene como objetivo transmitir medidas de emergencia para mitigar los efectos de la crisis resultante de la pandemia del covid-19 en la aviación civil brasileña», argumentó el Senador. El MP avanza en puntos importantes y urgentes en el sector de las líneas aéreas. Presentó solo una enmienda editorial para aclarar una referencia legal.

O senador Eduardo Gomes expressou que o MP tem o objetivo de promover um alívio imediato no fluxo de caixa das empresas do setor aéreo. Ele enfatizou que, com a crise causada pelo coronavírus, a demanda por vôos domésticos diminuiu 93% e os vôos internacionais, com uma queda de 98%. «O artigo é extremamente urgente e tem como objetivo transmitir medidas emergenciais para mitigar os efeitos da crise resultante da pandemia da covid-19 na aviação civil brasileira», argumentou o senador. La crisis sanitaria está experimentando un número cada vez más elevado de reclamaciones de usuarios de aerolíneas a nivel mundial. El caos provocado en España ha disparado las reclamaciones de las cancelaciones provocadas por la pandemia de Coronavirus. Las previsiones estiman para finales de 2020 continuarán más complicadas para solucionar las reclamaciones y conflictos entre pasajeros y aerolíneas.
Según la Asociación de Líneas Aéreas (ALA) de España, el caos en los viajes provocado por el Coronavirus ha disparado las reclamaciones a las compañías por las cancelaciones de los vuelos en unas 400.000 solicitudes. Aunque las cifras oficiales no están disponibles, la plataforma Reclamador.es señala que desde el pasado 24 Marzo 2020 lleva tramitadas más de 3.650 reclamaciones por vuelos cancelados por el Coronavirus, de las 10.000 registradas este año. Este panorama, explica Almudena Velázquez, Codirectora legal de la firma, se debe a que las aerolíneas “han intentado imponer al consumidor un bono por el importe del vuelo sin informarles adecuadamente de sus derechos”. La Comisión Europea (CE), ha tomado cartas en el asunto en Mayo 2020 para recordar que los pasajeros pueden pedir la devolución del billete y que solo ellos pueden elegir entre esta opción y los vales. Sin embargo, las compañías niegan malas prácticas y afirman que, poco a poco, están cumpliendo con los reintegros.
Solicitud reembolsos
El estudio Aretxabaleta Abogados, según Ainhoa Bilbao, socia de ha expresado asesora legal de aerolíneas, la situación pudo ser confusa en un primer momento, agravada por la falta de personal y problemas de liquidez. Pero, en general, afirma, “las compañías tienen clara la normativa y la están aplicando”. Algo sobre lo que discrepa Olalla Carballo, abogada experta en consumo, según denuncia, en la práctica, se está dificultando el proceso de solicitud del reembolso, primando el bono o el cambio de fechas del vuelo. Como señala, la emergencia sanitaria por el Coronavirus se considera “una circunstancia extraordinaria”, lo que significa que no hay una compensación extra, pero “el viajero tiene derecho al reembolso del precio del billete en el plazo de siete días”, tal y como recoge el Reglamento Europeo 261/2004 sobre Derechos de los Pasajeros. Si la aerolínea rechaza esta solicitud, explica la letrada, el consumidor tiene dos opciones: presentar una reclamación ante la Agencia Estatal de Seguridad Aérea (AESA) para que emita un informe sobre la procedencia del reembolso (no vinculante), pero de gran ayuda si se litiga, o bien acudir directamente a la vía judicial en un proceso verbal que, si no supera los € 2.000 Euros, no exige abogado ni procurador.
Nuevo procedimiento
El problema de estos litigios es que, aunque afectan a muchísimos pasajeros, son de baja cuantía y se dirimen en los ya sobrecargados juzgados de en lo Mercantil, sobre los que también van a recaer los Concursos de Acreedores. En Madrid, por ejemplo, la media para resolver un asunto es de casi 11 meses, lo que puede disuadir a consumidores de perseguir reclamaciones de € 200 Euros.
