Denuncia por estafa venta pasajes

Viva Air Colombia fue denunciada penalmente por estafa ante la Fiscalía. El representante de la Cámara Alejandro Ocampo advirtió que la compañía estafó a sus clientes por venderles tiquetes, cancelar su operación y después negarse a devolver el dinero a más de 400.000 afectados. La tormenta que vive Viva Air no parece disiparse, luego de que el 27 de Febrero de 2023, sin previo aviso, suspendiera sus operaciones, dejando varados a miles de usuarios. Ahora un nuevo nubarrón se le atraviesa a la aerolínea: una denuncia por estafa, que radicó, el 08/03 el representante a la Cámara ante la Fiscalía General de la Nación. El Congresista advirtió “no vamos a dejar que roben a los colombianos. Interpuse denuncia por estafa contra Viva Air por haberle vendido tiquetes a los colombianos, cancelar operación y no devolver el dinero a los más de 400 mil afectados. No vamos a dejar que roben a los colombianos”.

La radicación de la denuncia que la compañía habría incurrido en el delito de estafa como está tipificado en el Artículo Nº246 del Código Penal, que advierte que “El que obtenga provecho ilícito para sí o para un tercero, con perjuicio ajeno, induciendo o manteniendo a otro en error por medio de artificios o engaños, incurrirá en prisión de 32 a 144 meses y multa de 66.66 a 1.500 salarios mínimos legales mensuales vigentes”.

Una de las más persistentes peticiones que la Asociación Nacional de Agencias de Viajes y Turismo (ANATO) hizo al Gobierno nacional en los últimos meses es la verificación o análisis del músculo financiero de las aerolíneas que en la actualidad tienen actividades en Colombia o que entrarían al país a operar. La base de esta solicitud la anteceden los hechos ocurridos con otras compañías aéreas que al conocerse que dejaron de laborar, afectaron a los usuarios y a las agencias de viajes. Dicha petición se retomó en la 42 Vitrina Turística de ANATO y tras el reciente anuncio de Viva Air, que con la suspensión de su operación dejó a la expectativa el desarrollo de los viajes que los consumidores habían adquirido con la aerolínea y dejaron la responsabilidad en manos de las agencias de viajes, que ya habían remitido el dinero de las ventas a la aerolínea.

“Al ver esta decisión, hemos pedido al Ministerio de Transporte, al Ministerio de Comercio, Industria y Turismo y a las superintendencias tomar medidas que permitieran a los viajeros reacomodar sus viajes o recibir la devolución de su dinero y fuimos escuchados”, afirmó la presidenta Ejecutiva de ANATO, Paula Cortés Calle. La dirigente gremial recordó que la Superintendencia de Transporte ya informó que someterá a control a la aerolínea Viva Air y solicitará a la Superintendencia de Sociedades la admisión a proceso de reorganización empresarial para superar las situaciones críticas que dieron origen a la imposición de la medida. La compañía aérea también deberá definir a los pasajeros el estado de reservas emitidas y confirmadas.

“Esperamos lograr la devolución de los dineros a los pasajeros por parte de Viva Air”, explicó la Presidenta Ejecutiva de ANATO. Dentro de las medidas tomadas por las entidades se encuentra también la exigencia de preservar el pasivo recibido por los recursos recaudados por la venta anticipada de tiquetes, tiqueteras y por aviación no regular de pasajeros, de lo cual deberá presentar reporte en el término de tres días calendario y, en lo sucesivo, el último día hábil de cada mes, hasta cuando se superen las condiciones que dieron origen a la presente decisión. “Agradecemos al Ministerio de Transporte y a la Superintendencia de Transporte haber tenido en cuenta nuestra solicitud. No podemos dejar que situaciones como estas afecten el dinamismo que venía teniendo el sector, la confianza ganada por los viajeros y la buena labor que vienen desempeñando las agencias de viajes”, dijo Paula Cortés Calle.
