La Superintendencia de Transporte de Colombia abrió el pasado Miércoles 01/03 una investigación administrativa y formuló cargos contra Viva Air Colombia por suspender súbitamente sus operaciones el Lunes 27/02 afectando a los usuarios del transporte aéreo. La medida se tomó mediante una resolución por el presunto incumplimiento de la ley debido a la suspensión súbita de sus operaciones afectando a los usuarios que contaban con reservas emitidas y confirmadas.

La ACDAC aseguró que en Noviembre 2022 la compañía aérea había realizado medidas de fuerza para alertar sobre la crisis de la compañía y que ninguno de los implicados se ha expresado en favor de los empleados. «En este momento se han visto afectadas alrededor de 6.200 familias. Llamamos a buscar alternativas para que los empleos no se pierdan y que la compañía subsista», dijo el líder sindical.

Según Frontier, el sistema de asientos de la aerolínea asigna automáticamente asientos adyacentes para niños y al menos un tutor en su grupo sin cargo adicional. La aerolínea generalmente cobra por la selección de asientos, pero las familias tienen la opción de pagar para sentarse juntas sin depender de las tareas automáticas gratuitas. Los miembros de Frontier también pueden aprovechar las promociones de «niños vuelan gratis» en ciertos vuelos cuando viajan con alguien de 14 años o menos.

Breeze Airways señaló que siempre ha permitido que las familias se sienten juntas gratis. Aunque la aerolínea generalmente cobra las asignaciones de asientos en sus boletos más baratos, se renuncia a la tarifa por la selección de asientos familiares.

Southwest Airlines, famosa por sus asientos abiertos, política de comida por número, permite a las familias con niños de seis años o menores abordar temprano, después del grupo A. Eso aumenta sus posibilidades de poder sentarse a bordo, según la aerolínea.

United Airlines tiene una nueva función de mapa de asientos que ayudará a las familias con niños menores de 12 años a encontrar asientos juntos de forma gratuita, anunció la aerolínea el Lunes 21/02. La función incluirá boletos Basic Economy. La nueva tecnología de mapa de asientos encontrará dinámicamente asientos Economy adyacentes disponibles en el momento de la reserva y abrirá mejoras gratuitas a otros asientos disponibles según sea necesario, dijo la aerolínea.

En los casos en que los asientos uno al lado del otro no estén disponibles, los clientes podrán cambiar a otro vuelo a su destino con asientos adyacentes en la misma cabina de forma gratuita. No se cobrará ninguna diferencia de tarifa en tales casos, dijo United Airlines en un comunicado de prensa.

El CEO de United Airlines, Scott Kirby, reconoció la frustración de las familias en una entrevista el Martes 22/02 en la cadena de noticias CNBC: «Como padre de siete hijos, entiendo esto y me he sentado lejos de nuestros hijos en muchos vuelos», dijo Scott Kirby. United cree que la nueva política «eliminará gran parte del estrés del proceso inicial. Así que reservas tu boleto, sabes que tienes un asiento, en lugar de tener que esperar para llegar al aeropuerto y cruzar los dedos y esperar que puedas conseguir un asiento [al lado de tu hijo]», dijo Scott Kirby.

Los asientos United Polaris, First Class y Economy Plus no están incluidos en el nuevo cambio de política de asientos familiares. Más opciones de asientos adyacentes estarán disponibles en United Airlines de inmediato. El cambio completo de política entrará en vigencia a principios de Marzo 2023, dijo la aerolínea.

Delta Air Lines dijo el Lunes 21/02 que «no cobra tarifas de asientos familiares e independientemente de la clase de boleto comprada, siempre trabajará con los clientes caso por caso para garantizar que se satisfagan las necesidades de asientos de su familia». El sitio web de Delta se refiere a los asientos familiares «previa solicitud», lo que refiere a los pasajeros que no pueden asegurar asientos a través del sitio web o la aplicación móvil de la aerolínea para que se comuniquen con Reservas. La tecnología de mapa de asientos de Delta bloquea algunas áreas para asientos familiares hasta 48 horas antes de un vuelo.