El Ejecutivo ha planteado la posibilidad de crear un procedimiento administrativo, desarrollando una ley de 2017, que otorgaría ejecutividad a las resoluciones de AESA. Sin embargo, no convence a los abogados de consumo, que temen la desprotección de los pasajeros. En tanto, Almudena Velázquez expresa que “se tarda entre seis y ocho meses en conseguir una sentencia, y que, además, la mitad de las disputas no llegan a juicio, ello no justifica que se sustraigan del ámbito judicial”. En su experiencia, el proceso con AESA es igual de lento, por lo que sería una solución claramente insuficiente. Además, a falta de más detalles sobre el proyecto, supondría que los jueces expertos en esta materia no revisarían las resoluciones. En cualquier caso, opina Ainhoa Bilbao, está vía no debería ser obligatoria para el consumidor, pues, de lo contrario, “se podría vulnerar su derecho de acceso a la justicia”.
Rebrotes
Las últimas medidas sanitarias aprobadas en diferentes lugares en España para controlar los rebrotes del virus podrían elevar las reclamaciones a las compañías, siendo los casos de aquellos ciudadanos que se queden en tierra por el confinamiento y que no hayan sido previsores contratando un seguro. “La ley no regula el derecho de reembolso en caso de que el vuelo no esté cancelado y sea el pasajero el que no puede viajar”, explica Olalla Carballo. Sin embargo, cree que hay argumentos para defender el reembolso. En primer lugar, se podría alegar que es un caso de fuerza mayor, que suspende la exigibilidad de la obligación de pago. Además, el ciudadano viene obligado a cumplir las restricciones de movilidad. Por último, también se podría invocar la cláusula Rebus sic Stantibus que permite la revisión de los contratos por circunstancias anómalas sobrevenidas.

If the airline rejects this request, explains the lawyer, the consumer has two options: file a claim with the State Aviation Safety Agency (AESA) to issue a report on the origin of the refund (non-binding), but very helpful if is litigated, or go directly to the court in a verbal process that, if it does not exceed € 2,000, does not require a lawyer or attorney.
New procedure
The problem with these lawsuits is that, although they affect many passengers, they are of small amounts and are settled in the already overburdened commercial courts, on which the Bankruptcy Proceedings will also fall. In Madrid, for example, the average time to resolve an issue is almost 11 months, which can discourage consumers from pursuing claims of € 200 Euros.
The Executive has raised the possibility of creating an administrative procedure, developing a 2017 law, which would grant AESA resolutions enforcement. Acreedores aprueban Plan Reestructuración South African Airways
Los acreedores de South African Airways (SAA) finalmente aprobaron el Plan de Reestructuración de la aerolínea, descartando el final de sus actividades por el momento y allanando el camino para la reanudación de sus operaciones. Durante la votación que tuvo lugar el Martes 14 Julio 2020, el 86% de los acreedores votaron a favor del plan que requerirá alrededor de US$ 600 millones del Gobierno sudafricano para rescatar South African Airways. El gobierno sudafricano, el único accionista de SAA, ya ha mostrado simpatía por el plan de reestructuración, principalmente porque involucra a posibles inversores estratégicos dispuestos a inyectar capital en la aerolínea. El Junio 2020, los acreedores votaron a favor del aplazamiento de la decisión de aceptar o rechazar el plan de reestructuración que fue presentado por el rescate Profesionales Empresas en África del Sur (BRP) en el último el día, el 17 Junio 2020.
