Ministerio Transporte y aerolíneas se reunen para maximizar controles sanitarios por epidemia

El Ministerio de Transporte de Argentina se reunirá hoy 11/03 con todas las líneas aéreas internacionales que operan en Argentina para analizar los pasos por seguir en relación con la propagación del coronavirus en el país. Desde la cartera de Transporte observan con mucha preocupación la situación de la epidemia. Las medidas activas y en pro de controlar cada uno de los lugares de entrada, se efectivizan coordinando con las distintas empresas aéreas que operan en la Argentina y trabajando también en materia de puertos marítimos, que son entrada de pasajeros de ultramar.

Aeronavegantes

La Asociación de Aeronavegantes de Argentina (AAA) ha recomendado recientemente a los Tripulantes de Cabina Pasajeros (TCP) a realizar el aislamiento de 14 días. Tras las medidas recientes del Gobierno de Argentina de que toda persona que ingrese al país de las zonas de alto riesgo, deberá efectivizar la cuarentena obligatoria en sus respectivos hogares.

La expansión del coronavirus (COVID-19) a nivel global y las nuevas recomendaciones del Ministerio de Salud de la Nación Argentina podrían generar un dolor de cabeza a las aerolíneas con base en la Argentina. El gremio de los Aeronavegantes les indicó a sus afiliados que trabajan en los vuelos a las zonas afectadas que se pueden plegar a la disposición de aislamiento de dos semanas. La Asociación Argentina de Aeronavegantes que conduce Juan Pablo Brey recomendó hoy en un comunicado interno a su base gremial: «Los tripulantes que regresan de la zona de contagio (Madrid y Roma) podrán de manera voluntaria realizar el aislamiento de 14 días sugerido por el Decreto del Poder Ejecutivo Nacional. Cualquier tripulante que por motivos justificables y atribuibles al Coronavirus considere pertinente no realizar vuelos a las zonas identificadas como focos de contagio, se encuentra avalado por este sindicato. Toda medida va variando de manera dinámica, al tiempo que las autoridades nacionales toman decisiones. Los regresos a base serán coordinados por el área operativa de la empresa», sostuvieron desde la agrupación sindical.

Desde el sindicato también pusieron a disposición un formulario para todos aquellos que quieran solicitar los 14 días de licencia para vuelos que regresan al país desde zonas declaradas en riesgo. Protocolo Sanidad

A través de una resolución del Ministerio de Transporte, la Administradora Nacional de Aviación Civil (ANAC) de Argentina dispondrá que todas las aerolíneas nacionales e internacionales que arriben a la Argentina desde el extranjero cumplan el protocolo del Ministerio de Salud para tratar casos sospechosos de coronavirus.

Los requisitos que deberán seguir de manera obligatoria las empresas aéreas que operen en suelo argentino son varios. El primero indica que todos los pasajeros y la tripulación deberán llenar el formulario, que será provisto por la cartera sanitaria, “Declaración de Salud del Viajero”. Desde el Ministerio solicitaron que “hasta tanto ese stock esté disponible” las aerolíneas colaboren para “imprimir los formularios cuando así resulte necesario, durante los primeros días de inicio de esta operatoria”.

El segundo punto sostiene: “Se reitera la obligación de toda las aerolíneas de informar durante el vuelo la presencia de cualquier posible caso sospechoso a las autoridades aeroportuarias, antes del arribo al aeropuerto. La detección podrá producirse por un aviso del pasajero o un miembro de la tripulación o por la observación del personal de abordo o de otro pasajero”.

El tercer punto es que ante la presencia de un caso sospechoso la aerolínea “deberá incluir la novedad en la parte sanitaria de la Declaración General de Aeronave y advertir tal incidencia a los Servicios de Tránsito Aéreo (Torre de Control), con carácter previo a su arribo”.

El cuarto punto hace referencia a cuáles son los indicios para considerar a una persona sospechosa de estar contagiada de COVID- 19. Lo primero es si evidencia síntomas de fiebre y tos, fiebre y dolor de garganta o dificultad respiratoria. Y luego incluye a todo sujeto que provenga o haya estado en los últimos 14 días en China, Japón, Corea del Sur, Italia, Irán, Francia, Alemania o España. También a quienes hubieran tenido contacto cercano con un caso de coronavirus o hubiera trabajado o atendido pacientes en algún centro de salud con pacientes sospechosos o confirmados de estar infectados.

El quinto punto: “En el caso de detección de un caso sospechoso se ejecutará el protocolo vigente ubicando la aeronave en el Puesto 18 (o en el que, en su caso, defina la autoridad del Aeropuerto) a efectos de la concurrencia de médicos asistenciales del aeropuerto y del personal de Sanidad de Fronteras para la evaluación del caso denunciado”. También hay indicaciones para una denuncia tardía de algún contagiado. Lo que deberá hacer la tripulación, con el avión ya ubicado en la manga, es aplazar el egreso del pasaje de la aeronave y comunicar de inmediato a las autoridades para proceder con el protocolo, el que involucra el llenado de formularios de declaración de salud del viajero de todo el pasaje y tripulación con identificación del caso sospechoso; y el reporte en la Declaración General de la Aeronave por parte de la aerolínea.

