Synergy Group vuelve a presentar EoI para participación en Jet Airways

Synergy Group nuevamente intresada en la aerolínea Jet Airways ha presentado nueva EoI (Expresión de Interés) este Domingo 05/01. El grupo inversor sudamericano había presentado anteriormente su interés, pero los prestamistas decidieron optar por una nueva ronda de EOI después de que otras compañías también habían mostrado interés.

Además de Synergy Group, Turbo Aviation, con sede en Hyderabad, el fondo con sede en Dubai y Hinduja Group están en la carrera por una participación en el operador con conexión a tierra. Sin embargo, por el momento no está claro si es probable que las tres compañías presenten su EoI o no.

Regionalización de Aeroparque

Desde la cartera de Transporte se hizo referencia a la decisión de que los vuelos regionales vuelvan a operar desde el Aeroparque Jorge Newbery. El actual Ministerio de Transporte expresó su extrañeza acerca de por qué el anterior gobierno tomó la decisión de sacar los vuelos regionales de Aeroparque, desfavoreciendo con esa medida a Aerolíneas Argentinas/Austral Líneas Aéreas. American podría enfrentar reclamos de pilotos y azafatas

American Airines ha atravesado los dos primeros cuartos del 2019 en medio de conflictos y reclamos operativos en el áera de Mantenimiento cuando los mecánicos de la compañía se acostumbraron a retrasar intencionalmente los vuelos como una forma de enviar un mensaje a la gerencia derivando en reclamos ante la justicia y oganismos aeronáuticos. American Airlines gana una batalla judicial contra los mecánicos cuando un mecánico de la aerolínea fue arrestado por sabotear un avión, luego de que intentó desactivar el sistema de navegación en un avión. Hacia el 4Q2019 la situación ha mejorado sustancialmente en el Area Mantenimiento, aunque continúan algunos retrazos en su extensa red de rutas.

Pilotos, otra tormenta

Los contratos de trabajo de Piloto y Auxiliar de Vuelo ahora serán modificables. Las negociaciones contractuales se intensificarían entre la administración de la compañía y los sindicatos que representan a los pilotos y azafatas: El contrato con las azafatas representado por la Asociación de Azafatas Profesionales se hizo enmendable a partir del mes de Diciembre 2019. El contrato con los pilotos representado por la Asociación de Pilotos Aliados se hizo enmendable a partir de Enero 2020.

La mayoría de nuestros competidores utilizan un modelo basado en incentivos para mantener la confiabilidad operativa, mientras que la gerencia de American Airlines se aferra a un modelo basado en la coerción. Un acuerdo que incentive efectivamente a nuestros pilotos para mantener la operación y recuperarse rápidamente de las averías equiparía mejor a la aerolínea para competir y tener éxito.

American podría ingesar en otro año complicado para las relaciones laborales con sus pilotos y azafatas ya que sus contratos que se pueden modificar. Tanto la gerencia como los sindicatos puedan llegar a un acuerdo antes de ver los efectos indeseados de reclamos laborales. El enfoque reactivo que la Gerencia ha adoptado con los mecánicos para administrar los conflictos podría complicar el panorama hacia el futuro.

An agreement that effectively encourages our pilots to maintain the operation and recover quickly from breakdowns would better equip the airline to compete and succeed.

American could ingest another complicated year for labor relations with their pilots and hostesses since their contracts can be modified. Both management and unions can reach an agreement before seeing the unwanted effects of labor claims. The reactive approach that Management has taken with mechanics to manage conflicts could complicate the outlook for the future.

Funcionarios despedidos no cobraron la doble indemnización

Tras la nueva dirección en el Grupo Aerolíneas, alrededor de cuarenta funcionarios fueron desvinculados de Aerolíneas Argentinas. El nuevo conflicto se deriva de la doble indemnización que ha regulado el Presidente Alberto Fernández, no debutó bien puertas adentro en Aerolíneas Argentinas. Los cuarentas funcionarios que la nueva gestión ha desvinculado, no se les ha aplicado el pago multiplicado por dos que establece el Decreto 34/2019.

El 13 Diciembre 2019 se había realizado una reunión del Directorio en la que se nombraría a los nuevos directivos de la compañía. Un total de diez funcionarios fueron despedidos. Otros de alta gerencia: cuatro de la gerencia comercial, tres de gestión, cinco de la económica y financiera, cuatro de abastecimiento y logística, dos de asuntos legales, cuatro de recursos humanos, cinco de sistemas, entre gerentes y subgerentes, y uno de recursos técnico y aeronáuticos.

Al primer lote, de los directores, fueron a los primeros que les depositaron el importe. No hubo negociación. A cada uno se les depositó la indemnización simple. Inmediatamente, los directores se dieron vuelta a consultar a los abogados. Entre los abogados laboralistas, la duda es desde cuándo está vigente el decreto. El decreto está vigente desde el 13 Diciembre 2019, justo el día de la legislación por decreto. Los abogados, mayoritariamente, concuerdan que la indemnización comprende a todos los trabajadores del sector privado despedidos sin justa causa que hayan iniciado una relación laboral antes del 13 Diciembre 2019. Ese es el argumento que tomaron los directivos de la línea aérea para rechazar la indemnización simple. Un tema más, a diferencia del sector público Aerolíneas Argentinas y su grupo de empresas son sociedades anónimas, por lo tanto, el derecho que se aplica es el común. Finalmente, la mayoría rechazaron la propuesta. Por otra parte, llegó la propuesta a los gerentes. Con ellos, la cosa fue distinta. Les ofrecieron las indemnizaciones simples, pero, a diferencia de los directores, si renunciaban a la indemnización doble, les mantenía a ellos y a su grupo familiar, una cobertura de medicina privada por seis meses. Hasta el 31 Diciembre 2019, las posturas habían sido diversas, aunque, como los despidos y las propuestas fueron después, aún tenían la posibilidad de rechazar o aceptar el pago indemnizatorio.

Desde la compañía expresaron que «Son negociaciones entre privados y no podemos informar nada», contestaron. Así se abren nuevas controversias sobre los conceptos de liquidaciones de indemnizaciones de los funcionarios despedidos en Aerolíneas Argentinas. Todo parecería indicar que habrá algún procedimiento judicial.

That is the argument taken by airline managers to reject simple compensation. One more issue, unlike the public sector Aerolíneas Argentinas and its group of companies are public limited companies, therefore, the law that applies is the common one. Finally, most rejected the proposal. On the other hand, the proposal came to the managers. With them, the thing was different. They were offered simple compensation, but, unlike the directors, if they gave up double compensation, they kept them and their family group a private medicine coverage for six months. Until December 31, 2019, the positions had been diverse, although, as the dismissals and the proposals were later, they still had the possibility of rejecting or accepting the compensation payment.

From the company, they said that «They are negotiations between private parties and we cannot report anything», they replied. This opens up new controversies about the concepts of compensation settlements of the dismissed officials in Aerolíneas Argentinas. Everything seems to indicate that there will be some judicial procedure.
