Procuraduría mexicana advierte sobre cobros equipaje de mano

La Procuraduría Federal del Consumidor (Profeco) de México ha anunciado una advertencia pública a las aerolíneas para que cesen ante los cobros a los pasajeros por llevar equipaje de mano.

La Suprema Corte de Justicia de la Nación (SCJN), había reclamado entre otras cosas, a la gratuidad del equipaje en varias ocasiones. Sin embargo, eso no ha detenido las estrategias de las compañías aéreas al momento de vender tickets desde México hasta el derecho a llevar equipaje de mano de manera gratuita. La Ley de Aviación Civil (LAC) de la República de México establece que, para vuelos nacionales e internacionales los pasajeros tienen derecho a transportar como mínimo y sin cargo alguno, 25 kilogramos de equipaje cuando los vuelos se realicen en aeronaves con capacidad para veinte pasajeros o más, y 15 kilogramos cuando la aeronave sea de menor capacidad. Nuevamente, las aerolíneas han reclamado esta regulación, pero la SCJN no ha fallado a su favor. La LAC también reguló que los pasajeros también poseen derecho a llevar en cabina hasta dos piezas de equipaje de mano. Las dimensiones de cada pieza de equipaje de mano deben ser de hasta 55 centímetros de largo por 40 centímetros de ancho por 25 centímetros de alto; además el peso de ambas no deberá exceder los diez kilogramos. Nuevamente, las aerolíneas se fueron a los tribunales, y tampoco obtuvieron resultados favorables. Otro derecho que tenemos es que, en el caso de menores de dos años, se tiene derecho a viajar sin pago de boleto (sin equipaje y sin asiento). Lo importante, es que tienen el derecho a llevar un cochecito para bebé sin cobro alguno, hecho que en ocasiones pretende ser cobrado por las aerolíneas al obligar a documentar dicho instrumento. Las aerolíneas también son responsables, en vuelos de conexión, de los daños causados a pasajeros y equipaje facturado en tránsito o por retraso en el servicio de transporte aéreo; en consecuencia, también la ley las hace responsables del equipaje facturado desde el momento en que expida el talón correspondiente hasta que entregue el equipaje al pasajero en el punto de destino. Para aquellos pasajeros que deseen viajar sin equipaje, se oferta tarifas preferenciales, es donde los consumidores comenzarían a perde sus derechos, pues si existe el reconocido derecho a viajar con equipaje, no se puede dejar al arbitrio de las compañías proponernos tarifas especiales a costa de renunciar a nuestros derechos, pues es allí en donde comienza el juego de las tarifas en perjuicio del usuario del transporte aéreo.

Los precios de los boletos de avión no debieran regirse por un estándar mínimo de peso en los equipajes o por renunciar a ellos, pues de alguna forma, al limitar nuestra libertad de tránsito con un mínimo indispensable de equipaje se induce al consumidor a comprar los boletos más caros cuando se opta por ejercer dicho derecho. En todo caso, teniendo todos los pasajeros los mismos derechos, sin que implique renuncias a los mismos, las tarifas tendrían que variar por otros criterios, tales como la fila, el espacio entre asientos, servicios adicionales, entre otros ítems.

En México se han registrado 1.431 quejas en contra el arbitrio del cobro de equipaje, alcanzando en 2019, la cifra llegó casi a 2.000 quejas. Ahora bien, otros datos por demás interesantes en relación con los cobros indebidos por la primera maleta arrojan, que, del año 2017 al 2019, los usuarios presentaron 259 quejas, de las cuales, sin embargo, casi ninguna derivó en sanciones o en medidas de apremio en contra de las compañías, pues solamente hubo seis sanciones. Además, el exceso de equipaje tiene que ser transportado de acuerdo con la capacidad disponible de la aeronave y la aerolínea, sólo en este caso, tiene derecho a solicitar al pasajero, un pago adicional. Todo lo anterior, conforme a datos entregados por la Procuraduría Federal del Consumidor en respuesta a diversas solicitudes de acceso a la información.

