Empleados cargas exentos arbitraje

AW | 2022 07 12 09:35 | GOVERNMENT / AIRLINES

US cargo employees exempt from arbitration

Justice maintains air cargo employees are exempt from arbitration

The United States Supreme Court has held that airline cargo clerks traveling across state lines are exempt from the Federal Arbitration Act (FAA) because they belong to a «class of workers engaged in foreign or interstate commerce» under § 1 of the FAA.

Latrice Saxon worked for Southwest Airlines and was responsible for training and supervising teams of ramp agents who load and unload aircraft cargo on Southwest aircraft traveling across state lines. Latrice Saxon filed a class action alleging failure to pay proper FLSA overtime wages in the Northern District of Illinois (IL). However, Latrice Saxon had signed an arbitration agreement requiring her to arbitrate their wage disputes, and Southwest moved to dismiss the lawsuit and compel arbitration under the FAA.

Latrice Saxon opposed the motion, citing FAA § 1, which exempts «employment contracts for seamen, railroad clerks, or any other class of workers engaged in foreign or interstate commerce». He argued that ramp supervisors, like seamen and railroad employees, were a «class of workers engaged in foreign or interstate commerce», but the district court agreed with Southwest, finding that only employees involved in the «transportation real», not those who simply handle goods, were within the § 1 of the FAA. On appeal, the Seventh Circuit Court of Appeals disagreed with the District Court’s decision, holding that «the act of loading cargo onto a vehicle for interstate transportation is itself commerce». The Seventh Circuit’s decision conflicted with an earlier Fifth Circuit decision, Eastus v. ISS Facility Services, Inc., 960 F.3d 207 (2020), and the Supreme Court granted certiorari to resolve the conflict between the two circuits.

The decision of the Supreme Court

In a unanimous decision, the Supreme Court held that shippers who load and unload aircraft cargo traveling within the state perform a direct role in the interstate transportation of goods and thus belong to a «class of workers engaged in commercial commerce foreign or interstate» under § 1 of the FAA. The Tribunal conducted an analysis in two stages. First, it examined how to define the relevant «class of workers». The Court rejected Latrice Saxon’s argument that the «class of workers» should be defined as virtually all airline employees, which would include shift schedulers or those who design the Southwest website. Rather, the Court held that the investigation should focus on the job duties of the employees themselves, rather than the employer’s business and that Latrice Saxon «belongs to a class of workers who physically load and unload cargo on and off aircraft frequently».

Next, the Court considered whether that class of aircraft cargo shippers «engaged in foreign or interstate commerce». It determined that «someone who loads cargo onto an aircraft bound for interstate traffic is intimately involved with the commerce of that cargo» and that workers like Saxon who load and unload aircraft cargo traveling in interstate commerce are exempt from FAA.

Employer takeout

Although the Court found a class of workers exempt from the Federal Arbitration Act, it expressly rejected the contention that this exemption should apply to all employees of an employer involved in foreign or interstate transportation. He went on to provide examples of positions that would not meet the exemption, such as workers engaged in interstate asphalt sales or workers providing cleaning services to a corporation engaged in interstate commerce. Employers involved in interstate or foreign commercial transportation should consult legal counsel if they plan to use arbitration agreements as part of their dispute resolution process.

Pilotos SAS continúan en huelga

AW | 2022 07 11 20:11 | AIRLINES / AVIATION ORGANISMS

Pilotos rechazan nuevas acciones de repatriación

Scandinavian Airlines_logo.svg

SAS pilots continue on strike

Pilots reject new repatriation actions

The striking pilots of the Swedish airline SAS Airlines reject new actions to repatriate stranded tourists. The airline’s management had violated the agreed conditions. The pilots of the Scandinavian Airlines airline reject new interruptions of their strike, which has been going on for a week, after the repatriation campaigns of stranded tourists over the weekend.

