Aerolíneas enfrentarían extensión período de cuarentena

Las líneas aéreas de la República Argentina avizoran una extensión del período de cuarentena aplicado al transporte aéreo descontando poder reiniciar sus operaciones de cabotaje a partir del 1 Septiembre 2020 por el aumento de los casos de contagios en el país. El 1 Septiembre 2020 se había estipulado como fecha de reapertura pautada por el Gobierno de Argentina. Hacia principios de Junio el Ministerio de Transporte había comunicado la posibilidad de mover la fecha de apertura hacia principios de Julio 2020 debido a los bajos índices de contagios en el interior del país para esa fecha. Actualmente, ante el rebrote de la pandemia, ahora se está analizando correr la línea de reapertura del 01/09 para más adelante.

Para las líneas aéreas locales era una fecha clave, pues, ese día termina el plazo que limita la comercialización y operación de vuelos, según las normas dictadas en Abril 2020. Sin embargo, a medida que la línea de reapertura se posponga, entre las aerolíneas crece la incertidumbre por el futuro económico y su autonomía para continuar sobreviviendo.

Desde las líneas aéreas están analizando que el Gobierno considerará extender las restricciones debido a la situación sanitaria provocada por el pandemia. Tras las ventas exitosas de tickets aéreos a finales de Julio 2020 en el Hot Sale, ahora las compañías no quieren arriesgarse a ofrecer fechas que luego deberán reprogramar.

Ante la falta de comunicación y confirmación oficial las aerolíneas locales continuarán con la incertidumbre de diagramar programaciones de vuelos. Las pocas señales que salieron desde algunos funcionarios de las áreas de Salud y Transporte, sugieren que el escenario más probable es el de una postergación de la reapertura del sistema de transporte aéreo.

De hecho, la falta de certezas para trazar un plan de operaciones cumplible hizo que algunas compañías internacionales hayan desistido de retomar los vuelos con destino a Buenos Aires. El caso más reciente fue Emirates Airline, que comunicó esta semana que cancela esa ruta hasta nuevo aviso: “Esperamos reiniciar nuestras operaciones en Buenos Aires cuando sea comercial y operacionalmente factible hacerlo. Haremos un anuncio formal si hay algún avance en este sentido”.

La expectativa de tener alguna certeza oficial se trasladará hacia el próximo Miércoles 12 Agosto 2020, cuando se organizará una reunión por la IATA titulado “Argentina listos para el despegue”. Esta reunión virtual será una mesa de discusión para la reanudación segura de la aviación. En ella participarán Paola Tamburelli, titular de la Administración Nacional de la Aviación Civil (ANAC); Pablo Ceriani, Presidente de Aerolíneas Argentinas; José Botelho, de la Asociación de Latinoamericana de Transporte Aéreo (ALTA), y Daniel Ketchibachian, CEO de Aeropuertos Argentina 2000. Los directivos de las empresas aéreas estiman que posterior a la reunión podría haber anuncios respecto a un calendario concensuado de reapertura de la aviación comercial. En Abril 2020, cuando se dictó la restricción hasta el 1 Septiembre, la IATA había advertido en una nota al Gobierno de Argentina que “limitar las operaciones aéreas tiene un efecto económico grave, pues implica que las aerolíneas no generarán ningún ingreso en más de cuatro meses, poniendo en riesgo los más de 329.000 empleos sustentados por el sector en el país”.

Justicia habilita a Flybondi participar discusión futuro aeroestación

El 23 Abril 2020 Aeropuertos Argentina 2000, la empresa concesionaria de Aeropuerto Internacional El Palomar, solicitaba a la autoridad de la Administración Nacional de Aviación Civil (ANAC) el cierre de la aeroestación que es la base de las operaciones low cost de Flybondi Líneas Aéreas y Jetsmart Airlines Argentina y de otras compañías que solicitaron pista en la primer terminal aérea low cost de Sudamérica y emblema del proceso que el Gobierno anterior denominó la «Revolución de los aviones». Así fue como las aerolíneas se enteraron de que su centro de operaciones se encontraba en riesgo y que tal vez se verían obligados a redefinir sus planes aerocomerciales.

