La próxima Presidencia ha anunciado los primeros lineamientos con una fuerte posición marcando una tendencia hacia la desinversión en el áerea del petróleo, lo que se refleja un fuerte impacto de los combustibles en el sector de la aviación industria-comercial.

En el último debate contra Donald Trump, Joe Biden aseguró que volcaría sus energías en ir acabando con la industria del petróleo, el combustible insustituible actualmente para el negocio aéreo, encargado de canalizar los flujos de tráfico aéreo. El demócrata dijo que se planteaba que “en 2035 Estados Unidos fuera el primer país en emisión neta cero”.

Ryanair recurre a Justicia europea contra ayudas a aerolíneas

La aerolínea europea low cost Ryanair ha anunciado este Viernes 06/11 que ha presentado ante el Tribunal de Justicia de la UE (TJUE) un recurso contra la autorización por la Comisión Europea al Gobierno español para inyectar € 475 millones de Euros a Air Europa con el fin de evitar su quiebra inmediata. Actualmente, Air Europa tiene un préstamo de € 140 millones de Euros avalado por el Instituto de Crédito Oficial (ICO) y € 600 millones en deudas acumuladas, con unos resultados operativos negativos. El Gobierno de España ha justificado esta ayuda en que la aerolínea es estratégica y en que podrá devolver la cuantía en seis años, pese a que entre 2013 y 2018 acumuló € 80 millones en beneficios económicos.

Ryanair, se está posicionando nuevamente como una aerolínea más agresiva que nunca tras los embates económicos que sufren las aerolíneas en este período de pandemia, que se encuentran muy débiles financieramente. La low cost irlandesa ha asegurado que llevará a los tribunales europeos todos los casos en los que se concede ayuda estatal que contravenga la legislación comunitaria, en particular, aquellos que socaven los principios de no discriminación y libertad para ofrecer servicios. En Agosto 2020, Ryanair contemplaba la desaparición de Air Europa, y expresó que ello sería beneficioso para todos, incluso pese a que ambas aerolíneas anunciaron en mayo de 2017 un acuerdo entre las dos que consideraron histórico entonces. “Creo que los consumidores españoles probablemente se beneficiarían si Air Europa abandonara el mercado. Sé que en el corto plazo no parece lo correcto, porque desaparece una marca muy conocida”, afirmó el Director Legal de la low cost irlandesa, Juliusz Komorek. En Septiembre 2020 ha intensificado su campaña en contra de las ayudas estatales al llevar al Ejecutivo comunitario ante la Justicia europea para desautorizar los rescates de seis aerolíneas por parte de sus respectivos Gobiernos: SAS Airlines, Finnair, TAP Portugal, Air France, KLM Airlines, y Lufthansa German Airlines. En todos esos casos, sus cuotas superaban el 50 por ciento del tráfico, mientras que en el de Air Europa no se acerca al 20 por ciento.

Avianca Argentina despide empleados fuera de ley

Avian Líneas Aéreas, bajo la marca Avianca Argentina continúa atravesando la inactividad desde Junio 2019 tras la presentación del proceso de adecuación de quiebra adeudando sueldos hace casi un año y medio. Recientemente, la línea aérea regional ha despedido a siete trabajadoras según la empresa con la supuesta causa justa por tener otros trabajos. La Asociación de Aeronavegantes de Argentina (AAA) ha emitido un comunicado que la empresa Avian Líneas Aéreas decidió despedir a trabajadoras con el argumento de que trabajan para otra empresa. «Las compañeras, lógicamente, han comenzado otros trabajos para ganarse la vida. De ningún modo eso exime de responsabilidades a Avianca», explicaron en un comunicado.

La rápida acción del Sindicato AAA ha emitido el comunicado repudiando el accionar de Avian Líneas Aéreas, y advirtió que iniciarán presentaciones legales ante la Justicia de Argentina, después que siete empleadas han recibido un telegrama de despido con justa causa, en los términos del Artículo 88 de la Ley de Contrato de Trabajo. El Gremio de Aeronavegantes artilló: “el cínico argumento esgrimido resulta ser el de trabajar para otra empresa, en casos en que las compañeras, lógicamente, han comenzado con otros trabajos para ganarse la vida”.

En Abril 2019 la compañía arrastraba una deuda de US$ 30 millones de Dólares, con la suspensión de la cuenta corriente de combustible y el retiro de aeronaves por falta de pago. Finalmente, en el mes de Junio 2019 anunciaron que dejarían de volar por seis meses, en base a una reestructuración pero la aerolínea regional no ha vuelto a volar con el consiguiente incumplimiento de los contratos laborales de los empleados sin cobro de sueldo por 19 meses. La AAA expresó que “de ningún modo eso extingue los derechos de nuestros afiliadas ni exime de sus responsabilidades y obligaciones a Avianca. Esto no hace más que confirmar el carácter miserable de la conducción de esta fallida aerolínea, que adeuda salarios desde hace casi dos años y nunca puso en regla su precaria e insolvente situación económica y jurídica”.

El comunicado del Sindicato de Aeronavegantes asegura que se “está evaluando no sólo la respuesta a este burdo ataque en plena vigencia de la prohibición de despidos, sino también otras posibles acciones de carácter jurídico que puedan caberle a los responsables de este vergonzoso y despreciable accionar”.

El Consorcio Murari Lal Jalan y Kalrock Capital que manejará los destinos de Jet Airways había presentado un plan para resucitar la aerolínea de presupuesto de la India. El Profesional de Resolución (RP) encargado de todos los procesos de auditoría, ha trasladado una solicitud con el National Company Law Tribunal (NCLT) solicitando la aprobación para el consorcio para activar el plan presentado.

