Americanos atrapados en Venezuela en medio disputa diplomática

Cientos de ciudadanos de Estados Unidos se encuentran atrapados en la República de Venezuela en medio de la pandemia del Coronavirus y las negociaciones entre Washington y Caracas para repatriarlos están siendo bloqueadas por las maniobras del régimen del Presidente venezolano Nicolás Maduro por conseguir que la Administración Trump levante las sanciones contra la aerolínea estatal venezolana Conviasa.

Venezuela ha rechazado las ofertas del Departamento de Estado de Estados Unidos para organizar vuelos directos desde Estados Unidos y Caracas, o a través de terceros países como España o México, para trasladar a los ciudadanos venezolanos varados en el país norteamericano y a los estadounidenses atrapados en el país sudamericano. Alrededor de unos 800 ciudadanos estadounidenses que se encuentran atrapados en Venezuela han solicitado ayuda para regresar a Estados Unidos.

La República de Venezuela, cuyo sistema de salud se encuentra en total colapso, está muy mal posicionada para atender la crisis sanitaria provocada por el COVID-19. La mayoría de sus hospitales enfrentan problemas de suministros de agua, electricidad e insumos médicos y el país cuenta con poco más de 300 respiradores artificiales. Los intentos por repatriar a los estadounidenses se encuentran estancados en medio de la insistencia del régimen de que los vuelos sean realizados por la línea aérea estatal venezolana Conviasa, la cual fue sancionada por la administración Trump en febrero, dijeron las fuentes consultadas.

Estados Unidos lidera una coalición internacional de casi 60 países que desconoce la legitimidad del actual Presidente venezolano Nicolás Maduro, considerando que el líder opositor Juan Guaidó es el verdadero jefe de Estado de Venezuela. Carlos Vecchio, Embajador del Gobierno interino de Guaidó en Estados Unidos, dijo en una entrevista que su equipo ha estado trabajando con la Administración Trump para organizar los vuelos para repatriar a los venezolanos varados en Estados Unidos. “Hemos logrado con los Estados Unidos dos aviones gratuitos, saliendo de Miami, y yendo hacia México, y llegando a Venezuela y simplemente el régimen no les deja aterrizar. También hemos hablado, en su oportunidad, con las líneas aéreas privadas que estaban dispuestas ir a Venezuela, con los tickets aéreos que ya tenían estos venezolanos, y simplemente el régimen al cerrar el espacio aéreo, al no permitirles ir, pues no pueden ir a Venezuela”, expresó Carlos Vecchio.

El régimen de Maduro, por su parte, insiste que ya ha ofrecido resolver el problema, versión que volvió a circular el Jueves 20/08 cuando el Canciller Jorge Arreaza, reiterara a través de su cuenta de Twitter que Venezuela estaba dispuesta a repatriar a los ciudadanos estadounidenses haciendo uso de los aviones de Conviasa, pero Carlos Vecchio sostuvo que esa es una falsa oferta. Los funcionarios del régimen “dicen ‘estamos dispuestos que Conviasa pueda ir a Estados Unidos para llevar a los americanos y regresar a los venezolanos’, pero eso es un juego político, porque ellos saben que Conviasa está sancionada por traficar ilegalmente con el oro y por tener como pasajeros a terroristas, por lo tanto no hay solución. Ya lo hemos dicho, si ya se han dado aviones gratis, si las líneas aéreas privadas están dispuestas a ir, ¿por qué entonces tanta manipulación y por qué tanto juego con esto? Y la respuesta es porque simplemente no hay un interés de resolver el problema de los venezolanos varados sino más bien manipular políticamente con el tema”, dijo Carlos Vecchio.

Un funcionario estadounidense dijo que la Administración Trump ha intentado una docena de diferentes mecanismos para tratar de conseguir la liberación de los estadounidenses, pero no quiso dar más detalles citando el sensible estado de las negociaciones. “Nosotros seguimos realizando los esfuerzos diplomáticos para regresarlos a Estados Unidos”, dijo el funcionario. La portavoz del Departamento de Estado, Morgan Ortagus, dijo que el régimen de Maduro no está permitiendo que los ciudadanos estadounidenses abandonen Venezuela “pese a los múltiples esfuerzos del gobierno de los Estados Unidos para organizar los vuelos de evacuación humanitarios. Hemos hecho ofertas en el pasado que permitiría a los ciudadanos estadounidenses salir, pero hemos sido rechazados por Maduros y sus allegados. Vamos a seguir explorando opciones para permitir que los ciudadanos estadounidenses puedan dejar Venezuela y regresar a los Estados Unidos”, declaró Morgan Ortagus.

