Kuwait Airways puede prohibir a los ciudadanos israelíes abordar sus aviones en Alemania, según dictaminó un tribunal de Frankfurt

Líderes judíos y políticos en Alemania criticaron el fallo dictado por el tribunal de distrito por la política de la aerolínea Kuwait Airways. El demandante, un estudiante israelí que vive en Frankfurt, apelará. Así lo afirmó su abogado.

“Esta es una sentencia vergonzosa para la democracia y para Alemania”, dijo el abogado Nathan Gelbart a la agencia de noticias alemana DPA. “No se puede permitir que este fallo se mantenga”, agregó. Gelbart es el abogado alemán de The Lawfare Project, un fondo de litigios con sede en Nueva York para israelíes que alegan violaciones de derechos civiles.

Al rechazar los cargos, el Tribunal dijo que no era razonable esperar que una aerolínea “cumpliera un contrato si eso va en contra de las leyes de su estado” y tener que enfrentar consecuencias legales en el país. El tribunal agregó que no estaba dentro de su jurisdicción decidir si la ley kuwaití era razonable.

Pero el alcalde de Frankfurt, Uwe Becker, declaró que “una línea aérea que practica la discriminación y el antisemitismo al negarse a volar pasajeros israelíes no debería tener permiso para despegar o aterrizar en Frankfurt, o en cualquier otro aeropuerto en Alemania. Esta ley kuwaití, que es profundamente antisemita y que prohíbe el transporte de israelíes, no puede ser motivo legal para la violación de las normas internacionales».

Deidre Berger, jefa de la oficina del Comité Judío Estadounidense en Berlín, dijo al periódico Bild que Alemania debería seguir el ejemplo de los Estados Unidos y Suiza: “Si una línea aérea se niega a llevar pasajeros israelíes a bordo, no se le debe permitir operar en Alemania. Los políticos no deberían eludir sus deberes y simplemente culpar a los tribunales”, aseveró.

En enero de 2016, Kuwait Airways abandonó su ruta de 35 años entre la ciudad de Nueva York y Londres después de que el Departamento de Transporte de Estados Unidos descubriera que la aerolínea estaba violando la ley estadounidense al prohibir a los pasajeros por nacionalidad. La decisión siguió a una apelación de un ciudadano israelí contra un fallo negativo del departamento.

Jewish leaders and politicians in Germany criticized the ruling issued by the district court for the policy of the airline Kuwait Airways. The plaintiff, an Israeli student living in Frankfurt, will appeal. This was stated by his lawyer.

«This is a shameful sentence for democracy and for Germany», lawyer Nathan Gelbart told the German news agency DPA. «This failure can not be allowed to continue», he added. The court added that it was not within its jurisdiction to decide whether Kuwaiti law was reasonable.

But the mayor of Frankfurt, Uwe Becker, stated that «an airline that practices discrimination and anti-Semitism by refusing to fly Israeli passengers should not have permission to take off or land in Frankfurt, or any other airport in Germany. This Kuwaiti law, which is deeply anti-Semitic and prohibits the transport of Israelis, can not be a legal reason for the violation of international standards».

Deidre Berger, head of the office of the American Jewish Committee in Berlin, told the Bild newspaper that Germany should follow the example of the United States and Switzerland: «If an airline refuses to take Israeli passengers on board, it should not be allowed operate in Germany. Politicians should not shirk their duties and simply blame the courts», he said.

In January 2016, Kuwait Airways abandoned its 35-year route between New York City and London after the US Department of Transportation discovered that the airline was violating US law by prohibiting passengers by nationality.
