AW-7000012Wk.jpgEU grants airlines time out-Brexit agreement

The European Union gives airlines the deadline for the Brexit non-agreement.

The plan would potentially force the sale of shares for carriers to remain in the air. Brussels will grant to airline groups such as IAG, owner of British Airways and Iberia, a period of seven months to review the composition of its shareholders in order to retain all flight rights within the EU if Britain falls from the block without an agreement. month.

The strict adjustment period for airlines, which must demonstrate that they are majority owned and controlled by EU citizens to have all the rights to fly across the continent. EU member states are widely supporting the approach before Britain’s scheduled departure on March 29, 2019.

Aviation is a tightly regulated sector that faces a double blow from Brexit, as an abrupt departure from the UK from the EU would interrupt not only the flight schedules but also the licenses that operators currently use to operate, which are administered based on the nationality of the shareholders.

EU senior officials say the proposed seven-month grace period is combined with precise requirements and deadlines, which would force operators such as IAG and Ryanair, which also has a large number of UK shareholders, to potentially activate the forced sale of EU investor shares.

The plans of airline groups to maintain existing licenses must be presented to regulators within two weeks after the adoption of the bill, which could arrive later this month. «This plan will establish, in a complete and precise manner, the measures aimed at achieving full compliance with the [EU] ownership and control requirements as of October 27, 2019 at the latest. When the airline has not submitted a plan within the time limit of [two weeks], the competent licensing authority will revoke the operating license», states the bill.

While easyJet, based in Ryanair and Luton, says they have contingency plans to ensure that 50% of their shareholders are EU citizens, possibly through the forced use of stock sales, IAG has been reluctant to explain their proposals to deal with a Brexit without agreement. According to independent estimates, IAG faces the biggest challenge of all, as some analysts believe that its current participation in the EU is 25 percent. Brussels has warned IAG that its favorite plan to continue flying freely around Europe would not comply with EU laws, according to senior officials. At a press conference on Friday, IAG president Willie Walsh declined to comment on the work IAG was doing with its Spanish airlines to prepare them for Brexit. He added that he hoped that the United Kingdom and the EU would reach «a global agreement» on Brexit. A spokesman for IAG said the group was confident they would comply with EU property rules after Brexit.

José Luis Ábalos, Minister of Public Works of Spain, told Parliament this week that Iberia and other airlines were working hard to adjust their control structure and ownership to be ready for the Brexit. The EU airlines’ compliance rules are part of a package of emergency laws that aim to keep basic transport services running if Britain leaves without an agreement next month.

Spain, France, Finland and Poland led the calls to offer much more generous agreements for carriers and airline groups, so the interruption levels were reduced after a Brexit without agreement. In particular, Spain called for a more relaxed approach to enforce airline ownership rules.

European Comission

In contrast, the European Commission has adopted a less lenient approach, arguing that future negotiations with Britain would be undermined by offering single market benefits to UK transport groups in a scenario without an agreement, even for a temporary period. The compromise discussed by the ambassadors of the other 27 member states extends more operational freedoms to freight carriers, with a limit on flight numbers. Passenger flights are limited to point-to-point travel, which could cause considerable disruption for non-EU airlines operating from the United Kingdom.

The French request that carriers enjoy single market rights for a limited period after Brexit has been rejected by other member states. Germany and the Netherlands were among the countries calling for a more disciplined approach to contingency measures for a Brexit without an agreement, according to a diplomatic note from the meeting.

In its original proposal, the commission avoided giving the airlines a period of adjustment. At this week’s meeting, he noted the concerns of several member states about ownership and control of airlines, including Spain, France, Cyprus, Hungary and Ireland. But EU officials said we should not give a competitive advantage to those who did not plan ahead. The seven-month deadline was described by officials as a way to align airlines with property regulations in a fair way, since airlines would have to submit their restructuring plans before the Brexit occurs.

The Dutch government wants airlines to share information about their passengers with the government in the future. This information is necessary in the fight against terrorism and serious crimes, said Justice and Security Minister Ferdinand Grapperhaus, in a letter to the Tweede Kamer, the Lower House of the Dutch parliament.

The data will be stored for five years and will be managed by an independent body, which will be overseen by the Netherlands Data Protection Authority. The police and the Prosecution Service, among others, will have access to this information.

