DOT aplicaría sanciones debido cancelaciones y retrasos

El Departamento de Transporte (DOT) de Estados Unidos podría tomar fuertes medidas contra las aerolíneas, ante el reclamo de los Senadores Alex Padilla (D-Calif.) y Elizabeth Warren (D-Mass.), debido el incremento de las tarifas en vuelos nacionales, las cancelaciones y retrasos. Los Senadores enviaron una carta a Pete Buttigieg, Secretario del DOT pidiendo aplicar sanciones con las compañías aéreas por sus fallas operativas: «Escribimos para instar al Departamento de Transporte a utilizar plenamente su autoridad legal para proteger a los consumidores y promover la competencia en la industria de las aerolíneas», expresa la carta enviada al Departamento de Transporte de Estados Unidos. Además, reclaman por el aumento en las tarifas que alcanzaría ya el 34.1% en Junio 2022 para vuelos nacionales. «Después de recibir decenas de miles de millones de dólares en asistencia de los contribuyentes estadounidenses, las principales aerolíneas han correspondido aumentando drásticamente los precios de los boletos y alcanzando nuevos mínimos en el trato a los viajeros», señalan los Senadores en la misiva.

También hicieron mención a los beneficios que les otorgó a las aerolíneas el Gobierno cerca de los US$ 58 mil millones en subvenciones federales. «Para poner fin a estas prácticas dañinas para el consumidor y salvaguardar la competencia en la industria, el departamento debe desempeñar un papel de liderazgo mediante el uso agresivo de la autoridad que le ha otorgado el Congreso», manifiestan los Senadores.

El DOT dio respuesta diciendo que últimamente ha tenido la colaboración de las aerolíneas y que han contribuido a la solución con horarios más razonables por parte de los transportistas, aumentando su enfoque en el servicio al cliente y aumentando el salario de los trabajadores. «El DOT continuará tomando medidas para proteger los derechos de los pasajeros de las aerolíneas y los derechos de los consumidores, y cuando las aerolíneas no cumplan con sus responsabilidades, serán responsables», indicó el DOT.

En el caso de la aerolínea United Airlines, el CEO Scott Kirby, ha pronosticado los retrasos y cancelaciones de vuelos hasta el próximo año, aunque irán mejorando de manera gradual sus horarios y salidas a tiempo con la contratación de personal. «Nuestra suposición básica es que mejorará gradualmente y no volveremos a la utilización normal y los niveles normales de personal hasta el próximo verano», dijo Scott Kirby.

Sancionan por contratos que vulnerarían derechos de usuarios

La Superintendencia de Transporte de Colombia ha iniciado algunas investigaciones de las cláusulas que están prohibidas expresamente por ley en condiciones se podrían afectar los derechos de los usuarios del transporte aéreo. Las acciones involucrarían sanciones a diecinueve aerolíneas por una suma total total de COP$ 1.478.099.196. Como resultado de veinticuatro investigaciones administrativas, adelantadas por el presunto incumplimiento a las disposiciones del Estatuto del Consumidor que prohíben la inclusión de cláusulas abusivas en los contratos, la Superintendencia de Transporte sancionó a diecinueve aerolíneas, exoneró de responsabilidad a otras cuatro y existe un caso más que sigue en curso.

“La labor oficiosa realizada por la Superintendencia en la detección de cláusulas abusivas en los contratos de transporte de 24 aerolíneas, es muestra de que la supervisión administrativa resulta fundamental para promover la efectiva realización de los derechos de todos los usuarios del sector y defender el interés general previsto en la normatividad. Trabajamos con rigurosidad para que todos como viajeros podamos acceder a un servicio de transporte aéreo en el que impere el cumplimiento de la ley y así evitar desequilibrios injustificados”, señala el Superintendente de Transporte, Wilmer Arley Salazar Arias.

