Audiencia conciliación entre Embraer/SMSJC finaliza sin acuerdo
La audiencia de conciliación entre Embraer S.A. y el Sindicato de Trabajadores Metalúrgicos de São José dos Campos (SMSJC) en el Juzgado de Trabajo terminó sin acuerdo. El Juzgado Regional del Trabajo de la XV Región (TRT-15) informó que la reunión, que se realizó a través de Internet el Martes 8 Septiembre 2020 por la mañana, no contó con un acuerdo entre las partes. La empresa anunció 900 recortes, que se sumarán a los 1.600 despidos de empleados. El sindicato tenía una propuesta para revertir los despidos.
La audiencia fue programada luego de una solicitud de Embraer, que está en proceso de despedir a 2.500 empleados, 900 fueron despedidos el Jueves 03/09 y 1.600 se incorporaron al Plan de Despido Voluntario (PDV). La audiencia cubre los 900 despidos de la semana pasada.
Embraer informó que en la audiencia presentó una propuesta para extender los beneficios de asistencia médica y subsidio alimentario a los empleados despedidos. El Sindicato de Trabajadores Metalúrgicos de São José dos Campos se mantuvo intransigente, rechazó la propuesta y ni siquiera estuvo dispuesto a aceptarla para la apreciación de los metalúrgicos a través del montaje. El fabricante de aviones también dijo que permanece abierto a la negociación, como siempre lo ha hecho desde el inicio del proceso.

La propuesta del sindicato prevé el mantenimiento, hasta Junio 2021, de un plan médico y vales de alimentación para los profesionales que sean despedidos entre el 1 de Septiembre y el 31 de Diciembre de 2020.

Embraer/SMSJC conciliation hearing ends without agreement

The conciliation hearing between Embraer S.A. and the São José dos Campos Metalworkers Union (SMSJC) in the Labor Court ended without agreement. The Regional Labor Court of the XV Region (TRT-15) reported that the meeting, which was held over the Internet on Tuesday, September 8, 2020 in the morning, did not have an agreement between the parties. The company announced 900 cuts, which will add to the 1,600 layoffs of employees. The union had a proposal to reverse the layoffs.

The São José dos Campos Metalworkers Union (SMSJC) has reported that the aeronautical company refused to comply with the proposal to reverse the dismissals of last week and also those who joined the PDV. The union’s proposal provides for the maintenance, until June 2021, of a medical plan and food vouchers for professionals who are laid off between September 1 and December 31, 2020.
Pandemic and failure of the association
To justify the layoffs, Embraer alleges the impact caused by the coronavirus pandemic and the cancellation of the partnership with Boeing, in addition to the lack of expectations of recovery in the air transport sector in the short and medium term. According to the company, the cuts were made with the “objective of ensuring the sustainability of the company and its engineering capabilities”. Since the beginning of the pandemic, Embraer has adopted a series of measures such as collective vacations, reduction of working hours, dismissal (temporary suspension of contracts) and paid leave.

Harassment report
The Public Ministry of Labor (MPT) is investigating complaints received from Embraer employees who denounce pressure to join the POS. The Metalworkers Union launched a campaign to encourage the reporting of cases of harassment in connection with the POS, which referred the complainants to the MPT. According to the union, 15 workers were ordered to go to the MPT, which received three complaints in late August. Embraer highlighted that the POS was a voluntary process and was communicated with transparency to people, following the code of ethics and conduct. According to the company, the employees were informed by official channels about the program.
Billions of losses
Embraer recorded a loss of R$ 2.95 billion in the first six months of 2020. In the second quarter alone, the net loss was R$ 1.68 billion, the worst result for a quarter in 20 years. According to Embraer, in the first six months of 2020, only four commercial aircraft and 13 executives were delivered, as a result of the coronavirus pandemic. In the first semester, the accumulated net loss of the Brazilian company was R$ 2,950 million, while in the first semester of 2019 the company presented a loss of R$ 134 million. The company states that there was no cancellation in the commercial portfolio, only changes in the delivery period.
JV Boeing-Embraer cancellation
In late April 2020, Boeing announced the termination of the Joint Venture agreement that would give the US giant control over Embraer’s commercial aviation division amid crises in the aviation sector and the global economy, leaving Embraer without a defined alternative plan.
Embraer reported in the balance sheet that the costs of business separation related to the strategic alliance with Boeing, now closed, recognized in January 2020, were R$ 96.8 million. In an attempt to reduce the impacts on the company, Embraer signed a contract in July with five public and private banks to contract loans for US$ 300 million to finance working capital for exports.