Airbus Group junto a SKY Airline anunciaron la inauguración de su nuevo centro de formación para pilotos. El establecimiento permitirá capacitar a los operadores y pilotos que trabajan para las compañías mencionadas. Asimismo, este tiene una extensión de 1 700 metros cuadrados. El establecimiento está ubicado en la Ciudad de Santiago de Chile. El centro de formación se constituye como el cuarto establecimiento en Latinoamérica de Airbus y uno de los más modernos de la región. Así, cuenta con equipos de instrucción de pilotos para aviones A320, resaltando dentro de ellos un simulador de vuelo de última generación.

La chilena SKY Airlne ha anunciado que volará a partir de Diciembre 2021 la ruta Santicago de Chile/SCL—Buenos Aires/AEP. La aerolínea de presupuesto volará con dos frecuencias semanales (2Frq/S), mientras que a mediados de mes 12/2021incrementará a cuatro frecuencias por semana (4Frq/S). Estas se complementarán con los siete vuelos en funcionamiento con destino al Aeropuerto Internacional de Ezeiza, sumando un total de once vuelos al Área Metropolitana de Buenos Aires (AMBA).

Las operaciones al corazón de la capital se suman a las siete frecuencias que actualmente posee en la ruta Santiago de Chile/SCL—Buenos Aires/EZE. Desde Diciembre 2021 la low cost chilena SKY Airline incrementará su oferta de vuelos a la Argentina, poniendo en marcha dos frecuencias por semana al Aeroparque Jorge Newbery de la ciudad de Buenos Aires, y pocos días después las duplicará. Sumados a los siete vuelos que ya tiene a Ezeiza, constituirá una propuesta de once con destino a la capital argentina.

El International Aviation group (IAG) ha creado una subsidiaria low cost de British Airways (BA) denominada BA Euroflyer. La nueva marca ha sido registrada oficialmente este Miércoles 10 de Noviembre de 2021. La nueva startup bajo el ala del grupo de aviación continuará manteniendo la identindad visual de British Airways pero con una estructura diferente. La estructura societaria de la low cost se desarrollará con su propia estructura, para lo cual British Airways acaba de registrar la marca BAEuroflyer para conectar desde el Aeropuerto London/Gatwick/LGW con el resto de Europa.

La nueva compañía de presupuesto ha sido registrada oficialmente y será probablemente la que termine por regular las relaciones laborales con la plantilla de empleados. British Airways, tras el acuerdo con los sindicatos de pilotos, que le permitían poner en marcha la operación, no ha dado demasiada información. Se sabe simplemente que la compañía tendrá unas relaciones laborales diferentes de la matriz y que operará a partir de la última semana de Marzo 2022. No controlará todas las operaciones desde London/Gatwick porque también desde ese aeropuerto opera una rama de negocio al Caribe y Florida, que mantiene tanto su estructura como sus normas laborales habituales. British Airways ha suspendido sus vuelos de corto y medio radio de acción en London/Gatwick cuando empezó la pandemia, en Marzo de 2020. El negocio nunca había sido rentable y la pandemia ha agrabado la situación suspendiendo la actividad de manera indefinida. Anteriormente, los aviones cubrían rutas en Mallorca, Alicante y Málaga, en España. Pero tras la crisis del transporte de los viajes producto de la pandemia se ha creado nuevas oportunidades para resurgir una unidad de negocios low cost desde la aeroestación.

Acuerdo sindical

Un avance en las negociaciones con el sindicato que representa a los auxiliares de vuelo ha estimulado a British Airways a apuntar a Marzo de 2022 para el debut de su nuevo servicio de corta distancia desde el aeropuerto de Londres/Gatwick. El nuevo desarrollo sigue a un gran avance en las conversaciones del mes pasado de Octubre 2021 con el sindicato de pilotos. La aerolínea acordó mejores salarios y otros beneficios para los miembros de British Airline Pilots Association (BALPA) para operar los aviones en la nueva operación de bajo costo. El sindicato llevó la nueva propuesta a sus miembros y el 82 por ciento votó a favor de aceptar el acuerdo. «Nuestros planes para una nueva subsidiaria de BA para volar de corta distancia en Gatwick están progresando bien, y aunque todavía tenemos algunas negociaciones adicionales que resolver, parece probable que estemos en funcionamiento para volar el calendario de verano [2022]», dijo el CEO y presidente de BA, Sean Doyle, en un comunicado.

