Grandes aerolíneas unen detrás de JetBlue contra DOJ

JetBlue Airways ha anunciado las fechas récord y de pago para los pagos anticipados adicionales a los accionistas de Spirit Airlines luego de que el Presidente Ejecutivo Robin Hayes se comprometiera nuevamente la semana pasada de luchar contra lo que llamó la demanda sin precedentes del Departamento de Justicia (DOJ) de los Estados Unidos para detener su fusión planificada valorada en US$ 3.8 mil millones de Dólares.

En una declaración del 17 de Marzo de 2023, JetBlue anunció que había establecido el 27/03 como la fecha récord para el prepago a los accionistas de Spirit Airlines de US$ 0.10 por acción de Spirit Airlines, con el pago del prepago adicional del 31/03 en línea con el acuerdo de fusión.

Hablando en la conferencia de JP Morgan Industrials el 14/03 Robin Hayes reconoció que la demanda del Departamento de Justicia presentada el 07/03 en el Tribunal de Distrito de los Estados Unidos en Massachusetts fue inesperada: «No tiene precedentes. No es algo que hayamos visto antes», expresa el CEO de JetBlue Airways. Cuando se le preguntó sobre su opinión y sobre el Departamento de Transporte (DOT), dijo que la compañía estaba enfocada en ganar el caso. «Al final del día, el Departamento de Justicia tiene una opinión. Tenemos una opinión diferente. Ya sabes, un juez ahora decidirá. Creemos que este acuerdo es tremendamente pro-consumidor. Si nos fijamos en el propio expediente del DOT, hay miles de cartas y presentaciones de apoyo, y muy pocas en contra. Hay muchas otras personas que apoyan que no necesariamente han comentado todavía. Así que personalmente creo que si vamos a juicio ganaremos el caso».

Cuando se le preguntó cuáles serían las implicaciones si operar con un Certificado de Operador Aéreo (AOC) único se retrasa por algún tiempo, Robin Hayes no se comprometió, diciendo que sería en interés de las aerolíneas, los trabajadores y las comunidades si el caso se resolviera rápidamente. «Nuestra prioridad número uno en este momento es prepararnos para el juicio, litigar nuestros argumentos y ganar el caso», sentenció el Presidente de JetBlue Airways.

Sobre la batalla legal del Departamento de Justicia para detener la llamada asociación comercial de la Alianza del Noreste (NEA) entre JetBlue Airways y American Airlines anunciada en Julio de 2020, dijo que JetBlue estaba esperando escuchar el resultado del caso juzgado en el Tribunal de Distrito de los Estados Unidos en Boston en Septiembre de 2022. «Realmente no cambia nada en el sentido de que estamos operando la NEA hoy. […] Tomó la mayor parte de un año implementarlo, pero luego entraremos en el cuarto año. Así que, de nuevo, creo que los beneficios están ahí para que todos los vean. JetBlue nunca ha sido más grande en Nueva York. Hemos crecido en Boston gracias al NEA, y nos gustaría poder seguir haciéndolo».

Las opiniones de Robin Hayes sobre la NEA fueron repetidas por el CEO de American Airlines, Robert Isom, quien expresó confianza en la alianza y dijo que no había un Plan B: «La NEA está produciendo valor por lo que no puedo imaginar que se dictamine en contra. Todo lo que hemos hecho ha producido beneficios para el consumidor, y todas las preocupaciones nunca han surgido. Hemos estado operando esto ahora por un par de años. Así que no estoy viendo un Plan B».

Cuando se le preguntó por su opinión sobre la fusión JetBlue-Spirit, el CEO de United Airlines, Scott Kirby, admitió que bloquearla no me parecía justo ni correcto: «Decir que una aerolínea no puede combinarse para ser la quinta más grande del mundo cuando la escala importa, si yo fuera Robin estaría escupiendo enojado. Eso simplemente no parece justo». También dijo que no tenía ningún problema con la NEA: «No tenemos un perro en la caza de ninguno de esos, pero realmente, me gusta nuestra posición competitiva. Estamos ganando cuota de mercado. Me gusta nuestra posición competitiva de cualquier manera».

Es de esperar que JetBlue Airways continue presentando las apelaciones correspondientes de los casos para alcanzar a su criterio los justos acuerdos entre las aerolíneas.

When asked what the implications would be if operating with an unique Air Operator Certificate (AOC) is delayed for some time, Robin Hayes did not commit, saying that it would be in the interest of airlines, workers and communities if the case was solve quickly. «Our number one priority at this time is to prepare for the trial, litigate our arguments and win the case», said JetBlue Airways President.

On the legal battle of the Department of Justice to stop the so called Commercial Association of the Northeast (NEA) Alliance between JetBlue Airways and American Airlines announced in July 2020, he said that JetBlue was waiting to listen to the result of the case of the Court in the District Court in the District Court of the United States in Boston in September 2022. «Nothing does not change in the sense that we are operating the NEA today. That simply does not seem fair». He also said he had no problem with the NEA: «We don’t have a dog in the hunt for any of those, but I really like our competitive position.