«If we know better where and when criminals and terrorists travel, we can also deal with them faster», Grapperhaus said in his letter. He is convinced that this measure will serve for security. It will only be used for its purpose: the prevention and detection of terrorism and serious crimes. This bill has yet to be approved by the Tweede Kamer and the Eerste Kamer, the Dutch Senate. A \ W

Reclamos gremios en Argentina

aw-700001089

AW | 2019 01 23 11:41 | AIRLINES / GOVERNMENT

Aeronautical Guilds in Argentina threaten new strikes on Airlines and Latam Airlines

The aeronautical guilds of Argentina expect to hold a meeting with the Secretary of Labor in claims of a pending payment of 2018, which could lead to a new strike of not agreeing between parties.

The aeronautical unions demand a salary adjustment pending last year in Aerolíneas Argentinas and Austral Líneas Aéreas. Another claim to the doors is that of Latam Argentina Airlines with an unresolved parity so far. Both negotiations are carried out four months apart, but the claims now continue in parallel.

Aerolíneas / Austral

In the case of the joint venture of Aerolíneas Argentinas and Austral, the negotiation was ongoing throughout January but without a horizon according to the view. The main obstacle is the claim of the unions for a 6.5% extra increase that, they argue, should be incorporated into the salaries of the activity last September by application of the trigger clause and that the authorities of the nationalized company were unaware of understanding that the inflation of that month was already outside the scope of the parity 2018. In recent days the airline managers offered instead of that percentage the payment of a fixed sum of between $ 5,000 and 32 thousand pesos (depending on each category) and two rise as a bridge to defer formal parity negotiation until the second quarter: 10.2% with the salaries of January, and another 4.1% with those of March. The lack of recognition of 6.5% by the company led the unionists to reject any other adjustment.

If an agreement between the government and the unions does not succeed, the measure of force would affect around 90% of the air traffic. The payroll claims of the aeronautical unions include salary improvements, the general aero commercial policy aimed at low cost lines at the expense of the flag company, the specific problems of each union as the deregulation of the ramp service to the detriment of Intercargo , the creation of a union facilitated by Flybondi and Norwegian Air Argentina. Próximo paro pilotos en Argentina

AW-70004344222.jpgAW | 2019 01 16 16:30 | AIRLINES / AVIATION ORGANISMS / GOVERNMENT

Trade unions analyze next for pilots in Argentina

The pilots of airlines in Argentina will return this week to the measures of force with affectation of the flights, by the labor conflict that maintains with the Government does more than a month. This Tuesday 15 January 2019 had completed the Compulsory Conciliation established by the Government, and the aeronautical unions could stop during this week.

The conflict broke out at the beginning of December 20108 with Resolution 895/18 whereby the National Civil Aviation Administration (ANAC) facilitated the process of «Revalidation of licenses for foreign pilots». Basically, the ANAC recognizes the experience of any foreign pilot and grants him an Argentine license so he can fly in the country. This was previously restricted to only sports drivers.

Conflict interpretations

The guilds see the official decision as a potential danger for the current and future sources of work of the local pilots. They maintain that nothing has to do with the measure with the intention of repatriating Argentine workers who are abroad. For the Government, however, the benefit is only for the foreign instructors who come to train the workers of the new firms that disembark in the country, but the unions insist that this is not explicit anywhere in the measure.

The pilots of the airlines of Latam Airlines Argentina, Avianca Argentina, Andes Líneas Aéreas, Aerolíneas Argentinas and Austral Líneas Aéreas launched a strike of 48 hours for 13 and 14 December 2018, but the Ministry of Labor dictated the mandatory conciliation until 28 December and then extended it until January 15, 2019. That mandatory conciliation expired this Tuesday at 23:59 pm, so the Association of Airline Pilots (APLA) and the Union of Airline Aviators (UALA) confirmed the return of the fight plan.

APLA and UALA argue that the Government’s objective is not only to facilitate the entry of foreign instructors into the Argentine market, but that they work as non-unionized commercial pilots to erode the firepower of the combative aeronautical guilds. According to the Minister of Transportation, Guillermo Dietrich, when the conflict broke out, the ANAC decided to expedite the validation of the licenses of the foreign pilots because the new airlines that come to operate in Argentina need to bring instructors to train the local personnel hired.

AW-7000003.pngDeregulation service ramp in Argentina

Deregulate the provision of ramp services in airports in Argentina, eliminating the monopoly of exclusivity

The Government of Argentina eliminates the exclusivity of ramp services at the airport in Argentina to Intercargo. The National Civil Aviation Administration (ANAC) will be in charge of the inspection of the service.