The SPG pilots’ union accused on Sunday 07/10 the company’s management of having violated the agreed framework conditions. According to union leader Martin Lindgren, the flights were only intended for destinations where there are few or no alternatives for a return flight. However, Martin Lindgren said that to the surprise of the pilots’ union, many planes had also visited popular holiday destinations such as Rhodes, Crete and Split. Currently, there are alternative travel options in these destinations. For this reason, the SPG has decided not to allow any more exceptions after the flights on Sunday 10/07.

SAS spokeswoman Karin Nyman criticized the union’s decision. The company has tried to ensure exact compliance with the complex requirements for the approximately seventy flights over the weekend. She rejected the union’s information on alternative travel options for stranded tourists. The Christian New Year’s holiday season is at its absolute peak, all seats are fully booked with all airlines, which the pilots’ union is also aware of, Karin Nyman had expressed.

The SAS pilots had resigned their jobs on July 4 after failing in collective bargaining. They are protesting against planned salary cuts, which, according to their information, could amount to up to 30 percent.

ANA Airways reconfirma pedidos Boeing

AW | 2022 07 11 14:17 | AIRLINES / INDUSTRY

Cambia pedido Boeing 777 por cargueros próxima generación
Ordena 20 Boeing 737-8 MAX más 10 opciones

All-Nippon-Airways-Logo

ANA Airways reconfirms orders to Boeing

Change Boeing 777 order for next generation freighters
Order 20 Boeing 737-8 MAX plus 10 options

All Nippon Airways said Monday 07/11 that it has converted two of its 20 orders for the next-generation Boeing 777-9 airliner to the Boeing 777-8F cargo version, becoming the third airline to commit to the big future freighter since that Boeing launched the program in early 2022. The carrier’s initial purchase plan was exclusively for passenger jets.

ANA Airways said it has also finalized a tentative order for thirty (30) Boeing 737-8 MAX aircraft, which represents twenty (20) in firm orders, plus ten (10) purchase options. The order had been first announced in January 2019.

ANA Airways is a large, combined airline that operates nine Boeing 767-300F and two Boeing 777F midsize freighters, based on its fleet as of March 2021. The Japanese carrier said the new 777-8F freighters will enter service sometime in 2028. or 2029 and signify the company’s growth plans for the air cargo business.

The Japanese airline originally ordered the 777-9 aircraft in 2014, but the plane’s development has been plagued by engineering challenges. Boeing recently delayed the expected delivery of the 777-9 to 2025, more than a year later than planned. The first freighter variants are not scheduled to be ready until 2027. Boeing, until recently, referred to both variants generically as the 777-X.

Boeing’s biggest customer for the new wide-body freighter is Qatar Airways, which has an order form for 34 planes plus options for 16 more. Lufthansa’s cargo division has signed a purchase agreement for seven Boeing 777-8F freighters, while Ethiopian Airlines has a letter of intent for five units.

The planemaker is facing new competition from rival Airbus in the cargo sector that it dominated for decades. Airbus presented at the end of 2021 a new wide-body freighter based on the popular A350 airliner. Airbus has 24 firm orders for the A350F, with more waiting to be finalized. Experts say the planes are roughly comparable in capability.

The Boeing 777-8F has roughly the same payload capacity as a 747-400F freighter, while offering a 25% improvement in fuel efficiency, emissions and operating costs, according to the American builder. It will also have two additional pallet positions than the legacy 777 freighter, along with a 15% fuel benefit. Technological enhancements include a new carbon fiber composite wing and fuel-efficient GE engines. With a range of 4,410 nautical miles, the 777-8 will allow airlines to make fewer stops and lower landing fees on long-haul routes. Boeing’s 2021 commercial market outlook projects a 70% increase in the global freighter fleet by 2040, including some 450 new large wide-body freighters.

Australia levanta restricciones COVID-19

AW | 2022 07 11 14:10 | AIR TRAFFIC / GOVERNMENT / AIRLINES

Australia lifts up COVID-19 restrictions

Health restrictions lifted in Australia

Travelers to Australia can visit the country without worrying about COVID-19 travel restrictions from July 6, 2022. The new order means those entering Australia will no longer need to show proof of vaccination. This follows the lifting of quarantine restrictions and testing requirements for COVID-19.

