Corte Suprema caso PLUNA

AW | 2021 07 09 01:47 | AIRLINES / GOVERNMENT

Supreme Court PLUNA case

Uruguay Supreme Court confirms conviction of ex-CEO of BROU

The sentence of twenty months in prison of the former Executive Director of the Banco República de Uruguay (BROU), Fernando Calloia, was confirmed on Tuesday 06/07 by the Supreme Court of Uruguay, thus extinguishing the chain of appeals available to the accused involved in scandal to buy planes from the Uruguayan airline PLUNA Líneas Aéreas.

Fernando Calloia was found guilty of abuse of functions by granting a guarantee of US$ 12 million to the firm Cosmo Lineas Aereas, for the acquisition of the aircraft belonging to the former flag carrier PLUNA. The sentence also includes a fine of UY$ 1,337,000 Uruguayan Pesos/US$ 30,560 and the disqualification from holding public office for two years. But Fernando Calloia will not have to serve any actual prison time because he has been granted parole. Calloia was president of the BROU during the government of José Mujica.

At the time of its liquidation, in 2012, PLUNA accumulated a liability of US$ 300 million, and in an attempt to recover something, the company’s seven aircraft were put up for auction. On October 1, 2012, during the auction, Hernán Calvo Gómez, representing Cosmo Lineas Aereas, wanted to buy the planes. Calvo Gómez was the godfather of the grandchildren of Juan Carlos López Mena, owner of Buquebús, who wanted to take charge of the planes and acted through this other company.

The ruling of the Supreme Court of Uruguay on Tuesday 06/07 was unanimously supported by its five members. The Court of Appeals had indicated that Fernando Calloia acted deliberately and consciously to make the presentation of the Cosmo company viable in a clearly abusive and arbitrary manner, which was later shown to be linked to the owner of Buquebus, Juan Carlos López Ore.

Fernando Calloia ordered the then Manager of the BROU business division, Raúl García, to grant the endorsement after receiving the call from the then Minister of Economy, Fernando Lorenzo, so the bank’s technical services skipped each and every one of the most elementary rules of prudence that banking activity should have. Raúl García had testified that he had informed Calloia that the conditions for the guarantee were not met. «Calloia tells me that it was a matter of national interest […] that he had the consent of the bank directors necessary to do so». He has also stated that López Mena was the one who reported that he issued the documents in the name of Cosmo Líneas Aéreas, a firm that notoriously served as a front, according to the prosecution.

Fracaso reunión aéreas argentinas

AW | 2021 07 06 18:47 | AIRLINES / GOVERNMENT

Argentine air meeting failed

Government-airlines without agreements for air quotas

The Government of Argentina, the airlines together with the International Air Transport Association (IATA) have met this Tuesday 06/07 in the morning in a virtual way to try to reach an agreement regarding the air traffic quota imposed by the authorities on June 25, 2021, which limits 600 passengers per day with a maximum for entering the country, which generated a strong claim from Argentines stranded abroad. The meeting lasted a few minutes to establish the approaches of both parties. There has been no announcement or definition on determinations with the number of flights from abroad that can land in Argentina and the passengers who are stranded.

On behalf of the national government, the head of the National Civil Aviation Administration (ANAC), Paola Tamburelli; and the Secretary of Planning, Gastón Jaques. While in representation of Iata participated María José Taveira, regional representative of the entity in Argentina, Paraguay and Uruguay; Alejandro Muñoz Torres, Member of Foreign Relations for Latin America and the Caribbean; Lars Pottgiesser, Head of Business Development for the Americas region. The Minister of Transportation, Alexis Guerrera, neither Peter Cerdá, IATA Vice President for the Americas, nor the Chief of Cabinet of Ministers, Santiago Cafiero, whose presence had been demanded by both IATA and JURCA (Chamber of Air Lines in Argentina) were not present.

The IATA association has insisted on lifting the imposed passenger quotas for international flights, as well as knowing what will happen next week with the end or not of the restrictions on air quotas by 07/12.

On June 30, 2021, the airline companies association had refused to participate in a meeting when they warned that the Chief of Staff, Santiago Cafiero, would not be present, who was responsible for signing Administrative Decision No. 643, which reduced from 2,000 600 the number of foreign passengers that can enter Argentina per day.

“Of course IATA represents the interests of the airlines. They proposed to reduce the restrictions on flights in the Argentine Republic. We explain that this has to do with caring for the life and health of Argentines. Doing an analysis of the epidemiological evaluation, which of course results in the imposition of the necessary measures to guarantee them”, explained Paola Tamburelli, from the ANAC.

The restriction on the return of tourists who are abroad left thousands of Argentines outside the country without a certain date of return to the country. The Argentine Government has not yet authorized any international air operation after July 12, 2021. From the ANAC, the governmental body that administers civil aviation, they indicated that the rearrangement of passengers is a decision that corresponds to each airline, but from the airlines they maintain that the limitations of the quotas, also limit the return of the passengers stranded abroad.

EEUU obliga aéreas reembolso equipaje

AW | 2021 07 05 06:38 | GOVERNMENT / AIRLINES

United States will force air baggage reimbursement

Airlines will refund money for delayed luggage

The Federal Government of the United States seeks that airline customers are protected from possible abuses in the sector, given the increase in air traffic. With this measure by the Joe Biden Administration, it is intended that passengers are more protected in case their luggage arrives late. United States airlines operating in the country must compensate for the delay in the delivery of luggage for which they charge an extra and do not arrive at their destination on time.

