Corte Suprema de Chile rechaza acuerdo Latam-AA-IAG Group
La Corte Suprema de Chile rechazó este Jueves 23 Mayo 2019 un acuerdo de Joint Business Agreements (JBA) para negocios conjuntos entre Latam Airlines Group, American Airlines e International Consolidated Airlines Group (IAG). La Fiscalía Nacional Económica (FNE) valoró el fallo de la Corte Suprema que revirtió la aprobación del TDLC y prohibió la alianza entre Latam, British y Iberia, y lo calificó como una noticia positiva para los usuarios. “Esta sentencia es una buena noticia para los pasajeros chilenos, porque impide la monopolización de las más importantes puertas de acceso a Europa y Norteamérica desde nuestro país. Manifestamos nuestra oposición ante el TDLC y reclamamos ante la Corte Suprema la resolución que las aprobó, porque estas alianzas implicaban riesgos que superaban considerablemente a los beneficios esperados”, dijo el Fiscal Nacional Económico, Ricardo Riesco en un comunicado.
Latam Airlines, la mayor aerolínea de América Latina, había anunciado en 2016 un Joint Business Agreements (JBA) con American Airlines e IAG, pero dependían de la aprobación de organismos antimonopolios en el mundo.
El acuerdo JBA recibió la autorización en Octubre 2018 por el Tribunal de Defensa de la Libre Competencia (TDLC) de Chile, pero fue objetada por la Fiscalía Nacional Económica y la Asociación Chilena de Agencias de Turismo. «Se decide que no se aprueban los Joint Business Agreements pactados entre Latam Airlines, American Airlines, Iberia y British Airways, sometidos a consulta del tribunal, en todo aquello relativo al transporte aéreo de pasajeros […]. Se reafirma la imposibilidad de trasladar la aprobación de este tipo de joint venture en otras jurisdicciones a la realidad nacional, pues las condiciones del mercado en que se aprueban aquellos difieren sustancialmente del mercado de transporte aéreo en Chile», dijo la sentencia en un fallo unánime de la asamblea.
Cuando se anunció el acuerdo, la Asociación Chilena de Agencias de Turismo rechazó la medida argumentando la alianza “permitiría a estas aerolíneas controlar el 78% del mercado en la ruta desde Chile hacia Norteamérica y el 64% del mercado hacia Europa». La Corte Suprema de Chile también indicó que la FNE debe estudiar los acuerdos suscritos entre Latam y American Airlines, denominados Alliance Agreement, y tomar las medidas que estime necesarias para resguardar la libre competencia.

The National Economic Prosecutor’s Office (FNE) assessed the decision of the Supreme Court that reversed the approval of the TDLC and prohibited the alliance between Latam, British and Iberia, and described it as positive news for users. «This ruling is good news for Chilean passengers, because it prevents the monopolization of the most important access doors to Europe and North America from our country. We expressed our opposition to the TDLC and we demanded before the Supreme Court the resolution that approved them, because these alliances involved risks that considerably exceeded the expected benefits», said the National Economic Prosecutor, Ricardo Riesco in a statement.

When the agreement was announced, the Chilean Association of Tourism Agencies rejected the measure arguing the alliance «would allow these airlines to control 78% of the market on the route from Chile to North America and 64% of the market to Europe». The Supreme Court Chile also indicated that the FNE should study the agreements signed between Latam and American Airlines, called the Alliance Agreement, and take the measures it deems necessary to safeguard free competition.
