Aerocivil define si aprueban fusión con Avianca

El destino de Viva Air Colombia (Fast Colombia S.A.S.) se define el Martes 21/03, donde la agencia Aerocivil de Colombia determinará si aprueba la integración Avianca–Viva Air. Después de unas semanas tensas para el mercado aéreo colombiano, el destino de la aerolínea low cost se definirá si aprueban o no la integración de ambas aerolíneas en un proceso para evitar el concurso de línea aérea de prresupuesto colombiana. Las dos aerolíneas han afirmado que la polémica integración es la única opción viable para salvar a Viva Air de la quiebra.

La aerolínea de bajo costo ha argumentado que su integración con Avianca es la única opción para superar su crisis. Los aviones de la aerolínea permanecen en tierra desde el 27 de Febrero de 2023 y se sabe que, por lo menos tres de ellos, fueron reclamados por sus arrendatarios en Estados Unidos.

Aerocivil aseguró que ha estudiado más de setenta archivos para tomar una decisión tras el primer intento fallido de consumar esta operación que tuvo que iniciar desde el principio por un error de trámite. La autoridad aeronáutica también ha tenido en cuenta la posición de los terceros interesados, entre los que figuran JetSMART Airlines Group, Ultra Air, LATAM Airlines Group, Wingo y Aerolíneas Argentinas, en medio de un mercado revolucionado de fusiones y adquisiciones.

Mercado colombiano
La integración entre Viva Air y Avianca, a juicio de los competidores, de aprobarse la solicitud concentrarían más de un 50% del mercado y se afectaría la libre competencia. La suspensión súbita de los vuelos operados por Viva Air ha traído consecuencias para el sector turístico colombiano. Por ejemplo, estudios de las plataformas Kayak y Viajala muestran que los tiquetes nacionales se han encarecido más de 20% para diversos destinos y, en otros casos, hay ciudades que se quedaron sin cobertura o sin rutas directas. De acuerdo con la Asociación Colombiana de las Agencias de Viajes y Turismo (ANATO), estos agentes reportaron COL$ 8.000 millones en riesgo debido a la paralización de la low cost. De hecho, en el marco de la junta de Ciudades Intermedias de Colombia, los alcaldes de 65 municipios hicieron un llamado urgente al Gobierno nacional para que alcance soluciones a las crisis que enfrentan en sus localidades por conexión aérea.

El Ministro de Transporte, Guillermo Reyes, indicó que la aerolínea recaudó antes del cese de su operación COL$ 272.000 millones, por concepto de la venta de pasajes aéreos, tiqueteras y la recepción de pagos de diversas agencias de turismo. Una situación que causó malestar entre los usuarios que han sido reacomodados en vuelos de las demás aerolíneas. Esto ha desencadenado un desprestigio de Viva Air mientras se profundizaba su crisis financiera. La Superintendencia de Transporte sometió a control a la compañía y posibles multas. Además, la Superintendencia de Sociedades estudia la posibilidad de que se establezca una reorganización empresarial. Así mismo, la empresa está envuelta en un proceso legal tras la denuncia del Gobierno ante la Fiscalía por posible estafa a los usuarios.

Mientras tanto, Viva Air Colombia y Avianca Airlines tienen abierta una investigación por parte de la Superintendencia de Industria y Comercio (SIC) desde Diciembre 2022 que presuntamente iniciaron el proceso de integración sin solicitarle permiso a la Aerocivil.

La definición por parte de la agencia de Aerocivil determinará si aprueba la sinergia Avianca-Viva Air Colombia o si finaliza poniendo fin a la fusión de aerolínea colombiana, sepultando las esperanzas para volver a volar.
