Aprueban Plan reestructuración SAA

Acreedores aprueban Plan Reestructuración South African Airways

SAA Restructuring Plan Approved

Creditors Approve South African Airways Restructuring Plan

South African Airways (SAA) creditors finally approved the airline’s Restructuring Plan, ruling out the end of its activities for the time being and paving the way for the resumption of operations. During the vote that took place on Tuesday, July 14, 2020, 86% of creditors voted in favor of the plan that will require around US $ 600 million from the South African Government to rescue South African Airways. The South African government, SAA’s sole shareholder, has already shown sympathy for the restructuring plan, mainly because it involves potential strategic investors willing to inject capital into the airline. In June 2020, creditors voted in favor of the postponement of the decision to accept or reject the restructuring plan that was presented by the Bailout Professionals Companies in South Africa (BRP) on the last day, June 17, 2020.

Former SAA Commercial Director Philip Saunders was named interim CEO of the new airline expected to emerge from the restructuring. Kgathatso Tlhakudi, acting Director General of the Ministry of the Department of Public Enterprises, said the government will soon appoint a transaction consultant to seek strategic partners willing to invest in the airline.

The company’s restructuring needs a US$ 1 million capital injection to pay US$ 175 million in compensation for the rebates; US$ 128 million in layoffs; US$ 99 million to cover payments from lessors, US$ 35 million to other creditors and US$ 164 million of direct injection of capital into the operation. Most of these payments can be made within three years, according to the plan.

SAA perspective

The Government of South Africa had expressed that it would support the project and that the desire to participate was precisely to see SAA emerge from the restructuring process, being viable and sustainable as a national airline. For that, however, a restructuring and reduction will be necessary. After the restructuring process, South African Airways will have only six aircraft in the fleet, initially in this first stage of adaptation to the global health crisis.

From July 2020 to February 2021, the prospect is to maintain only six narrow-body aircraft and 1,000 employees, a very different number from the fleet of 44 aircraft and 5,000 employees that existed before the judicial recovery. After February 2021, the idea is to increase the fleet to 19 aircraft over the next nine months and shortly thereafter receive seven A350-900s that would arrive in December 2021, bringing the fleet to 26 aircraft and the company would have about 2,900 employees. Despite the cuts with the approval of the restructuring process, almost all destinations operated by South African Airways in the country and throughout the African continent will remain operational, as well as nine other intercontinental routes.

SAL herstruktureringsplan goedgekeur

Corte Internacional Justicia respalda a Qatar disputa bloqueo aéreo

International Court of Justice (ICJ) | LinkedIn

ICJ supports Qatar Airways

International Court of Justice backs Qatar air dispute

The International Court of Justice (ICJ), the main UN court, has backed Qatar Airways in a dispute with four neighboring countries that imposed an air blockade more than three years ago. The body based in The Hague, United Kingdom of the Netherlands, rejected on 14 July 2020 an appeal by Bahrain, Egypt, Saudi Arabia and the United Arab Emirates (UAE) against a previous decision of the International Civil Aviation Organization ( ICAO) over sovereign airspace.

ICAO ruled in 2018 that it had jurisdiction to handle Qatar’s claim that its neighbors had violated a convention regulating the free passage of Qatar Airways aircraft through foreign airspace. The four residents of Qatar disagreed, claiming that ICAO was not the proper body to judge in the dispute. The four Arab countries severed ties with the Qatar government in June 2017, accusing the country of backing the extremists, along with other allegations denied by the Qatari government. A series of punitive measures included a ban on Qatar Airways planes from its airspace, the closure of Qatar’s only land border (with Saudi Arabia), and the expulsion of Qatari citizens.

The main regional news service, Al Jazeera, reported that the Qatari government welcomed the ruling on Tuesday 07/14, saying it will lead blocking countries to face justice for violating international aviation rules. «We are confident that ICAO will finally consider these actions illegal. This is the latest in a series of resolutions that expose the blocking countries’ continued disregard for international law and due process. Step by step, their arguments are dismantled and vindicated the position of Qatar», said the Minister of Transport and Communications, Jassim Saif Ahmed Al Sulaiti, in an official statement.

