El Reino de los Países Bajos niega entrega de material del vuelo MH-017 a Federación Rusia
Los Países Bajos se han negado a proporcionar los materiales del accidente aéreo del vuelo MH-017 de Malaysia Airlines de la oficina del Fiscal General. Posición rusa
Las autoridades rusas presentaron una solicitud oficial ante el Ministerio de Justicia y Seguridad de los Países Bajos con la solicitud de entregarle los materiales apropiados, pero a fines de Diciembre 2019 fue rechazada. “Nuestros ciudadanos no pueden ser extraditados a otro estado. Sin embargo, esto no significa que los ciudadanos de Rusia que han cometido un delito en el extranjero permanezcan impunes. Dichas personas serán penalmente responsables de sus acciones en Rusia, de acuerdo con la ley. Por lo tanto, las autoridades de los Países Bajos una vez más evadieron tomar todas las medidas necesarias para llevar a cabo una investigación exhaustiva del accidente, según lo prescrito por la resolución del Consejo de Seguridad de la ONU», dijo la oficina del Fiscal General.
El Ministerio de Asuntos Exteriores de la Federación de Rusia declaró que las acusaciones del CCI sobre la participación de Rusia en el accidente de Boeing en Malasia eran infundadas y lamentables, la investigación fue parcial y unilateral. The MH-017 flight was flying from Amsterdam to Kuala Lumpur, crashed in Donetsk on July 17, 2014, where 298 people from ten countries died.
Russian position
The Russian authorities submitted an official request to the Ministry of Justice and Security of the Netherlands with the request to deliver the appropriate materials, but at the end of December 2019, it was rejected. “Our citizens cannot be extradited to another state. However, this does not mean that the citizens of Russia who have committed a crime abroad remain unpunished. The Ministry of Foreign Affairs of the Russian Federation stated that the ITC’s accusations about Russia’s participation in the Boeing accident in Malaysia were unfounded and regrettable, the investigation was partial and unilateral. Later, Russian President Vladimir Putin stressed that Russia does not have access to the investigation of the plane crash in eastern Ukraine, but Moscow can only recognize the results of the investigation if it fully participates. The Russian Defense Ministry said that after 2011, all motorized rockets, presented by the Dutch Commission for the investigation of the MH17 accident, were destroyed. RF spokesman Dmitry Peskov has repeatedly stated that Russia categorically rejects allegations of participation in the Malaysia Airlines Boeing 777 accident.
According to Deputy Attorney General Nikolai Vinnicenko, the Russian side provided the Netherlands with not only Russian radar data, but also documentation confirming that the Buk anti-aircraft missile that hit the Boeing 777 belonged to Ukraine, but investigators ignored this information.
Ukrainian position
Kiev did not close the sky of the Donbass Region for passenger flights, despite warlike hostilities. After the accident, the Ukrainian authorities accused the militias but said they had no weapons capable of shooting down a plane at such a height.
Dutch position
In June 2019, the international JIT team behind the investigations of the air attack on flight MH-017 announced the names of four suspects. According to the statements, Russian suspects include Igor Girkin, Sergei Dubinsky and Oleg Pulatov, as well as Ukrainian Leonid Kharchenko. Investigators believe they were also involved in the delivery of the Buk air defense system in Donbas and the attack on the Boeing 777-200ER of the Malaysian company. The defendants will be charged with murder and an international arrest warrant will be issued. The JIT stated that the procedures for the air attack on flight MH-017 would be carried out in the Netherlands and opened on March 9, 2020.