El impacto de la pandemia ha afectado las economías de las líneas aéreas, el turismo y diferentes sectores que motorizan las economías. Tras permanecer cerrado el Aeropuerto Internacional El Palomar, se han visto perjudicadas las compañías Flybondi Líneas Aéreas, JetSmart Airlines Argentina, la concesionaria de servicios logísticos en tierra Acciona, entre muchas empresas que de manera directa e indirecta complementan a la activación del país. La desaceleración económica y las inacciones del Gobierno de Argentina frente a la necesidad de conservar empleos, continúan representando serios problemas para los empleados de las aerolíneas, aeropuertos y demás sectores que complementan las actividades del Aeropuerto El Palomar.

La anulación de los vuelos hacia los diferentes aeropuertos del país son consecuentes con la disminución de trabajo que continúa impactando en muchos aeropuertos, como por ejemplo Bariloche, desde donde acompañan la preocupación de los trabajadores de Flybondi que piden la reapertura del Aeropuerto El Palomar, porque han sido autorizados parcialmente a operar desde Ezeiza, pero no les resulta viable. «Los barilochenses tenemos algo que decir a las autoridades nacionales para que habiliten definitivamente los vuelos y se mejore la oferta en materia de conexión aérea», expresó el concejal Pablo Chamatrópulos de la Ciudad de Bariloche.

La empresa española de servicios aeronáuticos Acciona, que prestaba servicios a la aerolínea low cost JetSmart Airlines Argentina en los aeropuertos de El Palomar, Salta y Neuquén, anunció este 05/11 a sus cincuenta empleados que quedarán cesantes, producto de que abandonará su unidad en Argentina por la parálisis del sector. Hasta ahora, la única empresa habilitada para volar es Aerolíneas Argentinas, mientras que Gobierno concentró todos los vuelos en Ezeiza. Según la empresa el cierre obedece al impacto que hemos enfrentado producto de la pandemia COVID-19. El comunicado de Acciona dice lo siguiente: «Este año la industria aeroportuaria, a escala global, ha sufrido uno de los más profundos impactos en su historia, producto de la pandemia mundial. Las restricciones producto de la pandemia han generado un nuevo contexto que ha obligado a Acciona a tomar la dura decisión de cerrar sus operaciones de handling de pasajeros en la Argentina, finalizando el contrato que la compañía mantenía con su único cliente, JetSmart», agrega la firma que presta servicios aeronáuticos en España, Alemania y Chile. Acciona mantuvo su operación en la Argentina completamente a pérdida durante los siete meses en que los vuelos de cabotaje estuvieron suspendidos. Apenas una semana después de que se reiniciaran los vuelos de cabotaje, con la lógica expectativa de que todas las empresas del sector vuelvan a tener ingresos, la empresa decidió levantar su unidad de negocio del país.

Incongruencias del Gobierno

El Viernes 23/10, unos días después de que se habilitaran los vuelos y se aprobara la fusión entre Aerolíneas Argentinas y Austral Líneas Aéreas, en asamblea de accionistas, el Organismo Regulador del Sistema Nacional de Aeropuertos (SNA) comunicó a la Administración Nacional de Aviación Civil (ANAC) que el único corredor sanitario seguro de la zona del AMBA es el Aeropuerto de Ezeiza. La aerolínea de presupuesto Interjet continúa adeudando dos meses de quincena a sus trabajadores, como así también dificultades en últimos meses para establecer operaciones. Interjet, a Mexico-based low-cost airline, has canceled all of its Sunday flights and unloaded thousands of passengers as reports emerged that it had not paid for jet fuel. La aerolínea Latam Airlines Argentina insistió ante el Ministerio de Trabajo en su solicitud de abrir un Procedimiento Preventivo de Crisis (PPC) para cerrar la filial local y pagar una indemnización equivalente al 50% de lo que establece el convenio colectivo. Esa solicitud ya ha sido rechazada por el Ministerio de Trabajo encabezada por Claudio Moroni. Los directivos de la filial argentina de la aerolínea admitieron que no tienen expectativas con un nuevo pedido de PPC, entendiendo que el Gobierno volverá a rechazar la solicitud formulada.

La aerolínea había anunciado su cese de operaciones el 17 de Junio de 2020, con la presentación de la solicitud para abrir un procedimiento de crisis con el Ministerio de Trabajo. Independientemente de la cantidad exacta que se abone, el número de acuerdos actualmente celebrados representan dos tercios del personal de Latam Airlines retirado. Inclusive algunos empleados de Latam Airlines o Latam Travel, también han decidido por retiros voluntarios.

Estos acuerdos de despido representan una puja que la empresa pide desde el exterior y las demandas de los sindicatos aeronáuticos. La postura de afirmación legal de Latam Airlines Group es que está pasando por una situación de fuerza mayor como resultado de la decisión del Gobierno de haber suspendido todos los vuelos comerciales desde mediados de Marzo 2020, debido a la pandemia. Según esta interpretación, la sociedad se enmarca en el Artículo Nº 247 de la Ley de Contratos Laborales de Argentina, que establece que cuando los despidos se den por fuerza mayor, el importe de la indemnización es equivalente a la mitad del establecido en el Convenio Colectivo de Trabajo.

El Martes 28/10, una marcha convocada por los sindicatos se ha dado cita en Aeroparque hacia la Embajada de la República de Chile, culminando la manifestación en el Obelisco, sobre la Avenida 9 de Julio. La mayoría de los convocados responden a los sindicatos de Personal de Tierra (APA), Técnicos Aeronáuticos (USTARA) y Tripulación de Cabina (ATCPEA). La demanda de los sindicatos es que se aplique el Decreto Nº 528, que prorrogó la doble compensación hasta Diciembre 2020.