«As more and more of us travel internationally and become more confident in managing our risk from COVID, our airports are getting busier. Removing these requirements will not only reduce delays at our airports, it will encourage more visitors and skilled workers to choose Australia as a destination. And for Australian citizens, with the removal of these requirements, returning home will be much easier», said Clare O’Neil of the Home Affairs.

Travelers who have been patiently waiting to return to Australia will find that it is now even easier. The Next Vacay online travel search system expects to see growing demand in the region. «Australia has shown a strong public health response towards COVID-19 and has been one of the most rigorous border controls in the world that we have seen during the Coronavirus pandemic», said Naveen Dittakavi, founder and CEO of Next Vacay. Since tourists have been patiently waiting to visit the country, we expect this reopening to have a significant impact on the travel industry. Current travel trends have 2022 as the year of bucket list travel, with people seeking those once-in-a-lifetime international destinations, so it’s no surprise that searches for Australia’s covid vaccine travel have increased by 900% in the past.

«While people looking to travel to Australia expect to find slightly cheaper airfare, flights to Australia are expected to be considerably higher than pre-pandemic levels due to the huge financial hit airlines have taken over the course of the pandemic of COVID», said Naveen Dittakavi. Australia frequently tops travellers’ lists, and the country is attracting visitors with a new tourism campaign, which is just the first step in a long-term travel marketing strategy to boost tourism in the country.

EEUU exige a aerolíneas sentar a pasajeros/niños sin recargo

DOT_Isologotype

DOT requires I do not charge children fees

US requires airlines to seat passengers/children without surcharge

The United States Department of Transportation (DOT) has warned airlines to stop charging extra fees to passengers with children for accommodating them together. The DOT announced that airlines should «make any immediate adjustments necessary to ensure that small children can sit next to their accompanying adults», including upgrading to a more premium seat. The Federal agency stressed that airlines that use seat blocking technology in their reservation systems will have to have enough seats available for those traveling with small children.

For its part, Airlines for America (A4A), said that «US airlines have always worked to accommodate customers traveling together, especially those traveling with children, and will continue to do so».

The high demand of passengers due to the strong reactivation of tourism continues to generate difficulties when it comes to having a seat reservation. This means that airlines continue to maximize availability on each flight, but at the same time they must face the lack of personnel to attend air services in the country.

In 2007, it was leased to Nok Air for a few months, and returned to the XL Airways fleet in 2008. In 2009, it was leased by Malaysia Airlines, and in 2010 it was transferred to its subsidiary Firefly. In 2014, it was put into storage until the Indonesian airline Sriwijaya Air leased it. In 2021, it passed to Blue Air, and now it comes to BoA Aviación.

During the International Air and Space Fair (FIDAE 2022), BoA announced its plan to introduce two Airbus A330-200s, replacing its older Boeing 767-300s. The new Airbus A330s will join BoA in the second half of this year 2022.

ALPA rechaza propuesta pilotos

AW | 2022 07 10 08:44 | AVIATION ORGANISMS / AIRLINES

Sindicato ALPA rechaza propuesta alivio tripulaciones

ALPA rejects pilot proposal

ALPA union rejects crew relief proposal

The US pilots’ union Air Line Pilots Association, International (ALPA) criticizes proposals to ease the pilot shortage. North America’s largest pilot union, the ALPA has filed a grievance against two proposals that could alleviate the pilot shortage currently plaguing commercial aviation and cause flight disruptions in the entire industry.

The ALPA union has requested the Department of Transportation (DOT) of the United States to reject the proposals of the airlines Republic Airways and SkyWest Airlines to reduce the number of hours required to operate as an airline pilot in function for the relief of the payroll of staff available on airlines as a result of current crew shortages.

One of the largest regional airlines, Republic Airways, had applied to waive the requirement of 14 CFR 61.159, which requires 1,500 hours of flight time to earn an ATPL airline pilot rating. Meanwhile, Skywest Airlines has made a similar claim to address the current lack of pilots on airline payrolls.