El anterior Director Comercial de SAA, Philip Saunders, fue nombrado Director Ejecutivo interino de la nueva aerolínea que se espera que surja de la reestructuración. Perspectivas de SAA
El Gobierno de Sudáfrica había expresado que apoyaría el proyecto y que el deseo de participar era precisamente ver que SAA emergiera del proceso de reestructuración, siendo viable y sostenible como una aerolínea nacional. Para eso, sin embargo, será necesario una reestructuración y reducción. Tribunal de São Paulo decreta quiebra de Avianca Brasil
El Tribunal Federal de São Paulo, Brasil ha decretado el Martes 14 Julio 2020 la quiebra de Avianca Brasil / Oceanair Linhas Aéreas S.A., en una decisión tomada por el Juez Tiago Henriques Papaterra Limongi, del 1er Banco de Quiebras y Recuperación Judicial. La aerolínea se había declarado en bancarrota ante el Tribunal de São Paulo seis 6 años atrás, después de más de un año y medio de recuperación judicial llena de agitaciones y disputas comerciales.
Se esperaba la quiebra de la compañía desde los primeros meses de la reorganización judicial, que comenzó en Diciembre 2018, después de cancelaciones de vuelos, paradas de bases, regreso de aviones y la suspensión de operaciones en Mayo 2019. Sin embargo, la compañía, incluso se había ganado la vida, después de que la Justicia de São Paulo rechazara la declaración de quiebra en Septiembre 2019.
Avianca Brasil tenía préstamos de Gol y Latam Airlines Brasil e incluso recibió una propuesta de compra de Azul Linhas Aéreas, todos interesados en sus activos, principalmente las franjas horarias (slots) de la compañía en los aeropuertos de São Paulo/Congonhas y Rio/Santos Dumont. Sin embargo, la crisis causada por la pandemia hizo que la recuperación de la compañía fuera inviable, aún más en un escenario de un sector aéreo financieramente frágil y la caída de la demanda, debido a la pandemia.

The Government of the United Kingdom of Great Britain has approved the development of a seventh airport in Greater London. The currently deprecated airstrip, known as Manston International Airport (MSE/EGMH) until 2014, was acquired by RiverOak Strategic Partners. Development projections for the new airport is to make it fully operational by 2023. Manston International Airport will be incorporated into the six airports that Greater London currently has: London/Heathrow, London/Gatwick, London/City, Southend (Southend-on- Sea in Essex), Stansted (Southend-on-Sea in Essex) and Luton (Bedfordshire).
Manston Airport in Kent is currently underway for a 45-day consultation period to determine the future of the airport. At a distance of over 70 miles, it is the furthest airport from central London, which means it is not likely to be a Londoner’s first choice. Heathrow is only 19 miles away, and even Luton and Southend, the most distant in the city, are less than 40 miles away. The current plan is to have scheduled commercial and private short distance flights, the main objective of the airport is to create a global cargo center that can handle 10,000 cargo movements per year. Before Manston closed in 2014, KLM operated scheduled flights between the airport and its center in Amsterdam Schiphol (AMS). «Once built, Manston will be one of the most modern, efficient and environmentally friendly loading centers in the world», said RiverOak Director of Strategic Partners Tony Freudmann.
As is customary with development plans in the aviation industry, the airport has faced some opposition. Although the government has officially given the go-ahead for development of the new airport, the decision could still be revoked if challenged enough before the end of a six-week deadline.

The Government of the Republic of Sudan has authorized the reopening of flights that follows the easing of restrictions related to the global health crisis and a modest decrease in daily Coronavirus cases. Khartoum International Airport has started some international passenger flights, according to the announcement of Thursday 09/07 by the aviation authorities. The airport will now receive flights from Turkey, Egypt and the United Arab Emirates, the Sudan state news agency reported yesterday.
The decision was approved by the health authorities as the country eases its blockade on the pandemic. Sudan first closed business and restricted the civil movement in April 2020. This week, the Government has begun to relax measures in the capital, Khartoum, and its surroundings. The relaxation comes as the Sudanese economy continues to struggle and inflation has exceeded 100% and the economy is expected to contract this year. The reopening does not mean the end of anti-virus measures in the country. Starting July 14, 2020, the Health Ministry will inspect all visitors, including Sudanese citizens, to the airport, according to the Sudan News Agency.
