Un juez de Aix-en-provence, Francia, ha acordado la intervención judicial de la compañía aérea irlandesa Ryanair, al tiempo que la obliga a pagar una fianza de cinco millones de euros. La decisión, que no tiene exactamente las mismas características que una intervención judicial en el derecho español, había sido recurrida el pasado diez de enero por la empresa irlandesa, pero el viernes fue confirmada por la Sala de Instrucción del Tribunal de Apelación de Marsella.

La condena tiene lugar por lo que en el derecho francés se llama “travail dissimulé”, que viene a ser emplear a personal sin declararlo como establece la reglamentación ordinaria. Esta decisión judicial obliga a la compañía a abonar cinco cuotas de un millón de euros hasta febrero de 2018. Este dinero persigue garantizar que la empresa comparecerá ante los tribunales y también para proveer fondos para una eventual condena al pago de daños y perjuicios.

La investigación se centró en el periodo que va desde 2011 a 2014, cuando la Ursaaf francesa, que vendría a ser lo que la Tesorería de la Seguridad Social es en España, detectó el impago o la evasión de hasta 6,8 millones de euros en contribuciones que debían de haberse desembolsado por el empleo de personal en la base de Marsella.

El representante de la compañía aérea irlandesa compareció ante los tribunales y adujo su derecho al silencio y se negó a responder al juez que instruía el caso, cuando este le preguntó por una presunta maniobra fraudulenta para acoger a sus trabajadores a la normativa irlandesa y evadir el pago de contribuciones a la Seguridad Social en Francia.

Ryanair no comparte esta lectura de la normativa que hacen las autoridades francesas y en su momento decidió cerrar todas sus bases en Francia y operar a ese país siempre desde bases extranjeras. Sin embargo, los hechos ocurridos entre 2011 y 2014 siguen su marcha en los tribunales.

«En todo este tiempo y pese a los anuncios que tanto la provincia como el municipio realizaron para construir una nueva terminal con mejor infraestructura, no se ha logrado responder a las necesidades que un Aeropuerto como el de Rosario necesita, que tiene un gran potencial para posicionarse ante otras ciudades del interior del país y para sumar vuelos y más pasajeros. Claro que sumar vuelos sin prever las obras necesarias es totalmente irresponsable», indicó Giuliano y agregó:

“El recurso del tractor para mover los aviones y la cancelación de vuelos cuando el tractor no funciona encendió todas las alarmas y Rosario no se merece semejante situación de desidia».

«Queremos aportar ideas y soluciones a los problemas que aún persisten en el Aeropuerto. Según detalla la norma, dicho permiso tendra una vigencia de cuatro años y podrá ser renovada. Asimismo, precisa que la aerolínea usará un avión Airbus 320 y tendrá permiso para operar en 12 rutas a nivel nacional.

La aerolína anunció meses atrás que espera iniciar sus operaciones en mayo y la venta de pasajes desde abril. Asimismo, recalcó que ofrecerá una tarifa de S/60 por vuelos de 30 minutos. El servicio no incluirá comida a bordo, pero el pasajero podrá abonar un cargo adicional si desea recibirla.

Una vez finalizados estos trabajos, agregaron las autoridades, se comenzarán las obras definitivas (en la plataforma comercial y las calles de rodaje), como hasta ahora sin la interrupción de la operatoria de la aviación comercial regular. Los pilotos de KLM Cityhopper del Embraer 175 dio el personal un saludo especial al inicio del nuevo avion para el vuelo de traslado a Amsterdam.

El nuevo Embraer 175 esta hoy sábado en Schiphol después de un vuelo de traslado, con escala en Recife (Brasil), Sal (Cabo Verde) y Faro (Portugal).

La unidad con la matrícula PH-EXK ya es el número 35 en la flota Embraer de KLM Cityhopper. Estos son treinta de E190 (100 pasajeros) y cinco (88 pasajeros) del E175.

«Además, los países del Cono Sur buscan descubrir Brasil, y el Amazonas es un destino importante para los argentinos y los chilenos», agregó.

El gobernador de Chubut, Mario Das Neves, luego de una reunión con el presidente de Aerolíneas Argentinas, Mario Agustín Dell Acqua, anunció que el Gobierno evalúa la posibilidad de efectuar vuelos a las Islas Malvinas.

Según indicó, la empresa aérea podría programar vuelos que unan las ciudades chubutenses de Trelew y Comodoro Rivadavia con las Islas Malvinas.

En una conferencia de prensa, Das Neves señaló acerca de una reunión con Dell Acqua y otros funcionarios en la Ciudad de Buenos Aires: “Nos preguntaron cuál era nuestro parecer respecto a la posibilidad de un vuelo a Malvinas y les dijimos que éste era un pueblo malvinense y nos parecía correcto”.

El gobernador chubutense afirmó también que “es un tema que se está tratando en Cancillería” y confirmó que el presidente de Aerolíneas Argentinas a fin de mes visitar Chubut.

Respecto del estado de las gestiones, la canciller Susana Malcorra, aseguró al senador nacional por Chubut, Alfredo Luenzo, que “hasta el momento, el tema de las conexiones aéreas entre el territorio continental argentino y las Islas Malvinas, ha sido tratado con carácter meramente exploratorio”.

Malcorra manifestó en su respuesta al legislador que “en las conversaciones mantenidas con el Reino Unido sobre diversos aspectos de la relación bilateral, no se ha avanzado aún en la definición de empresas, rutas y escalas”.