The ALPA pilots’ union has said that «undermining the landmark First Officer Qualification Standards Act would put passengers and crews at risk. Republic and SkyWest, despite receiving significant government funding, still don’t know how to operate an airline without compromising safety. Taxpayers subsidized these airlines and are now trying to undermine the most effective safety measure in modern times, which has resulted in a 99.8% reduction in airline passenger fatalities. The petitions would be laughable if they were not so serious, and should be summarily dismissed», said Joe DePete, President of the ALPA Pilots Association.

Taking reference to the statements of the airline Republic Airways regarding the type of training they have: “Republic’s proposal that its academy is similar to the pilot training provided by the armed forces is totally wrong. Not only is this a solution in search of a problem, it will have deadly consequences by allowing less experienced first officers to sit in the cockpit”, said Joe DePete.

The First Officer Qualification Law (FO), approved by the United States Congress in 2010, has been formulated to raise the safety standard after a series of air accidents in the country. The changes introduced by the law have made it possible to improve the operational safety of airlines by making it possible to achieve an optimal level of training for flight crews.

Máximo ejecutivo Aeroflot condenado

AW | 2022 07 08 19:25 | AIRLINES / GOVERNMENT

Aeroflot CEO convicted

Important airline executive jailed in fraud case
More frauds incurred in Aeroflot Russian Airlines

A top executive of the airline Aeroflot Russian Airlines was found guilty of major fraud and was sentenced to prison. On July 8, 2022, Vladimir Alexandrov, Deputy General Director of Aeroflot, was sentenced to seven years in prison by the Moscow Gagarinsky District Court. The top executive of the Russian airline was found guilty of a large-scale multimillion-dollar fraud, the Russian news agency Interfax reported. «The court ruled to convict Vladimir Alexandrov of the crime under Part 4 of Article 159 of the Russian Criminal Code for large-scale fraud, and to sentence him to seven years’ imprisonment in a high-security penitentiary, said Court Judge , Olga Arbuzova, quoted by local media. Following the Court’s ruling, the Deputy Director General was also fined ₽ 900,000 Rubles/US$ 14,343.

Vladimir Alexandrov was arrested in October 2019, after the Russian authorities suspected that he had signed four contracts with two lawyers, Alexander Slivko and Dina Kibets, on behalf of Aeroflot. At that time, the top executive of the airline reached an agreement for the provision of legal assistance to Aeroflot in various civil and criminal proceedings. However, according to the Attorney General’s Office, the airline did not need such services, since it has its internal Legal Department for such cases.

Vladimir Alexandrov is not the first top Aeroflot executive to come to the attention of Russian authorities recently. On June 15, 2022, Mikhail Minayev, Director of Fleet Planning and Aircraft Acquisition of Aeroflot, was placed under arrest by the Moscow Khoroshevsky Court, as he was accused «in the framework of investigative actions carried out by authorized bodies», the Aeroflot Press Department confirmed to Interfax at the time. If convicted, Mikhail Minaev could face up to ten years in prison and a fine of up to ₽ 1,000,000 million Rubles/US$ 17,637.

In early May 2022, the Khoroshevsky Court arrested Andrey Panov, another high-ranking member of Aeroflot’s management team. At the time, the former Deputy General Manager was accused of being involved in a similar major fraud case. In April 2022, just before the arrest, Russian Federal Security Service (FSB) agents raided Aeroflot’s Moscow office and seized hard drives and documents belonging to the Department of Marketing and Strategy. The raid came after Andrey Panov published an opinion column on the Russian invasion of Ukraine in the Financial Times, in which he called on his former colleagues currently remaining in Russia to «sabotage the war effort». Immediately after the raid, the local police questioned employees who worked in Aeroflot’s Strategy and Marketing Department.