Reclamo justo

Los clientes de las aerolíneas estadounidenses se han quejado durante mucho tiempo de los asientos que separan a los niños pequeños de sus padres en los vuelos y los costos adicionales asociados con la compra de asientos para sentarse juntos. El Presidente Joe Biden abordó los esfuerzos del Gobierno para frenar tales tarifas en su discurso sobre el Estado de la Unión en Febrero 2023, promocionando una Ley de Prevención de Tarifas Basura que también apuntaría a las tarifas de los resorts y las tarifas de boletos para conciertos, entre otros. «Las tarifas de equipaje son lo suficientemente malas, no pueden tratar a su hijo como una pieza de equipaje», dijo Joe Biden en el discurso.

Un aviso de Julio de 2022 del Departamento de Transporte (DOT) pidió a las aerolíneas estadounidenses que hicieran que los niños con asiento junto a los adultos acompañantes estuvieran disponibles sin costo adicional. El grupo de defensa American Economic Liberties Project elogió el liderazgo del presidente Biden en el tema y pidió al Gobierno estadounidense que ponga fin permanentemente a las tarifas de asientos familiares.

«Bajo un intenso escrutinio, United ahora ha reconocido públicamente que las tarifas de asientos familiares son un problema, algo que muchas otras aerolíneas estadounidenses niegan. Pero el diablo está en los detalles, y aunque las acciones voluntarias de United pueden resultar útiles, no son un reemplazo para la regulación gubernamental», dijo William McGee, investigador principal de aviación y viajes en el Proyecto de Libertades Económicas de Estados Unidos, en un comunicado.

Ley Declaración Derechos Pasajeros

Los Representantes del Senado de Estados Unidos se encuentra elaborando una propuesta que podría exigir que las aerolíneas paguen a los pasajeros afectados US$ 1.350 Dólares en conceptos de multas. Dos senadores estadounidenses están tratando de implementar una «Declaración de Derechos de los Pasajeros» que, de ser aprobada, daría a los viajeros más protecciones.

Esto es el concepto que eso significa: Haber pagado un boleto de avión y aún así ser golpeado por un vuelo sobrevendido es una de las mayores frustraciones de los viajes con lo que conlleva requerir que haga nuevos arreglos de transporte, costarle un día de viaje y también puede agregar gastos inesperados, como una noche adicional de servicios de cuidado de perros y facturas por salir a cenar. En 2022 se ha observado un aumento masivo en el número de pasajeros golpeados en las diez aerolíneas más grandes de los Estados Unidos en comparación con el año anterior, según un informe del consumidor del Departamento de Transporte. Casi 83.000 pasajeros fueron expulsados de sus vuelos nacionales en 2022, frente a aproximadamente 14.500 en total en 2021.

Debido a esta tendencia y la crisis que llevó a Southwest Airlines a cancelar 17.000 vuelos durante las vacaciones, dos Senadores estadounidenses, Edward Markey (D-Massachusetts) y Richard Blumenthal (D-Connecticut), han propuesto un par de proyectos de ley, titulados «Declaración de Derechos de los Pasajeros de Aerolíneas» y «Ley de Prohibición de Aerolíneas de Imponer Tarifas Ridículas» (FAIR).

«Las aerolíneas más grandes de nuestra nación ni siquiera pueden garantizar a los consumidores que sus vuelos no se retrasarán o cancelarán, que su equipaje no se perderá o que no se quedarán varados en la puerta debido a la sobreventa. Debemos empoderar a los reguladores y defender los derechos de los pasajeros para que sean tratados con dignidad antes, durante y después de su vuelo», dijo Edward Markey sobre la legislación en un comunicado de prensa.

Una de las protecciones al consumidor propuestas por los proyectos de ley es una garantía de que los viajeros reciban al menos US$ 1.350 si son retirados de un avión demasiado lleno. Más allá de eso, los proyectos de ley también prohibirían a las aerolíneas limitar la cantidad otorgada a los pasajeros que voluntariamente renuncian a su asiento y presionarían para que los viajeros reciban el pago en efectivo (a diferencia de los vales para viajes futuros).