El séptimo y último punto: “En el caso de ausencia de auto-reporte de algún pasajero o tripulación y que la tripulación no haya registrado u observado algún caso sospechoso y así se registre en la parte sanitaria de la Declaración General de Aeronave, el personal de la aerolínea deberá recolectar las Declaraciones Juradas y entregarlas al personal de Sanidad de Fronteras luego de la apertura de puertas en manga o bien en el momento de cumplimentar el trámite del certificado de Libre Plática”. El Ministerio de Transporte de Argentina está acercando propuestas a JetSmart Airlines Argentina después de reunirse para arribar a una solución a corto plazo para JetSmart. La compañía low cost está teniendo dificultades para operar en el Aeroparque luego de haber adquirido a la empresa Norwegian Air Argentina, después de que la ANAC Argentina señalace incongruencias operativas para Norwegian Air Argentina ante la falta de aprobaciones técnicas para la flota A320CEO de JetSmart para operar en el Aeropuerto Jorge Newbery.

El Ministro de Transporte, Mario Meoni, ha señalado la posibilidad en el corto plazo encontrar una solución al problema suscitado a partir de las dificultades que tiene la compañía low cost JetSmart Airlines Argentina para operar en Aeroparque, luego de haber adquirido a la empresa Norwegian Argentina. Cuando la aerolínea low cost JetSmart compró Norwegian Argentina en Diciembre 2019 continuó operando en el Aeropuerto Jorge Newbery con los aviones Boeing 737-800 pertenecientes a la compañía noruega, hasta tanto estas aeronaves fueran retornando progresivamente a Europa y fueran reemplazados por los Airbus A320CEO de la compañía JetSmart, surgió una controversia debido a trámites que JetSmart no habría realizado, por lo que la compañía debió extender el leasing (alquiler) de los aviones noruegos para poder seguir cubriendo las rutas que volaba Norwegian Air Argentina.

El encuentro Gobierno-JetSmart intentará destrabar la situación para encontrar alternativas y soluciones en el corto plazo. “Estamos reuniéndonos permanentemente con la compañía buscando alternativas y soluciones, es probable que encontremos alguna solución a corto plazo, estamos trabajando en forma conjunta con la ANAC, con Aerolíneas Argentinas, con JetSmart. La investigación del comité también ha encontrado la FAA no cumplió con su deber de identificar los problemas clave de seguridad y garantizar que se abordaran adecuadamente durante el proceso de certificación. La combinación de estos problemas condenó los vuelos de Lion Air y Ethiopian Airlines», según el informe.

Posturas Boeing/FAA

El constructor aeroespacial Boeing dijo en un comunicado que había cooperado ampliamente con la investigación del Comité de Transporte y que revisaría el Informe Preliminar. La FAA dijo que se ha acogido con beneplácito el escrutinio y que las lecciones aprendidas de las investigaciones será un trampolín hacia un nivel de seguridad aún mayor.

La publicación del informe se produce días antes del primer aniversario el 10 Marzo 2020 del segundo accidente aéreo en Etiopía. El defensor de los consumidores desde hace mucho tiempo Ralph Nader, cuya nieta estaba a bordo del vuelo ET-302 de Ethiopian Airlines, envió una carta a Roger Wicker, el Senador Republicano de Mississippi que preside el Comité de Comercio, Ciencia y Transporte del Senado, hace tres días diciendo que la pesada investigación del panel del Senado se estaba llevando a cabo.

Boeing ha defendido el desarrollo del 737 MAX, diciendo que la compañía cumplió con los requisitos de la FAA. JetSmart recibió por parte de la ANAC la autorización para prorrogar por siete días el alquiler de los aviones Boeing 737-800 a los fines de poder cumplimentar en ese plazo los trámites pertinentes para lograr la habilitación que necesitan para operar en Aeroparque con sus propios aviones Airbus A320CEO.

ANAC afirmó que avanza en una solución para la situación de JetSmart. “En cuanto a la problemática de la empresa JetSmart, que adquirió las acciones de la compañía Norwegian Air Argentina, debe aclararse que una operación por el estilo es incumbencia propia de dos empresas privadas, pero el uso de las rutas aéreas esta concedido y controlado por el Estado. Necesitamos saber con que aeronaves piensan utilizar esas rutas y una serie de detalles técnicos que son imprescindibles para analizar seriamente la solicitud”, sostuvo la titular de la ANAC Argentina.