CAA India alerta a SpiceJet

AW | 2022 07 08 18:48 | AIRLINES / AVIATION ORGANISMS / AVIATION SAFETY

CAA India alerts SpiceJet

Warning about recurring security flaws

India’s Directorate General of Civil Aviation (DGCA) has presented SpiceJet with a good cause notice giving it three weeks to defend itself from regulatory action after a series of safety lapses of the company’s aircraft fleet. In its notice to the low-cost airline dated July 5, 2022, which the Ministry of Civil Aviation posted on its Twitter account the following day, it said that SpiceJet has failed to establish safe, efficient and reliable air services, noting a series of occasions since 04/01 in which aircraft have had to return to their point of origin or continue to their destination with degraded safety margins.

The airline alleged that vendors and suppliers were not being paid regularly, leading to shortages of spare parts and frequent invocation of its minimum equipment list (MEL). The MEL is a document that regulates which components of an aircraft may be inoperative during normal operations. The regulator warned the airline that if it does not respond within three weeks, the matter will proceed ex parte.

In a separate tweet, Aviation Minister Jyotiraditya Scindia said that passenger safety is paramount and even the smallest error hampering safety will be thoroughly investigated and corrected.

Local media have reported a number of incidents in recent weeks, including three incidents on July 5, 2022: a Boeing 737-800 flying from Delhi to Dubai diverted to Karachi due to a fuel gauge malfunction; a de Havilland Canada DHC-8-Q400 aircraft windshield cracked en route from Kandla to Mumbai; and a cargo plane’s weather radar failed en route from Kolkata to Chongqing, forcing it to turn back. All three planes landed safely, but the events brought the number of technical incidents involving SpiceJet in the past eighteen days to eight, broadcaster NDTV reported on July 6.

The DGCA blamed the failures on poor internal safety oversight at the carrier, delayed maintenance and the company’s troubled finances. An incident on May 1 involving a Boeing 737-800 in which 17 people were injured prompted the authority to inspect the entire fleet.

«We are an IATA-IOSA certified airline. SpiceJet successfully completed a meticulous audit program for recertification in October 2021. We have been regularly audited by the DGCA. All of our aircraft were audited a month ago by the regulator and found to be they were safe», the airline said on July 7, 2022.

Aw-TransNusa Airlines__Isologotype

TransNusa postpones launch

Indonesia’s TransNusa postpones launch to 10/2022

Indonesian airline TransNusa Airlines has postponed the launch of operations to October from July 2022 due to delivery delays of Airbus A320CEO aircraft. Bayu Sutanto, Managing Director of TransNusa, said the airline plans to launch commercial services in early October 2022, with his focus now on recertifying his Air Operator Certificate (AOC).

TransNusa took delivery of an Airbus A320NEO in December 2021. The Indonesian startup is still awaiting the delivery of the two Airbus A320-200CEO aircraft (2) which are now expected in late July and mid-September 2022, respectively. Deliveries were delayed for technical reasons. TransNusa plans to register its AOC with three Airbus A320CEOs in its fleet before commercial flights begin. The three aircraft are leased to China Aircraft Leasing Group (CALC). It also plans to add ARJ21 jets from the Commercial Aircraft Corporation of China (COMAC). Chinese media have released images of an ARJ21, in TransNusa livery, undergoing test flights prior to delivery in Shanghai, China. Bayu Sutanto says that the timing of ARJ21 deliveries depends on when the A320 fleet is operational. According to reports, Indonesia has validated the Chinese type certificate of China’s ARJ21, a plane that will start flying in August 2022 under the colors of TransNusa Airlines, being the first air operator to incorporate this type of aircraft in Indonesia.

In November 2021, after a year-long hiatus from the industry, TransNusa announced through its official Instagram post that the airline planned to return to the market beginning with the rebranding of its business model as Low Cost Carriers (LCC). ). The airline used to operate as a regional airline focusing on routes to the eastern part of the country and remote areas. The application for the Air Operator Certificate (AOC) has been started along with other preparations. Estimate to return to service flights in early 3Q2022.

TransNusa tunda peluncuran

TransNusa Indonesia tunda peluncuran hingga 10/2022