Otras protecciones en los proyectos de ley incluyen:
Exigir a las aerolíneas que proporcionen reembolsos de boletos y transporte alternativo para vuelos retrasados entre una y cuatro horas.
Exigir a las aerolíneas que proporcionen reembolsos de boletos, transporte alternativo, compensación y cubran el costo de comidas y alojamiento (según corresponda) para vuelos retrasados más de cuatro horas.
Tomar medidas enérgicas contra el uso del clima por parte de las aerolíneas como excusa para retrasos y cancelaciones que en realidad son culpa de las aerolíneas.
Prohibir que las aerolíneas reduzcan aún más el tamaño de los asientos hasta que el DOT implemente un requisito de tamaño mínimo de asiento.
Prohibir a las aerolíneas cobrar tarifas exorbitantes e innecesarias que no guardan relación con el servicio prestado (como cobrar a las familias extra por elegir asientos juntos).
Exigir que las aerolíneas reembolsen las tarifas de equipaje inmediatamente por equipaje dañado o perdido.

Si bien los dos proyectos de ley se han presentado, aún no se han convertido en ley. Cuándo serán votados no se ha anunciado, pero ha habido un retroceso de las aerolíneas. Airlines for America (A4A), un grupo comercial que representa a las aerolíneas con sede en Estados Unidos, emitió recientemente un comunicado diciendo que «las propuestas son miopes e inevitablemente aumentarían los costos y reducirían las opciones para el consumidor».

Pero un adelante de una nueva ley que permita proteger a los usuarios del transporte traería beneficios ante el gran número de reclamos que ha estado ocurriendo, ha hecho que el Gobierno centre la atención en respaldar a los pasajeros que de un modo u otro continúan siendo damnificados por medidas arbitrarias de las aerolíneas en Estados Unidos.

Biden administration will drive Law Prevention of Junk Rates

As the Biden Administration undertakes to take energetic measures against airlines that charge families to feel together, many carriers are updating their policies to facilitate parents to sit with their children. United Airlines announced technological updates on Monday that would automatically assign adjacent seats, as well as a new more flexible policy to allow families to separate change flights. United Airlines CEO Scott Kirby acknowledged the families’ frustration in an interview on Tuesday 2/22 on CNBC news: «As a father of seven children, I understand this and have sat far from our children on many flights Scott Kirby said. United believes the new policy will «take a lot of the stress out of the initial process. So you book your ticket, you know you’ve got a seat, instead of having to wait to get to the airport and cross your fingers and hope you can get a seat [ next to your son]», said Scott Kirby.

United Polaris, First Class and Economy Plus seats are not included in the new family seating policy change. More adjacent seat options will be available on United Airlines immediately. The full policy change will take effect in early March 2023, the airline said.

Delta Air Lines said Monday 2/21 that it «does not charge family seating fees and regardless of ticket class purchased, will always work with customers on a case-by-case basis to ensure their family’s seating needs are met». Delta’s website refers to family seats «upon request,» which refers to passengers who are unable to secure seats through the airline’s website or mobile app to contact Reservations. Delta’s seat map technology blocks some areas for family seating up to 48 hours before a flight.

Other protections in the bills include:

While the two bills have been submitted, they have not yet become law. When they will be voted, it has not been announced, but there has been a setback from the airlines. Airlines For America (A4A), a commercial group that represents airlines based in the United States, recently issued a statement by saying that «the proposals are myopic and inevitably would increase the costs and reduce the options for the consumer».

But a forward of a new law that allows to protect transport users would bring benefits to the large number of claims that has been happening, has caused the government to focus attention on supporting passengers who, of one mode or another continue to be affected by Arbitraria measures of airlines in the United States.