La implementación del proyecto de compra de Norwegian por parte de Jetsmart Airlines Argentina era devolver progresivamente los tres aviones Boeing 737-800 de Norwegian Air que alquila en forma temporaria para sus vuelos de cabotaje y reemplazarlos por sus propios aviones Airbus A320-200 (CEO). Al no lograr la autorización para volar con aeronaves A320, solicitaron un permite de wet lease, lo que permite alquilar aviones con tripulación. Pero la ANAC no autorizó ninguno de los dos pedidos hasta ahora, solo prorrogó por siete días el alquiler de los aviones Boeing 737-800 que pertenecen a la compañía noruega Norwegian. Se esperaba que en ese plazo puedan completar los trámites pertinentes para lograr la habilitación que necesitan para operar en Aeroparque con sus aviones Airbus A320CEO, según el organismo regulador.

Una de las condiciones que debe cumplir JetSmart es adecuar el Certificado de Explotador de Servicios Aéreos (CESA), ya que el que poseen en este momento para las operaciones desde Aeroparque es el que corresponde a Norwegian Air Argentina, existiendo incompatibilidad después de la adquisición.

Reunión ANAC-JetSmart

Sin embargo, esta semana anunció que el Gobierno demoraba los permisos necesarios para que pudiese comenzar a usar sus propias aeronaves en las rutas que pertenecían a Norwegian y que salían desde Aeroparque. Perspectivas JetSmart

JetSmart Airlines Argentina y Norwegian Air Argentina seguirán operando con normalidad, pero por separado hasta que se concrete la sinergia. JetSmart Argentina no han descartdo que los inversores de la compañía realicen ahora una revisión de su estrategia. La ANAC les había autorizado una extensión del leasing (alquiler) con los aviones Boeing 737-800 para evitar una situación conflictiva con los pasajeros, ya que al no poder operar los vuelos de Aeroparque hubiesen quedado muchos sin volar, con el consecuente perjuicio. Por este motivo se les ha concedido un nuevo plazo en el marco de una negociación que se está llevando adelante con los directivos de la empresa para resolver el la transición.

La empresa estuvo a punto esta mañana de no poder cumplir con los vuelos programados desde Aeroparque debido a que la ANAC no autorizó la operación con los aviones propios, hasta tanto no presentase la documentación pertinente de habilitación, ya que uno de los aviones de Norwegian Air Argentina tenía un plazo de vencimiento hoy 04/03, por lo que el primer Boeing 737-800 en ser desprogramado volvera a su leasor esta noche rumbo hacia Europa.

JetSmart adquirió en Diciembre 2019 la compañía de cabotaje Norwegian Air Argentina, y entre las condiciones de la operación se encontraba que la empresa perteneciente a Indigo Partners Group alquilaba temporalmente los tres aviones que Norwegian poseía en Argentina para luego devolverlos progresivamente en el transcurso de los primeros meses de este año para ser reemplazados por su flota homogeneizada de Airbus A320CEO. Para poder concretar este reemplazo, JetSmart debía presentar una serie de documentos de habilitación de sus propias aeronaves para operar las rutas de Norwegian Air Argentina desde Aeroparque y fuentes de la ANAC indicaron que en todo momento estuvieron en contacto con la empresa para solicitar la presentación de dicha documentación, sin que este trámite se cumpliese adecuadamente. JetSmart Airlines Argentina ha indicado que la compañía había realizado la presentación de toda la documentación, y que no han recibido pedidos específicos de nuevos documentos o modificaciones.

En la mañana del 04/03 el sector de Legales de la Administración de la ANAC, junto con el Ministerio de Trabajo, avanzaban en una fundamentación de las razones por las cuales no se concedió aún la habilitación, y las fuentes consultadas del sector ratificaron que JetSmart «no puede operar rutas de Norwegian Air Argentina ya que no ha finalizado de presentar la documentación necesaria para completar el expediente. Por ejemplo, el Wet Lease (que es un tipo de contrato de leasing) de las aeronaves de Norwegian no está finalizado, la empresa adeuda papeles. La solicitud de operación a través de un Wet Lease implica la acreditación, conforme a la normativa nacional, de las condiciones de operación del equipamiento y personal de JetSmart bajo las condiciones de Norwegian. Además, el CESA (Certificado de Explotador de Servicios Aéreos), que otorga la ANAC a las empresas para explotar comercialmente el transporte aéreo, de JetSmart debe ser enmendado ya que en ese documento se encuentran las características de las operaciones que puede realizar».

La ANAC ha indicado que el CESA que posee JetSmart los habilita a operar regularmente desde El Palomar y no desde Aeroparque, por lo cual es necesaria una enmienda y remarcaron que, si bien se trata de un trámite administrativo que debieron realizar con anticipación, la presentación de la documentación no implica necesariamente la aprobación, por lo que aún resta saber si la empresa podrá operar en Aeroparque los vuelos de Norwegian con aeronaves propias. «Al realizar la compra de una empresa, no significa que se le transfieren las autorizaciones de la otra empresa.