ICAO is now free to continue dealing with the case. The ruling will bring great personal satisfaction to the CEO of Qatar Airways Group, Akbar Al Baker, who is also Secretary General of the Qatar National Tourism Council and CEO of Hamad International Airport and Qatar Duty Free, among other key roles dedicated to national service. The CEO of Qatar Airways expressed in October 2019 at the Trinity Forum in Doha, that the Republic of Qatar «is self-sufficient as an economy, it has made us more independent and proud. And it has shown the world that no matter how small you are, when you it’s about sovereignty, dignity, self-esteem, even a small nation can take on the great nations. We have shown what leadership and stability can do for people. And we have high expectations of our ability to deliver. We lost 18 destinations overnight in the morning and we lost a market of US$ 1.75 billion when the blockade came, but we did not shy away from expansion. We replaced the 18 destinations with 34 new ones. We continue to receive new aircraft and we are putting pressure on Airbus and Boeing to continue to supply our We continue building our infrastructure and thinking about the future. We have no bad intentions with anyone. We want to be the best and work with others. If they take a step towards us, we will take 1,000 steps towards them. But they have put all their cards on the table, which they should never do in diplomacy. You have to keep the door open».

Qatar Airways perspective

During the crisis, Qatar Airways maintained a global network that never fell below 30 destinations. It also helped repatriate nearly two million people.

Qatar Airways plans to resume almost two-thirds of its pre-pandemic network before the end of the month if travel restrictions continue to decrease worldwide. This means that the number of flights would almost double in July 2020 with about 3,500 scheduled, compared to just under 2,100 in June 2020.

Rusia a Corte Europea por derribo MH17

AW | 2020 07 13 14:37 | AIR INVESTIGATION / GOVERNMENT

Russia to European Court for demolition MH17

Netherlands to bring Russia to European Court of Justice for shoot down MH017

The Government of the United Kingdom of the Netherlands has announced a request to appeal to the Russian Federation before the European Court of Human Rights for its alleged complicity in the 2014 shootdown of flight MH-017 of a Malaysia Airlines Boeing 777-200ER.

The Boeing 777-200ER aircraft with registration 9M-MRD was shot down with a Russian-made Buk missile by pro-Russian rebels in the eastern Ukraine, resulting in the deaths of 298 civilians, two-thirds of whom were Dutch. Dutch Foreign Minister Stef Blok said the measure is designed to support individual cases brought by relatives of some of the victims at the European court: «Achieving justice for 298 victims of the shooting down of MH17 is and will remain the maxim government priority. As a government, we have information and evidence that leads to the conclusion of the participation of the Russian Federation», said Stef Blok. By launching an interstate case against Russia, the Dutch government will share all available and relevant information about the shootdown of flight MH17 with the European court to support individual cases brought against Russia, the Foreign Ministry said.

Moscow’s position continues to be in denial of having participated in the shooting down of the plane. In April 2020, a report found that Colonel General Andrei Burlaka, of the Russian Federal Security Service, is one of the Russian officials who allegedly authorized the transfer of the Russian Buk missile launcher that shot down the plane. He is reportedly only two steps away from the chain of command of Chief Alexander Bortnikov of the Federal Security Service (FSB), who reports directly to Russia’s President Vladimir Putin. The suspects, Russians Sergei Dubinsky, Oleg Pulatov and Igor Girkin, and Ukrainian Leonid Kharchenko, are being tried in absentia for their involvement in the tragedy. Leonid Kharchenko, who led a combat unit as Commander in Eastern Ukraine, was arrested on unrelated charges near his home in Eastern Ukraine on March 11, 2020. In May 2020, Igor Girkin, former Colonel of the Service of Russia’s FSB intelligence said it feels a moral responsibility for the disaster.

Malaysia MH-017 Timeline

Malaysia Airlines flight MH-017/MAS-017 was a scheduled passenger flight from Amsterdam to Kuala Lumpur, Singapure, which was shot down on July 17, 2014 while flying over eastern Ukraine. The 283 passengers and 15 crew members were killed. Contact with the plane, a Boeing 777-200ER, was lost when it was about 50 km from the Ukrainian-Russian border, and the wreckage of the plane fell near Hrabove in Donetsk Oblast, Ukraine, 40 km (25 miles) from the border. Malaysia Airlines was the second loss of aircraft during 2014, after the disappearance of flight 370 on March 8, 2014.

