Defensoría Pueblo Argentina recomendaciones por cancelaciones

En las últimas semanas se multiplicaron las denuncias de damnificados respecto a cancelaciones de vuelos en medio de una reorganización de la malla aérea en Argentina producto de la reapertura prograsiva de los vuelos en el país. Consejos para proceder a los reclamos justos de los usuarios del transporte frente a las denuncias por falta de respuestas han producido una avalancha de notificaciones. La Defensoría del Pueblo de la Nación ha comunicado que se recepcionaron numerosas denuncias de usuarios de la empresa estatal Aerolíneas Argentinas, que de manera inconsulta ha reprogramado cambios y/o cancelaciones en vuelos establecidos, por lo que muchos pasajeros no han contado con la información al respecto, sin poder acceder a los medios de contactos digitales ni de manera presencial para canalizar los reclamos pertinentes.

Desde la Defensoría del Pueblo de la Nación, en la Provincia de Santa Fe, expresaron: “La institución tomó conocimiento de que usuarios que habían contratado vuelos a través de la aerolínea de bandera recibieron posteriormente una comunicación anunciando el cambio o la cancelación e invitándolos a comunicarte a través de WhatsApp, pero sin indicar a qué número. Aquellos que por sus propios medios lograron conseguir el número, escribieron pero solo recibieron opciones automatizadas que no resuelven el problema y no existe personal para responder estas consultas”, indicó el organismo. Los afectados también señalaron que, al acudir presencialmente a las oficinas de Aerolíneas Argentinas en el Aeropuerto Internacional Rosario, se encontraron con que la misma se encuentra cerrada. Al consultar al personal de la terminal, este señaló que son numerosas las personas que llegan al lugar con el mismo problema. En ese sentido, recomiendan a los usuarios, ir los días y horarios en que hay un vuelo para presentarse ante el personal afectado al mismo. También en las redes sociales, principalmente en la cuenta de Twitter de la aerolínea, se repiten los reclamos en este sentido, que en algunos casos han empezado a tener repercusión en medios de comunicación. La Defensoría del Pueblo recomienda a quienes se vean afectados por esta situación realizar una presentación ante la Administración Nacional de Aviación Civil (ANAC), que es el órgano de control correspondiente. Una vez realizado ello, puede también consultar a la delegación Rosario de la Defensoría del Pueblo de la Nación al correo electrónico inforos@defensoriasantafe.gob.ar.

¿Cómo presentar quejas?

Las quejas deben ser presentadas en forma escrita conteniendo nombre, apellido y domicilio del damnificado y precisan estar firmadas por el mismo o por un representante, en los casos de que aquel se encontrara incapacitado. En el escrito deberá detallarse la naturaleza del problema y las instancias posteriores al mismo, así como también los reclamos y respuestas recibidas si es que se hubieren efectuado. La queja se presenta en el plazo máximo de un año calendario de ocurrido el hecho, acto u omisión motivo de la misma y será acompañada por fotocopia de todos los comprobantes relacionados. Las actuaciones frente a la Defensoría son absolutamente gratuitas y no requieren de la asistencia o firma de abogado. Recibido el reclamo, se enviará una nota donde se informará el número de actuación y el área que llevará adelante el trámite.

Las consultas pueden también hacerse por teléfono desde cualquier parte del país con el costo de una llamada local al 0810-333-3762 y por fax al (011) 4819-1581 o a cualquiera de nuestras oficinas del interior del país. En ambos casos, luego de ser evaluada la cuestión, se solicitará la remisión de la misma por escrito y debidamente firmada, a fin de cumplimentar los recaudos exigidos por el Art. 19 de la Ley 24.284. Las compañías aéreas Air France, KLM Airlines y Martinair Cargo lanzaron el primer Programa Mundial de Combustible Sostenible de Aviación (SAF) para la industria de la carga aérea, permitiendo a los exportadores y agentes de carga participar en la reducción de las emisiones de CO₂ en la aviación. Al invertir en el Programa SAF Cargo, los clientes contribuirán no sólo a estimular una primera fase de utilización del SAF en la industria aérea, sino también a ampliar el mercado de este combustible, por un futuro más limpio para el transporte aéreo. «Nuestro compromiso de reducir las emisiones de CO₂ es uno de los pilares de nuestra estrategia de carga. El primer paso hacia un futuro libre de carbono es el crecimiento neutro en carbono de la industria de la aviación. Esto implica que no debería haber un aumento de las emisiones de CO₂ a pesar del crecimiento del tráfico. Invertir en SAF es una etapa necesaria en este proceso y es uno de los principales instrumentos para reducir las emisiones de CO₂. Desde hace varios años, Air France y KLM lideran la búsqueda de soluciones vinculadas con el uso de combustibles alternativos. KLM operó el primer vuelo comercial del mundo utilizando SAF el 29 de Junio de 2011, con un vuelo que unió el aeropuerto de Ámsterdam/Schiphol con París/ Charles de Gaulle. Air France, el mismo año, operó su primer vuelo utilizando este combustible entre Toulouse y París en el marco del Salón Aeronáutico de París-Le Bourget 2019. Poco después, ambas compañías empezaron a ofrecer a sus clientes corporativos la opción de un viaje de negocios más sostenible promoviendo la innovación en materia de combustible sostenible de aviación.