La República Oriental del Uruguay ha anunciado la reapertura del sector turístico con la Unión Europea. El Ministro de Turismo de Uruguay, Germán Cardoso, anunció este Martes 18/08 que Uruguay reabrirá fronteras para el turismo a los ciudadanos de la Unión Europea. Esta decisión se tomó después de que las operaciones de reanudación entre Madrid y Montevideo en Julio 2020 hayan funcionado positivamente.

En una reciente declaración de la cartera de Turismo, se ha indicado que solo fueron cuatro pasajeros que dieron positivo a COVID-19 sobre un total de arribados de 2.880 pasajeros en el Aeropuerto Internacional Montevideo/Carrasco desde Julio 2020. “Con los mismos requisitos cuando se abrieron las puertas del país a los vuelos de Iberia y Air Europa para el transporte de ciudadanos uruguayos, residentes legales y extranjeros en casos excepcionales, se permitirá el ingreso de turistas provenientes de la Unión Europea a Uruguay”, afirmó el Ministro.

En el marco de su proyecto Smart Health Travel, el Aeropuerto Internacional de Carrasco contó con estrictas medidas y protocolos de seguridad sanitaria con el asesoramiento de un equipo multidisciplinario de expertos. Luego de la llegada, los turistas permanecerán en cuarentena por siete días, al séptimo día se debe realizar otra prueba (PCR), de lo contrario, permanecerán en cuarentena por 14 días desde el aterrizaje.

Es importante mencionar que el pasado 1 Julio 2020 la Unión Europea reabrió fronteras, anunciando que Uruguay era, y sigue siendo, el único país de América Latina cuyos ciudadanos y residentes tienen acceso a los países de la Unión. La aerolínea Amas Uruguay Línea Aérea incorporará la reapertura de los vuelos Montevideo-Sao Paulo con una frecuencia semanal los días Sábados empleando aeronaves jet Embraer E190-100 que está incorporando en las próximas semanas la aerolínea uruguaya.

Latam Airlines Group publicó resultados financieros 2Q2020

Latam Airlines Group ha anunciado la publicación de sus resultados financieros correspondientes al 2Q2020. Este Miércoles 19/08 Latam Airlines Group S.A. ha presentado al Securities and Exchange Commission (SEC) de Estados Unidos los resultados correspondientes al primer semestre del 2020. Entre Abril y Junio 2020, el grupo aéreo sudamericano tuvo operaciones limitadas debido a las restricciones de viaje. También ha solicitado en este período el acogimiento al Capítulo 11 de la Ley de quiebras en los Estados Unidos el 26 Mayo 2020 para iniciar un proceso de reorganización.

Durante el segundo trimestre, LATAM tuvo ingresos totales de US$ 571,9 millones de Dólares, una disminución del 75,9%. El grupo de aerolíneas también registró una caída del 93,9% en los ingresos por pasajeros. No obstante, ha experimentado un aumento del 18,4% en los ingresos por carga, debido a la situación de pandemia que ha alentado este tipo de transporte. El grupo finalizó el segundo trimestre con más de US$ 1.400 millones de Dólares en efectivo y equivalentes de efectivo. También redujo su deuda financiera en US$ 803,6 millones. En total, el grupo tuvo un resultado negativo neto de US$ 890 millones de Dólares.

Acuerdo refinanciación

Primeramente la empresa propuso una reducción salarial voluntaria del 25% para los ejecutivos y del 20% en general para Julio, Agosto y Septiembre 2020. Aproximadamente el 95% del total de empleados del grupo aceptó esta propuesta, dijo la aerolínea. No obstante, durante el segundo y tercer trimestre, Latam Group también disminuyó su plantilla en un 30%.

Aerolíneas del grupo

Los resultados del grupo aéreo más importante de Latinoamérica reflejan el daño colateral alcanzado producto de la pandemia actual. Latam Airlines Group poseía 342 aviones en 2019, aunque estaba operando con una estructura de personal por arriba del promedio de las aerolíneas en el mundo. La aerolínea se encuentra en proceso de reducción del tamaño de su flota. El grupo ha rechazado 23 contratos de arrendamiento de aeronaves y está en proceso de despedir nueve más.

Fuerte reclamo de empleados de aéreas low cost en Argentina

Empleados de las aerolíneas low cost Flybondi Líneas Aéreas y JetSmart Airlines Argentina se han manifestado el 20/08 en varios puntos del país por la reapertura de los vuelos, mejores condiciones de trabajo en condiciones igualitarias frente al cierre del Aeropuerto Internacional El Palomar.

