Aerolíneas y Aeroflot realizan acuerdo código compartido

La Administración Nacional de Aviación Civil (ANAC) de argentina ha anunciado la tramitación de la solicitud de aprobación del Anexo II al Acuerdo de Código Compartido suscripto entre Aerolíneas Argentinas y Aeroflot Russian Airlines. El Memorandum expresa que Aerolíneas Argentinas será el transportista operador y la empresa Aeroflot Russian Airlines el transportista de marketing respecto de los tramos: BUENOS AIRES/EZE—MADRID/MAD, MADRID—BUENOS AIRES/EZE, BUENOS AIRES/EZE—ROMA/FCO, ROMA/FCO—BUENOS AIRES/EZE, BUENOS AIRES/EZE—NUEVA YORK/JFK, BUENOS AIRES/EZE—MIAMI/MIA, MIAMI/MIA—BUENOS AIRES/EZE. Por su parte, Aeroflot Russian Airlines será el transportista de operaciones y la compañía Aerolíneas Argentinas el transportista de marketing en relación con los tramos: MOSCÚ/SVO—MADRID/MAD, MADRID/MAD—MOSCÚ/SVO, MOSCÚ/SVO—ROMA/FCO, ROMA/FCO—MOSCÚ/SVO, MOSCÚ/SVO—NUEVA YORK/JFK, NUEVA YORK/JFK—MOSCÚ/SVO y MOSCÚ/SVO—MIAMI/MIA y el retorno MIAMI/MIAMOSCÚ/SVO—MOSCÚ/SVO.

Actualmente, Aerolíneas Argentinas cuenta con concesión otorgada por la Resolución N° 272 de fecha 2 de Marzo de 1999 de Ex Ministerio de Economía y Obras Servicios Públicos, modificada por la Resolución N° 16 de fecha 23 de Enero de 2013 de la Secretaría de Transporte, prorrogada por la Resolución N° 218 de fecha 18 de Abril de 2013 de la Secretaría de Planificación, para explotar servicios regulares internacionales de largo recorrido de transporte aéreo de pasajeros, correo y carga con aeronaves de gran porte en diversas rutas, entre las que se contempla la posibilidad de operar con escalas intermedias y facultad de alterar y omitir las mismas entre puntos en la República Argentina, Estados Unidos, España, Italia, Federación Rusia.

Aeroflot Russian Airlines cuenta con autorización para explotar servicios regulares internacionales de transporte aéreo de pasajeros, carga y correo entre MOSCÚ/SVO—BUENOS AIRES/EZE, con escalas intermedias en Budapest, Dakar o Isla de Sal, con derechos de tráfico de tercera, cuarta y quinta libertades y aeronaves de gran porte, conferida por la Resolución N° 10 de fecha 19 de Enero de 1989.

El Artículo 110 de la Ley N° 17.285 del Código Aeronáutico de Argentina establece que los acuerdos que impliquen arreglos de “pool”, conexión, consolidación o fusión de servicios o negocios, deberán someterse a la aprobación previa de la autoridad aeronáutica y que si ésta no formulase objeciones dentro de los noventa (90) días, el acuerdo se considerará aprobado. El Decreto Nº 1.401 de fecha 27 de noviembre de 1998 establece en su Artículo 1º que la compartición de códigos se encuentra comprendida entre los arreglos determinados por el Artículo 110 de la Ley N° 17.285 del Código Aeronáutico Argentina.

El Artículo 3º del citado Decreto Nº 1.401/98 establece que en toda operación de servicios de compartición de código, los explotadores y sus agentes autorizados deberán informar al público usuario con total transparencia quién será el transportador, el tipo de aeronave utilizada en cada etapa del servicio, los puntos de transferencia y toda otra información relevante sobre las características del servicio.