Intercargo was the company that provides the airport services applied to the airlines in the Argentine Republic, retaining exclusivity for all the airlines operating in Argentina, with the exception of Aerolíneas Argentinas/Austral Líneas Aéreas, whose service was covered by Aerohandling, Grupo Airlines company. and the American American Airlines, which has its own service.

Called public tender

The Government of Argentina will call public bidding with National Decree No. 49/2019 published in the Official Gazette to find bidders for the provision of ramp services in all airports in the country. The decree also determines the creation of a commission integrated by the authorities of the Ministry of Transport, Labor, ORSNA and ANAC, Aeropuertos Argentina 2000, Intercargo and Aerohandling. The aeronautical unions will also be summoned, faced with the Government. Ramp services include the ascent and descent of passengers, loading and unloading of luggage, haulage with tractors, the task of signallers and the external and internal cleaning of aircraft, among others.

The International Civil Aviation Convention (ICAO) of 1944, which provides that «any airport of a Contracting State that is open to its domestic aircraft for public purposes shall also be open, under uniform conditions, to aircraft of all other Contracting States in with respect to the use of all facilities and services for air navigation. Such conditions require the uniformity of opportunities for all the airlines that operate in the Argentine Republic or have it as a stopover or point of destination».

The resolution establishes that the National Civil Aviation Administration (ANAC) will supervise the service as a complement to the public use of facilities at the airports of the National Airports System (SNA) and other aerodromes under the jurisdiction of the National State, that will also approve the rates.

In September 2018 the Government of Argentina had considered a progressive deregulation to eliminate the monopoly of the ramp services in all the Argentine airports where the majority of the airlines operate. The scope of Decree No. 49/2019 now considers competitiveness in a market that for a long time was dominated by intercargo exclusivity, with prices for its high-flying services. A \ W

Indonesian airlines seek protection against foreign airlines

The President of the National Association of Air Transport Companies of Indonesia (INACA), Ari Askhara, has asked the government to provide protection to the aviation companies of Indonesia against the influx of foreign airlines, as many domestic airlines are in a critical condition.

Ari, who is also Chairman of the Director of the flag carrier Garuda Indonesia, asked the government not to issue any operational permits for new national airlines. «The 11 airlines are now ‘panting’, so do not add new players, the government has to protect domestic airlines, do not easily grant places to foreign airlines at our airports or centers,» said Ari Askara in Jakarta on Tuesday. He also called on relevant stakeholders to help domestic airlines survive by reducing airport costs and reducing the prices of avtur (aviation fuel) to ease their burden.

He called on operators of state airports and PT Angka Pura (AP I and AP II), as well as the Indonesian Flight Navigation Services Institution (LPPNPI), AirNav Indonesia, to reduce airport costs by 30% . Meanwhile, he called on state oil and gas producer Pertamina to reduce the average price by 10%. A \ W

Airlines asked him to prepare not to negotiate before the vote in the May Plan

Brussels has warned the remaining 27 countries of the European Union that they must urgently explain how their airline licenses comply with the block ownership rules or face the loss of their rights to fly after Brexit.

In a letter sent last week, Violeta Bulc, the EU commissioner responsible for transport, revealed that not all national governments had established detailed plans on how airlines would meet the «ownership and control requirements in all possible scenarios» of Brexit EU officials have recently prioritized warnings to airlines as part of an effort to avoid a complete collapse of the industry in a Brexit scenario without agreement. British Airways and its sister airline Iberia, the Spanish airline that is also owned by IAG, are among the companies that have not yet explained how they will meet the strict EU ownership criteria after Brexit. According to EU regulations, airlines must be controlled and owned by more than 50 percent of EU investors to maintain their ability to fly freely in the block.

Ms. Bulc asked the EU27 transport ministers to move to explain how the affected airlines licensed by each country would meet this criterion on March 30, the day after Brexit. She warned them that this is an urgent matter «given the remaining short term that lies ahead».

Ryanair and EasyJet have already revealed that they will eliminate the voting rights of non-EU shareholders to comply with the EU control rule. They have also applied for secondary operations licenses to allow fights to continue: EasyJet from Austria and Ryanair from the UK.