En Febrero y Marzo de 2021, la Superintendencia de Transporte inspeccionó las páginas web de las aerolíneas que operan en el país, con el propósito de verificar la disponibilidad y el contenido de sus contratos de transporte, a los que tenían acceso los usuarios. Fue así como se revisaron 69 cláusulas contractuales, encontrando que 56 de ellas contenían disposiciones abusivas como, por ejemplo, la limitación de la responsabilidad de las aerolíneas y la renuncia de los derechos de los usuarios, lo que podría generar un desequilibrio injustificado en perjuicio de los viajeros, afectando el tiempo, modo o lugar en que podían ejercer sus derechos. Entre las aerolíneas sancionadas están: Wingo, Latam Airlines, Aeroméxico, Air Europa, Air France, Avianca Airlines, Avior Airlines, Copa Airlines, Easyfly, Viva Air, GCA Airlines, Iberia Líneas Aéreas, JetBlue Airways, KLM Airlines, Satena Airlines, Turkiyë Airlines y United Airlines.

Cargos

El Artículo 42 de la Ley 1480 de 2011 de Colombia define las cláusulas abusivas como aquellas que producen un desequilibrio injustificado en perjuicio del consumidor y las que, en las mismas condiciones, afecten el tiempo, modo o lugar en que el consumidor puede ejercer sus derechos, prohibiendo expresamente su inclusión en los contratos celebrados con los consumidores.

Algunas de las cláusulas encontradas en los contratos publicados por las aerolíneas:
Desconocían la responsabilidad solidaria en los casos en que se operan vuelos bajo la figura de código compartido.
Disminuían las obligaciones de la aerolínea en la ejecución del contrato de transporte.
Afectaban el respeto a las reservas realizadas en debida forma por los pasajeros.
Omitían dar a conocer a los usuarios los cambios o novedades que se producían en el vuelo.
Limitaban la responsabilidad en el transporte del equipaje.
afectaban el derecho a obtener reembolsos según la normatividad aplicable.
Restringían el derecho a obtener compensaciones en los casos previstos en la ley.
No proporcionaban información completa, veraz e idónea sobre la forma en que los pasajeros podían ejercer sus derechos cuando surgieran conflictos derivados de la interpretación o ejecución del contrato de transporte.

Sanciones aplicadas

Como resultado de lo anterior, el monto de las sanciones impuestas a las diecinueve aerolíneas encontradas responsables de incluir cláusulas abusivas en sus contratos de transporte, suman un total de COP$ 1.478.099.196 y, además, la Superintendencia de Transporte orden aa algunas aerolíneas ajustar, en un término de cinco días, las cláusulas contractuales calificadas como abusivas. Otras investigadas procedieron, durante la actuación, con los ajustes del caso.

In February and March 2021, the Transportation Superintendence inspected the websites of airlines operating in the country, in order to verify the availability and content of their transportation contracts, to which users had access. Charges

Article 42 of Law 1480 of 2011 of Colombia defines abusive clauses as those that produce an unjustified imbalance to the detriment of the consumer and those that, under the same conditions, affect the time, manner or place in which the consumer can exercise their rights, expressly prohibiting its inclusion in contracts concluded with consumers.

Some of the clauses found in the contracts published by the airlines:
They were unaware of joint and several liability in cases where flights are operated under the figure of shared code.
The obligations of the airline in the execution of the transport contract were reduced.
They affected respect for reservations duly made by passengers.
They failed to inform users of the changes or developments that occurred on the flight.
They limited the responsibility in the transport of the luggage.
affected the right to obtain reimbursements according to the applicable regulations.
They restricted the right to obtain compensation in the cases provided by law.
They did not provide complete, truthful and suitable information on the way in which passengers could exercise their rights when conflicts arising from the interpretation or execution of the transport contract arose.

Sanctions applied

As a result of the foregoing, the amount of the sanctions imposed on the nineteen airlines found responsible for including abusive clauses in their transport contracts, add up to a total of COP$ 1,478,099,196 and, in addition, the Superintendency of Transport ordered some airlines to adjust, in a term of five days, the contractual clauses qualified as abusive. Other investigated proceeded, during the action, with the adjustments of the case.
