Espera resolución Justicia argentina contra bandas tarifarias

En Diciembre del 2021 se publicó en Argentina el Decreto 879/2021 en el Boletín Oficial que estableció, entre otros puntos, el regreso de las bandas tarifarias al mercado aerocomercial. También estableció un régimen de asignación de capacidad y frecuencias para los servicios. Las bandas tarifarias deberían comenzar a regir desde el 24 de Junio de 2022, según lo dispuesto por el decreto. No obstante, una cautelar enviada en Febrero 2022 por la lowcost Flybondi podría obstaculizar la medida firmada en diciembre por el ministro de Transporte de la Nación, Alexis Guerrera. La medida Cautelar radica en el Juzgado Contencioso Administrativo Federal N° 7, que depende del juez Pablo Cayssials, quien envió consultas a los distintos organismos del Estado involucrados en la política aerocomercial como el Ministerio de Transporte, la ANAC, entre otros, en el corto plazo daría a conocer la resolución.

Reclamo de las LowCost

Flybondi avanzó con la medida judicial, mientras que JetSmart Airlines Argentina espera su resolución. A estas se le sumaría una tercera low cost, la colombiana Viva Air, que comenzaría sus operaciones en el país a partir de Junio 2022. El Gerente General de JetSmart Airlines, Gonzalo Pérez Corral, dijo este Lunes 02/05 en conferencia de prensa que optan por la prudencia, pero reiteró su crítica “a toda regulación dado a que creemos que la libre competencia es el mejor canal para nivelar los mercados. Estamos trabajando para mostrar nuestra idea y los objetivos que muestran que cuando hay regulación o bandas mínimas el mercado se reduce, mientras que sin esas regulaciones se causa el efecto contrario”.

Las lowcost señalan que con las bandas tarifarias se forzará a las aerolíneas a que suban los precios y que de esta forma se quitará la posibilidad de volar a miles de pasajeros y que el mercado se concentrará en los niveles socioeconómicos medio alto y alto. Insisten en que las consecuencias prácticas del decreto son inequívocas y que impactará negativamente en los pasajeros, en el turismo y las provincias, y que beneficiaria a la aerolínea de bandera, Aerolíneas Argentinas, impidiendo así toda competencia a través de los precios. Un funcionario del Gobierno nacional señaló en off the record que la decisión que se conozca respecto a bandas tarifarias se está dialogando en una mesa que integran todas las aerolíneas, cámaras y grupos involucrados. Además, afirmaron que aún no se resolvió cómo serán esas bandas.

In December 2021, Decree 879/2021 was published in Argentina in the Official Gazette, which established, among other points, the return of the fare bands to the commercial air market. They insist that the practical consequences of the decree are unequivocal and that it will negatively impact passengers, tourism and the provinces, and that it would benefit the flag carrier, Aerolineas Argentinas, thus preventing any competition through prices. A national government official pointed out off the record that the decision that is known regarding fare bands is being discussed at a table made up of all the airlines, chambers and groups involved. In addition, they stated that it has not yet been resolved what these bands will be like.