Existen avances en el proceso de evaluación que adelanta la Aeronáutica Civil de Colombia frente a la solicitud de integración que hicieron Avianca y Viva Air. Se ha dado traslado a estas dos aerolíneas para que en tres días hábiles se pronuncien sobre la solicitud de tercerías presentadas por cinco aerolíneas con interés en Viva Air Colombia: Aerolíneas Argentinas, Ultra Air S.A.S., Wingo, LATAM Airlines y JetSMART Airlines. Avianca Airlines como Viva Air tienen quince días hábiles para pronunciarse de otros escritos presentados por terceros “y de ser el caso la controviertan, en los términos del Numeral 4 de la Ley 1340 de 2009″. Además, se comunica sobre el caso a la Superintendencia de Transporte “como entidad que ejerce control y vigilancia para que, de considerarlo pertinente, intervenga en el presente trámite a efectos de aportar elementos de utilidad para el análisis de la operación proyectada, advirtiéndole que para tal efecto tiene un plazo de 15 días hábiles, conforme a lo dispuesto en los artículos 8 y 10 de la Ley 1340 de 2009″.

La agencia que regula la aviación comercial Aerocivil Colombia detectó un error en los procesos en la primera decisión de objeción que hizo frente al caso Avianca-Viva Air. En primer término Viva Air se acogió a un proceso de insolvencia bajo Decreto Nº560 del Proceso de Recuperación Empresarial para superar su difícil situación financiera. Consecutivamente, tanto JetSMART Airlines Group como LATAM Airlines Group han mostrado interés en adquirir la aerolínea low cost colombiana.

Viva Air deja cinco aviones

Una drástica decisión ha tomado Viva Air ante la crisis económica que atraviesa. La aerolínea informó que a partir del 21 de Febrero del 2023 dejarán de operar cinco aviones Airbus A320NEO donde se afectarán a 300 trabajadores por esta medida. La empresa anotó que luego de acogerse al Decreto Nº560 para el Proceso de Recuperación Empresarial se presentaron importantes negociaciones con los dueños de los aviones buscando llegar a acuerdos, pero a pesar de esto fueron notificados por uno de ellos que deben dejar en tierra, por el momento, cinco de los aviones hasta nueva orden en los Estados Unidos. La confirmación proviene del Abogado Carlos Roncancio, que representa a la organización Sindicato de Trabajadores del Transporte Aéreo Colombiano Servicios Logística y Conexos (SINTRATAC). “Desde hace rato Viva Air está en cesación de pagos, hoy económicamente la compañía esta muy mal. Nos enteramos que mañana cinco aviones se van, con lo cual prácticamente 300 trabajadores directos van a ver afectados su empleo”, expresó Carlos Roncancio.

Producto de la baja comercial de estas aeronaves, personal de pilotos, auxiliares de vuelo y técnicos quedarían cesantes en el cumplimiento de sus funciones. El abogado anotó que esos 5.000 trabajadores están vinculados de manera directa e indirecta, pues la empresa construyó durante más de diez años empleos formales y de calidad, sumando además el desarrollo económico que permitió a diversas regiones del país la posibilidad que da acceso al transporte aéreo a todos los colombianos.

Ante la falta de programación de vuelos, LATAM Airlines Colombia dispuso de sus aeronaves para reacomodar los pasajeros de Viva Air que se verán afectados por la decisión. Las reprogramaciones o cancelaciones que tengan fecha de vuelo entre el 21 y el 27 de Febrero de 2023, y que hayan adquirido sus tiquetes antes del 20/02 pueden tramitarse el endoso o cancelación. “Este ofrecimiento se puso a disposición de Viva Air Colombia en aras de ayudar en la protección de sus pasajeros”, subrayó en el comunicado LATAM Airlines Colombia.

Integración Avianca-Viva Air

La solicitud de integración de Avianca-Viva Air se ha pospuesto la negociación por el espacio de una semana, con el fin de evaluar si la Aeronáutica Civil (Aerocivil) tendrá una respuesta favorable sobre la solicitud de integración. Además, que en caso de que exista una solicitud, esta estaría sujeta a un periodo de espera adicional para obtener las autorizaciones regulatorias aplicables, tiempo que Viva Air no tiene para mantenerse en el mercado.