Actualmente continúan las indefiniciones respecto al futuro del Aeropuerto Internacional El Palomar. Desde la compañía de presupuesto Flybondi consiguieron una sentencia favorable en la Justicia que le permitirá al menos estar al tanto de las discusiones que se lleven a cabo sobre el tema. De acuerdo con un fallo de la Sala II de la Cámara Contencioso Administrativo Federal emitido el Martes 04/08, la aerolínea deberá ser participada de las gestiones que se realicen vinculadas al cierre o a la reducción de operaciones y tomada como parte interesada. En concreto, la medida cautelar le otorga vista por el plazo de diez días hábiles y copia de todo expediente vinculado al tema y le permite intervenir en esas actuaciones en forma previa al dictado de una decisión por parte del Organismo Regulador del Sistema Nacional de Aeropuertos (ORSNA). El fallo, firmado por los jueces de cámara Luis María Márquez, María Claudia Caputi y José Luis López Castiñeira, revoca así una resolución previa en la que el juez interviniente había desestimado la medida solicitada por Flybondi por considerar que los riesgos alegados eran hipotéticos y el planteo prematuro por, entre otros factores, estar basado en versiones periodísticas.

La ANAC ha explicado que la continuidad del Aeropuerto El Palomar es uno de los puntos que el Gobierno todavía no terminó de definir de cara a la reactivación de la actividad. La aeroestación es un punto importante del tráfico aéreo que ayuda a descongestionar Aeroparque con un creciente número de slots. El Palomar transportó 1,8 millones de pasajeros en 2019 teniendo un incremento del 142% respecto de 2018. Sin embargo, algunas semanas atrás el Ministro de Transporte, Mario Meoni, dijo en diálogo virtual con una universidad cordobesa que «para justificar el funcionamiento de tres aeropuertos, Buenos Aires debería registrar por lo menos el doble del actual volumen de viajeros» por lo que, al menos en un primer momento, alcanzaría con las instalaciones de Ezeiza, dado que Aeroparque estará cerrado por refacciones hasta el 30/11.

Como sucede en los países con economías en desarrollo, existen ciudades que poseen varios aeropuertos alternativos que permiten ampliar las ofertas de compañías y variedad de destinos. El Gran Buenos Aires necesita diversificarse para desarrollar más ofertas frente a una demanda creciente con el mayor número de operadores que ha tenido, ahora interrumpido por la pandemia, pero necesariamente importante para planificar una aviación más federal y democrática.

Los estudios realizados por IATA, ACI y OACI indican, que el rumbo para el retorno de los vuelos en el mundo presentaría un panorama de avances y retrocesos producto del desconocimiento y del desarrollo propio de esta peste mundial.

Desde Transporte sostienen que debido al incremento de los índices de contagios de Coronavirus, se estaría evaluando la fecha de apertura de los vuelos domésticos en Argentina. Desde el sector de las aerolíneas reclaman la falta de definiciones para sostener una fecha de reinicio. Las líneas aéreas que operan en el país como Aerolíneas Argentinas, Austral Líneas Aéreas, JetSmart Airlines Argentina y Flybondi Líneas Aéreas, iniciaron la venta de tickets aéreos con ofertas al mercado para volar a partir del 01/09, lo que trae más confusiones acerca de los dichos recientes de la comprensión del texto de la ANAC sobre la fecha de apertura de los vuelos, si era para ventas o para reinicio de operaciones aéreas.

En otros tiempos existía en Argentina la Subsecretaria de Transporte Aerocomercial encargada del diseño de la política aerocomercial. Actualmente, la ANAC controla, regula y fiscaliza la actividad, pero no puede decidir cuándo determinar las mejores acciones en tiempos críticos como la pandemia mundial.

Reactivan iniciativa de Líneas Aéreas Paraguayas

Desde la Dirección Nacional de Aeronáutica Civil (DINAC) de la República de Paraguay han anunciado la reactivación de la iniciativa de reanudar las actividades de Líneas Aéreas Paraguayas (LAP). El titular de la DINAC, Félix Kanazawa, adelantó que la marca Líneas Aéreas Paraguayas/LAP podría volver a ponerse en marcha con rutas de conexión directa a Estados Unidos y Europa. Asimismo, indicó que los vuelos burbuja con Uruguay podrían habilitarse en las próximas semanas.