Trabajadores de Flybondi y Jetsmart se manifestaron por el regreso de los vuelos y contra el cierre del Aeropuerto El Palomar, movilizándose en catorce puntos del país para pedir al Ministerio de Transporte que rehabilite el tráfico aéreo, tras cinco meses de cuarentena y ante un eventual colapso. Una de las manifestaciones fue sobre el Aeropuerto de El Palomar, que lleva su propia batalla enfrentados con un sector de la Justicia y el Gobierno.

En algunas ciudades, los empleados se manifestaron en aeropuertos, en otras como el caso de Bariloche, en sectores emblemáticos de turismo. “Queremos volver a trabajar. Que se mantengan los 10.000 puestos de trabajo a nivel nacional de manera directa e indirecta que hoy están en peligro”, indicó Manuel Trim, referente del Sindicato de Flybondi en Bariloche. En esa sucursal la empresa tiene 18 empleados y Jetsmart, 8 trabajadores.

Reclamos en todo el país

Los gremios aeronáuticos han expresado que tienen listos los protocolos sanitarios de la ANAC que permiten volver a volar en condiciones sanitarias seguras. “Es muy seguro a diferencia del transporte terrestre. Acá se toma la temperatura, los aviones tienen filtros que renuevan el aire y ya no se puede llevar equipaje de mano en la cabina, solo se puede despachar. Reclamamos una fecha concreta para el reinicio de la actividad aerocomercial. Dicen que en 60, 80 días se vuelve. Una empresa privada no es sustentable en el tiempo sin facturación”, expresó el sindicalista de Flybondi, Manuel Trim. El sindicato de trabajadores recalcó que “la actividad aerocomercial es planificada. Hay que vender tickets con anticipación, hay que solicitar rutas. Les pedimos al Ministerio de Transporte, de Salud, a ANAC que nos den una respuesta”.

Además del reclamo de reapertura del espacio aéreo nacional, también han exigido por la continuidad operativa del Aeropuerto Internacional El Palomar. Esta semana la Justicia Federal a cargo del Jueza Federal Martina Forns podría dictar su cierre por una denuncia de impacto ambiental. Sorprendieron las declaraciones desde el Ministerio de Transporte, a cargo de Mario Meoni, en contra de la terminal, al alegar que tiene mucho costo mantener una tercera plaza en el Área Metropolitana de Buenos Aires (AMBA), una verdadera desprolijidad manejar los asuntos con tanta despreocupación e irresponsabilidad en medio de una crisis económica sin precedentes. “Para una empresa low cost es viable volar desde ahí y para los pasajeros, también. Hay transporte público y es más conveniente transportarse hasta El Palomar que a Ezeiza. A veces, ir hasta ahí es más caro que el ticket aéreo”, dijo Manuel Trim.

Un sector del la política del kirchnerismo, la agrupación La Cámpora, que está más vinculado a Aerolíneas Argentinas y a los gremios APLA y APA, todavía presionan para el cierre definitivo de la aeroestación. Pero también el Martes 18/08 salió el actual Jefe Comunal, Lucas Ghi, con una defensa del Aeropuerto y sus puestos de trabajo: «En la medida que el aeropuerto reúna todas las condiciones que los organismos acrediten, tiene que funcionar. En esta Argentina, que está atravesando un momento tan difícil, tomar una decisión de esta naturaleza, que impacte en varios cientos de trabajadores y trabajadoras no me parece que sea adecuado», dijo Lucas Ghi.

Vecinos y trabajadores se manifestaron también en reclamo justo de las fuentes laborales y por el aeropuerto low cost. Según una encuesta difundida por Flybondi, realizada por la consultora CIO entre vecinos de Morón, Hurlingham y Tres de Febrero, el 82% cree que tener un aeropuerto activo en la zona donde vive es beneficioso, mientras que solo el 15% considera que es perjudicial.

En el otro extremo se encuentran los vecinos agremiados bajo el nombre de Stop Flybondi. Este grupo, encabezado por el abogado Lucas Marisi, inició el 17 Diciembre 2019 una acción en la Justicia para solicitar el cese total de operaciones de la terminal aérea con el argumento de que genera una contaminación sonora que excede los límites de lo saludable; el mismo reclamo podría aplicarse en el Aeropuerto Jorge Newbery donde se encuentra localizado en plena urbe de la Ciudad de Buenos Aires.

Centenares de trabajadores de diferentes partes del país como Córdoba, Bariloche, Iguazú, Morón, entre otros puntos se han sumado a la jornada para reclamar sus justos derechos para conservar sus fuentes laborales y permitir la reactivación de la aeroestación de El Palomar para trabajar en iguales condiciones laborales que Aerolíneas Argentinas.