The shoot down occurred in the Donbass War, during the Battle at Shakhtarsk Raion, in an area controlled by the pro-Russian rebels. The Ukrainian Air Force had suffered losses from increasingly sophisticated air defense weapons. Responsibility for the investigation was delegated to the Dutch Security Board (DSB) and the Dutch-led Joint Investigation Team (JIT), who concluded that the plane was shot down by a Buk surface-to-air missile launched from pro-separatist control. -Russian territory in Ukraine. According to JIT, the Buk that was used originated from the 53rd Anti-Aircraft Missile Brigade of the Russian Federation and had been transported from Russia the day of the accident, fired from a field in a rebel-controlled area, and then returned to Russia. Based on the JIT findings, the governments of the Netherlands and Australia held Russia responsible for the deployment of the Buk facility and followed legal routes as of May 2018. The Russian government denied its involvement in the downing of the plane, and his explanation of what caused the shoot down has varied over time. Coverage in the Russian media has also differed from that of other countries. Russia blames the Ukrainian Government for allowing civilian flights in a war zone.

Immediately after contact with the plane was lost, the rebel militia in Donetsk claimed to have shot down an Ukrainian military transporter An-26. When it became clear that the wreckage that fell near Hrabove came from a civilian plane, the separatists withdrew this claim and refused to shoot down any aircraft. The DSB and JIT findings are consistent with previous claims by US and German intelligence sources and claims by the Ukrainian government.

Londres incorpora 7mo aeropuerto 2023

AW | 2020 07 11 12:01 | AIRPORTS / GOVERNMENT

Aeropuerto Internacional Manston incorpora al gran Londres

RSP | RiverOak Strategic Partners

London incorporates seventh airport in 2023

Manston International Airport incorporates Greater London

The Government of the United Kingdom of Great Britain has approved the development of a seventh airport in Greater London. The currently deprecated airstrip, known as Manston International Airport (MSE/EGMH) until 2014, was acquired by RiverOak Strategic Partners. Development projections for the new airport is to make it fully operational by 2023. Manston International Airport will be incorporated into the six airports that Greater London currently has: London/Heathrow, London/Gatwick, London/City, Southend (Southend-on- Sea in Essex), Stansted (Southend-on-Sea in Essex) and Luton (Bedfordshire).

Manston Airport in Kent is currently underway for a 45-day consultation period to determine the future of the airport. At a distance of over 70 miles, it is the furthest airport from central London, which means it is not likely to be a Londoner’s first choice. Heathrow is only 19 miles away, and even Luton and Southend, the most distant in the city, are less than 40 miles away. The current plan is to have scheduled commercial and private short distance flights, the main objective of the airport is to create a global cargo center that can handle 10,000 cargo movements per year. Before Manston closed in 2014, KLM operated scheduled flights between the airport and its center in Amsterdam Schiphol (AMS). «Once built, Manston will be one of the most modern, efficient and environmentally friendly loading centers in the world», said RiverOak Director of Strategic Partners Tony Freudmann.

As is customary with development plans in the aviation industry, the airport has faced some opposition. Although the government has officially given the go-ahead for development of the new airport, the decision could still be revoked if challenged enough before the end of a six-week deadline.

Reapertura aviación Sudán

AW | 2020 07 11 11:37 | AIR TRAFFIC / GOVERNMENT

Sudan aviation reopening

Republic of Sudan reopens the country’s airports

The Government of the Republic of Sudan has authorized the reopening of flights that follows the easing of restrictions related to the global health crisis and a modest decrease in daily Coronavirus cases. Khartoum International Airport has started some international passenger flights, according to the announcement of Thursday 09/07 by the aviation authorities. The airport will now receive flights from Turkey, Egypt and the United Arab Emirates, the Sudan state news agency reported yesterday.

The decision was approved by the health authorities as the country eases its blockade on the pandemic. Sudan first closed business and restricted the civil movement in April 2020. This week, the Government has begun to relax measures in the capital, Khartoum, and its surroundings. The relaxation comes as the Sudanese economy continues to struggle and inflation has exceeded 100% and the economy is expected to contract this year. The reopening does not mean the end of anti-virus measures in the country. Starting July 14, 2020, the Health Ministry will inspect all visitors, including Sudanese citizens, to the airport, according to the Sudan News Agency. Flights from the countries mentioned are allowed because their airports are open and they agreed to let Sudanese planes use their airspace. Repatriation flights for Sudanese citizens in other countries in Africa and Asia will also continue, Sudan Civil Aviation Authority Director Ibrahim Adlan told the agency.