Desde el organismo nacional han expresado que el capital para la conformación de una aerolínea nacional se llevará a cabo con fondos provenientes del sector privado. Actualmente se está realizando el planeamiento para la puesta a punto de la conformación de la legendaria línea aérea paraguaya. “Aquí no se está planteando desde la administración de la DINAC reactivar Líneas Aéreas Paraguayas con fondos del Estado. Es necesario aclarar que dicha iniciativa proviene del sector privado”, sostuvo el funcionario de la DINAC, Lorenzo Orué.

El organismo de la DINAC ha detallado que desde 2016 tiene registrado a LAP como marca y que a cualquier empresa interesada se le puede adjudicar la matrícula del uso de la misma. “Pueden entrar a competir como una empresa de bandera, pero movido con capital privado. Desde un principio se aclaró ese punto y que no se trataba de reflotar LAP con capital del Estado. Una empresa interesada puede presentar su propuesta a la DINAC y constituye una empresa solicitando el uso de la denominación de LAP, así como su logotipo y matrícula para competir en el mercado nacional como cualquier otra empresa privada”, expresó el organismo.

El Estado de Paraguay tiene la libertad de convocar a los potenciales oferentes a usufructuar el nombre de LAP, ya que existen muchos interesados en el sector privado. La DINAC no obstaculizaría en ningún tipo de canon especial a la empresa que esté interesada en explotar la marca LAP. “Queremos una empresa con bandera paraguaya, ya que muchas personas han intentado revivir a LAP, pero no se puede hacer a través del Estado”, dijo la DINAC.

Aerolíneas reanudan rutas tras apertura de fronteras en el Caribe

El servicio aéreo de la Región Caribe se está expandiendo a medida que los destinos reabren lentamente sus fronteras a los visitantes internacionales y los transportistas regionales lanzan un nuevo servicio entre las islas.

Granada comenzó una reapertura por etapas el 15 Julio 2020 y clasifica a los visitantes como de riesgo bajo, medio o alto, a los efectos de la entrada. El Ministerio de Turismo y Aviación Civil ha detallado los protocolos para los viajeros a Granada en un documento oficial completo para cada una de las tres categorías.

La aerolínea interCaribbean Airways, con sede en Turks & Caicos ha comunicado este Martes 04/08 el lanzamiento de nuevos vuelos regionales desde el Aeropuerto Internacional Barbados/Grantley Adams a Granada, Santa Lucía, San Vicente y las Granadinas y Dominica. Las rutas ampliadas de la aerolínea del Caribe Oriental brindarán viajes de conexión a las 22 ciudades existentes a las que sirve interCaribbean a través de su red Pancaribeña, dijeron funcionarios de la compañía en un comunicado.

“Barbados tiene la suerte de que interCaribbean haya sido elegido como su centro sur con miras a la expansión y el establecimiento de la sede en el futuro. Los funcionarios de Barbados se reunieron recientemente con varias aerolíneas que han expresado interés en operar en el Caribe oriental y meridional”, dijo Mia Mottely, Primera Ministra de Barbados.

Caribbean Airlines, con sede en Trinidad & Tobago, ha lanzado recientemente un servicio al Caribe Oriental desde Barbados. Aerolíneas Argentinas fuera del control obligatorio de la AGN

El Gobierno de Argentina ha excluido en el Proyecto de Ampliación del Presupuesto en el debate en la Cámara de Diputados el 04/08 un artículo que excluye a Aerolíneas Argentinas de la obligatoriedad del control de la Auditoría General de la Nación (AGN). La compañía que recibe elebados recursos por parte del Estado, ha sido criticada por la oposición política durante el debate en el recinto. En el Artículo 17 se establece que «las empresas Aerolíneas Argentinas Sociedad Anónima y Austral Líneas Aéreas/Cielos del Sur Sociedad Anónima y sus controladas, se rigen por las normas y principios de derecho privado, no siéndoles aplicables legislación o normativa administrativa alguna que reglamente la administración, gestión y/o control de las empresas o entidades en las que el Estado nacional o los Estados provinciales tengan participación».