La compañía aérea, que el mes de 10/2021 confirmó que quiere comprar la totalidad de Latam Airlines Group, informó que el resultado negativo es producto de mayores gastos financieros relacionados con los intereses de préstamos y el alquiler de aeronaves, según publica Examen. A pesar del resultado negativo, los ingresos operativos crecieron casi 60%, a R$ 2.710 millones de Reales/US$ 494 millones. Este monto representa el 89,7% de los niveles registrados en el tercer trimestre de 2019, antes de la pandemia. La empresa también logró, por primera vez desde el inicio de la pandemia, recuperar los ingresos operativos por asiento kilómetro disponible (ASK), que cerró en 31,4 centavos, un incremento del 12,5% respecto al trimestre anterior. «En el trimestre, recuperamos nuestros ingresos unitarios a niveles pre-pandémicos, una de las pocas aerolíneas del mundo que ya ha alcanzado este hito y lo ha hecho un trimestre antes de nuestras expectativas», destacó el Presidente de Azul Linhas Aéreas, John Rodgerson.

Los gastos operativos de Azul aumentaron 22,8% en el período, presionados por el aumento de 28,6% en los precios de los combustibles y la devaluación de la moneda brasileña.

Las aerolíneas, que suelen obligar a los pasajeros a acudir a los tribunales para lograr indemnizaciones, podrían verse obligadas a cambiar de estrategia. Tanto la low cost irlandesa Ryanair como la compañía de Air Europa han sido condenadas por mala fe. Nuevo revés judicial para Ryanair. El Juzgado Mercantil N.º 3 de Madrid acaba de condenar a la low cost a abonar a un pasajero 250 euros por el retraso de más de tres horas de un vuelo y, además, le impone las costas del procedimiento judicial por existir mala fe pese al allanamiento previo. El motivo ha sido la desatención de la reclamación extrajudicial, lo que habría evitado acudir a la vía judicial.

El posicionamiento de la Justicia española, con varias sentencias condenatorias a compañías aéreas por este mismo motivo, podría suponer un antes y un después para los consumidores. Son varias las compañías que intentan esquivar las indemnizaciones obligando a sus clientes a acudir a los tribunales para conseguirlas.

El pasado mes de Octubre 2021 el Juzgado de lo Mercantil Nº 3 de Palma falló contra Air Europa, que tuvo que abonar a un pasajero 600 euros por la cancelación de un vuelo y, además, hacerse cargo de las costas “con especial declaración de temeridad y mala fe por su conducta contraria a sus propios actos, obligando al demandante a acudir a la vía judicial en dos ocasiones”. Con esta condena, esperamos que Ryanair comience a cambiar su política y deje de saturar los juzgados españoles, abonando a sus viajeros en los casos de cancelación o retraso de vuelo las indemnizaciones que les corresponden en tiempo y sin necesidad de obligarles a asumir otros gastos como serían los que suponen acudir a los tribunales a recuperar su dinero”, explica Jorge Ramos.

Protección contra aerolíneas insolventes llega a Bruselas

La crisis del Coronavirus ha hecho aflorar las deficiencias de las legislaciones de la Unión Europea (UE). Según afirma, la pandemia ha provocado “la peor crisis hasta la fecha para la industria de los viajes, destapando las deficiencias de las legislaciones de la Unión Europea en materia de viajes y servicios de transporte. Turoperadores y minoristas no pudieron reembolsar a sus clientes debido a su incapacidad para recuperar el dinero del viajero de los proveedores de servicios, y más concretamente de las aerolíneas, una situación que ha sido perjudicial para toda la cadena de valor”.