Last week, it was revealed that the EU Commission had warned IAG that its plan to continue flying in and around Europe in the case of a Brexit without agreement was not enough. The company planned to maintain the flight rights of the EU and the United Kingdom by stating that its airlines are nationally owned by a number of companies, rather than being seen by the larger group, which is made up of the majority of investors. that do not belong to the EU.

The Spanish government said it was «convinced that Iberia is a Spanish company and we are also convinced that, if necessary, the company will make the necessary adjustments to ensure that it complies with European regulations».

IAG, which is a Spanish company but has its headquarters in the United Kingdom, said: «We are confident that we will comply with the rules of ownership and control of the EU and the United Kingdom after Brexit».

The European Commission is considering giving British airlines additional time to reach a majority stake in the EU in order to maintain their flight rights on the Continent.

Aer Lingus and Vueling, owned by IAG, as well as Ryanair and Easyjet, would be affected by a Brexit without agreement.

However, an official of the EU Commission has revealed that the block can not make ground flights within the EU immediately operated by British airlines to implement «corrective measures or actions» to comply with the rules of ownership of The EU.

The source revealed that the EU Commission has the right to act in case it finds that an operating license does not comply with the applicable requirements, including ownership and majority control of the EU.

«In this case, you can set a date for the implementation of corrective measures by the competent authority for the granting of licenses, in case the carrier in question no longer has the right to exercise its rights to operate air services within the Union». The Euractiv news website told the EU.

In December, the EU Commission revealed plans to maintain «basic» transport connectivity between the EU and the UK in the case of a Brexit without agreement, which would allow British flights to land and take off in the EU.

The temporary flight rights will be valid until March 2020 «to avoid a total traffic interruption». But the restrictions mean that flight operators can not fly to other EU destinations or take new passengers to a destination outside the United Kingdom. A \ W

The challenge of the airlines for the Brexit

European airlines could have adverse effects for Brexit

The measures to allow flights to continue between the European Union and Great Britain in the case of a disorderly Brexit is unlikely to be enough to avoid some simbronazos in commercial aviation.

Britain is expected to leave the EU on March 29, 2019, but, less than three months, the UK Prime Minister, Theresa May, has failed to obtain support in her country for an exit agreement, which increases the chances of a break without agreement in relationships. «We are a little worried because the first guidelines have been issued and, I believe, represent a restriction in traffic», said Alexandre de Juniac, General Director and CEO of the International Air Transport Association (IATA). The measures were based on traffic between the EU and Great Britain in 2018, so it did not take into account the planned increases in flights this year.

In the case of a Brexit without agreement, flights would have to start to adjust or even cancel once traffic has reached the 2018 ceiling on which the measures were based.

Spain would support most of the EU rules after Brexit. Brexit threatens IAG, parent of British Airways (BA). Half of Spain’s national passengers and a quarter of the total could be punished if IAG can not prove that their Iberia and Vueling weapons are owned by EU investors.

One of the licensing conditions for the operations of EU operators is that they are controlled by private national assets of the member states, or the states themselves, something that IAG, based in London, has said it does through its own Spanish registry and the granting of the voting rights of Iberia and Vueling. in local holding companies.

The EU has said that IAG must verify that the structure meets the requirements before Britain leaves the block on 29 March 2019 or runs the risk of canceling its right to operate some services. With the group itself based at Heathrow Airport and 21% owned by Qatar Airways with extensive stakes in the United Kingdom and the United States, this may not be easy. IAG reiterated on Wednesday that it remains confident that it will «comply with the ownership and control rules of the EU and the United Kingdom after Brexit», after a broad commitment to all relevant regulators and governments.

Vueling, Iberia and Iberia Express together had a 47% share of Spanish national passengers in March, according to the latest report from the Ministry of Public Works. Combined with BA and the Irish unit Aer Lingus, the global market share was around 25%.

Spain relies on Iberia to establish global commercial links and the Vueling discount based in Barcelona is vital for the Catalan economy. Spain is also more dependent on aviation than most countries, since tourism accounts for more than 10% of GDP and close to 13% of employment.

The Spanish Agency for Safety and Air Protection (AESA), which informs the government, may find itself in the unenviable position of having to decide if Iberia and Vueling flights are due to land, since the competence to assess compliance rests with National authorities, said the European Commission. Even if AESA determines that Iberia and Vueling are Spanish enough to keep their licenses, competitors such as Air France-KLM Group and Lufthansa could object and the commission itself could intervene. The airline was warned that its plans to continue flying in Europe and around it after Brexit will not work. A \ W