La Aerocivil dio a conocer cómo va el proceso de integración de Avianca y Viva Air. Por medio de la Resolución Nº300 del 17 de Febrero del 2023, estableció que el trámite continuará bajo el Artículo 10 de la Ley Nº1340 de 2009, por medio de la cual se dictan normas en materia de protección de la competencia. Con esto decidió comunicar a la Superintendencia de Transporte, como entidad que ejerce control y vigilancia, para que, de considerarlo pertinente, intervenga en el trámite con el fin de aportar elementos de utilidad para el análisis de la operación proyectada, advirtiéndole que tendrá un plazo de quince días, conforme a la ley. De igual forma, la autoridad aeronáutica corrió quince días hábiles para que Avianca y Viva Air se pronuncien con respecto a lo aportado por terceros. Además ambas compañías tienen tres días para pronunciarse sobre las supuestas ofertas de terceros interesados que habría de Aerolíneas Argentinas, Ultra Air, Wingo, LATAM Airlines Colombia y JetSMART Airlines Group.

Plan integración Avianca
Avianca ha enviado un plan para que Aerocivil avale la integración. Avianca sostuvo el Miércoles 15/02 que las propuestas de los otros competidores aéreos por la compañía de bajo costo son inviables, por lo que reiteró a la Aeronáutica Civil (Aerocivil) cuáles son las acciones que ejecutarían para salvar a la aerolínea colombiana si les avalan su proceso de integración. “Avianca considera que las recientes propuestas de distintos competidores son técnicamente inviables, toda vez que cualquier toma de control de Viva requeriría, una vez acordada la compra, procesos de aprobación en diversos países que tomarían tiempo que la low-cost claramente no tiene. […] Por eso, ponemos en tela de juicio la intención real de estas ofertas de actores que luego de oponerse a la integración por meses y negar la existencia de una crisis, hoy quieren aparecer como salvadores con soluciones que carecen de credibilidad”.

Teniendo en cuenta que la Aerocivil había solicitado ajustes sobre los condicionamientos anteriormente presentados para la sinergia Avianca-Viva Air, Avianca detalló a la agencia aeronáutica cuáles son las acciones que adelantarán para salvar a la aerolínea de bajo costo, en caso de que les permitan integrarse en un mismo grupo aéreo.

El punto principal, de acuerdo con la aerolínea, será que si la Aeronáutica Civil le da luz verde para fusionarse con Viva Air Colombia, entregará hasta 105 permisos de despegue y aterrizaje (slots) en el Aeropuerto Internacional Bogotá/El Dorado/BOG, en Bogotá, con el fin de que cualquier aerolínea pueda operar hasta 15 permisos adicionales en dicha terminal aérea. “Con estos espacios disponibles en distintas franjas horarias, que incluyen las de mayor tráfico de pasajeros, cualquier otra aerolínea que cuente con aviones y capacidad de inversión, podría entrar a operar hasta 15 aviones adicionales en El Dorado, el único aeropuerto en Colombia que hoy cuenta con restricciones que limitan la entrada libre a líneas aéreas que quieran competir”, precisó la compañía aérea Avianca. Así mismo señaló que, en su compromiso por salvar Viva Air, mantendría la marca de la aerolínea, su modelo de bajo costo, además de las rutas y aviones que actualmente opera, al igual que todos los puestos de trabajo de sus empleados. En línea con lo anterior, la compañía aérea aseguró que igualmente protegería las tarifas y frecuencias aéreas en las que tanto Avianca y Vivar Air, en conjunto, tengan una alta participación en el mercado. A ello se le suma, según Avianca, que garantizará “que las aerolíneas extranjeras que distribuyen sus pasajeros a través de Viva lo puedan seguir haciendo y con ello su acceso garantizado al mercado colombiano”. La última propuesta de la aerolínea es ofrecer acuerdos de código compartido a la compañía aérea del Estado colombiano, Satena Airlines, en los trayectos en lo que sea el único operador, con el fin de que los territorios más aislados del territorio nacional se puedan conectar a través de la red de destinos de Avianca.