Los SAF todavía no están disponibles a gran escala. Ryanair busca lobista en España para frenar rescates aerolíneas

La compañía irlandesa Ryanair ha recurrido ante la Justicia Europea por los reclamos de rescate del Gobierno de España hacia Air Europa en pleno proceso de absorción por Iberia. En España, por el momento el Gobierno sólo ha rescatado a Air Europa, aerolínea del Grupo Globalia, a través de dos préstamos por valor de € 475 millones de Euros. El gigante irlandés Ryanair busca un lobista en la península Ibérica para frenar los rescates de las aerolíneas que considera injusto. Mientras tanto, en Bruselas y Dublín, la compañía tiene personal dedicado a los asuntos legales y regulatorios en la Unión Europea (UE), pero no posee ningún representante en España y Portugal para accionar ante los reclamos en un momento clave por las ayudas al sector, sumido en una profunda crisis de los vuelos. Los reclamos ante el Tribunal de Justicia de la Unión Europea (TJUE) por parte de Ryanair contra el Gobierno español están relacionados el rescate de Air Europa sosteniendo que las ayudas o rescates representan una desigualdad ante otras aerolíneas.

Ryanair intenta poner trabas a los rescates aéreos recurriendo a una decena de presentaciones ante el TJUE. Gran parte de los Estados Miembros han comenzado a rescatar a sus líneas aéreas nacionales, asfixiadas por la falta de liquidez. Bruselas está dando aprobación a la mayoría de estas ayudas estatales y, paralelamente, Ryanair ha recurrido ante el TJUE porque cree trato injusto y desleal. Como respuesta, la aerolínea irlandesa ha llevado ante la Justicia Europea al Gobierno español y su Fondo de Apoyo a la Solvencia de Empresas Estratégicas, dotado con € 10.000 millones de Euros para inyectar liquidez a la compañía aérea española Air Europa.

Airbus insta compromiso con aranceles transatlánticos y Brexit

El fabricante de aviones europeo Airbus Group SE ha solicitado que se acaben las disputas diplomáticas separadas sobre la salida de Gran Bretaña de la Unión Europea (UE) y una disputa de subvenciones a aeronaves transatlánticas con The Boeing Company que eclipsan colectivamente su negocio. Sus comentarios se produjeron después de que la industria manufacturera de Gran Bretaña advirtiera de un posible golpe de nocaut si el primer ministro Boris Johnson no puede lograr un acuerdo comercial con la UE antes de que los acuerdos temporales terminaran el 31 de Diciembre de 2020. La cúpula de Airbus ha solicitado compromiso para resolver las diferencias sobre las subvenciones a las aeronaves en la que la UE y los Estados Unidos han impuesto aranceles a múltiples mercancías. «Pedimos una desescalada […] y encontrar un acuerdo a largo plazo entre los Estados Unidos y la UE, y creemos que esto es lo que sucederá. Y sucederá bajo la Administración Biden, pero creo que habría sucedido de todos modos», dijo Guillaume Faury a la Conferencia de Montreal, en Canadá.

Los diplomáticos dicen que la UE y la Administración Trump saliente están en negociaciones serias para poner fin a la lucha comercial de dieciséis años, que ha llegado a su fin justo cuando Gran Bretaña abandona la Unión Europea. Airbus se encontró apretada entre los dos conjuntos de negociaciones comerciales la semana pasada cuando Gran Bretaña detuvo los aranceles sobre las mercancías estadounidenses adoptadas en apoyo de Airbus al completar su salida en la UE. GullivAir es una nueva aerolínea de la República de Bulgaria. La aerolínea británica iniciará su horario de verano boreal 2021 para inaugurar vuelos directos a Buenos Aires y Brasil. A partir del 28 de Marzo 2021, British Airways operará el servicio con un Airbus A350-1000 haciendo escala en Sao Paulo, Brasil, durante una hora aproximadamente. En lugar de operar dos vuelos a la misma región de América del Sur, British Airways ha decidido condensar los vuelos en uno solo. El Gobierno de Croacia ha aprobado una inyección de € 79,7 millones de Euros en su compañía nacional Croatia Airlines con el fin de mitigar los efectos de la pandemia de Coronavirus y la depreciación del mercado de vuelos en el mundo. El Estado ha intervenido recapitalizando la aerolínea con € 46,5 millones de Euros este 14/12, pero también aportará € 33,2 millones de Euros como préstamo de capital.
