SINDMETALSJC on Twitter: "A edição 1024 do Jornal do Metalúrgico já está disponível. Acesse nosso site e confira! - http://t.co/9xethKXJGy"

Union-Embraer agreement fails

Embraer/SMSJC conciliation hearing ends without agreement

The conciliation hearing between Embraer S.A. and the São José dos Campos Metalworkers Union (SMSJC) in the Labor Court ended without agreement. The Regional Labor Court of the XV Region (TRT-15) reported that the meeting, which was held over the Internet on Tuesday, September 8, 2020 in the morning, did not have an agreement between the parties. The company announced 900 cuts, which will add to the 1,600 layoffs of employees. The union had a proposal to reverse the layoffs.

The hearing was scheduled after a request from Embraer, which is in the process of laying off 2,500 employees, 900 were laid off on Thursday 03/09 and 1,600 joined the Voluntary Dismissal Plan (PDV). The hearing covers the 900 layoffs from last week.

Embraer reported that at the hearing it presented a proposal to extend health care and food subsidy benefits to laid off employees. The São José dos Campos Metalworkers Union remained intransigent, rejected the proposal and was not even willing to accept it for the appreciation of the metallurgists through the assembly. The aircraft manufacturer also said it remains open to negotiation, as it has always done since the beginning of the process.

The São José dos Campos Metalworkers Union (SMSJC) has reported that the aeronautical company refused to comply with the proposal to reverse the dismissals of last week and also those who joined the PDV. SMSJC said it even proposed a salary cap as a way to redistribute income to maintain jobs and that the proposal was rejected. In addition, he reported that he held a face-to-face meeting that authorized the entity to take legal action to try to reverse the dismissals and that he sent letters to the Executive Branch, Congress, the governor of São Paulo, João Doria (PSDB), and the City Council and the São José dos Campos City Council asking to schedule meetings to address the massive Embraer discussion.

Embraer did not detail how many of the 2,500 employees laid off are from the São José dos Campos headquarters, which concentrates around 10,000 of Embraer’s 16,000 employees in Brazil.

On Wednesday September 9, 2020, the São Paulo State Engineers Union (SEESP) will take a virtual vote on a proposal that provides for a minimum number of professionals in the Embraer area. The proposal defines how much to keep 3,000 engineers at Embraer in São Paulo (including subsidiaries Eleb and Yaborã). The company currently has 3,100 engineers. The union’s proposal provides for the maintenance, until June 2021, of a medical plan and food vouchers for professionals who are laid off between September 1 and December 31, 2020.

Pandemic and failure of the association

To justify the layoffs, Embraer alleges the impact caused by the coronavirus pandemic and the cancellation of the partnership with Boeing, in addition to the lack of expectations of recovery in the air transport sector in the short and medium term. According to the company, the cuts were made with the “objective of ensuring the sustainability of the company and its engineering capabilities”. Since the beginning of the pandemic, Embraer has adopted a series of measures such as collective vacations, reduction of working hours, dismissal (temporary suspension of contracts) and paid leave.

The São José dos Campos Metalworkers Union says the layoffs caught it by surprise. The agency considers the dismissals announced on Thursday 03/09 illegal.

Harassment report

The Public Ministry of Labor (MPT) is investigating complaints received from Embraer employees who denounce pressure to join the POS. The Metalworkers Union launched a campaign to encourage the reporting of cases of harassment in connection with the POS, which referred the complainants to the MPT. According to the union, 15 workers were ordered to go to the MPT, which received three complaints in late August. Embraer highlighted that the POS was a voluntary process and was communicated with transparency to people, following the code of ethics and conduct. According to the company, the employees were informed by official channels about the program.

Billions of losses

Embraer recorded a loss of R$ 2.95 billion in the first six months of 2020. In the second quarter alone, the net loss was R$ 1.68 billion, the worst result for a quarter in 20 years. According to Embraer, in the first six months of 2020, only four commercial aircraft and 13 executives were delivered, as a result of the coronavirus pandemic. In the first semester, the accumulated net loss of the Brazilian company was R$ 2,950 million, while in the first semester of 2019 the company presented a loss of R$ 134 million. The company states that there was no cancellation in the commercial portfolio, only changes in the delivery period.

JV Boeing-Embraer cancellation

In late April 2020, Boeing announced the termination of the Joint Venture agreement that would give the US giant control over Embraer’s commercial aviation division amid crises in the aviation sector and the global economy, leaving Embraer without a defined alternative plan.

Embraer reported in the balance sheet that the costs of business separation related to the strategic alliance with Boeing, now closed, recognized in January 2020, were R$ 96.8 million. In an attempt to reduce the impacts on the company, Embraer signed a contract in July with five public and private banks to contract loans for US$ 300 million to finance working capital for exports.

Protesta Latam Brasil por 2700 despidos

AW | 2020 09 09 11:52 | AIRLINES

Protest in Latam Brazil for 2,700 layoffs

Latam Brazil employees continue to protest 2,700 layoffs

On September 6, 2020, about 50 pilots and flight attendants held a protest at the Sao Paulo/Guarulhos Airport against the position adopted by the Latam Airlines Brasil company in the midst of the Covid-19 pandemic crisis. Professionals gathered demanding that the company launch an unpaid leave program after the company began laying off 2,700 employees

After filing for Chapter 11 of the Bankruptcy Law in the United States, Latam Airlines Group proposed to professionals a permanent reduction in salaries, an offer that was rejected by almost 90% of the crew. Competitors Gol Linhas Aéreas and Azul Linhas Aéreas managed to close agreements with the National Aeronauts Union (SNA) to make a temporary cut in hours and remuneration during the next 18 months, a model also defended by the Latam Brazil crew.

Trade Union-Latam Negotiations

After failing negotiations, Latam Group had announced the dismissal of pilots, co-pilots and flight attendants, totaling 2,700 employees. The layoffs, which represent 38% of the 7,000 crew members of the company, began through a voluntary dismissal process that ended on Tuesday 08/09. In total, 345 employees joined the program. The dismissals will be made from 09/09 and will last until next Friday 09/11. Latam claims that it pays higher wages than its competitors in Brazil and that it needs to match companies in the sector. According to the company, changes in its remuneration policy had already been the subject of negotiations with the union even before the pandemic, but with the crisis, the change took priority.

The airline has communicated that 97% of the crew that will be disconnected are no longer on flight stopovers and that their operation will have no impact with the reduction of the workforce. He also said that “it has always been open to dialogue with the aim of preserving the greatest number of jobs and maintaining its long-term sustainability”.

International ops

Latam Airlines Group is defining the resumption of part of its international operations in Brazil and its subsidiaries in South America for the year 2021. Latam Airlines Brazil will reestablish the air network between São Paulo/GRU to other destinations it served in the pre-pandemic in America, Europe, Africa and Oceania.

The resumption dates are based on Latam Group’s decision to keep the reserves closed until a certain time. This is the case of the São Paulo-Mendoza route, for example, which should not be operated this year because its reserves are currently closed until 12/31. Flights with closed reservations until March 27, 2021 include departures from Lima to Brasilia and Foz do Iguaçu, as well as from São Paulo/GRU to Bogotá, Córdoba, Milan/Malpensa, Paris/CDG and Punta del Este. There are also operations that are currently closed on reservations until June 2021. They are flights from São Paulo/GRU to Barcelona with reservations closed until June 29, 2021 and Johannesburg with reservations closed until June 30, 2021. As of August 2021 It is the turn of the flights between São Paulo/GRU and Santa Cruz de La Sierra, in Bolivia, to return to the Latam Group reservation system.
