Gobierno de Argentina aprueba contrato ingeniería entre Aerolíneas y Boeing
El Ministerio de Transporte de Argentina aprobó la contratación de un servicio de desarrollo e ingeniería y provisión de componentes aeronáuticos de origen extranjero, con el objetivo de que Aerolíneas Argentinas pueda satisfacer la necesidad de incorporar una alteración mayor en las aeronaves de su flota Boeing.
El Artículo 16 de la Ley Nº 18.875 establece, respecto de los servicios de consultoría e ingeniería, que “se podrá contratar con firmas o profesionales extranjeros únicamente en casos excepcionales, aprobados previamente por resolución del ministerio competente, que sólo podrá fundarse en la falta de capacidad técnica local en el asunto del servicio o de la consulta, e imposible de suplir por vía de subcontratación, debiendo darse a publicidad el dictamen técnico correspondiente”.
Así, según la resolución 80/2019 publicada este Viernes, 15 Febrero 2019 en el Boletín Oficial, las áreas en cuestión hicieron énfasis en la necesidad de contratar un servicio de desarrollo e ingeniería y provisión de componentes aeronáuticos de origen extranjero, con el objetivo de que Aerolíneas Argentinas pueda satisfacer la necesidad de incorporar una alteración mayor en las aeronaves de su flota Boeing 737 Next Generation.
De esta manera, las áreas manifestaron que ARSA considera necesario extender el proceso de selección del servicio a oferentes extranjeros por el impacto estratégico y económico y la criticidad de la alteración mayor en relación a la seguridad operacional. Así, decidieron limitar el procedimiento “exclusivamente a oferentes locales podría implicar la exclusión de oferentes que resulten técnicamente competentes y a su vez más convenientes desde el punto de vista de la gestión del proyecto”.
En este sentido, la medida firmada por Guillermo Dietrich explica que las áreas expresaron que “las tareas de mantenimiento necesarias para la incorporación de las soluciones técnicas que se requieren, son de alto impacto en los sistemas existentes de las aeronaves afectadas y que no pueden ser llevadas a cabo por proveedores que no estén debidamente certificados”.

Article 16 of Law No. 18,875 establishes, with respect to consulting and engineering services, that “it may be contracted with foreign firms or professionals only in exceptional cases, previously approved by resolution of the competent ministry, which can only be based on the lack of local technical capacity in the matter of the service or consultation, and impossible to supply by way of subcontracting, should be given publicity the corresponding technical opinion”.
Thus, according to resolution 80/2019 published this Friday, February 15, 2019 in the Official Gazette, the areas in question emphasized the need to contract a development and engineering service and provision of aeronautical components of foreign origin, with the objective of that Aerolíneas Argentinas can satisfy the need to incorporate a greater alteration in the aircraft of its Boeing 737 Next Generation fleet.
In this way, the areas stated that ARSA considers it necessary to extend the process of selecting the service to foreign bidders due to the strategic and economic impact and the criticality of the major alteration in relation to operational safety. Thus, they decided to limit the procedure “exclusively to local bidders could involve the exclusion of bidders that are technically competent and at the same time more convenient from the point of view of project management”.