Argentina acuerdo convenio Flybondi

AW | 2020 07 10 13:30 | AIRLINES / GOVERNMENT

Argentina agreement Flybondi agreement

Government-Flybondi establish freezing agreement wages/parity

The Government of Argentina has approved to continue the salary reductions and to freeze joint ventures at Flybondi Líneas Aéreas. In a convulsed aviation market, the government has taken steps to ensure that the budget airline continues to receive oxygenation through mitigation measures in a flexible agreement with the company union.

Flybondi has adopted new measures to mitigate the economic impact of the pandemic and has reached an agreement with the company union to extend the suspensions by July, August and September 2020, with a salary reduction of up to 35% and the virtual freeze of the parities until the end of 2020.

The agreement was presented this Wednesday 08/07 in virtual form before the Ministry of Labor, where they see with interest the survival of the low cost airline in a complicated scenario for the Government, after the announced departure of Latam Airlines Argentina, which have tarnished the commitments of the future of commercial aviation.

Initially, Flybondi had presented its crisis system to the labor portfolio four days before Decree 329/20, by which dismissals due to force majeure were prohibited and licenses were authorized with deductions in wages negotiated with the unions under the Article 223 Bis, a model resisted by the aeronautical unions that authorized cuts of up to 25% to personnel without tasks.

Flybondi was a pioneer in the salary reduction model envisaged by the Government in the context of quarantine. Faced with the brake on the commercial activity since March 2020 due to the health emergency and the isolation imposed on the firm’s base of operations at El Palomar Airport, the understanding highlights a clear vocation on both sides to deploy a defensive strategy for the level of employment, preserving valuable human and technical resources for when operations must be reactivated, without prejudice to having to discontinue all daily work shifts and for all the specialties that make up this organization and that are represented as a whole by the union entity, except those tasks scheduled and to carry out the technical maintenance of the aircraft fleet and/or operational and commercial derived from this surprise and immediate mentioned stoppage.

The Flybondi Workers Association this week approved the agreement in a meeting via teleconference and ordered that it be individually endorsed by its affiliates to give it greater support in the face of unanimous rejection by the air unions of the wage cuts.

Latam Group inyecta capital

AW | 2020 07 09 15:58 | AIRLINES / GOVERNMENT

Latam Airlines Group has added US$ 1.3 billion to the bankruptcy financing proposal, while the Brazil unit seeks protection. The largest group of Latin American airlines of Latam Airlines has announced on Thursday 09/07 that it has obtained an additional US$ 1,300 million for its financing proposal before a Bankruptcy Court in New York, while adding its unit in Brazil to the debt restructuring process.

Latam Airlines Group filed for bankruptcy protection in May, with the aim of reordering a debt with a liability of US$ 18 billion. It was the world’s largest airline to date seeking an emergency reorganization due to the Coronavirus pandemic. The announcement brings relief about an additional US$ 1.3 billion in financing from Oaktree Capital Management LP and its subsidiaries, enough to meet the company’s financing requirements amid the crisis. The company had already secured US$ 900 million for the Cueto Group and Qatar Airways shareholder process. «Combined […] it is expected that no financial support from governments will be required», the company said in a statement early Thursday 09/07.

Latam Airlines subsidiaries

The proposal still required the approval of the US Court of Justice. Latam Airlines Group also announced that it would add its unit in Brazil to the bankruptcy protection process in the United States, calling the measure a «natural step in light of the ongoing COVID-19 pandemic».

The airline’s subsidiaries in Chile, Colombia, Peru, Ecuador and the United States joined the Chapter 11 process after the company’s initial bankruptcy announcement in May. «LATAM Airlines Brasil will continue to operate passenger and cargo flights as normal, as LATAM Airlines group and its affiliates have done since entering Chapter 11», the statement said.

Three of Latin America’s largest airlines, Latam Airlines, Aeroméxico and Avianca Holdings, are now in Chapter 11, as governments have avoided potential rescue packages. Analysts expect a change in the post-crisis outlook in the region with fewer competitors and higher prices.
