El CIADI y la sanción contra el Grupo Aerolíneas

La decisión del Ciadi, el tribunal arbitral del Banco Mundial, está en estudio en la Procuración del Tesoro y aún no decidieron si se opta por el pago, la nulidad o la apelación

Aerolíneas Argentinas (AR) fue privatizada en 1990. Iberia pagó por ella con 260 millones de dólares que consiguió endeudando a la misma AR. También entregó 1610 millones en títulos públicos que había adquirido al 20 por ciento de su valor, pero que el gobierno argentino se los reconoció por el 100 por ciento. La administración de Iberia fue liquidando aeronaves, oficinas en el exterior, rutas, simuladores de vuelo y otros activos de AR, hasta que se presentó en el 2000 en convocatoria de acreedores. En 2001, el Grupo Marsans, tomó el control de la empresa. Se trataba de un consorcio español formado entre otros por Air Comet, una firma que solo hacia charters privados sin operar jamás vuelos de línea.

En la etapa Marsans se continua vaciando AA a través de las técnicas fraudulentas de “apalancamiento” (los aviones alquilados y otros bienes y servicios pagados por AA los usaba Air Comet) y “canibalismo” (los aviones de AA eran desguazados y las partes que servían eran usadas por los aviones de Air Comet). AA se quedó prácticamente sin aviones propios.

Hace dos semanas, el tribunal arbitral del Banco Mundial fijó su postura respecto del reclamo que desde 2009 mantenía el Grupo Marsans (en realidad, el fondo que se hizo cargo del litigio) al Estado, por la expropiación de Aerolíneas Argentinas, Austral, Jet Pak, Optar y Aero Handling.

El laudo dice que el Tesoro deberá indemnizar a los españoles con un monto de US$ 320 millones, equivalentes a alrededor de $ 5760 millones. La decisión supondrá seguramente largos momentos de estudio de cada una de las 613 páginas que tiene el laudo.

La Procuración podría apelar la decisión o, en su caso, pedir la nulidad. Si apela, no se abrirá un tribunal de alzada ya que el procedimiento del Ciadi no lo prevé. Lo que sucederá es que los mismos árbitros revisarán el laudo y, según la propia jurisprudencia, suelen haber modificaciones en los montos pero no en el fondo, salvo que aparezcan hechos nuevos. No parece ser el caso.

Otra opción, que es la que se estudia por estos días, es pedir la nulidad del proceso. El problema de ir por este camino es que la Argentina abusó del recurso en los años anteriores y lo usó como una forma de dilatar las negociaciones y los pagos. «A diferencia de otros casos en los que se pidió absurdamente y sin mayores fundamentos, hay un fallo en disidencia que tiene algunos argumentos que nos pueden ayudar. Pero hay tiempo aún», dijo una fuente de la Procuración.

Atlantic Star Airlines ha iniciado las gestiones para iniciar servicios regulares al Territorio británico de ultramar de la Isla Ascensión, en el Océano Atlántico

La Isla Ascensión es una isla de unos 91 km² de superficie. La isla volcánica se encuentra en las aguas ecuatoriales del Océano Atlántico Sur, a unos 1.600 kilómetros de la costa de África ya 2.250 kilómetros de la costa de Brasil y a unos 6.700 kilómetros de Londres.

Atlantic Star Airlines ha expresado que estaba trabajando con el socio técnico Cello Aviation (CLJ, Birmingham Int’l ) para ofrecer un servicio aéreo regular entre Londres y la Isla Ascención. El servicio a cargo del South Atlantic Air Bridge se ha suspendido hasta 2019/20, que empleaba un Airbus A330-200, sólo podría reanudar una vez que la pista de asfalto 13/31 del Aeropuerto Base Aérea Militar de la Isla Ascensión (Wideawake) fuera reparada. Las planificaciones sobre la reanudación de los vuelos a la Isla Ascención están en tratativas para su continuidad.

Air China ha abierto una sede en Cuba para facilitar los viajes entre La Habana y Beijing

Air China, abrió este jueves una oficina comercial en Cuba para fomentar la cooperación en el sector turístico que permitirá un mayor intercambio de viajeros entre ambas naciones y la región del Caribe.

En una sencilla ceremonia que estuvo encabezada por el embajador de China en La Habana, Chen Xi y el gerente general de Air China en Cuba, Zhang Xin, se dio apertura a esta sede que facilitará los viajes entre la capital cubana y Beijing mediante el vuelo directo que opera desde finales de 2015.

«La marca Air China ha sido cada día más popular en Cuba y los países caribeños. Desde hoy vamos a ofrecer mejores servicios a todos los pasajeros con esta oficina», expresó Zhang Xin en las palabras de bienvenida.

«Cuba tiene recursos naturales muy atractivos para los turistas chinos, gente muy cálida, así como un pintoresco paisaje, mares azules y hermosas playas» —Chen Xin

«Este vuelo directo ha desempeñado un papel importante en la facilitación de los intercambios personales entre China y Cuba, así como en América Latina, y ha contribuido en gran medida al desarrollo de la cooperación en diferentes áreas«, dijo Chen Xin.

Desde el vuelo inaugural de Air China a Cuba unos 24.000 viajeros de diferentes nacionalidades han optado por tomar esta aerolínea. «Han habido 156 vuelos entre Pekín y La Habana y hemos mantenido regularidad, seguridad y comodidad en todos sus viajes».

El diplomático afirmó que las relaciones sino-cubanas están en su mejor momento después de más de medio siglo de lazos y sin duda este vínculo directo ayudará a promover la visita de los turistas chinos a la isla. «Cuba tiene recursos naturales muy atractivos para los turistas chinos, gente muy cálida, así como un pintoresco paisaje, mares azules y hermosas playas», dijo.

Chen Xin dijo que la cooperación en el turismo y el transporte aéreo tendrá un gran potencial y buenas perspectivas debido al interés de los viajeros chinos de conocer Cuba y las diferentes naciones caribeñas.

Con una duración de casi 20 horas de vuelo y una parada técnica en Montreal, Canadá, el vuelo de Air China a Cuba es el único enlace directo entre China y la región del Caribe.