Posición de Aerolíneas

Voceros de Aerolíneas Argentinas aclararon que este artículo no exime a la línea aérea de los controles gubernamentales que les corresponde a ese tipo de sociedades. «Muy por el contrario, con esta redacción la compañía no solo estará sujeta a fiscalización de los entes que controlan a las sociedades anónimas regidas por la Ley General de Sociedades, como la Inspección General de Justicia (IGJ), sino que además le resultará aplicable lo previsto en la Ley 24.156, que establece la intervención de la Sindicatura General de la Nación. Asimismo, vale destacar que el 10 de Marzo de este año, Aerolíneas solicitó a la AGN la auditoría sobre sus estados contables 2020 y la certificación de las transferencias de dinero que recibe del estado nacional, lo que se efectivizó con la firma del convenio correspondiente el último 29 de Julio. Algo que no sucedió entre los años 2016 y 2019, en los que la AGN no realizó auditoria alguna sobre los números de ARSA. Con el texto propuesto se busca confirmar la naturaleza jurídica de Aerolíneas y equipararla al estatus del resto de las sociedades anónimas con participación mayoritaria del Estado, lo que resulta fundamental para el funcionamiento de una compañía que compite en el mercado aéreo», expresó la compañía.

Según el último informe de la Asociación Argentina de Presupuesto (ASAP), durante el primer semestre de 2020 se realizaron aportes de capital a las empresas Aerolíneas Argentinas S.A. y Austral Líneas Aéreas/Cielos del Sur por AR$ 14.953 millones de Pesos. Sólo durante el mes de junio pasado, el Tesoro Nacional realizó aportes de capital a Aerolíneas Argentinas y Austral Líneas Aéreas por AR$ 1.973,8 millones de Pesos.

Posición política fiscalizadora

Según los Diputados opositores de Juntos por el Cambio, tal como está redactado el artículo en el proyecto de ampliación presupuestaria, Aerolíneas Argentinas no estará obligada a someterse al control de la AGN, más allá de los convenios que puedan firmarse. Recuerdan que no es la primera vez que el Gobierno busca evitar que la línea aérea sea auditada. Anteriormente, bajo el Gobierno Nacional de Cristina Kirchner había incluido un artículo similar en la Ley de Presupuesto 2016. Adujo que, por tratarse de una empresa mixta, no correspondía que la compañía fuese controlada por la AGN. Esta decisión fue cuestionada por el entonces presidente de la AGN, Leandro Despouy, lo que motivó que un año después, durante el Gobierno de Mauricio Macri, se diera marcha atrás con aquella decisión en la Ley de Presupuesto 2017. Así, la AGN recuperó la facultad de controlar la empresa estatal, facultad que nuevamente el kirchnerismo pretende ahora eliminar.

Position in Aerolíneas

Spokesmen for Aerolíneas Argentinas clarified that this article does not exempt the airline from the governmental controls that correspond to this type of company. «On the contrary, with this wording, the company will not only be subject to inspection by the entities that control public limited companies governed by the General Companies Law, such as the General Inspectorate of Justice (IGJ), but it will also be applicable the provisions of Law 24,156, which establishes the intervention of the General Syndicate of the Nation. Also, it should be noted that on March 10 of this year, Aerolíneas requested the AGN to audit its 2020 financial statements and the certification of transfers of money received from the national state, which was made effective with the signing of the corresponding agreement on July 29. Something that did not happen between 2016 and 2019, in which the AGN did not carry out any audit on the ARSA numbers. According to the latest report of the Argentine Budget Association (ASAP), during the first half of 2020, capital contributions were made to the companies Aerolíneas Argentinas S.A. and Austral Líneas Aéreas/Cielos del Sur for AR$ 14,953 million pesos. During the past June alone, the National Treasury made capital contributions to Aerolíneas Argentinas and Austral Líneas Aéreas for AR$ 1,973.8 million pesos.

Political position audit

According to the opposition Deputies of Together for Change, as the article is written in the budget expansion project, Aerolíneas Argentinas will not be obliged to submit to the control of the AGN, beyond the agreements that may be signed. They recall that it is not the first time that the Government seeks to prevent the airline from being audited. Previously, under the National Government of Cristina Kirchner, it had included a similar article in the 2016 Budget Law. It argued that, since it was a mixed company, it was not appropriate for the company to be controlled by the AGN. This decision was questioned by the then president of the AGN, Leandro Despouy, which motivated that a year later, during the Government of Mauricio Macri, the decision was reversed in the 2017 Budget Law. Thus, the AGN recovered the power to control the state-owned company, a power that Kirchnerism once again intends to eliminate.