Gobierno Provincia de Entre Ríos disolvería LAER

Este Jueves 20/08 ha ingresado a la Cámara de Diputados de la Provincia de Entre Ríos un proyecto del Poder Ejecutivo por el que se autoriza a «llevar a cabo el procedimiento de disolución y liquidación de la empresa Líneas Aéreas Entre Ríos Sociedad del Estado». La empresa LAER Líneas Aéreas no realiza actividad aerocomercial desde 2014.

La iniciativa, que ingresó este jueves a la Cámara de Diputados de Entre Ríos, autoriza al Poder Ejecutivo Provincial a “llevar a cabo el procedimiento de disolución y liquidación de la empresa Líneas Aéreas Entre Ríos Sociedad del Estado (LAERSE), conforme lo previsto por el Artículo Nº22 del Estatuto Constitutivo de la misma faculta al Poder Ejecutivo para que en un plazo de 60 días proceda a dictar los actos jurídicos que estime necesarios para facilitar la concreción efectiva de las operaciones relacionadas con las finalidades señaladas. La disolución y finalmente la liquidación cuya autorización se requiere encuentra su fundamento jurídico en el Artículo Nº22 del mencionado Estatuto, donde se dispuso que, conforme lo dispuesto en el Artículo 5° de la Ley de Sociedades del Estado N° 20.705, la sociedad podrá liquidarse mediante la autorización legislativa al Poder Ejecutivo, añadiendo las modalidades admitidas en cuento a los órganos habilitados. La Sociedad tuvo por objeto principal realizar los servicios comerciales de transporte aéreos, regulares y no regulares, de pasajeros y de carga como así también de correspondencia, encomiendas de trabajo aéreo, entre otros, cometidos que en la actualidad ha perdido la razón de ser atendida jurídicamente al momento de otorgarle existencia, en orden a que no se encuentra desarrollando actividad alguna vinculada de manera directa con aquél. Por ende, la liquidación final solicitada, la cual comenzará con las operaciones propias de la etapa de disolución, se encuadra en la falta de actividad de la sociedad, dado la imposibilidad sobreviniente de lograr el objeto social; siendo que no cabe duda que la inactividad está tácitamente reconocida en la vía administrativa. Dicho ello, teniendo en cuenta que la liquidación comienza con la disolución la misma se encuadra en las disposiciones del Artículo 94, inc. 4°) LGS, es decir por imposibilidad sobreviniente de cumplir con el objeto por el cual se formó. Actualmente la misma se encuentra intervenida por el Poder Ejecutivo Provincial a fin analizar su rentabilidad y con el objetivo de definir su funcionamiento o su disolución y liquidación. Bien sabido es que desde el año 2014 la aerolínea estatal entrerriana ha dejado de volar, por lo cual, al no tener vuelos el Ejecutivo ha sostenido, vía subsidios, el pago de salarios a personal que no tiene actividad alguna, el cual se fue relocalizando en otras áreas del Estado de modo tal de reducir costos ociosos, y que Fiscalía de Estado tiene bajo su órbita los juicios pendientes de resolución, por lo que este Poder Ejecutivo ha decidido su liquidación toda vez que la falta de actividad de la misma sólo representa un gasto para el Estado. A modo de síntesis se reproducen los objetivos para el presente año que interesa el Sr. Interventor sostener, a saber: ‘[…] mantener el taller de mantenimiento; trabajar con Fiscalía a fin de atender las demandas iniciadas contra L.A.E.R.S.E., confeccionar el Ejercicio Económico 2020, mantener un orden administrativo, técnico y legal frente a las inspecciones de los organismos nacionales, reparar la parte edilicia del hangar donde se brinda el servicio de hangares a terceros a cambio de un canon mensual, terminar de organizar el archivo de personal de la sociedad…’, entre otros”, se detalla.

“Claramente puede concluirse que ninguna de las propuestas elevadas por el Sr. Interventor se relaciona con la actividad principal para el cual fue constituida L.A.E.R.S.E. Asimismo, la Fiscalía de Estado por Nota N° 2369 3 indica todas las causas judiciales en que ha tomado intervención judicial y las judiciales en que ha intervenido como patrocinante legal de LAER. S.E. durante el período comprendido entre el 1 Julio 2016 al 30 Junio 2019, informando también si hubo o no acuerdo en las mismas. Dicho ello, se concluye en la necesidad de facultar expresamente a este Poder Ejecutivo para el dictado de los actos necesarios que posibiliten la realización ordenada y correcta de todas las operaciones tendientes a la culminación de la actividad societaria de acuerdo a las normas administrativas, civiles y tributarias vigentes, incluyendo la cancelación del pasivo, el reembolso del capital y la distribución del eventual remanente”, concluye el texto enviado a la Cámara de Diputados de la Provincia de Entre Ríos.
