La aerolínea low cost de Canadá, WestJet Airlines ha tomado entrega de su primer Boeing 787-9 para rutas internacionales sin escalas. Avión que lleva el nombre del presidente de la aerolínea, fundador; cuenta con nueva cabina más amplia.

Boeing entregó a WestJet el primero de los diez Boeing 787 Dreamliners, que marca el inicio de la expansión global de la aerolínea. GECAS efectúa traspaso A320 de Avianca Brasil a Azul Linhas Aéreas

General Electric Capital Aviation Services (GECAS) ha realizado el traspaso de diez aeronaves Airbus A320CEO de Avianca Brasil Airlines para Azul Linhas Aéreas. La rematriculación los aviones de Avianca a petición de La Agencia Nacional de Aviación Civil (ANAC) analiza la retirada del Registro Aeronáutico Brasileño (RAB). De acuerdo con la agencia, el procedimiento se está realizando tras la solicitud presentada el pasado Martes por la empresa de leasing dueña de las aeronaves, GECAS.

Las primeras aeronaves afectadas a la flota de Azul Linhas Aéreas con dos A320NEO PR-OBR Y PR-OBQ que se realizaron trabajos de pintura y reacondicionamientos de ambas aeronaves. Las rematriculaciones de los A320NEO serán PR-OBQ como PR-YYA y el PR-OBR como PR-YYB. Los aviones pertenecen al leasor BOC Aviation.

El organismo regulador del sector aéreo brasileño informó que la cancelación de la matrícula en el RAB puede ocurrir en hasta cinco días hábiles. Si se confirma la medida, la devolución de las aeronaves debe ser inmediata. El proceso para la retirada de las aeronaves del registro de la nAC Brasil está previsto en el Decreto Nº 8.008/13, informó la agencia. La norma prevé la ágil retirada de la aeronave por el propietario en casos de incumplimiento. Según la agencia, la cancelación de registro reduce los riesgos de financiamiento de activos de alto valor en contratos aeronáuticos, como los derivados de procesos de empresas en recuperación judicial, como es el caso de Avianca.

ANAC Brasil alertó que la suspensión del registro de las aeronaves usadas por Avianca puede generar impacto en los vuelos previstos para los próximos días. ANAC expresó: «continúa acompañando con atención la situación operacional de la empresa, siempre en constante vigilancia en cuanto al cumplimiento de los requisitos de seguridad exigidos en los Reglamentos Brasileños de Aviación Aeronáutica (RBAC) y los deberes de prestación de servicios a los pasajeros».

Los pasajeros afectados por cancelación de vuelo gozan de los siguientes derechos: reembolso íntegro del valor pagado por el paso; reacomodación en otros vuelos de la propia compañía o de otra empresa que ofrezca un servicio equivalente al mismo destino en la primera oportunidad; o ejecución del servicio por otra modalidad de transporte.aw-icon-txt-01

Los sindicatos confirmaron que suspenden la medida de fuerza programada por 48 hs

El Ministerio de Transporte de Argentina decidió derogar la resolución de reválida de licencias a pilotos extranjeros, por lo cual los trabajadores agremiados en APLA y UALA abandonaron la medida de fuerza que iban a realizar jueves y viernes. «En vistas al paro anunciado por pilotos, se derogará la resolución, y la validación de licencias extranjeras continuará haciéndose con la legislación anterior», informaron en un comunicado desde el Ministerio de Transporte. A partir de las 08:00 hs se llevó a cabo una audiencia en el Ministerio para continuar el diálogo y consensuar una nueva reglamentación al Artículo 106 del Código Aeronáutico.

El Ministerio de Transporte decidió derogar la resolución de reválida de licencias a pilotos extranjeros, por lo cual los sindicatos APLA y UALA levantaron el paro de 48 horas de pilotos de aerolíneas que debía comenzar a las 6 de hoy. La oficina de prensa del Ministerio anunció en un comunicado que «luego de que el sindicato de pilotos confirmara las medidas de fuerza y la paralización de los vuelos, se decidió derogar la Resolución Nº 895/2018 de reválida de licencias a pilotos extranjeros».

La medida del paro gremial afectaría el servicio a 96.000 pasajeros que tenían programados vuelos entre el jueves y el viernes, días en los que estaba anunciado el paro.aw-icon-txt-01

La Asociación de Pilotos de Líneas Aéreas (APLA) y la Unión de Aviadores de Líneas Aéreas (UALA) de Argentina anunciaron hoy un paro total de actividades por 48 horas a partir de este jueves, para protestar contra la normativa que favorece la llegada de pilotos extranjeros al país. «En línea con la actual SONY DSCpolítica aerocomercial, la Administración Nacional de Aviación Civil (ANAC) insiste en abrir libremente nuestros cielos a pilotos extranjeros para poder reemplazarnos si ejercemos nuestro derecho constitucional de huelga», expresa el Sindicato APLA.

La Secretaría de Trabajo había convocado a una reunión entre las partes para mediar en el conflicto sindical, pero el secretario general de la Asociación de Pilotos de Líneas Aéreas (APLA), Pablo Biró ratificó el paro. El gobierno nacional, a través de la Secretaría de Trabajo, dictó hoy la conciliación obligatoria en el conflicto de los pilotos, pero los sindicalistas del sector sostienen que no fueron notificados y ratificaron la medida de fuerza de 48 horas a partir de este Jueves, 17 Enero 2019.