The new measures applied to commercial aviation seek to protect consumers and also promote fair competition. In the framework of a press conference by Brian Deese, Joe Biden’s Economic Advisor, «these rules, specifically, will ensure that if a passenger pays for luggage, they must receive that money back if the suitcase does not arrive on time». With these new measures, it is not only intended that this applies to things related to luggage, but also if a passenger pays for a service such as Wi-Fi and it does not work, they will quickly receive that money back. Brian Deese explained that these two measures are part of a package that the US president will make public soon and will be sent to the Department of Transportation (DOT) for implementation with the aim of promoting greater competition and lowering prices for consumers. The government package will also include an obligation to report baggage and cancellation costs transparently and in advance so that consumers clearly understand the fees and what they are actually paying for.

This announcement is made within the framework of the increasingly notorious opening of commercial air travel at all airports in the country. Last year with social distancing, airlines had to stop their operations, severely affecting their finances. Unlike the previous year, airlines are slowly recovering from the economic downturn they experienced last year, which is why the International Air Transport Association (IATA) reported fewer losses in the first quarter compared to consumption in the same period. from the previous year. With the arrival of the boreal summer, the number of flights will be greater and there may be saturation, so it is possible that many users will be affected by luggage delays, which is why the government is already taking the necessary measures to avoid the abuses.

Récord de tráfico aéreo Estados Unidos

AW | 2021 07 04 17:17 | AIRLINES / AIR TRAFFIC

2,2 millones pasajeros fin de semana del 4 Julio 2021

AW-7000004

United States air traffic record

2.2 million passengers on the weekend of July 4, 2021

A record 2.2 million people flew during this weekend of July 4, 2021 commemorating the Independence of the United States. It is the highest amount of weekend traffic since the start of the pandemic, exceeding an additional 12,000 users than the same weekend in 2019.

Although traffic has reached higher levels, for the second weekend in a row there have been cancellations and interruptions that hit US airlines hard, mainly Southwest and American Airlines. On Friday 07/02, Southwest, a more accepted airline, had more flights canceled than any other airline in the world. Southwest canceled 194 flights, or 5% of its schedule, on 07/02 and delayed 1,400 additional flights reaching 39% of its total flight network. American Airlines was just behind Southwest, with 180 cancellations and 1,212 delays. Things improved a bit for Saturday night 07/03, with Southwest canceling 73 flights and delaying 1,171, or 35% of its total flights. American had 63 cancellations and 736 delays. Among America’s five largest domestic airlines, these two have been especially challenged in the era of travel at the end of the pandemic. The other three carriers, Delta Air Lines, United Airlines, and Alaska Airlines, have done considerably better.

On Saturday night, when the worst of the holiday weekend fever seemed to be subsiding, a minor water leak at New York’s John F. Kennedy International Airport led to several hundred additional flights being delayed or diverted within and out of that airport.

Argentina will bring more Sinopharm

Aerolíneas started operating 8 million doses of Sinopharm

Aerolíneas Argentinas will bring from China a total of 8 million doses of the Sinopharm vaccine on ten flights. The first of the ten flights departed this Friday 07/02 at 12:59 pm and is scheduled to return on Sunday 07/04 around 07:00 pm with the first shipment of 800,000 doses of the Sinopharm vaccine.

The Airbus 330-200, registration LV-FVH, of Aerolíneas Argentinas under flight number AR1070, took off from Ezeiza International Airport at 12:59 p.m. and is scheduled to return on Sunday 07/04 around 07:00 p.m. with the first shipment of 800,000 doses. Aerolíneas Argentinas began an operation to transfer 8 million doses of the Sinopharm vaccine from China in ten flights that will take off from here to July 15, 2021, the first of which departed this Friday 02/07, while the others will take place from the middle of next week at the rate of one service per day.

The flight departure was confirmed this Friday morning by CEO Pablo Ceriani of Aerolíneas Argentinas. “July arrived and excellent news for the vaccination campaign. We are going to carry out ten airline flights to China to bring 8 million doses of Sinopharm to the country. The first will take off today at 12:59 p.m., the remaining 9 will depart consecutively from July 7 to 15. These 10 flights are great news because in a period of a few days Argentina will have a huge number of new doses, which will allow this unprecedented vaccination campaign to be accelerated even more. A year ago we flew to China for the first time to bring medical supplies, today we are preparing an unprecedented operation with ten consecutive flights to bring vaccines to the country. Three of our A330s will be dedicated to this task and will make the route to Beijing with a technical stopover in Madrid. Since we began this logistical task, we have carried out 28 operations, bringing to the country more than 15 million doses. Having a flag airline allows the country to have a quick and effective response to each operational need in the transfer of vaccines”, said Pablo Ceriani.

Three Airbus 330-200 aircraft from the company’s long-range fleet will be used for the dose transport operation over the next three months. The series of trips began this Friday 02/07 with the departure of flight AR1070 from Ezeiza, following the same route as the previous flights destined for Beijing: an intermediate technical stopover in Madrid, Spain. The other nine subsequent flights will repeat the same scheme, from the middle of next week and on consecutive days.

The 8 million vaccines are part of the recently closed agreement with the China National Pharmaceutical Group Corp through which 24 million vaccines will arrive in the country between July and September 2021. Aerolíneas Argentinas has completed a total of twenty-one flights to Moscow until 02/07 in which 11,263,375 doses of the vaccine produced by the Gamaleya Institute were transported. In addition, from Beijing, a total of 5,195,200 arrived in the country in 7 flights. Thus, in 28 operations a total of 16,458,575 doses were brought.