Para ECTAA, hay una necesidad urgente de fortalecer derechos de los viajeros. Por este motivo, reclama que se establezca la tan esperada y necesaria protección contra la insolvencia de las aerolíneas, además de alinear las normativas de protección de los pasajeros con la Directiva de Viajes Combinados para resolver disposiciones contradictorias. También insta a Bruselas a legislar sobre las relaciones entre empresas para permitir que el ecosistema de viajes siga funcionando es un caso de disrupción. Pawel Niewiadomski, Presidente de ECTAA, explica que “al final, la crisis ha demostrado que la protección de los viajeros solo puede mejorarse si todo el ecosistema funciona de manera armonizada”.

El Sindicato de Pilotos de la aerolínea regional LIAT Airlines, solicitó el Martes 09/11 a sus gobiernos accionistas que ayuden a llegar a un acuerdo con respecto a las indemnizaciones pendientes adeudadas a los ex pilotos de la aerolínea. Patterson Thompson, Presidente de la Asociación de Pilotos de Líneas Aéreas de las Islas de Sotavento (LIALPA), ha pronunciado el reclamo en la Isla Antigua, reconociendo que si bien la pandemia de Coronavirus había complicado las cosas, los gobiernos accionistas deberían comprometerse a cumplir con los pagos pendientes a los ex empleados. Dijo que los gobiernos de Barbados, San Vicente y las Granadinas y Dominica deberían unirse a los esfuerzos emprendidos por el Primer Ministro de Antigua y Barbuda, Gaston Browne, para hacer frente a la situación. Patterson Thompson declaró: «Si no quiere unirse a los esfuerzos del Sr. Gaston Browne, ¿qué puede hacer por nosotros allí, usted y el Primer Ministro (Dr. Ralph) Gonsalves (de San Vicente y las Granadinas)? El mes de Octubre 2021, el Primer Ministro Gaston Browne hizo un llamamiento a los sindicatos regionales para que reconsideren sus posiciones sobre la última oferta hecha a los trabajadores despedidos de la aerolínea. Expresó que lo que se requiere es la cooperación de los sindicatos, y señaló que «algunos líderes sindicales están haciendo demandas poco razonables, haciendo demandas en las que no tienen base legal para hacer. Como les he dicho a los otros sindicatos, si realmente piensan que se les debe el 100 por ciento de sus indemnizaciones y obligaciones del personal, vayan a los tribunales y demuéstrelo. Si no pueden probarlo, entonces los gobiernos te están dando un pago compasivo, tómate y corre». La aerolínea había despedido a alrededor del 90 por ciento de su personal el año pasado como parte de un ejercicio de reestructuración y ha reanudado sus operaciones a una escala mucho menor.

El Presidente del Waterfront and Allied Workers Union (WAWU), con sede en Dominica, Donald Rolle, dijo que los sindicatos regionales están unidos en la búsqueda de los millones de dólares adeudados a los trabajadores y han rechazado la última oferta de los gobiernos accionistas. «La oferta sobre la mesa que es pagar a los trabajadores de LIAT, el 50 por ciento de su salario de despido y hay un componente que implica compensación mediante la emisión de tierras y bonos. Pero otro miembro ejecutivo de LIALPA, Arian Blanchard, quien también dijo que si bien se ha hecho una oferta a los trabajadores, no es por escrito. «Somos un ejecutivo muy responsable y atento. Estamos explorando todas las vías para obtener los detalles que necesitábamos aclarar en la propuesta y lo hicimos como el presidente habría mencionado en una reunión con el Primer Ministro Browne y él aclaró los detalles. Pero no podemos volver a nuestros miembros y decir que dijo el primer ministro. Eso es rumor. Mentalmente es agotador porque la mayoría de las personas serían responsables de sus familias y, en algunos casos, hay personas que ambos sostén de la familia fueron empleados por LIAT», sostiene Arian Blanchard.

Patterson Thompson rechazó la sugerencia de que los pilotos de la aerolínea deberían asumir parte de la culpa por los problemas de la aerolínea, diciendo que la gerencia había tomado algunas decisiones irresponsables. «LIAT ha cometido errores una y otra y otra vez durante un período de tiempo», dijo, recordando que la asociación les había advertido que no se retiraran de una determinada ruta, que posteriormente ignoraron. “Y luego, cuando regresamos a St. Thomas tres días a la semana, los vuelos (estaban) tres cuartos [llenos].