El paro, dispuesto por los pilotos agremiados en APLA (Asociación de Pilotos de Líneas Aéreas) y UALA (Unión de Aviadores de Líneas Aéreas), afectará a las compañías aéreas que vuelan cabotaje en el país con pilotos argentinos, Aerolíneas Argentinas, Austral Líneas Aéreas, Andes Líneas Aéreas, Avianca Argentina y Latam Airlines Argentina.

Mientras tanto, no así a Flybondi Líneas Aéreas y Norwegian Air Argentina, ya que estas empresas no cuentan con personal afiliado a ninguno de los sindicatos que lo decretaron, sino más bien por gremios propios de ambas aerolíneas.

El conflicto se inició en el cuestionamiento por parte de los pilotos de la Resolución Nº 895/2018 que se publicó el 22 Noviembre 2018 de la ANAC que resolvió la habilitación de instructores extranjeros de vuelo.

Actualmente la norma establece que los pilotos extranjeros solo pueden operar como instructores y están habilitados a volar por un período de dos años, que es el período fijado cuando una compañía compra aviones y los pilotos locales no tienen la autorización para operarlos. Los gremios argumentaron entonces que esta resolución es una puerta que se abre para avanzar con el contrato de pilotos extranjeros fuera de convenio para poder romper huelgas y frente a esta situación dispusieron un paro por 48 horas para los días 13 y 14 Diciembre 2018, pero la cartera de Trabajo dictó la conciliación obligatoria por 15 días hábiles.

Sindicatos analizan próximo para de pilotos en Argentina

Los pilotos de aerolíneas en Argentina volverán esta semana a las medidas de fuerza con afectación de los vuelos, por el conflicto laboral que mantienen con el Gobierno hace más de un mes. Este Martes 15 Enero 2019 había finalizado la Conciliación Obligatoria establecida por el Gobierno, y los gremios aeronáuticos podrían parar durante esta semana.

El conflicto estalló a principios de Diciembre 20108 con la Resolución 895/18 por la que la Administración Nacional de Aviación Civil (ANAC) facilitó el proceso de “Reválida de licencias a pilotos extranjeros”. Básicamente, la ANAC reconoce la experiencia de cualquier piloto extranjero y le otorga una licencia argentina para que pueda volar en el país. Esto antes estaba restringido sólo a los pilotos deportivos.

Conflicto interpretaciones

Los gremios ven a la decisión oficial como un potencial peligro para las actuales y futuras fuentes de trabajo de los pilotos locales. Esa conciliación obligatoria venció este Martes a las 23:59 hs, por lo que la Asociación de Pilotos de Líneas Aéreas (APLA) y la Unión de Aviadores Líneas Aéreas (UALA) confirmaron el retorno del plan de lucha.

APLA y UALA sostienen que el objetivo del Gobierno no es sólo facilitar el ingreso de instructores extranjeros al mercado argentino, sino que estos trabajen como pilotos comerciales no sindicalizados para erosionar el poder de fuego de los combativos gremios aeronáuticos. Según aseguró el ministro de Transporte, Guillermo Dietrich, cuando estalló el conflicto, la ANAC decidió agilizar la validación de las licencias de los pilotos extranjeros porque las nuevas aerolíneas que vienen a operar en la Argentina necesitan traer instructores para capacitar al personal local contratado.aw-icon-txt-01

Trade unions analyze next for pilots in Argentina

La Justicia de Argentina avaló que la compañía Aerolíneas Argentinas desestime con una “Cláusula Gatillo” pautada con los trabajadores como reaseguro de actualización de salarios. La Cámara Laboral de Argentina rechazó una medida cautelar a favor de los trabajadores cuya actualización salarial quedó muy por debajo de la inflación en 2018.

En plena feria judicial, un Tribunal de Primera Instancia y la Cámara Laboral rechazaron dictar una medida cautelar que proclamara la vigencia con la consecuente obligación de cumplir la cláusula de actualización de los salarios.

El reclamo, formulado por la Asociación de Pilotos de Líneas Aéreas (APLA), no está definitivamente cerrado, pero deberá tramitar como un proceso laboral ordinario y, entretanto, Aerolíneas quedó tácitamente facultada para no aplicar la actualización automática de los salarios de los trabajadores. La entidad gremial había pedido el dictado de una medida cautelar que contuviera una declaración de vigencia que avente la incertidumbre sobre la vigencia del Acta Acuerdo del 21 Diciembre 2017 y a la vez confirme la obligación de cumplimiento de la Cláusula Gatillo, y la APLA reclamaba que se disponga la plena vigencia por ultractividad de la cláusula 4 de dicho convenio salarial.

El Tribunal sostiene: “La pretensión cautelar guarda estrecha conexión con los planteos de fondo, lo que refuerza la necesidad de ventilarse en su cauce propio mediante el juez natural y con todas las garantías procesales correspondientes, entre ellas la bilateralidad del Proceso. El Tribunal entiende que la pretendida declaración de vigencia de la cláusula convencional, a través de la medida precautoria constituye el presupuesto que se asentaría la procedencia de los reclamos salariales incoadas en la pretensión sustancial. Por todo lo expuesto, desestímase la medida cautelar requerida”, sostuvo la resolución del Poder Judicial.aw-icon-txt-01

Gremio aeronáutico y Norwegian Air Argentina avanzan en la redacción de un acuerdo para establecer un convenio de trabajo particular.
